		<official-title>To amend the Supplemental Appropriations Act, 2008 to
		  provide for additional weeks of emergency unemployment

		<section id="HBF33A2ECAB8946EC8D6E973EFE1AB2FB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Unemployment Compensation Extension Act of
			 2009</short-title></quote>.</text>
		</section><section id="H3C9A323A09CE41618D2087BC29D5ABEB"><enum>2.</enum><header>Additional
			 benefits</header>
			<subsection id="H5A8EC739A1BA45D88C9229285689C7C9"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 4002 of the
			 Supplemental Appropriations Act, 2008 (Public Law 110–252; 26 U.S.C. 3304 note)
			 is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H0C8485542F224F88800D7D833BD2BA71" style="OLC">
					<subsection id="H5D7181FFFD2B48BCA24356B2EFA4CD66"><enum>(d)</enum><header>Further
				additional emergency unemployment compensation</header>
						<paragraph id="H0C4346EA716443E79D98BE0B022F58FA"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">If, at the time that
				the amount added to an individual’s account under subsection (c)(1)
				(hereinafter <quote>additional emergency unemployment compensation</quote>) is
				exhausted or at any time thereafter, such individual’s State is in an extended
				benefit period (as determined under paragraph (2)), such account shall be
				further augmented by an amount (hereinafter <quote>further additional emergency
				unemployment compensation</quote>) equal to the lesser of—</text>
							<subparagraph id="HC6C5E1D2ED8D42D698E90284C72A3CD6"><enum>(A)</enum><text>50 percent of the
				total amount of regular compensation (including dependents’ allowances) payable
				to the individual during the individual’s benefit year under the State law;
				or</text>
							</subparagraph><subparagraph id="H65FD61D0C42943DF860EC4CC459DD21E"><enum>(B)</enum><text>13 times the
				individual’s average weekly benefit amount (as determined under subsection
				(b)(2)) for the benefit year.</text>
							</subparagraph></paragraph><paragraph id="H2BE2F571470D43AEAFB55FDBDEA53EF6"><enum>(2)</enum><header>Extended benefit
				period</header><text display-inline="yes-display-inline">For purposes of
				paragraph (1), a State shall be considered to be in an extended benefit period,
				as of any given time, if—</text>
							<subparagraph id="H41DE2CA329424D21A72A5C0AA173347A"><enum>(A)</enum><text display-inline="yes-display-inline">such a period is then in effect for such
				State under the Federal-State Extended Unemployment Compensation Act of
				1970;</text>
							</subparagraph><subparagraph id="H85DCB01E40414166B523DFD1D08FEDF0"><enum>(B)</enum><text display-inline="yes-display-inline">such a period would then be in effect for
				such State under such Act if section 203(d) of such Act—</text>
								<clause id="HE0A529B8E1E14513828772216CB0F887"><enum>(i)</enum><text display-inline="yes-display-inline">were applied by substituting ‘4’ for ‘5’
				each place it appears; and</text>
								</clause><clause id="H5EE7FE084B104AB0B4C7E49367FB0059"><enum>(ii)</enum><text display-inline="yes-display-inline">did not include the requirement under
				paragraph (1)(A) thereof; or</text>
								</clause></subparagraph><subparagraph id="H8E4B956D5DCA4E2D8A732B33CECE9485"><enum>(C)</enum><text display-inline="yes-display-inline">such a period would then be in effect for
				such State under such Act if—</text>
								<clause id="H22EFFE1AFC294512B70257D1D428D417"><enum>(i)</enum><text display-inline="yes-display-inline">section 203(f) of such Act were applied to
				such State (regardless of whether the State by law had provided for such
				application); and</text>
								</clause><clause id="HA4D1C39FB941414C99C1CD7E5BF6C630"><enum>(ii)</enum><text display-inline="yes-display-inline">such section 203(f)—</text>
									<subclause id="HEBB77490E7934D77A34C2E2969B79FAA"><enum>(I)</enum><text display-inline="yes-display-inline">were applied by substituting ‘6.0’ for
				‘6.5’ in paragraph (1)(A)(i) thereof; and</text>
									</subclause><subclause id="H0FCE32F3912A4FC2AC19CAF40605664F"><enum>(II)</enum><text display-inline="yes-display-inline">did not include the requirement under
				paragraph (1)(A)(ii) thereof.</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="HD266FFFF47004609A48E6367B0433685"><enum>(3)</enum><header>Coordination
				rule</header><text display-inline="yes-display-inline">Notwithstanding an
				election under section 4001(e) by a State to provide for the payment of
				emergency unemployment compensation prior to extended compensation, such State
				may pay extended compensation to an otherwise eligible individual prior to any
				further additional emergency unemployment compensation, if such individual
				claimed extended compensation for at least 1 week of unemployment after the
				exhaustion of additional emergency unemployment compensation.</text>
						</paragraph><paragraph id="H31F5CE44F2F4436682DAEEAFDEC022EB"><enum>(4)</enum><header>Limitation</header><text>The
				account of an individual may be augmented not more than once under this
				subsection.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3F682EA2786646F2A61E80D0833164D6"><enum>(b)</enum><header>Conforming
			 amendment to non-Augmentation rule</header><text display-inline="yes-display-inline">Section 4007(b)(2) of the Supplemental
			 Appropriations Act, 2008 (Public Law 110–252; 26 U.S.C. 3304 note) is
			 amended—</text>
				<paragraph id="HD9B6652914474BCE914057A4BCFCAB78"><enum>(1)</enum><text>by striking
			 <quote>then section 4002(c)</quote> and inserting <quote>then subsections (c)
			 and (d) of section 4002</quote>; and</text>
				</paragraph><paragraph id="H4BC86532D6D142A38F5505FD525B6F36"><enum>(2)</enum><text>by striking
			 <quote>paragraph (2) of such section)</quote> and inserting <quote>paragraph
			 (2) of such subsection (c) or (d) (as the case may be))</quote>.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="HCA1C5D9BB704435683AC5C631AF49552"><enum>(c)</enum><header>Transfer of
			 funds</header><text>Section 4004(e)(1) of the Supplemental Appropriations Act,
			 2008 (Public Law 110–252; 26 U.S.C. 3304 note) is amended by striking
			 <quote>Act;</quote> and inserting <quote>Act and the Unemployment Compensation
			 Extension Act of 2009</quote>.</text>
			</subsection><subsection id="H83EE4848B2E441E99DD49DB0A298B34F"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply as if
			 included in the enactment of the Supplemental Appropriations Act, 2008, except
			 that no amount shall be payable by virtue of such amendments with respect to
			 any week of unemployment commencing before the date of the enactment of this
			 Act.</text>
