		  provisions relating to the carrying of concealed weapons by law enforcement
		  officers, and for other purposes.</official-title>

		<section id="H0D9A2B5E84114C6DA79E197627D375C7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Law Enforcement Officers Safety Act Improvements Act of
			 2009</short-title></quote>.</text>
		</section><section id="H87B6EC5B602D4343A742B0785E4F18C4"><enum>2.</enum><header>Amendments to law
			 enforcement officer safety provisions of title 18</header>
			<subsection id="H03A14AF3161947A4BBE17DB404B8879C"><enum>(a)</enum><header>Carrying of
			 concealed firearm by qualified law enforcement officer</header><text>Section
			 926B of title 18, United States Code, is amended—</text>
				<paragraph id="HB008901CB6344DDFAFE22CD721F63EEB"><enum>(1)</enum><text>in subsection
			 (c)—</text>
					<subparagraph id="H42FC8ECD39854C049F9A1F1EB89D7979"><enum>(A)</enum><text>in paragraph (1),
			 by inserting <quote>(or apprehension)</quote> after <quote>arrest</quote>;
			 and</text>
					</subparagraph><subparagraph id="H26C703C63EDC413E9B6E03598979127D"><enum>(B)</enum><text>in paragraph (3),
			 by inserting <quote>which could result in suspension or loss of police
			 powers</quote> before the semicolon;</text>
					</subparagraph></paragraph><paragraph id="H8CEF3BB68283447D82E0D9B04C233B05"><enum>(2)</enum><text>by striking
			 subsection (e) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H8F0FB43EECCB49A2BFF2C5507DCF64C0" style="OLC">
						<subsection id="H3CB11D4EB63C44E4B6CD250BB6E42D0A"><enum>(e)</enum><text display-inline="yes-display-inline">As used in this section, the term ‘firearm’
				has the same meaning as defined in section 921 of this title and is deemed to
				include ammunition the possession of which is not expressly prohibited by
				Federal law, or which are not subject to the provisions of the National
				Firearms Act, but does not include—</text>
							<paragraph id="H3203DA0F54A5483EBB2FDA2B55D22279"><enum>(1)</enum><text display-inline="yes-display-inline">any machinegun (as defined in section 5845
				of the National Firearms Act);</text>
							</paragraph><paragraph id="H9A69BFDBE9AA47B0B888C5C6DD04AF0D"><enum>(2)</enum><text display-inline="yes-display-inline">any firearm silencer (as defined in section
				921 of this title); or</text>
							</paragraph><paragraph id="H6195231C68AB45048CFFD6C80ED9AE5D"><enum>(3)</enum><text display-inline="yes-display-inline">any destructive device (as defined in
				section 921 of this title).</text>
							</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HD02BE16FC451452E8D22D0B46A81A47C"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="H182B28C6121F4C9489BC397031B4CA44" style="OLC">
						<subsection id="H83EB2E9983BC4C7CBD221865C69BBBF3"><enum>(f)</enum><text>For purposes of
				this section, a law enforcement officer of the Amtrak Police Department, a law
				enforcement officer of the Federal Reserve System, and a law enforcement or
				police officer of the executive branch of the Federal Government qualifies as
				an employee of a governmental agency who is authorized by law to engage in or
				supervise the prevention, detection, investigation, or prosecution of, or the
				incarceration of any person for, any violation of law, and has statutory powers
				of arrest (or
				apprehension).</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HA51DD1F04E5043448B37651AE78CAF76"><enum>(b)</enum><header>Carrying of
			 concealed firearm by qualified retired law enforcement
			 officer</header><text>Section 926C of title 18, United States Code, is
			 amended—</text>
				<paragraph id="H2757808375614FB2AD66D1C9E267EFC0"><enum>(1)</enum><text>in subsection
			 (c)—</text>
					<subparagraph id="H10092E6826C0449E8A2437BA449DF3B6"><enum>(A)</enum><text>by striking
			 paragraph (1) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="H8898C5E2F91745478A9F56F5B2330608" style="OLC">
							<paragraph id="HC4F4BD22D3A84101AD47D63FA6A1477F"><enum>(1)</enum><text display-inline="yes-display-inline">separated from service in good standing, or
				was honorably discharged from service, with a public agency as a law
				enforcement
				officer;</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HC550F4B6C5B843B9BA146456F2013F58"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text>
						<clause id="H7F5F538495DB4901A78CEA9D73A92A26"><enum>(i)</enum><text>by
			 striking <quote>retirement</quote> and inserting <quote>separation</quote>;
			 and</text>
						</clause><clause id="HC3C1469064CA44E08BC899BD2AE7EBB8"><enum>(ii)</enum><text>by
			 inserting <quote>or apprehension</quote> after <quote>arrest</quote>;
			 and</text>
						</clause></subparagraph><subparagraph id="H03E6B24E1F154D9BADED55DFCAA38570"><enum>(C)</enum><text>by striking
			 paragraphs (3) through (5) and inserting the following:</text>
						<quoted-block id="H450A8A215D7645AE9B893E7BF3E8DD16" style="OLC">
							<paragraph id="H0C215EBE1FDF41CF8EC3B903CDC96683"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H29098C690BC549A5A949896F2F98A8B4"><enum>(A)</enum><text>before such separation,
				served as a law enforcement officer for an aggregate of 10 years or more;
				or</text>
								</subparagraph><subparagraph id="H10AAE1A1F216444FB74DADBD9980305C" indent="up1"><enum>(B)</enum><text>separated from service with the
				agency, after completing any applicable probationary period of such service,
				due to a service-connected disability, as determined by the agency;</text>
								</subparagraph></paragraph><paragraph id="H52BFFC761ECC4BD6A8B6188417B67B26"><enum>(4)</enum><text>during the most
				recent 12-month period, has met, at the expense of the individual, the
				standards for qualification in firearms training for active law enforcement
				officers as set by the agency, the State in which the officer resides, or if
				the State has not established the standards, a law enforcement agency in the
				State in which the officer resides;</text>
							</paragraph><paragraph id="H09607D73B1734607895F8B9D0DF9689F"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H362D0F2CDB184EAD82945C91668D1524"><enum>(A)</enum><text display-inline="yes-display-inline">has not been found by a physician, licensed
				as such under State law, to not be qualified to handle a firearm for reasons
				related to mental health; and</text>
								</subparagraph><subparagraph id="HDC98180A60A44F74913C04044D04CE90" indent="up1"><enum>(B)</enum><text>has not entered into an agreement with
				the agency, in which the officer acknowledges he is not qualified to handle a
				firearm for reasons related to mental
				health;</text>
								</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H5A60CD413C8E4419B66A7067674E619B"><enum>(2)</enum><text>in subsection
			 (d)—</text>
					<subparagraph id="HD6301CB28FEC412DABFDB3B938128D1C"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
						<clause id="H9162DB92FE4849829BEC813E1B9ECBAA"><enum>(i)</enum><text>by
			 striking <quote>retired</quote> and inserting <quote>separated</quote>;
			 and</text>
						</clause><clause id="HD1A9145E6E724642BA4D166FC2C73EBE"><enum>(ii)</enum><text>by
			 striking <quote>to meet the standards established by the agency for training
			 and qualification for active law enforcement officers to carry a firearm of the
			 same type as the concealed firearm; or</quote> and inserting <quote>to meet the
			 active duty standards for qualification in firearms training as established by
			 the agency to carry a firearm of the same type as the concealed firearm
			 or</quote>; and</text>
						</clause></subparagraph><subparagraph id="H2E6B9F62D29B4F688C886442FBC874D7"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text>
						<clause id="H2828FF0A139A47E8A9B89BD457D80319"><enum>(i)</enum><text>in
			 subparagraph (A), by striking <quote>retired</quote> and inserting
			 <quote>separated</quote>; and</text>
						</clause><clause id="H46FF67FE3D1A4F4F91DCE8F8EEB6EE37"><enum>(ii)</enum><text>by
			 striking subparagraph (B) and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="HEDB2CDC5872D406FA0745FC5FB2A7145" style="OLC">
								<subparagraph id="HFBF936A815A3473FAB5601FC94F2BBA7"><enum>(B)</enum><text display-inline="yes-display-inline">a certification issued by the State in
				which the individual resides, or by a certified firearms instructor that is
				qualified to conduct a firearms qualification test for active duty officers in
				the State, which indicates that the individual has, not less recently than 1
				year before the date the individual is carrying the concealed firearm, been
				tested or otherwise found by the State or the certified firearms instructor to
				have met—</text>
									<clause id="H3FABB0AA904D47C38E27A255A549F907"><enum>(i)</enum><text display-inline="yes-display-inline">the active duty standards for qualification
				in firearms training as established by the State to carry a firearm of the same
				type as the concealed firearm; or</text>
									</clause><clause id="HA7FD7EAE40A04EFBAE7743A50553D689"><enum>(ii)</enum><text>if the State has
				not established such standards, standards set by a law enforcement agency in
				the State to carry a firearm of the same type as the concealed
				firearm.</text>
									</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph><paragraph id="H3D356C4D52B5413ABF31F0D6B71C4F07"><enum>(3)</enum><text>by striking
			 subsection (e) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H0E25ECA5815240DD876177FCAE3A6112" style="OLC">
						<subsection id="H897A4DA860B342C0A16B7B59229922EC"><enum>(e)</enum><text>As used in this
				section, the term ‘firearm’ has the same meaning as defined in section 921 of
				this title and is deemed to include ammunition the possession of which is not
				expressly prohibited by Federal law, or which are not subject to the provisions
				of the National Firearms Act, but does not include—</text>
							<paragraph id="H31468E85A207400B9A464604EF3DB9F6"><enum>(1)</enum><text display-inline="yes-display-inline">any machinegun (as defined in section 5845
				of the National Firearms Act);</text>
							</paragraph><paragraph id="H20CCC049B0E94FA48B88DAD3884CB103"><enum>(2)</enum><text display-inline="yes-display-inline">any firearm silencer (as defined in section
				921 of this title); or</text>
							</paragraph><paragraph id="HF4BCF4E554F8420EAF80EBFFB89EAB13"><enum>(3)</enum><text display-inline="yes-display-inline">any destructive device (as defined in
				section 921 of this title).</text>
							</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H7951F9F8B7DA4B8DB4225A85E67515A4"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="H4FDEE93E45E84AAB8434D949546452B1" style="OLC">
						<subsection id="H4CE84E9271414ED8B3DE8C0666B0B496"><enum>(f)</enum><text display-inline="yes-display-inline">In this section, the term <term>service
				with a public agency as a law enforcement officer</term> includes service as a
				law enforcement officer of the Amtrak Police Department, service as a law
				enforcement officer of the Federal Reserve System, service as a law enforcement
				officer or in a primarily law enforcement capacity for a branch of the United
				States Armed Forces, or as a law enforcement or police officer of the executive
				branch of the Federal
				Government.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H123EF813292949CCB4492BCB6BB5CDB3"><enum>(c)</enum><header>Possession of
			 firearm in a school zone by qualified law enforcement officer or qualified
			 retired law enforcement officer</header><text>Section 922(q)(2)(B)(vi) of such
			 title is amended by inserting <quote>, a qualified law enforcement officer (as
			 defined in section 926B(c)), or a qualified retired law enforcement officer (as
			 defined in section 926C(c))</quote> before the semicolon.</text>
