		<official-title>To authorize States or political subdivisions thereof to
		  regulate fuel economy and emissions standards for taxicabs.</official-title>

		<section id="HCC0990662B624098B3A874A719B076A2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Green Taxis Act of 2009</short-title></quote>.</text>
		</section><section id="H17FCEE7C12864011B4014CA5EAD9F960"><enum>2.</enum><header>State fuel
			 economy regulation for taxicabs</header><text display-inline="no-display-inline">Section 32919 of title 49, United States
			 Code, is amended by adding at the end the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="HC7A9AC82DF864AECA5E675B43D980194" style="OLC">
				<subsection id="H82C30BD81FAA4DB38488A10B270EC12D"><enum>(d)</enum><header>Taxicabs</header><text display-inline="yes-display-inline">Notwithstanding subsection (a), a State or
				political subdivision of a State may prescribe requirements for fuel economy
				for taxicabs and other automobiles if such requirements are at least as
				stringent as applicable Federal requirements and if such taxicabs and other
				automobiles—</text>
					<paragraph id="H58E273D26F724E50B40A4DA2FD325155"><enum>(1)</enum><text display-inline="yes-display-inline">are automobiles that are capable of
				transporting not more than 10 individuals, including the driver;</text>
					</paragraph><paragraph id="HE6D719244ACA42E090F51C747356EAFC"><enum>(2)</enum><text display-inline="yes-display-inline">are commercially available or are designed
				and manufactured pursuant to a contract with such State or political
				subdivision of such State;</text>
					</paragraph><paragraph id="HB564E26BCA264448B46BBC4E83422D4E"><enum>(3)</enum><text>are operated for
				hire pursuant to an operating or regulatory license, permit, or other
				authorization issued by such State or political subdivision of such
				State;</text>
					</paragraph><paragraph id="H5D25A233774D48EE80AEA03F1345CF11"><enum>(4)</enum><text display-inline="yes-display-inline">provide local transportation for a fare
				determined on the basis of the time or distance traveled or a combination of
				time and distance traveled; and</text>
					</paragraph><paragraph id="H362BB515C3524B0493FE91A2CE1D149C"><enum>(5)</enum><text>do not exclusively
				provide transportation to and from
				airports.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H421C22D78CAE4F4FB47C64EBF057375A"><enum>3.</enum><header>State regulation
			 of motor vehicle emissions for taxicabs</header><text display-inline="no-display-inline">Section 209 of the Clean Air Act (42 U.S.C.
			 7543) is amended by adding at the end the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="HE8E77CE6FDCC4B2398BFD3A6318887A1" style="OLC">
				<subsection id="HB8C4E18637364FCD83E2269D1FEB22F4"><enum>(f)</enum><header>Taxicabs</header><paragraph commented="no" display-inline="yes-display-inline" id="HED9F8230BA1B4D3BBF22604FBFE7C834"><enum>(1)</enum><text>Notwithstanding
				subsection (a), a State or political subdivision thereof may adopt and enforce
				standards for the control of emissions from new motor vehicles that are
				taxicabs and other vehicles if such standards will be, in the aggregate, at
				least as protective of public health and welfare as applicable Federal
				standards and if such taxicabs and other vehicles—</text>
						<subparagraph id="H358851D700A443F2979CDB32C90927C1"><enum>(A)</enum><text display-inline="yes-display-inline">are passenger motor vehicles that are
				capable of transporting not more than 10 individuals, including the
				driver;</text>
						</subparagraph><subparagraph id="H8A0679E5902F404082DCA647CEB981FD"><enum>(B)</enum><text display-inline="yes-display-inline">are commercially available or are designed
				and manufactured pursuant to a contract with such State or political
				subdivision thereof;</text>
						</subparagraph><subparagraph id="HE813FA42A3C5466883FAD74E5CB510DE"><enum>(C)</enum><text>are operated for
				hire pursuant to an operating or regulatory license, permit, or other
				authorization issued by such State or political subdivision thereof;</text>
						</subparagraph><subparagraph id="HE2D6642B9599498DA5EF4F27C9FF6FC5"><enum>(D)</enum><text display-inline="yes-display-inline">provide local transportation for a fare
				determined on the basis of the time or distance traveled or a combination of
				time and distance traveled; and</text>
						</subparagraph><subparagraph id="HD09275C921AD4214AFD4270807B7052D"><enum>(E)</enum><text>do not exclusively
				provide transportation to and from airports.</text>
						</subparagraph></paragraph><paragraph id="HA88B0447810B48EC8E906E6715EF347E"><enum>(2)</enum><text display-inline="yes-display-inline">If each standard of a State or political
				subdivision thereof is at least as stringent as the comparable applicable
				Federal standard, such standard of such State or political subdivision thereof
				shall be deemed at least as protective of health and welfare as such Federal
				standards for purposes of this
				subsection.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
