		<official-title>To amend the Geothermal Steam Act of 1970 to authorize
		  noncompetitive leasing of certain areas adjoining other lands for which a
		  qualified company or individual holds a pre-existing legal right to develop
		  geothermal resources, and for other purposes.</official-title>

		<section id="H0B6C310D1CB1440D811D95BB0B946980" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Geothermal Production Expansion
			 Act</short-title></quote>.</text>
		</section><section id="HD4E4D3583FE34B8AA5FD5C275608788C" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
			<paragraph id="HBF45663DA8054BA88BCAFEF50D199B48"><enum>(1)</enum><text display-inline="yes-display-inline">It is in the best interest of the United
			 States to develop clean renewable geothermal energy.</text>
			</paragraph><paragraph id="H94AB4D331E1647B68BF6EBE654370790"><enum>(2)</enum><text>Development of
			 such energy should be promoted on appropriate Federal lands.</text>
			</paragraph><paragraph id="H9D814A07FC664AAC87F53A418E3F4E11"><enum>(3)</enum><text>Under the Energy
			 Policy Act of 2005, the Bureau of Land Management is authorized to issue three
			 different types of non-competitive leases for production of geothermal energy
			 on Federal lands, including non-competitive geothermal leases to mining claim
			 holders that have a valid operating plan, direct use leases, and leases on
			 parcels that do not sell at a competitive auction.</text>
			</paragraph><paragraph id="H97ECA5D0A5AB4AE79D89B70CF3978161"><enum>(4)</enum><text>Federal geothermal
			 energy leasing activity should be directed towards those seeking to develop the
			 land as opposed to those seeking to speculate on geothermal resources and
			 thereby artificially raising the cost of legitimate geothermal energy
			 development.</text>
			</paragraph><paragraph id="HACD6265695AD4819AF898BD2C539C2C6"><enum>(5)</enum><text display-inline="yes-display-inline">Developers of geothermal energy on Federal
			 lands that have invested substantial capital and made high risk investments
			 should be allowed to secure a discovery of geothermal energy resources.</text>
			</paragraph><paragraph id="HF4B57835467349E087C5E9DC8667BC41"><enum>(6)</enum><text>Successful
			 geothermal development on Federal lands will provide increased revenue to the
			 Federal Government, with the payment of production royalties over
			 decades.</text>
			</paragraph></section><section id="HB33CAB65442842088C69F7A85A555D8E" section-type="subsequent-section"><enum>3.</enum><header>Noncompetitive leasing
			 of adjoining areas for development of geothermal resources</header><text display-inline="no-display-inline">The Geothermal Steam Act of 1970 is
			 amended—</text>
			<paragraph id="H1CD5A0B2FF8445618FC246D94716B4DB"><enum>(1)</enum><text>in section 2 (30
			 U.S.C. 1001)—</text>
				<subparagraph id="HAD76D1F66D0048639C6CEAAF5C8A8577"><enum>(A)</enum><text>by striking the
			 period at the end of each of paragraphs (e) and (f) and inserting a
			 semicolon;</text>
				</subparagraph><subparagraph id="H8832226263BA4F719F3BF0C28F49A3F4"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>, and</quote> at the end
			 of paragraph (g) and inserting a semicolon; and</text>
				</subparagraph><subparagraph id="H6B5BDE0580F944AA92AF4F61A63AE3E0"><enum>(C)</enum><text>by adding at the
			 end the following new paragraphs:</text>
					<quoted-block display-inline="no-display-inline" id="HAFAFDBAD673D4B06A4F459E626701335" style="OLC">
						<paragraph id="HA680C09294D2448CB2355090F9863E0E"><enum>(h)</enum><text display-inline="yes-display-inline"><term>industry standards</term> means the
				standards by which a qualified geothermal professional assesses whether
				downhole or flowing temperature measurements with indications of permeability
				are sufficient to produce geothermal steam or geothermal resources as
				determined through flow or injection testing or measurement of lost circulation
				while drilling;</text>
						</paragraph><paragraph id="H7CFA4FD62B1647D88B85BE2056E6BB59"><enum>(i)</enum><text display-inline="yes-display-inline"><term>qualified geothermal
				professional</term> means an individual who is an engineer or geoscientist in
				good professional standing with at least five years of experience in geothermal
				exploration, development, project assessment, or any combination of the
				forgoing;</text>
						</paragraph><paragraph id="H8380B4B8B6FC49F3BA0EDE7048D4CBD2"><enum>(j)</enum><text display-inline="yes-display-inline">the term <quote>qualified lessee</quote>
				means a person that may hold a geothermal lease under part 3202.10 of title 43,
				Code of Federal Regulations, as in effect on the date of enactment of the
				<short-title>Geothermal Production Expansion
				Act</short-title>; and</text>
						</paragraph><paragraph id="H11F61F94CE914B1FB8D2EF453B59C465"><enum>(k)</enum><text display-inline="yes-display-inline"><term>valid discovery</term> means a
				discovery of a geothermal resource by a new or existing slim hole or production
				well, that exhibits downhole or flowing temperature measurements with
				indications of permeability sufficient to meet industry
				standards.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H2ED1EDDEA53E481EA55C4CD2E2F39A3A"><enum>(2)</enum><text>in section 4(b)
			 (30 U.S.C. 1003(b)), by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HBCCF0D251D8847D1B70736A20C986DFF" style="OLC">
					<paragraph id="HEFDA9A99EF9B431C954EEDB1D77DA492"><enum>(4)</enum><header>Adjoining
				lands</header>
						<subparagraph id="H51CD657BF7F444C1BA7271DBBBF81B74"><enum>(A)</enum><header>In
				general</header><text>Areas that adjoin Federal lands for which a qualified
				lessee holds a legal right to develop geothermal resources may be available for
				noncompetitive lease under this section to the qualified lessee at the fair
				market value per acre, if—</text>
							<clause id="HAB025438A35044B29D00F6B80A5BEC2E"><enum>(i)</enum><text>the adjoining
				areas—</text>
								<subclause id="H0914FB6C717948A693682340D8C1FD66"><enum>(I)</enum><text>consist of an area
				of not more than a total of 640 acres;</text>
								</subclause><subclause id="H7845A564CD6D4632BDD6FBFB9044E2E8"><enum>(II)</enum><text>each consist of
				not less than one acre;</text>
								</subclause><subclause id="H8A083BB75375441A993D4DD091B4614E"><enum>(III)</enum><text>are not already
				leased under this Act or nominated to be leased under subsection (a);</text>
								</subclause></clause><clause id="H25E38A8209F246C097AB3E09B9CD389F"><enum>(ii)</enum><text>the qualified
				lessee has not previously received a noncompetitive lease under this paragraph
				in connection with the valid discovery for which data has been submitted under
				subclause (I) of clause (iii); and</text>
							</clause><clause id="HD787D5B0108F4AAC80E78DE94578B396"><enum>(iii)</enum><text>sufficient
				geological and other technical data prepared by a qualified geothermal
				professional has been submitted by the qualified lessee to the relevant Federal
				land management agency that would engender a belief in individuals who are
				experienced in the subject matter that—</text>
								<subclause id="HA1AD3E59941D4EFCB194C2CE2867A857"><enum>(I)</enum><text>there is a valid
				discovery of geothermal steam or geothermal resources on the lands for which
				the qualified lesseeholds the legal right to develop geothermal resources;
				and</text>
								</subclause><subclause id="H9307D0826C5F4A03B1D8B630F44FC788"><enum>(II)</enum><text>such thermal
				feature extends into the adjoining areas.</text>
								</subclause></clause></subparagraph><subparagraph id="H46546D0772E0454E8673B4285D160B69"><enum>(B)</enum><header>Fair market
				value per acre defined</header><text display-inline="yes-display-inline">As
				used in this paragraph, the term <term>fair market value per acre</term> means
				a dollar amount per acre that—</text>
							<clause id="H382BE60F518046E281ABB349C4174A24"><enum>(i)</enum><text>except as provided
				in this subparagraph, shall be equal to the market value per acre, as
				determined by the Secretary;</text>
							</clause><clause id="H7F2B99D3D75347379525EDF9F3474660"><enum>(ii)</enum><text>shall be
				determined by the Secretary with respect to a lease under this paragraph, by
				not later than the end of the 90-day period beginning on the date the Secretary
				receives an application for the lease;</text>
							</clause><clause id="H3F80DC5436184B338DA03A47150842DB"><enum>(iii)</enum><text>if the Secretary
				does not determine the fair market value per acre for a lease before the end of
				the period referred to in clause (ii), shall be $100 per acre (adjusted by the
				Secretary for inflation annually beginning with fiscal year 2011) until the
				Secretary establishes such fair market value; and</text>
							</clause><clause id="HA2FF6CADBDD342C5BBE8CEADC72C1275"><enum>(iv)</enum><text>for any lease for
				which an application is received before the end of the 15-year period beginning
				on the date of the enactment of this clause, shall not exceed $200 per acre
				(adjusted by the Secretary for inflation annually beginning with fiscal year
				2011).</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
