		<official-title>To amend the Immigration and Nationality Act to eliminate
		  the diversity immigrant program and to re-allocate those visas to certain
		  employment-based immigrants who obtain an advanced degree in the United
		  States.</official-title>

		<section id="H39C1451AADDC49F28EF30083CAFE8BC0" section-type="section-one"><enum>1.</enum><header>Elimination of diversity
			 immigrant program</header>
			<subsection id="H071656ACA35940F4BA99D586C3E1079C"><enum>(a)</enum><header>Worldwide level
			 of diversity immigrants</header><text>Section 201 of the
			 <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (8
			 U.S.C. 1151) is amended—</text>
				<paragraph id="HCE0E13AF954C4D27A5AEC103712600C1"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="HDE6C280DAA264A7CA4785D92BD306D1E"><enum>(A)</enum><text>by inserting
			 <quote>and</quote> at the end of paragraph (1);</text>
					</subparagraph><subparagraph id="H92505F118EFC4C9AB1D4DA0850F06E00"><enum>(B)</enum><text>by striking
			 <quote>; and</quote> at the end of paragraph (2) and inserting a period;
			 and</text>
					</subparagraph><subparagraph id="H1EA6BC4CCA2742BDBFB4A2ABE5CF7B81"><enum>(C)</enum><text>by striking
			 paragraph (3); and</text>
					</subparagraph></paragraph><paragraph id="HFCBD68477A184A8C958BA687B9E0528F"><enum>(2)</enum><text>by striking
			 subsection (e).</text>
				</paragraph></subsection><subsection id="H9F387A7DD3284A4DB9005DEBC863F0D5"><enum>(b)</enum><header>Allocation of
			 diversity immigrant visas</header><text>Section 203 of such Act (8 U.S.C. 1153)
			 is amended—</text>
				<paragraph id="H3392B559599D485AAFA9E8995C5C716"><enum>(1)</enum><text>by
			 striking subsection (c);</text>
				</paragraph><paragraph id="H7DEBAAF6572F418595FE8891ADBB538"><enum>(2)</enum><text>in
			 subsection (d), by striking <quote>(a), (b), or (c),</quote> and inserting
			 <quote>(a) or (b),</quote>;</text>
				</paragraph><paragraph id="HAB9FE558239242D48E9D71C96F98E525"><enum>(3)</enum><text>in subsection (e),
			 by striking paragraph (2) and redesignating paragraph (3) as paragraph
			 (2);</text>
				</paragraph><paragraph id="H9303ABDEEF2D4385BB8867EE01E21B25"><enum>(4)</enum><text>in subsection (f),
			 by striking <quote>(a), (b), or (c)</quote> and inserting <quote>(a) or
			 (b)</quote>; and</text>
				</paragraph><paragraph id="H2F4444874B7C4123BAE157C02DC7DEC1"><enum>(5)</enum><text>in subsection (g),
			 by striking <quote>(a), (b), and (c)</quote> and inserting <quote>(a) and
			 (b)</quote>.</text>
				</paragraph></subsection><subsection id="HA565CC7144BF445CB693004DCCC1882B"><enum>(c)</enum><header>Procedure for
			 granting immigrant status</header><text>Section 204 of such Act (8 U.S.C. 1154)
			 is amended—</text>
				<paragraph id="HED6A0A0B6DAC4510B3F8047CF7B3914"><enum>(1)</enum><text>by
			 striking subsection (a)(1)(I); and</text>
				</paragraph><paragraph id="H00FE30581BDC4264A30585A074B48273"><enum>(2)</enum><text>in subsection (e),
			 by striking <quote>(a), (b), or (c)</quote> and inserting <quote>(a) or
			 (b)</quote>.</text>
				</paragraph></subsection></section><section id="H41A42BF41D714A8EB90063C928025CAA"><enum>2.</enum><header>Visas for certain
			 employment-based immigrants who obtain an advanced degree in the United
			 States</header>
			<subsection id="H40AD8B552FE746D4B25EBFDAD9380900"><enum>(a)</enum><header>In
			 general</header><text>Section 203(b)(2) of the Immigration and Nationality Act
			 (8 U.S.C. 1153(b)(2)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD96714699D3D4B86A6F6BC4D364CCF" style="OLC">
					<subparagraph id="H273D475F07D74C34A54DB9D7FADC4BD7"><enum>(D)</enum><header>Certain aliens
				obtaining advanced degrees in the United States</header><text display-inline="yes-display-inline">Visas shall be made available, in a number
				not to exceed 55,000, to qualified immigrants who—</text>
						<clause id="H4081936AFFC94F9B90BDE1B07FAE6267"><enum>(i)</enum><text>are a member of a
				profession holding an advanced degree obtained within the United States;</text>
						</clause><clause id="HEF7C225F19624938AEE9BEAF003CE63C"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H7A9E96DAD7334028B7C61F94F9EE67E0"><enum>(I)</enum><text>obtained such degree
				within the United States during the 5-year period preceding the date on which
				the petition filed under section 204(a)(1)(F) for classification under this
				subparagraph is filed; or</text>
							</subclause><subclause id="H72CB278D04934AEB92CCEB907C8D2411" indent="up1"><enum>(II)</enum><text>has resided continuously in the United
				States in a lawful nonimmigrant status since obtaining such degree; and</text>
							</subclause></clause><clause id="HA3C1A107DC3D4BD39FDD49DE00DE009D"><enum>(iii)</enum><text>whose services
				in the sciences or medicine—</text>
							<subclause id="HE10E0A99EFDF4936BA46B6F97D88B21F"><enum>(I)</enum><text>are sought by an
				employer in the United States; and</text>
							</subclause><subclause id="HB23AA255DB0449D4B1E42493FFC9178C"><enum>(II)</enum><text display-inline="yes-display-inline">will substantially benefit prospectively
				the national economy of the United
				States.</text>
							</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HFDA5B238479F488DA58687ED776E0064"><enum>(b)</enum><header>Numerical
			 limitation</header>
				<paragraph id="HC732470728D64EDD9EE10001D919BCD8"><enum>(1)</enum><header>In
			 general</header><text>Section 201(d) of the Immigration and Nationality Act (8
			 U.S.C. 1151(d)) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H9EB3AC9021E04AD8B111E2E792DB7F71" style="traditional">
						<paragraph id="HF1575E5B38074AF9A77BA565D89DA2B" indent="up1"><enum>(3)</enum><text>Aliens described in section
				203(b)(2)(D) may be issued visas or may otherwise acquire the status of an
				alien lawfully admitted to the United States for permanent residence in a
				number not to exceed 55,000 in any fiscal
				year.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HB8651C364271468500EEE570A880B6B8"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 201(a)(2) of such Act (8 U.S.C. 1151(a)(2)) is
			 amended by striking <quote>and not to exceed</quote> and inserting <quote>and,
			 excluding immigrants described in section 203(b)(2)(D), not to
			 exceed</quote>.</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="H8AA94DCB7B734AF78846E7804D9F0687"><enum>3.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall take effect on October 1, 2009.</text>
