		<section id="H2A4F5F57B78A40C691147F784954F5FF" section-type="section-one"><enum>1.</enum><header>Immigration status,
			 employment authorization, and registration of aliens in the Commonwealth of the
			 Northern Mariana Islands</header>
			<subsection id="H14187370E84949A9AAEDC87993BA00D4"><enum>(a)</enum><header>Immigration
			 status</header>
				<paragraph id="HBEC7F221495D475492C8052003F76886"><enum>(1)</enum><header>Special
			 rule</header><text>Paragraph (1) of section 6(e) of the Joint Resolution
			 entitled <quote>A Joint Resolution to approve the <quote>Covenant To Establish
			 a Commonwealth of the Northern Mariana Islands in Political Union with the
			 United States of America</quote>, and for other purposes</quote>, approved
			 March 24, 1976 (48 U.S.C. 1806(e)), as added by section 702 of the Consolidated
			 Natural Resources Act of 2008 (Public Law 110–229; 122 Stat. 854)), is
			 amended—</text>
					<subparagraph id="HAF505940365C49B097CDB555D4CCA480"><enum>(A)</enum><text>in subparagraph
			 (A), by striking <quote>subparagraph (B),</quote> and adding
			 <quote>subparagraphs (B) and (C),</quote>;</text>
					</subparagraph><subparagraph id="H526219417F704435BEBC2BBF64095B94"><enum>(B)</enum><text>by redesignating
			 subparagraph (B) as subparagraph (D); and</text>
					</subparagraph><subparagraph id="H96D4ED30B3544135A1D1508CE78AF104"><enum>(C)</enum><text>by inserting after
			 subparagraph (A) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H1CE80CA72C4B4C06994727E3A8322358" style="OLC">
							<subparagraph id="HC4738C14F0974D24BFF3B076C606B128"><enum>(B)</enum><header>Special
				rule</header>
								<clause id="H086C3052067B44908C1BBCB9348C5BEF"><enum>(i)</enum><header>In
				general</header><text>Except as provided in subparagraph (D), no alien who is
				described in clause (ii) may be removed from the United States on the grounds
				that such alien's presence in the Commonwealth of the Northern Mariana Islands
				is in violation of section 212(a)(6)(A) of the Immigration and Nationality Act
				(8 U.S.C. 1182(a)(6)(A)), prior to the date that is 5 years after the
				transition program effective date.</text>
								</clause><clause id="H14EA43F47BBF4C2095D51F41598085CB"><enum>(ii)</enum><header>Alien
				described</header><text>An alien described in this clause is an alien
				who—</text>
									<subclause id="HC3607E5A56E44D158C2FEC723A23AEDB"><enum>(I)</enum><text>on May 8, 2008,
				was a resident of the Commonwealth of the Northern Mariana Islands and
				was—</text>
										<item id="HBF8F5405C9894715A2745D81C44AAB01"><enum>(aa)</enum><text>a
				permanent resident (as that term is defined in part 5–40.0–201 of the Northern
				Mariana Islands Administrative Code);</text>
										</item><item id="HDB6F8AC3504E4BC0B72B3776205311F4"><enum>(bb)</enum><text>an
				immediate relative of a citizen (as those terms are defined in such part
				5–40.0–201); or</text>
										</item><item id="HA928B78E79B240A7B3BA1CEC1AFD6BEE"><enum>(cc)</enum><text>the
				parent of a citizen (as that term is defined in such part 5–40.0–201) who was
				under 21 years of age; and</text>
										</item></subclause><subclause id="H402C5DD89D3441B69218D47EAC2189A8"><enum>(II)</enum><text>on the transition
				program effective date, was lawfully present in the Commonwealth of the
				Northern Mariana Islands or only temporarily absent from the Commonwealth
				pursuant to the immigration laws of the Commonwealth.</text>
									</subclause></clause></subparagraph><subparagraph id="H545EFEC052624C63AFF8C76280B38817"><enum>(C)</enum><header>Special
				nonimmigrant visa for parents</header>
								<clause id="H85BBE33764C04CC7993F602C449B41D6"><enum>(i)</enum><header>In
				general</header><text>An alien parent described in subparagraph (B)(ii)(cc) is
				eligible for a special nonimmigrant visa issued pursuant to this subparagraph.
				Such visa shall—</text>
									<subclause id="H1F8E766B71294D49B149C4F23C2068B6"><enum>(I)</enum><text>grant the alien
				all of the privileges granted to an alien lawfully admitted for permanent
				residence, except that the alien shall reside in the Commonwealth of the
				Northern Mariana Islands; and</text>
									</subclause><subclause id="H993BBE226E7F47768BAF9590A379DC39"><enum>(II)</enum><text>be valid until
				the earlier of—</text>
										<item id="HBF36EEC4A79F439AA4C4FAEE26198D39"><enum>(aa)</enum><text>the
				date that the child of the alien petitions for an adjustment of status for the
				alien to that of an alien lawfully admitted for permanent residence (as that
				term is defined in section 101(a)(20) of the Immigration and Nationality Act (8
				U.S.C. 1101(a)(20)));</text>
										</item><item id="H8A3247F3F7B84359881157460894A6D2"><enum>(bb)</enum><text>the
				date that the alien ceases to reside in the Commonwealth; or</text>
										</item><item id="H7AD648CB79424602BABF9DE5969F0FB1"><enum>(cc)</enum><text>November 28,
				2014.</text>
										</item></subclause></clause><clause id="HF3D7DA05D4C448F38FA5C3C65ACED6CC"><enum>(ii)</enum><header>Petitions for
				adjustment of status</header><text>A child of an alien parent described in
				subparagraph (B)(ii)(cc) may petition for an adjustment of status for the alien
				parent as described in clause (i)(II)(aa) during the period beginning on
				January 1, 2014, and ending on November 28, 2014, regardless of the age of the
				child.</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H1C34A675696D41EAA05093DA04347E05"><enum>(2)</enum><header>Construction</header><text>Such
			 paragraph (1), as amended by paragraph (1) of this subsection, is further
			 amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HC80343BDE9074209914F09F1EB292E4D" style="OLC">
						<subparagraph id="H9B01379945354C87AAA484168719764D"><enum>(E)</enum><header>Construction</header><text>This
				paragraph shall be construed to permit an alien who may not be removed
				212(a)(6)(A) of the Immigration and Nationality Act (8 U.S.C. 1182(a)(6)(A))
				under subparagraph (A) or (B) of this paragraph to leave the Commonwealth of
				the Northern Mariana Islands for a temporary absence and return to the
				Commonwealth pursuant to the entrance permit issued to the alien by the
				Commonwealth.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HD3D4D51BC18C404993E0CDE355FD7BFC"><enum>(3)</enum><header>Employment
			 authorization</header><text>Paragraph (2) of such section 6(e), is
			 amended—</text>
					<subparagraph id="HC7AFA03A32C74712A163A938E0B9E30A"><enum>(A)</enum><text>by redesignating
			 subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and moving
			 such clauses two ems to the right;</text>
					</subparagraph><subparagraph id="H933FC4C554954E7798FCE678C6766DB9"><enum>(B)</enum><text>by striking
			 <quote>An alien</quote> and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="H74A76015B2864F11AC6A9232EBD67A4B" style="OLC">
							<subparagraph id="HD7D7B6FDBE1645E9B6A58B63FD68A23F"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), an
				alien</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H44FD0ABD2C2F45EE8539BF1488570E3F"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="HBCB3973CB6884670918E3EFDFA9CB9C7" style="OLC">
							<subparagraph id="H7036FD89295B4496931086FA78C854F5"><enum>(B)</enum><header>Special
				rule</header><text>An alien who is described in paragraph (1)(B)(ii) shall be
				considered authorized by the Secretary of Homeland Security to be employed in
				the Commonwealth of the Northern Mariana Islands until the date that is 5 years
				after the transition program effective
				date.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H2C1BCB36C47E496CA30215794CD569A6"><enum>(4)</enum><header>Registration</header><text>Paragraph
			 3 of such section 6(e) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HB9A628FA84AE4744AF62E6344AE94B7E" style="OLC">
						<paragraph id="HE98DC257B8CF495CB277C0D92CD79C0A"><enum>(3)</enum><header>Registration</header>
							<subparagraph id="HAB83DF4B25E84A78AC90EAEE3A58BD4A"><enum>(A)</enum><header>Requirement for
				registration</header><text>Beginning not later than November 28, 2009, and on
				an on-going basis, the Secretary of Homeland Security shall require any alien
				present in the Commonwealth of the Northern Mariana Islands on or after the
				transition period effective date to register with the Secretary.</text>
							</subparagraph><subparagraph id="H9F2B1402573C4FFA99B51211400F5927"><enum>(B)</enum><header>Schedule for
				initial registration</header><text>The Secretary shall complete the initial
				registration of all aliens required to register under subparagraph (A) not
				later than February 1, 2010.</text>
							</subparagraph><subparagraph id="H85CEAAB8FA724486877B91A77D6D4037"><enum>(C)</enum><header>Inapplicability
				of prohibition on removal and employment authorization</header><text>Paragraphs
				(1) and (2) shall not apply to any alien who fails to register as required by
				this paragraph.</text>
							</subparagraph><subparagraph id="H755925CF37344DD7AFCAAD47D70DC1BB"><enum>(D)</enum><header>Cooperation</header><text>Notwithstanding
				any other provision of law, the Government of the Commonwealth of the Northern
				Mariana Islands shall provide to the Secretary all Commonwealth immigration
				records or other information that the Secretary deems necessary to assist in
				the implementation of this paragraph or other provisions of the Consolidated
				Natural Resources Act of 2008 (Public Law 110–229; 122 Stat. 854) or any
				amendment made by that Act.</text>
							</subparagraph><subparagraph id="HA290FD59F63141C493A4E95E584F90F2"><enum>(E)</enum><header>Construction
				with the INA</header><text>Nothing in this paragraph may be construed to modify
				or limit the application of section 262 of the Immigration and Nationality Act
				(8 U.S.C. 1302) or any other provision of the Immigration and Nationality Act
				(8 U.S.C. 1101 et seq.) relating to the registration of
				aliens.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="HEBCD673FF4F84AF6899E6BD64163DB3A"><enum>2.</enum><header>Adjustment of
			 status for permanent residents of the Commonwealth</header><text display-inline="no-display-inline">Section
			 6 of the Joint Resolution entitled <quote>A Joint Resolution to approve the
			 <quote>Covenant To Establish a Commonwealth of the Northern Mariana Islands in
			 Political Union with the United States of America</quote>, and for other
			 purposes</quote>, approved March 24, 1976 (48 U.S.C. 1806(e)), as added by
			 section 702 of the Consolidated Natural Resources Act of 2008 (Public Law
			 110–229; 122 Stat. 854)) is amended—</text>
			<paragraph id="HDD41111C6C5F4957B6FA7E199E367CDF"><enum>(1)</enum><text>by redesignating
			 subsections (f), (g), and (h), as subsections (g), (h), and (i), respectively;
			 and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1A521F9E367D483C9EF11F5213B6DDF0"><enum>(2)</enum><text>by inserting after
			 subsection (e) the following:</text>
				<quoted-block display-inline="no-display-inline" id="HC1DD5D57D2E44411AC7619AA6024B7D2" style="OLC">
					<subsection id="H43EB615B01B443AEBDFFFE8DA1F0CBCA"><enum>(f)</enum><header>Adjustment of
				status for permanent residents of the Commonwealth</header>
						<paragraph id="HF03AF9E2D63540E5B0D2E38BC51C0A6F"><enum>(1)</enum><header>Special
				nonimmigrant visa</header><text display-inline="yes-display-inline">An alien
				who was, on May 8, 2008, described in part 5–40.1–200 of the Administrative
				Code of the Northern Mariana Islands (as in effect on such date) is eligible
				for a special nonimmigrant visa issued pursuant to this paragraph. Such visa
				shall—</text>
							<subparagraph id="H0A84668515FD47E2996F34BDFC6CB231"><enum>(A)</enum><text>grant the alien
				all of the privileges granted to an alien lawfully admitted for permanent
				residence, except that the alien shall reside in the Commonwealth of the
				Northern Mariana Islands; and</text>
							</subparagraph><subparagraph id="HFD2FB11816E14C5CB8E0DEF24D4FA812"><enum>(B)</enum><text>be valid until the
				earlier of—</text>
								<clause id="H42B2EDBB4D76417881E141748539B103"><enum>(i)</enum><text>the date on which
				the alien adjusts status under paragraph (2); or</text>
								</clause><clause id="HD76023D3B607451F80F7931D4EEAE2E9"><enum>(ii)</enum><text>the date on which
				the alien ceases to reside in the Commonwealth.</text>
								</clause></subparagraph></paragraph><paragraph id="H78CD1D0E57994653847688C9AD0E36EC"><enum>(2)</enum><header>Adjustment of
				status</header><text>An alien is eligible for an adjustment of status to that
				of an alien lawfully admitted for permanent residence (as that term is defined
				in section 101(a)(20) of the Immigration and Nationality Act (8 U.S.C.
				1101(a)(20))), pursuant to this paragraph, if the alien—</text>
							<subparagraph id="H1C4C2529D8104903BE085EC8C96C0AEB"><enum>(A)</enum><text>was, on May 8,
				2008, described in part 5–40.1–200 of the Administrative Code of the Northern
				Mariana Islands (as in effect on such date); and</text>
							</subparagraph><subparagraph id="H043EC842F1574A1DB598FF8DBBAD3978"><enum>(B)</enum><text>applies for such
				status during the period beginning on January 1, 2014, and ending on November
				28,
				2014.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HE199DC331B1F4727AF2CF72E3BCAAAD8" section-type="subsequent-section"><enum>3.</enum><header>Northern Mariana
			 Islands visitor entry program transition</header>
			<subsection id="H0C804D0F64DF487A8302F8B6945DC88D"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Notwithstanding
			 section 705(b) of the Consolidated Natural Resources Act of 2008 (48 U.S.C.
			 1806(b)), the amendments made by section 702(b) of such Act shall take effect
			 on the date that is 180 days after the transition program effective date
			 described in section 6(a) of Public Law 94–241 (48 U.S.C. 1806(a)) (as added by
			 section 702(a) of the Consolidated Natural Resources Act of 2008). In a case in
			 which the transition program effective date has been modified under paragraph
			 (3) of such section 6(a) before the date of the enactment of this Act, such
			 amendments shall take effect on the date that is 180 days after the modified
			 date.</text>
			</subsection><subsection id="H752A6096C8C447888C71416960189569"><enum>(b)</enum><header>Treatment of
			 CNMI visitor entry program</header><text display-inline="yes-display-inline">During the 180-day period referred to in
			 subsection (a), the Secretary of Homeland Security shall administer the visitor
			 entry program of the Commonwealth of the Northern Mariana Islands consistent
			 with the provisions of Commonwealth law governing the program that were in
			 effect on the day before the commencement of such period.</text>
			</subsection></section><section id="H35A52FF5BF1C4EE182285909E434AB8C" section-type="subsequent-section"><enum>4.</enum><header>Family-based
			 immigration fee reduction for residents of the Commonwealth</header>
			<subsection id="H4F558DB200F4458D934F9ABA867DA954"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Consolidated
			 Natural Resources Act of 2008 (Public Law 110–229; 122 Stat. 754) is amended by
			 inserting after section 703 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H435587FB2A9744EB8BCD183DB8CCAAA5" style="OLC">
					<section id="HF5C29A9794604BD0B34E107D594D4E0B"><enum>703A.</enum><header>Family-based
				immigration fee reduction for residents of the Commonwealth</header>
						<subsection id="HDC94745A97B84888AA498E6A77E4275B"><enum>(a)</enum><header>Family-Based
				immigration benefit application and petition fees</header>
							<paragraph id="H494D907F9C30417E9D54721F30BB33B9"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary of
				State, the Attorney General, and the Secretary of Homeland Security shall
				reduce the fees for family-based immigration benefit applications and petitions
				(including associated fees, such as fees for fingerprinting or supporting
				documents) collected from residents of the Commonwealth of the Northern Mariana
				Islands who had immediate relative status pursuant to the immigration laws of
				the Commonwealth of the Northern Mariana Islands on May 8, 2008.</text>
							</paragraph><paragraph id="HF64B3BFE4A6543BCAD08424DC585395E"><enum>(2)</enum><header>Amount of
				reduction</header><text display-inline="yes-display-inline">The amount of the
				reduction shall be established by the Secretary of Homeland Security. It shall
				be a percentage reduction that is as least as great as the difference
				(expressed as a percentage) between the average per capita income in the
				Commonwealth of the Northern Mariana Islands and the average national per
				capita income in the United States as a whole (as determined according to the
				most recent data available from the Bureau of the Census).</text>
							</paragraph></subsection><subsection id="HBE561E8A61DF464FA993190EF4468BD4"><enum>(b)</enum><header>Requirements for
				sponsor’s affidavit of support</header><text display-inline="yes-display-inline">In the case of a resident of the
				Commonwealth of the Northern Mariana Islands who had immediate relative status
				pursuant to the immigration laws of the Commonwealth of the Northern Mariana
				Islands on May 8, 2008, section 213A(f)(1)(E) of the Immigration and
				Nationality Act (8 U.S.C. 1183a(f)(1)(E)) shall not apply.</text>
						</subsection><subsection id="HB9FF8638FB0E4A0587B90FE14C8D2801"><enum>(c)</enum><header>Effective
				date</header><text>This section shall take effect on the date of the enactment
				of this section and shall cease to be effective on December 31,
				2014.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HDF72523E781540E0985699932D11C4EE"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 contents for the Consolidated Natural Resources Act of 2008 (16 U.S.C. 1 note)
			 is amended by inserting after the item relating to section 703 the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H02678994B79A4D11A5CAB4A0C79D7C2C" style="OLC">
					<toc regeneration="no-regeneration">
						<toc-entry level="section">703A. Family-based immigration fee
				reduction for residents of the
				Commonwealth.</toc-entry>
					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HC6D14E94E51C4434AED0E20BE28EED53"><enum>5.</enum><header>Effective
			 dates</header>
			<subsection id="H3FA7454ADDB44E9198A5018D8F7DCF3E"><enum>(a)</enum><header>Section
			 3</header><text display-inline="yes-display-inline">Section 3 shall take effect
			 on the date of the enactment of this Act.</text>
			</subsection><subsection id="H9F0AB63F0E644AF2BA6039D245DFDDFD"><enum>(b)</enum><header>Section
			 4</header><text>Section 703A of the Consolidated Natural Resources Act of 2008,
			 as added by section 4 of this Act, shall be effective in accordance with
			 subsection (c) of such section 703A.</text>
			</subsection><subsection id="HC4EFF58F2D984770BDF2B0E3C0A8E3E0"><enum>(c)</enum><header>Other
			 provisions</header><text>Except as provided in subsection (b), the amendments
			 made by this Act shall take effect as if included in the enactment of subtitle
			 A of title VII of the Consolidated Natural Resources Act of 2008.</text>
