<section id="H143827A282C64D38A9764429054DE282" section-type="section-one"><enum>1.</enum><header>Authority of members of the United States Public Health Service and National Oceanographic and Atmospheric Administration Corps to transfer unused benefits under Post-9/11 Educational Assistance Program to family members</header> 
<subsection id="H9D68716FD51A4CE696DBE6FAD87F423B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3319 of title 38, United States Code, is amended—</text> 
<paragraph id="H3366DD330B674EB286AF9324D5D04A85"><enum>(1)</enum><text>by striking subsection (a) and inserting the following new subsection (a):</text> 
<quoted-block style="USC" id="H16D583AF99DB4638B504DACA76C0266F" display-inline="no-display-inline"> 
<subsection id="HCDDBB099B7FC4C0BB60B07D97C72127E"><enum>(a)</enum><header>Authority To transfer</header> 
<paragraph id="H25E097A4B9144042931130B8D7E22AB1"><enum>(1)</enum><header>Members of the Armed Forces</header><text display-inline="yes-display-inline">Subject to the provisions of this section, the Secretary of Defense, in order to promote the recruitment and retention of members of the Armed Forces, may authorize the Secretary concerned to permit an individual described in subsection (b)(1) who is entitled to educational assistance under this chapter to elect to transfer to one or more of the dependents specified in subsection (c) a portion of such individual’s entitlement to such assistance, subject to the limitation under subsection (d).</text></paragraph> 
<paragraph id="H3440D054AB0A44AE9167F0C243417C12"><enum>(2)</enum><header>Members of the United States Public Health Service</header><text display-inline="yes-display-inline">Subject to the provisions of this section, in order to promote the recruitment and retention of members of the United States Public Health Service, the Secretary of Health and Human Services may permit an individual described in subsection (b)(2) who is entitled to educational assistance under this chapter to elect to transfer to one or more of the dependents specified in subsection (c) a portion of such individual’s entitlement to such assistance, subject to the limitation under subsection (d).</text></paragraph> 
<paragraph id="HC6ACEF11E1AD445EA4560748F1E4360F"><enum>(3)</enum><header>Members of the National Oceanographic and Atmospheric Administration Corps</header><text display-inline="yes-display-inline">Subject to the provisions of this section, in order to promote the recruitment and retention of members of the National Oceanographic and Atmospheric Administration Corps, the Secretary of Commerce may permit an individual described in subsection (b)(3) who is entitled to educational assistance under this chapter to elect to transfer to one or more of the dependents specified in subsection (c) a portion of such individual’s entitlement to such assistance, subject to the limitation under subsection (d).</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H21D8462966E640EC9048F20C70FFE76C"><enum>(2)</enum><text>by striking subsection (b) and inserting the following new subsection (b):</text> 
<quoted-block style="USC" id="H1313118E3CE04B4C9770F9FB46CD97C3" display-inline="no-display-inline"> 
<subsection id="H4D04D146C0354191BA405608F4102E22"><enum>(b)</enum><header>Eligible individuals</header><text display-inline="yes-display-inline">For purposes of this section, an eligible individual is any of the following:</text> 
<paragraph id="H430A8CD1ACC64DFCBB791961AC4ACC0E"><enum>(1)</enum><text display-inline="yes-display-inline">A member of the Armed Forces who, at the time of the approval of the individual’s request to transfer entitlement to educational assistance under this section, has completed at least—</text> 
<subparagraph id="HF9D92588FAD24166A0D6A3BC67D493CF"><enum>(A)</enum><text>six years of service in the Armed Forces and enters into an agreement to serve at least four more years as a member of the Armed Forces; or</text></subparagraph> 
<subparagraph id="H50649A1EE05C41AF9EB265E770EB77C2"><enum>(B)</enum><text display-inline="yes-display-inline">the years of service as determined in regulations pursuant to section (k).</text></subparagraph></paragraph> 
<paragraph id="HA81480E7BB5E4EF0B31DF58ECFCCC336"><enum>(2)</enum><text display-inline="yes-display-inline">A member of the United States Public Health Service who, at the time of the approval of the individual’s request to transfer entitlement to educational assistance under this section, has completed at least—</text> 
<subparagraph id="HA552EDE336FD4C8D931EBB254D768E0C"><enum>(A)</enum><text>six years of service in the United States Public Health Service and enters into an agreement to serve at least four more years as a member of the United States Public Health Service; or</text></subparagraph> 
<subparagraph id="HEB183A1EE45E4FDEA81D47A9199C9F99"><enum>(B)</enum><text display-inline="yes-display-inline">the years of service as determined in regulations pursuant to section (k).</text></subparagraph></paragraph> 
<paragraph id="H71E66B8376AF4CF7967828C8A53A810A"><enum>(3)</enum><text display-inline="yes-display-inline">A member of the National Oceanographic and Atmospheric Administration Corps who, at the time of the approval of the individual’s request to transfer entitlement to educational assistance under this section, has completed at least—</text> 
<subparagraph id="HFEC01539839242B39DE1B648A0C8B806"><enum>(A)</enum><text display-inline="yes-display-inline">six years of service in the National Oceanographic and Atmospheric Administration Corps and enters into an agreement to serve at least four more years as a member of the National Oceanographic and Atmospheric Administration Corps; or</text></subparagraph> 
<subparagraph id="HBFE6AAEA2782404B83F9DFD435D03DB5"><enum>(B)</enum><text display-inline="yes-display-inline">the years of service as determined in regulations pursuant to section (k).</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HC2D168E1477D4C1EBBEAA92C9DE0DDEE"><enum>(3)</enum><text>in the second sentence of subsection (d), by striking <quote>Secretary of Defense</quote> and inserting <quote>, the appropriate Secretary</quote>;</text></paragraph> 
<paragraph id="H0A4F46C7B1794218BF69DD69AE84445B"><enum>(4)</enum><text>in subsection (f)—</text> 
<subparagraph id="H07F3BE406F2E473EA9F490674DE05400"><enum>(A)</enum><text>in paragraph (1), by striking <quote>armed forces</quote> and inserting <quote>Armed Forces, member of the United States Public Health Service, or member of the National Oceanographic and Atmospheric Administration Corps, as the case may be,</quote>; and</text></subparagraph> 
<subparagraph id="H1289A1D567E240A7A0B6CADC0D2F5680"><enum>(B)</enum><text>in paragraph (2), by striking <quote>Secretary concerned</quote> and inserting <quote>appropriate Secretary</quote>; </text></subparagraph></paragraph> 
<paragraph id="HE2CC729566DF45648CA1ECA4105E0A78"><enum>(5)</enum><text>in subsection (g)—</text> 
<subparagraph id="H6F6AA1D8B52B41E8BC462205FE654B9D"><enum>(A)</enum><text>in paragraph (1)(A), by striking <quote>in the armed forces</quote> and inserting <quote>in the Armed Forces, United States Public Health Service, or National Oceanographic and Atmospheric Administration Corps, as the case may be,</quote>; and</text></subparagraph> 
<subparagraph id="HEB030550258A4F42BC4FDB17629EBC95"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2)(A)(i), by striking <quote>in the armed forces</quote> and inserting <quote>in the Armed Forces, United States Public Health Service, or National Oceanographic and Atmospheric Administration Corps, as the case may be,</quote>;</text></subparagraph></paragraph> 
<paragraph id="HD9D66C01B4BE4E008B1C3F990EEB3D0D"><enum>(6)</enum><text>in subsection (h)—</text> 
<subparagraph id="HF7F7253B76CF40029FCAC0BC14822449"><enum>(A)</enum><text>in paragraph (2)(B), by inserting before <quote>as if the individual were not on active duty</quote> the following: <quote>, and in the case of a member of the Armed Forces,</quote>;</text></subparagraph> 
<subparagraph id="HECD65AFCCA9848888F1182EC78672793"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (3)(B), by inserting before <quote>as if the individual were not on active duty</quote> the following: <quote>, and in the case of a member of the Armed Forces,</quote>; and</text></subparagraph> 
<subparagraph id="HA84AE78D3DC24B8E81E481DD078E86F6"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (2)(A)(i), by striking <quote>in the armed forces</quote> and inserting <quote>in the Armed Forces, United States Public Health Service, or National Oceanographic and Atmospheric Administration Corps, as the case may be,</quote>;</text></subparagraph></paragraph> 
<paragraph id="H87EE860255B842A2B6087AC3448B2B68"><enum>(7)</enum><text>in subsection (i)(2)(A), by striking <quote>subsection (b)(1)</quote> and inserting <quote>paragraph (1)(A), (2)(A), or (3)(A) of subsection (b)</quote>;</text></paragraph> 
<paragraph id="H13A607A4D2DB47EAAC23423DE76B4E6F"><enum>(8)</enum><text>in subsection (j), by striking <quote>Secretary of Defense</quote> the following: <quote>appropriate Secretary</quote>; and</text></paragraph> 
<paragraph id="H064A5A8537D2429F8D35FD9BCDF2416D"><enum>(9)</enum><text>by inserting after subsection (k) and inserting the following new subsection:</text>

<subsection id="H56C3B3DFE8F64197AF173F0247D4776A"><enum>(l)</enum><header>Appropriate Secretary defined</header><text display-inline="yes-display-inline">In this section, the term <quote>appropriate Secretary</quote> means—</text> 
<paragraph id="H48ACDA026E1149A0BD105FA0CD669277"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary of Defense with respect to matters concerning members of the Armed Forces;</text></paragraph> 
<paragraph id="H375C4226F2C3455083EEFDA9A2C1D9A3"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary of Health and Human Services with respect to matters concerning the United States Public Health Service; and</text></paragraph> 
<paragraph id="HDF75ADCCF7434288A23E2FF90411A8CA"><enum>(3)</enum><text display-inline="yes-display-inline">the Secretary of Commerce with respect to matters concerning the National Oceanographic and Atmospheric Administration Corps.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H98092D561ADE4345A6D009BDC7CBBAF2"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this Act shall take effect as if included in the enactment of the Post-9/11 Veterans Educational Assistance Act of 2008 (title V of Public Law 110–252).</text></subsection></section>
