		<section id="H117FCA2C911841D5A3D83FF07E3D00D7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Harmful Algal Blooms and Hypoxia
			 Research and Control Amendments Act of 2009</short-title></quote>.</text>
		</section><section id="HCFAC3BC991624FB1A8CDE935DE57D7BE"><enum>2.</enum><header>Amendment of
			 Harmful Algal Bloom and Hypoxia Research and Control Act of 1998</header><text display-inline="no-display-inline">Except as otherwise expressly provided,
			 whenever in this Act an amendment or repeal is expressed in terms of an
			 amendment to, or repeal of, a section or other provision, the reference shall
			 be considered to be made to a section or other provision of the Harmful Algal
			 Bloom and Hypoxia Research and Control Act of 1998 (16 U.S.C. 1451
			 note).</text>
		</section><section id="H5ECF69D7D4E04062967711766DEC6966"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">The Act is amended by inserting after
			 section 602 the following:</text>

				<section id="H42CDB7614D75429B831EE974128DBDD5"><enum>602A.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
					<paragraph id="H3EC19AEC7F754F048FF47482131C27E4"><enum>(1)</enum><header>Administrator</header><text>The
				term <quote>Administrator</quote> means the Administrator of the Environmental
				Protection Agency.</text>
					</paragraph><paragraph id="H205745A20AA149F4BB0A564E99FD54C0"><enum>(2)</enum><header>Program</header><text>The
				term <quote>Program</quote> means the National Harmful Algal Bloom and Hypoxia
				Program established under section 603A.</text>
					</paragraph><paragraph id="H667FB3B07D734347A22FEDC9011E768E"><enum>(3)</enum><header>Under
				Secretary</header><text>The term <quote>Under Secretary</quote> means the Under
				Secretary of Commerce for Oceans and
				Atmosphere.</text>
					</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H4DC36FA7ED3E418CA88DBAC5DE894BB7"><enum>4.</enum><header>National Harmful
			 Algal Bloom and Hypoxia Program</header><text display-inline="no-display-inline">The Act is amended by inserting after
			 section 603 the following:</text>

				<section id="H630DE4E2722642EA948C3175EA129C94"><enum>603A.</enum><header>National
				Harmful Algal Bloom and Hypoxia Program</header>
					<subsection id="HE313B760E1E141E29130B5F0E8EA5EBE"><enum>(a)</enum><header>In
				general</header><text>Except as provided in subsection (d), the Under
				Secretary, through the Task Force established under section 603(a), shall
				establish and maintain a National Harmful Algal Bloom and Hypoxia Program
				pursuant to this section.</text>
					</subsection><subsection id="HDD0318BD1AD547A6B8B0969586643F60"><enum>(b)</enum><header>Duties</header><text>The
				Under Secretary, through the Program, shall—</text>
						<paragraph id="H542D5F77C544416E987FBB1D0BD8AB1B"><enum>(1)</enum><text>develop and
				promote a national strategy to understand, detect, predict, control, mitigate,
				and respond to marine and freshwater harmful algal bloom and hypoxia
				events;</text>
						</paragraph><paragraph id="H201C97D72FA140828D34139AAB1CD66D"><enum>(2)</enum><text>ensure the
				coordination of all Federal programs that address marine and freshwater harmful
				algal blooms and hypoxia, and other ocean and Great Lakes science and
				management programs and centers that address the chemical, biological, and
				physical components of marine and freshwater harmful algal blooms and
				hypoxia;</text>
						</paragraph><paragraph id="H9CFFBF218CCA425B80EDD6507EAC3B61"><enum>(3)</enum><text display-inline="yes-display-inline">coordinate and work cooperatively with
				regional, State, tribal, and local government agencies and programs that
				address marine and freshwater harmful algal blooms and hypoxia;</text>
						</paragraph><paragraph id="H22FBFC53E893405BB78F884008EC7094"><enum>(4)</enum><text display-inline="yes-display-inline">identify additional research, development,
				and demonstration needs and priorities relating to monitoring, prevention,
				control, mitigation, and response to marine and freshwater harmful algal blooms
				and hypoxia;</text>
						</paragraph><paragraph id="HE59E1F030C434ADDB59AC3954B7E00D3"><enum>(5)</enum><text display-inline="yes-display-inline">support international research efforts on
				marine and freshwater harmful algal blooms and hypoxia, and support
				international information sharing, mitigation, control, and response
				activities;</text>
						</paragraph><paragraph id="H15AC05BAE2054C7F9690637C773BDEE9"><enum>(6)</enum><text>ensure the
				development and implementation of methods and technologies to protect the
				ecosystems affected by marine and freshwater harmful algal blooms;</text>
						</paragraph><paragraph id="HDC1B5E157C794A31A4A68F2AD064D14F"><enum>(7)</enum><text display-inline="yes-display-inline">coordinate an outreach, education, and
				training program that integrates and augments existing programs to improve
				public education about and awareness of the causes, impacts, and mitigation
				efforts for marine and freshwater harmful algal blooms and hypoxia;</text>
						</paragraph><paragraph id="H3EFF34D3142A4C0B9F2368454F7929B8"><enum>(8)</enum><text display-inline="yes-display-inline">facilitate regional, State, tribal, and
				local efforts to develop and implement appropriate marine and freshwater
				harmful algal bloom and hypoxia response plans, strategies, and tools,
				including outreach programs and information dissemination mechanisms;</text>
						</paragraph><paragraph id="H9DBE6959A6DB48EC9355E6E5F147EDD6"><enum>(9)</enum><text display-inline="yes-display-inline">facilitate and provide resources for
				training of regional, State, tribal, and local coastal and water resource
				managers in the methods and technologies for monitoring, preventing,
				controlling, mitigating, and responding to marine and freshwater harmful algal
				blooms and hypoxia events;</text>
						</paragraph><paragraph id="H33FBED633BF74C4BADEE3F0B22A8C315"><enum>(10)</enum><text>develop and
				enhance critical observations, monitoring, modeling, data management,
				information dissemination, and operational forecasts;</text>
						</paragraph><paragraph id="H932817F4F7E94FF19F200393479FF99D"><enum>(11)</enum><text>oversee the
				development, implementation, review, and periodic updating of the Regional
				Research and Action Plans under section 603B; and</text>
						</paragraph><paragraph id="HD55B37F049BC40809CFDEA288A0C9162"><enum>(12)</enum><text>administer
				peer-reviewed, merit-based competitive grant funding to support—</text>
							<subparagraph id="H142FDEE22FDD4B1299B3990904FEB303"><enum>(A)</enum><text>the projects
				maintained and established by the Program; and</text>
							</subparagraph><subparagraph id="H7B79DE40B3F748CABCF47C7763F1D2A7"><enum>(B)</enum><text>the research and
				management needs and priorities identified in the Regional Research and Action
				Plans.</text>
							</subparagraph></paragraph></subsection><subsection id="H0A8C7503BD314612B7D92F23ECA2C822"><enum>(c)</enum><header>Cooperative
				efforts</header><text>The Under Secretary shall work cooperatively with other
				offices, centers, and programs within the National Oceanic and Atmospheric
				Administration and other agencies represented on the Task Force established
				under section 603(a), States, tribes, and nongovernmental organizations
				concerned with marine and freshwater aquatic issues related to harmful algal
				blooms and hypoxia.</text>
					</subsection><subsection id="H456F130341FA4A8CAF7BCC871AC977E8"><enum>(d)</enum><header>Freshwater
				program</header><text>With respect to the freshwater aspects of the Program,
				the Under Secretary and the Administrator shall jointly carry out the duties
				otherwise assigned to the Under Secretary under this section and section
				603B.</text>
					</subsection><subsection id="H1CF0FA359A2D46BE93B34B123D74CBB2"><enum>(e)</enum><header>Action
				strategy</header>
						<paragraph id="H63D311E84C4A4EF88C524F0C2923257F"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 12
				months after the date of enactment of the <short-title>Harmful Algal Blooms and Hypoxia Research and Control
				Amendments Act of 2009</short-title>, the Under Secretary, through the Task
				Force established under section 603(a), shall transmit to the Congress an
				action strategy that identifies—</text>
							<subparagraph id="HF46D21AB3D4C493EBF9B8BB1569C9657"><enum>(A)</enum><text>the specific
				activities to be carried out by the Program and the timeline for carrying out
				such activities; and</text>
							</subparagraph><subparagraph id="HDCABF6B4185A439B88AAF800B3635DD8"><enum>(B)</enum><text>the roles and
				responsibilities of each Federal agency in the Task Force established under
				section 603(a) in carrying out Program activities.</text>
							</subparagraph></paragraph><paragraph id="H918B32C7A58D4B588AD4D9678641BF2D"><enum>(2)</enum><header>Federal
				register</header><text>The Under Secretary shall publish the action strategy in
				the Federal Register.</text>
						</paragraph><paragraph id="HCE224F334FC84478ACCB7A7FBDFCAE7A"><enum>(3)</enum><header>Periodic
				revision</header><text>The Under Secretary shall periodically review and revise
				the action strategy prepared under this subsection as necessary.</text>
						</paragraph></subsection><subsection id="H04DB77E8B76040FCA868C748905EF25E"><enum>(f)</enum><header>Report</header><text>Every
				2 years after the submission of the action strategy, the Under Secretary shall
				prepare and transmit to the Congress a report that describes—</text>
						<paragraph id="H15824530A01943D4B6CD59321DD90B50"><enum>(1)</enum><text>the activities
				carried out under the Program and the budget related to these activities;
				and</text>
						</paragraph><paragraph id="H9EA4AA0BF64A43B18BC194D2B8685FD1"><enum>(2)</enum><text>the progress made
				on implementing the action
				strategy.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H91F546A52386404BA04AF827DD7A7523"><enum>5.</enum><header>Regional research
			 and action plans</header><text display-inline="no-display-inline">The Act is
			 amended by inserting after section 603A the following:</text>

				<section id="H0F872CBA67164A9198F0F32956F0B103"><enum>603B.</enum><header>Regional
				research and action plans</header>
					<subsection id="H3FC9C54125AC4D7795CC7AFA73673A0F"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Under Secretary,
				through the Task Force established under section 603(a), shall—</text>
						<paragraph id="HFBA57C819CF94D80B1E4044AFD240CC3"><enum>(1)</enum><text>identify the
				appropriate regions and subregions to be addressed by each Regional Research
				and Action Plan; and</text>
						</paragraph><paragraph id="H31AAF0ECC4D340149F93B45EAF98E8F4"><enum>(2)</enum><text>oversee the
				development and implementation of the Regional Research and Action
				Plans.</text>
						</paragraph></subsection><subsection id="H0ED49D8647474D3B943F5D2F928843A7"><enum>(b)</enum><header>Contents</header><text>The
				Plans developed under this section shall identify—</text>
						<paragraph id="H27733C90BB004A9CAA60DB9EDB1D4928"><enum>(1)</enum><text>regional
				priorities for ecological, economic, and social research on issues related to
				the impacts of harmful algal blooms and hypoxia;</text>
						</paragraph><paragraph id="H60144F593CB547188CCDA8F786CF1468"><enum>(2)</enum><text>research,
				development, and demonstration activities needed to develop and advance
				technologies for improving capabilities to predict, monitor, prevent, control,
				and mitigate harmful algal blooms and hypoxia;</text>
						</paragraph><paragraph id="HF56052E87CBD42CE9BE26B8142155D2B"><enum>(3)</enum><text>actions to
				minimize the occurrence of harmful algal blooms and hypoxia;</text>
						</paragraph><paragraph id="HC6AD1D2822A1493B90A788E5C33954FC"><enum>(4)</enum><text>ways to reduce the
				duration and intensity of harmful algal blooms and hypoxia, including in times
				of emergency;</text>
						</paragraph><paragraph id="H0594F0DD7C3C43C48BC61BE6E989BEAC"><enum>(5)</enum><text>research and
				methods to address human health dimensions of harmful algal blooms and
				hypoxia;</text>
						</paragraph><paragraph id="H7D4B1B8CFD744CAAB9EFFF97553FC8B8"><enum>(6)</enum><text>mechanisms to
				protect vulnerable ecosystems that could be or have been affected by harmful
				algal blooms and hypoxia events;</text>
						</paragraph><paragraph id="HE8E1386C78ED436F886311080E291714"><enum>(7)</enum><text>mechanisms by
				which data, information, and products are transferred between the Program and
				State, tribal, and local governments and relevant research entities;</text>
						</paragraph><paragraph id="H278B317B58AC497DB046203847A7092C"><enum>(8)</enum><text>communication,
				outreach, and information dissemination methods that State, tribal, and local
				governments and nongovernmental organizations can undertake to educate and
				inform the public concerning harmful algal blooms and hypoxia; and</text>
						</paragraph><paragraph id="H08E059CFB4034D2087E71AEDBC48B48C"><enum>(9)</enum><text>the roles that
				Federal agencies can play to help facilitate implementation of the Plan.</text>
						</paragraph></subsection><subsection id="H5655EAC0670343B3BCF6EE3F6C044D48"><enum>(c)</enum><header>Building on
				available studies and information</header><text>In developing the Plans under
				this section, the Under Secretary shall utilize and build on existing research,
				assessments, and reports, including those carried out pursuant to existing law
				and other relevant sources.</text>
					</subsection><subsection id="H298A3E227D6442EDA2B15667AA025319"><enum>(d)</enum><header>Development of
				plans</header><text>The Under Secretary may develop Plans under this section
				with assistance from the individuals and entities described in subsection
				(g).</text>
					</subsection><subsection id="H0A56B38EBEB2497E8F2DF2C795B546C9"><enum>(e)</enum><header>Plan timeline
				and updates</header><text display-inline="yes-display-inline">The Under
				Secretary, through the Task Force established under section 603(a), shall
				ensure that the Plans developed under this section are completed not later than
				12 months after the date of enactment of the <short-title>Harmful Algal Blooms and Hypoxia Research and Control
				Amendments Act of 2009</short-title>, and updated once every 5 years
				thereafter.</text>
					</subsection><subsection id="H607CEA2B7F75457891FDC1CA573B4FF0"><enum>(f)</enum><header>Reports</header><text>Not
				later than 12 months after the date of enactment of this Act, and once every
				two years after the completion of the Regional Research and Actions Plans, the
				Under Secretary shall transmit to the Congress a report that describes—</text>
						<paragraph id="H32FA0848CC244C0185A3C0DEEC511DA6"><enum>(1)</enum><text>the contents of
				each Plan;</text>
						</paragraph><paragraph id="H509C6DC93A3045B89F77FC4C8B5B74D8"><enum>(2)</enum><text>the activities
				taken to implement the Plans, including a description of research funded and
				actions and outcomes of Plan response strategies carried out; and</text>
						</paragraph><paragraph id="H891E0133AF30492AB5C83FC4D4CEB969"><enum>(3)</enum><text>Federal funding
				provided to implement the Plans.</text>
						</paragraph></subsection><subsection id="HB9168DFBAB3C4BB2844A36C7C5C33C5F"><enum>(g)</enum><header>Consultation</header><text>In
				developing the Plans under this section, as appropriate, the Under Secretary
				shall consult with—</text>
						<paragraph id="H0D7BC4BF7B9C41959D1B55A71F681909"><enum>(1)</enum><text>State coastal
				management and planning officials;</text>
						</paragraph><paragraph id="HB79E8D82639D47FFBC159A9D13606D41"><enum>(2)</enum><text>tribal resource
				management officials;</text>
						</paragraph><paragraph id="HF2D3E671D5BB4B88BAFF81A51F3DC2D5"><enum>(3)</enum><text>water management
				and watershed officials from both coastal States and noncoastal States with
				water sources that drain into water bodies affected by harmful algal blooms and
				hypoxia;</text>
						</paragraph><paragraph id="H5BBBCBC20A2E420199EED6A7DDA2BCF4"><enum>(4)</enum><text>public health
				officials;</text>
						</paragraph><paragraph id="H525EF712704249C99015C00B5C4A726D"><enum>(5)</enum><text>emergency
				management officials;</text>
						</paragraph><paragraph id="H85796253667C41AC9268B41B1736DE24"><enum>(6)</enum><text>nongovernmental
				organizations concerned with marine and aquatic issues;</text>
						</paragraph><paragraph id="H47B212E8A4234F308FD2848939946899"><enum>(7)</enum><text>science and
				technology development institutions;</text>
						</paragraph><paragraph id="H4576294E166543BB9FDF898E430D6214"><enum>(8)</enum><text>economists;</text>
						</paragraph><paragraph id="H2024D63D3311450AA0226F21AA3B5A93"><enum>(9)</enum><text>industries and
				businesses affected by marine and freshwater harmful algal blooms and
				hypoxia;</text>
						</paragraph><paragraph id="HE641D7ED43A44607AD304671A0F71769"><enum>(10)</enum><text>scientists, with
				expertise concerning harmful algal blooms or hypoxia, from academic or research
				institutions; and</text>
						</paragraph><paragraph id="HE3879B506DCA496D9DB0EC3F99CB6C99"><enum>(11)</enum><text>other
				stakeholders.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H7E2162BD69484081B38EC3A0BA72F553"><enum>6.</enum><header>Northern Gulf of
			 Mexico Hypoxia</header><text display-inline="no-display-inline">Section 604 is
			 amended to read as follows:</text>

				<section id="HB04E63A2ECEB48558D6320A59AA33B21"><enum>604.</enum><header>Northern Gulf
				of Mexico Hypoxia</header>
					<subsection id="HF2EF70B4397447D8B8E0EF2CC6D58154"><enum>(a)</enum><header>Task force
				initial progress reports</header><text display-inline="yes-display-inline">Not
				later than 2 years after the date of enactment of the
				<short-title>Harmful Algal Blooms and Hypoxia Research and
				Control Amendments Act of 2009</short-title>, the Mississippi River/Gulf of
				Mexico Watershed Nutrient Task Force shall complete and transmit to the
				Congress and the President a report on the progress made by Task Force-directed
				activities toward attainment of the coastal goal of the 2008 Gulf Hypoxia
				Action Plan.</text>
					</subsection><subsection id="H16A23C0FAEB04643A08F65DF7D21F243"><enum>(b)</enum><header>Task force
				5-Year progress reports</header><text display-inline="yes-display-inline">After
				the initial report required under subsection (a), the Task Force shall complete
				and transmit to Congress and the President a report every 5 years thereafter on
				the progress made by Task Force-directed activities toward attainment of the
				coastal goal of the 2008 Gulf Hypoxia Action Plan.</text>
					</subsection><subsection id="H40C35CC527A94948AFAA0EA2A21A45A4"><enum>(c)</enum><header>Contents</header><text>The
				reports required by this section shall assess progress made toward nutrient
				load reductions, the response of the hypoxic zone and water quality throughout
				the Mississippi/Atchafalaya River Basin, and the economic and social effects.
				The reports shall—</text>
						<paragraph id="H82789424B7E04B4B96EC31CC7692F5B6"><enum>(1)</enum><text>include an
				evaluation of how current policies and programs affect management decisions,
				including those made by municipalities and industrial and agricultural
				producers;</text>
						</paragraph><paragraph id="HCA8B8259E24A4E9EB680DC6687AAD2BE"><enum>(2)</enum><text>evaluate lessons
				learned; and</text>
						</paragraph><paragraph id="HB816A53116324F46930E1592A27A6CB4"><enum>(3)</enum><text display-inline="yes-display-inline">recommend appropriate actions to continue
				to implement or, if necessary, revise the strategy set forth in the 2008 Gulf
				Hypoxia Action
				Plan.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H437639B014C84A1B900E1AD7B3658741"><enum>7.</enum><header>Pacific
			 Northwest, estuaries, and Puget Sound hypoxia</header><text display-inline="no-display-inline">The Act is amended by inserting after
			 section 604 the following:</text>
			<quoted-block display-inline="no-display-inline" id="H86C0CB46A18741EAA9C3402D7E3B51B5" style="OLC">
				<section id="HAFCE316131F0443F8F0DDF9B6BFC070B"><enum>604A.</enum><header>Pacific
				Northwest, estuaries, and Puget Sound hypoxia</header>
					<subsection id="H51A137EDE3B74DED874A8EA80779E320"><enum>(a)</enum><header>Assessment
				report</header><text display-inline="yes-display-inline">Not later than 12
				months after the date of enactment of this Act, the Task Force established
				under section 603 shall complete and submit to Congress and the President an
				integrated assessment of hypoxia in the coastal and estuarine waters of the
				Pacific Northwest that examines the status of current research, monitoring,
				prevention, response, and control efforts.</text>
					</subsection><subsection id="HD6384B7010BB431782A8FCD71EDE4B4B"><enum>(b)</enum><header>Plan</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
				enactment of this Act, such Task Force shall develop and submit to Congress a
				plan, based on the integrated assessment submitted under subsection (a), for
				reducing, mitigating, and controlling hypoxia in the coastal and estuarine
				waters of the Pacific Northwest. In developing such plan, the Task Force shall
				consult with State, Indian tribe, and local governments, and academic,
				agricultural, industry, and environmental groups and representatives. Such plan
				shall include incentive-based partnership approaches. The plan shall also
				address the social and economic costs and benefits of the measures for
				reducing, mitigating, and controlling hypoxia. At least 90 days before
				submission of such plan to the Congress, a summary of the proposed plan shall
				be published in the Federal Register. After submission of the plan, the Task
				Force shall provide progress reports on the activities toward attainment of the
				goals set forth in the plan reduce, mitigate, and control hypoxia in the
				coastal and estuarine waters of the Pacific Northwest every 2
				years.</text>

			 appropriations</header><text display-inline="no-display-inline">Section 605 is
			 amended to read as follows:</text>

				<section id="H0BCA3CB6A75649A4A5F7876958F97244"><enum>605.</enum><header>Authorization
				of appropriations</header><text display-inline="no-display-inline">There are
				authorized to be appropriated—</text>
					<paragraph id="H9AEAE9C249C9421AB9D7EA67B614F548"><enum>(1)</enum><text display-inline="yes-display-inline">to the Under Secretary to carry out
				sections 603A and 603B, $35,000,000 for each of fiscal years 2010 through 2014,
				of which $5,000,000 for each such fiscal year shall be for the development of
				the Regional Research and Action Plans required by section 603B; and</text>
					</paragraph><paragraph id="HC051492EAA4C48E786F9773F06A664F0"><enum>(2)</enum><text display-inline="yes-display-inline">to the Administrator to carry out sections
				603A and 603B, $6,000,000 for each of fiscal years 2010 through
				2014.</text>
