		<section id="HBAEC0568075A4567A2C2CAC92DC3FEF7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Broadband Affordability Act of
			 2009</short-title></quote>.</text>
		</section><section id="HC6DD2C790C524D0E8225973E8D073A19" section-type="subsequent-section"><enum>2.</enum><header>Broadband Lifeline
			 Assistance Program</header><text display-inline="no-display-inline">Section
			 254(j) of the Communications Act of 1934 (47 U.S.C. 254(j)) is amended—</text>
			<paragraph id="H904168E856D7479BAF55E83477E45EB3"><enum>(1)</enum><text>by striking
			 <quote><header-in-text level="subsection" style="OLC"><enum-in-header>(j)</enum-in-header> Lifeline
			 Assistance.—</header-in-text>Nothing in this</quote> and inserting the
			 following:</text>

					<subsection id="H7891B8451C8943D4A3586060703A985E"><enum>(j)</enum><header>Lifeline
				Assistance</header>
						<paragraph id="H58F652B0C09C49DAA169B8F8F035B9FE"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Nothing in
				this</text>
						</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H00E7539E956240CC961DE17E37677B2F"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HDE529D07EDB040059F9752EBE68AD990" style="OLC">
					<paragraph id="H9F0B8B815EA74489AB72C0BDCA3BADD5"><enum>(2)</enum><header>Broadband
				Lifeline Assistance Program</header>
						<subparagraph id="H27E21A89C2D74A1493EAEF2CAE791F04"><enum>(A)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this paragraph is to promote
				the adoption of broadband service by all people of the United States while
				recognizing that the price of broadband service is a barrier to adoption for
				low income households.</text>
						</subparagraph><subparagraph id="H64CC4BF329374EC98D1C2428634F56DD"><enum>(B)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 270
				days after the date of enactment of the <short-title>Broadband Affordability Act of 2009</short-title>, the
				Commission shall take all actions necessary to establish a broadband lifeline
				program that enables qualifying low-income customers residing in urban and
				rural areas to purchase broadband service at reduced charges by reimbursing
				providers for each such customer served. Such broadband lifeline program shall
				be similar in structure to the Lifeline program for basic telephone service
				under subpart E of part 54 of title 47, Code of Federal Regulations.</text>
						</subparagraph><subparagraph commented="no" id="H84A4D9B51626410F8E23D083EBAB9B89"><enum>(C)</enum><header>State matching
				funds</header><text display-inline="yes-display-inline">In recognition of the
				interstate nature of broadband service, the Commission may determine, in
				consultation with the Federal-State Joint Board, whether State matching funds
				must be provided as a condition of eligibility for low-income households within
				such State.</text>
						</subparagraph><subparagraph id="HC46E02FAA19E49F9855735AE5677E062"><enum>(D)</enum><header>Amount of
				support</header><text display-inline="yes-display-inline">The Commission, in
				calculating the amount of support to be provided to each low-income household,
				shall routinely study the prevailing market price for broadband service and the
				prevailing speed of broadband service adopted by households. To fulfill this
				requirement, the Commission shall rely on information that it routinely
				collects or that is publicly available.</text>
						</subparagraph><subparagraph id="H28694FEC5C9C461AA44CA53243AD65F9"><enum>(E)</enum><header>Technology
				neutral</header><text display-inline="yes-display-inline">The Commission shall
				ensure that the broadband lifeline program is neutral as to the types of
				technology used to provide broadband service to promote competition from
				broadband service providers to qualify under such program. A broadband service
				provider need not be an eligible telecommunications carrier to receive support
				under the broadband lifeline program, but such provider shall obtain
				authorization from the Commission in order to participate in the
				program.</text>
