		<official-title display="yes">To direct the National Oceanic and
		  Atmospheric Administration to establish education and watershed programs which
		  advance environmental literacy, including preparedness and adaptability for the
		  likely impacts of climate change in coastal watershed regions.</official-title>

		<section commented="no" display-inline="no-display-inline" id="H7F3FF33901C849AAB79E4B1B0599DE7A" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Ocean, Coastal, and Watershed
			 Education Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H0A07E696427B46FB83CCBEFFD9C016AA" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings and purpose</header>
			<subsection commented="no" display-inline="no-display-inline" id="H4680152E82514613A0B9396A2432FEE8"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">The Congress finds the following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HEDBC2381204044348F7A1E1BA638CDBA"><enum>(1)</enum><text display-inline="yes-display-inline">The United States faces major challenges,
			 such as mitigating and adapting to the impacts of climate change, stewarding
			 critical coastal and marine resources including fish and wildlife habitat while
			 sustaining the commercial and recreational activities that depend on these
			 resources, and improving resilience to natural disasters, that collectively
			 threaten human health, sustainable economic development, environmental quality,
			 and national security.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H000AAD195F5F4585950930DE65BB2EDE"><enum>(2)</enum><text display-inline="yes-display-inline">Communities in coastal watersheds are
			 particularly vulnerable to these increasingly urgent, interconnected, and
			 complex challenges and need support for teacher professional development and
			 experiential learning among students of all ages.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H01D8B43F279F4D0F9400072EA69C70E2"><enum>(3)</enum><text display-inline="yes-display-inline">These challenges can be met with the help
			 of comprehensive programs specifically targeted to engage coastal watershed
			 communities, schoolchildren, and the general public to develop engaged and
			 environmentally literate citizens who are better able to understand complex
			 environmental issues, assess risk, evaluate proposed plans, and understand how
			 individual decisions affect the environment at local, regional, national, and
			 global scales.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H204C1DCD6A3E41D2BD97824C76D674E2"><enum>(4)</enum><text display-inline="yes-display-inline">The intrinsic social and conservation
			 values of wildlife-dependent and other outdoor recreation can play an important
			 role in outdoor educational programs that address the myriad of coastal and
			 ocean concerns, as well as instill a sustainable conservation ethic that will
			 enable them to face those challenges to the betterment of both the environment
			 and coastal communities.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC02608222DB248BD821F0E47EE9F5ADF"><enum>(5)</enum><text display-inline="yes-display-inline">The economic importance of coastal areas
			 and resources to the overall economy of the United States is significant.
			 According to the U.S. Commission on Ocean Policy, coastal and ocean-related
			 activities support millions of American jobs and generate more than $1
			 trillion, or one tenth of the Nation’s annual gross domestic product.
			 Sustainable use of the Nation’s natural resources can provide additional
			 economic opportunities to the United States economy.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HBA8F33EF80ED496987D3A1AB8CA0F089"><enum>(b)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to advance
			 environmental literacy, develop public awareness and appreciation of the
			 economic, social, recreational, and environmental benefits of coastal
			 watersheds, and emphasize stewardship and sustainable economic development of
			 critical coastal and marine resources, including an understanding of how
			 climate change is impacting those resources, through the establishment
			 of—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HDD110AD7CE1C49739A937C7F375C2CBE"><enum>(1)</enum><text display-inline="yes-display-inline">an Environmental Literacy Grant Program;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H406A79C3024A48C3999331E608FBF0F7"><enum>(2)</enum><text display-inline="yes-display-inline">regional programs under the B-WET
			 Program.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H99EA3AD3C91A48B48B66DC79A0A8BA8A" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H1AFB5C904C8C46BDAEDF009DB024626B"><enum>(1)</enum><header display-inline="yes-display-inline">Administrator</header><text display-inline="yes-display-inline">The term <quote>Administrator</quote> means
			 the Administrator of the National Oceanic and Atmospheric
			 Administration.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H66716ED2860848AA98040779FAD794E2"><enum>(2)</enum><header display-inline="yes-display-inline">Bay-watershed education</header><text display-inline="yes-display-inline">The term <quote>bay-watershed
			 education</quote> means environmental education focused on watersheds, with an
			 emphasis on stewardship and sustainable economic development of critical
			 coastal and marine resources, including an understanding of how climate change
			 is impacting those resources.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0779BD7DEB4F4B819F255B801596C910"><enum>(3)</enum><header display-inline="yes-display-inline">B-WET Program</header><text display-inline="yes-display-inline">The term <quote>B-WET Program</quote> means
			 the Bay-Watershed Education and Training Program of the National Oceanic and
			 Atmospheric Administration, as in effect immediately before the enactment of
			 this Act and modified under this Act or any subsequently enacted Act.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H54B9FC81C3E0463AA53D82660A273AC7"><enum>(4)</enum><header display-inline="yes-display-inline">Eligible entity</header><text display-inline="yes-display-inline">The term <quote>eligible entity</quote>
			 means a State agency, local agency, school district, institution of higher
			 education, or for-profit or non-profit nongovernmental organization,
			 consortium, or other entity that the Administrator finds has demonstrated
			 expertise and experience in the development of the institutional, intellectual,
			 or policy resources to help environmental education become more effective and
			 widely practiced.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC059F431A7164B68BDF49CD76506FFD3"><enum>(5)</enum><header display-inline="yes-display-inline">Environmental education</header><text display-inline="yes-display-inline">The term <quote>environmental
			 education</quote> means interdisciplinary formal and informal learning about
			 the relevant interrelationships between dynamic environmental and human
			 systems, including economic systems that depend on coastal, watershed and
			 marine resources for job creation and economic growth, that results in
			 increasing the learner’s capacity for decisionmaking, stewardship, and
			 sustainable economic development of natural and community resources.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H678693637D68464B91D0BCED06EACEA9"><enum>(6)</enum><header display-inline="yes-display-inline">Environmental literacy</header><text display-inline="yes-display-inline">The term <quote>environmental
			 literacy</quote> means the capacity to perceive and interpret the relative
			 health of environmental systems and the interrelationships between natural,
			 economic, and social systems and technology, and to assess options and take
			 appropriate action to maintain, restore, or improve the health of those systems
			 and promote sustainable economic development.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H83C086A9C74A40C6A5E48517C052342C"><enum>(7)</enum><header display-inline="yes-display-inline">High-leverage projects</header><text display-inline="yes-display-inline">The term <quote>high-leverage
			 projects</quote> means projects supported by grants authorized under this Act
			 that use Federal, State and nongovernmental financial, technical, and other
			 resources in such a manner that the potential beneficial outcomes are highly
			 magnified or enhanced.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H042706F82D1A43CABB33C16086368B73"><enum>(8)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <quote>State</quote> means each of
			 the several States of the United States, the District of Columbia, the
			 Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, the
			 Commonwealth of the Northern Mariana Islands, any other territory or possession
			 of the United States, and any Indian tribe.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H2294229B41094DF0B369A3AD078F1287" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Environmental literacy grant
			 program</header>
			<subsection commented="no" display-inline="no-display-inline" id="HF6AD2C772A4E4F10AF9F4872A2F6F744"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall establish a
			 national competitive grant program, to be known as the <quote>Environmental
			 Literacy Grant Program</quote>, under which the Administrator shall provide,
			 subject to the availability of appropriations, financial assistance to—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H8C3174F4F29D4E18B95DC24E22B3C1EF"><enum>(1)</enum><text display-inline="yes-display-inline">expand the adoption of coastal, ocean,
			 Great Lakes, and climate on all time scales education;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H95CFADB6322A42BEB7248A471D6FE825"><enum>(2)</enum><text display-inline="yes-display-inline">build administrative and technical capacity
			 with coastal, ocean, and watershed communities and stakeholder groups to
			 enhance their effectiveness;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF024C1DF99414F61A859620F5EEDA2DB"><enum>(3)</enum><text display-inline="yes-display-inline">encourage water-dependent,
			 wildlife-dependent, and other outdoor recreation, experiential learning, and
			 hands-on involvement with coastal and watershed resources as a method of
			 promoting stewardship and sustainable economic development of those
			 resources;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8557907790594693B102B2E2E1E01644"><enum>(4)</enum><text display-inline="yes-display-inline">develop and implement new approaches to
			 advance coastal, ocean, Great Lakes, and climate on all time scales education
			 and environmental literacy at national, regional, and local levels; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC56842D9C6624CAD944A207A9EA8B47B"><enum>(5)</enum><text display-inline="yes-display-inline">encourage formal and informal environmental
			 education about the systemic interrelationships between healthy coastal,
			 watershed, and marine resources and sustainable economic systems that depend on
			 such resources for job creation and economic development.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HAADE13EB59264EC5945DCF615F25A795"><enum>(b)</enum><header display-inline="yes-display-inline">Priorities</header><text display-inline="yes-display-inline">In awarding grants under this section, the
			 Administrator shall give priority consideration to innovative, strategic,
			 high-leverage projects that demonstrate strong potential for being sustained in
			 the future by a grant recipient beyond the time period in which activities are
			 carried out with the grant.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HBE939DDF91324C80B51C849F07B6FEFB"><enum>(c)</enum><header display-inline="yes-display-inline">Guidelines</header><text display-inline="yes-display-inline">No later than 180 days after the date of
			 enactment of this Act and after consultation with appropriate stakeholders, the
			 Administrator shall publish in the Federal Register guidelines regarding the
			 implementation of this grant program, including publication of criteria for
			 eligible entities, identification of national priorities, establishment of
			 performance measures to evaluate program effectiveness, information regarding
			 sources of non-Federal matching funds or in-kind contributions, and reporting
			 requirements for grant award recipients.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HA92A17F30DC74ECC937788FE0CDDF54C"><enum>(d)</enum><header display-inline="yes-display-inline">Limitation on use of funds by
			 administrator</header><text display-inline="yes-display-inline">Of the amounts
			 made available to implement this section—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H64521BBC04A74BB3AE974A8FAC15C36C"><enum>(1)</enum><text display-inline="yes-display-inline">no less than 80 percent shall be used for
			 competitive grants or cooperative agreements;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0CA97E50FDAE4CC4A6FBED331A47398F"><enum>(2)</enum><text display-inline="yes-display-inline">no more than 10 percent may be used by the
			 Administrator to implement the grant program; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCC682AFFF70F455FBF6C697E8106176F"><enum>(3)</enum><text display-inline="yes-display-inline">no less than 10 percent of the annual funds
			 appropriated for the program authorized under this section shall be used to
			 fund contracts or cooperative agreements to conduct strategic planning, promote
			 communications among grant recipients and within communities, coordinate grant
			 activities to foster an integrated program, and oversee national evaluation
			 efforts.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H3CA56B4D78984FCFA101C2692E91DF2E" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">B-WET Program</header>
			<subsection commented="no" display-inline="no-display-inline" id="HE79EC5F222DF43769B90B3C453556CF8"><enum>(a)</enum><header display-inline="yes-display-inline">Existing program</header><text display-inline="yes-display-inline">The Administrator shall conduct the B-WET
			 Program, including each of the regional programs conducted or under active
			 consideration for creation under such program immediately before the enactment
			 of this Act.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HB6FF7E0F3DBA4B6BB3545DF234933EA0"><enum>(b)</enum><header display-inline="yes-display-inline">New regional programs</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H2D3E7572D8E44280BD29B2CC10C7CE77"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator may create new regional
			 programs under the B-WET Program in accordance with a strategy issued under
			 this subsection.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD943ABA203E04B54B0C4A007D5BFA243"><enum>(2)</enum><header display-inline="yes-display-inline">Strategy</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="H1F44E91088FB456F98C0B5216C700A76"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall issue a strategy
			 for establishing such new regional programs.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H059337895B284039BCFF92036BB094F6"><enum>(B)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The strategy shall include the
			 following:</text>
						<clause commented="no" display-inline="no-display-inline" id="H2C862BDB0C9544FABE7879F3875014FF"><enum>(i)</enum><text display-inline="yes-display-inline">Evaluation of the need for new regional
			 program in areas that are not served under the B-WET Program on the date of
			 enactment of this Act.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H067B918E94984C2F9838F59D704F2AED"><enum>(ii)</enum><text display-inline="yes-display-inline">Identification of potential new regional
			 programs, including a listing of potential principal non-Federal
			 partners.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HAEB21D9B16494E1F9F393756D42F056A"><enum>(iii)</enum><text display-inline="yes-display-inline">A comprehensive budget for future expansion
			 of the B-WET Program over the period for which appropriations are authorized
			 under this Act.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H66813E36480741B8A80B9343E326EA8B"><enum>(iv)</enum><text display-inline="yes-display-inline">Such other information as the Administrator
			 considers necessary.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC4034D7671464B4984C5EDC7857D200D"><enum>(C)</enum><header display-inline="yes-display-inline">Consultation and public
			 comment</header><text display-inline="yes-display-inline">The Administrator
			 shall consult with relevant stakeholders and provide opportunity for public
			 comment in the development of the strategy.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFD74CB3639DF4FC48CDACBE9BED54F95"><enum>(D)</enum><header display-inline="yes-display-inline">Submission to Congress</header><text display-inline="yes-display-inline">The Administrator shall submit the strategy
			 to the Committee on Natural Resources of the House of Representatives and the
			 Committee on Commerce, Science, and Transportation of the Senate by not later
			 than 270 days after the date of enactment of this Act.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H460604F373AE47E4876A8C7A8540A834"><enum>(3)</enum><header display-inline="yes-display-inline">Priority consideration</header><text display-inline="yes-display-inline">In creating new regional programs under
			 this subsection, the Administrator shall give priority consideration to the
			 needs of—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HDD2C9B54E80649B8AF37055044207187"><enum>(A)</enum><text display-inline="yes-display-inline">United States territories, including Guam,
			 the Commonwealth of Puerto Rico, the Virgin Islands, the Commonwealth of the
			 Northern Mariana Islands, and American Samoa;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5915879110934603ABFC52C750E59784"><enum>(B)</enum><text display-inline="yes-display-inline">the Great Lakes States;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDF70E804BB8F4F0B9713C21D37F6BEC3"><enum>(C)</enum><text display-inline="yes-display-inline">Alaska; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H11B24E77F05449E6B6A81B5C1948AD0B"><enum>(D)</enum><text display-inline="yes-display-inline">the mid-Atlantic region.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H82325C9F2727429DA4C18C5E43459115"><enum>(c)</enum><header display-inline="yes-display-inline">Modification of B-WET Program</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H31403CEB76784D5FB7C40A50E1379B0D"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator may modify or realign
			 regional programs under the B-WET Program, based on—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H961AD690916B426AB72D506549A917D3"><enum>(A)</enum><text display-inline="yes-display-inline">changes in regional needs;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7E69F2BFFC254877A99DEED359B3F3AD"><enum>(B)</enum><text display-inline="yes-display-inline">mutual interest between the Administrator
			 and relevant stakeholders within a region or regions;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC9FE43429D4C404199442536E360DB1B"><enum>(C)</enum><text display-inline="yes-display-inline">changes in resources available to the
			 Administrator to implement the B-WET Program; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF710189A3ABA456CBE6CF8B76469905D"><enum>(D)</enum><text display-inline="yes-display-inline">other circumstances as determined necessary
			 by the Administrator.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB4790662110040D1AEE64F39E73F2EBC"><enum>(2)</enum><header display-inline="yes-display-inline">Consultation and public
			 comment</header><text display-inline="yes-display-inline">The Administrator
			 shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HBACEF038D399494C814B869FEA2BAED1"><enum>(A)</enum><text display-inline="yes-display-inline">consult with the persons conducting a
			 regional program and provide opportunity for public comment prior to making a
			 final decision to modify or realign such regional program; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7D6F053C7768474EBA693C1DD7D1AA82"><enum>(B)</enum><text display-inline="yes-display-inline">publish public notice of such a decision no
			 less than 30-days before the effective date of such a modification or
			 realignment.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA2349F812A0947D3B1B9E3848CF31DB8"><enum>(d)</enum><header display-inline="yes-display-inline">Regional program managers</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H11E0B40C918545F080D3CBD6D3BF7708"><enum>(1)</enum><header display-inline="yes-display-inline">Appointment of regional program
			 manager</header><text display-inline="yes-display-inline">The Administrator
			 shall be responsible for the selection, appointment, and when necessary
			 replacement of a regional program manager for each regional program under the
			 B-WET Program.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1DF1F32686E74514842193C35EEA8A3A"><enum>(2)</enum><header display-inline="yes-display-inline">Qualifications</header><text display-inline="yes-display-inline">To qualify for appointment as a regional
			 program manager, an individual must—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H6342B385B7BA462EA3606B15795C2606"><enum>(A)</enum><text display-inline="yes-display-inline">reside in the region for which appointed;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H94D4C1F943DC411C9433AAD2FA7E6BB7"><enum>(B)</enum><text display-inline="yes-display-inline">demonstrate competence and expertise in
			 bay-watershed education and training.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA5FBF7A304BA482782FE861C8EC06D43"><enum>(3)</enum><header display-inline="yes-display-inline">Functions</header><text display-inline="yes-display-inline">Each regional program manager shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H7C3786E324E240F99DAF962180BEA963"><enum>(A)</enum><text display-inline="yes-display-inline">be responsible for managing and
			 administering the B-WET Program in the region for which appointed, in
			 accordance with this Act;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8A1A778AB2894CE093130398833C9C81"><enum>(B)</enum><text display-inline="yes-display-inline">determine the most appropriate communities
			 within the region to be served by the B-WET Program;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H689D8DA1107B4AD3A829B7D24405127C"><enum>(C)</enum><text display-inline="yes-display-inline">encourage water-dependent,
			 wildlife-dependent, and other outdoor recreation, experiential learning
			 experiences for students, and hands-on involvement with coastal and watershed
			 resources as a method of promoting stewardship and sustainable economic
			 development of those resources and complementing core classroom
			 curriculum;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA91D48326E604EA983B216A80BE75097"><enum>(D)</enum><text display-inline="yes-display-inline">support communication and collaboration
			 among educators, natural resource planners and managers, and governmental and
			 nongovernmental stakeholders;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H04F114A43E8C41979056FB9796DB970D"><enum>(E)</enum><text display-inline="yes-display-inline">share and distribute information regarding
			 educational plans, strategies, learning activities, and curricula to all
			 stakeholders within its region;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4D259D9757514CC79B0F619188CE551C"><enum>(F)</enum><text display-inline="yes-display-inline">provide financial and technical assistance
			 pursuant to the guidelines developed by the Administrator under this section;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H939940B142564702B6BE9B8F034EA3DD"><enum>(G)</enum><text display-inline="yes-display-inline">perform any additional duties as necessary
			 to carry out the functions of the program.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H903B9179572F498590F7A8B316CD3B40"><enum>(e)</enum><header display-inline="yes-display-inline">Program guidelines</header><text display-inline="yes-display-inline">No later than 180 days after the date of
			 enactment of this Act and after consultation with appropriate stakeholders, the
			 Administrator shall publish in the Federal Register guidelines regarding the
			 implementation of the B-WET Program, as follows:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H374E2A59B3A84A7880D27B476B4386DC"><enum>(1)</enum><header display-inline="yes-display-inline">Contracts</header><text display-inline="yes-display-inline">The Administrator shall create guidelines
			 through which each regional program manager may enter into contracts (subject
			 to the availability of appropriations) to support projects to design,
			 demonstrate, evaluate, or disseminate practices, methods, or techniques related
			 to Bay-watershed education and training.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H509443B340AC49A1B2F9168861E249F8"><enum>(2)</enum><header display-inline="yes-display-inline">Grant making and cooperative
			 agreements</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="H5967B3CCCEA44B27B793ACCD07C1DC61"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall create guidelines
			 through which each regional program manager may provide financial assistance in
			 the form of a grant (subject to the availability of appropriations) or
			 cooperative agreement to support projects that advance the purpose of this Act.
			 The guidelines shall include criteria for eligible entities, identification of
			 national priorities, establishment of performance measures to evaluate program
			 effectiveness, and reporting requirements for grant award recipients.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBA1216DF25964A898CA668C64D1BCA9E"><enum>(B)</enum><header display-inline="yes-display-inline">Priority</header><text display-inline="yes-display-inline">In making grants under this paragraph, each
			 regional program manager shall give priority to those projects that
			 will—</text>
						<clause commented="no" display-inline="no-display-inline" id="H1E4B08066A884CE3B7ECCD34CE41DB5B"><enum>(i)</enum><text display-inline="yes-display-inline">promote bay-watershed education throughout
			 the region concerned;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H327F0FE9725E473A9DC14F25B4CA2121"><enum>(ii)</enum><text display-inline="yes-display-inline">advance strategic initiatives to
			 incorporate bay-watershed education into formal and informal education
			 systems;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H6B45497F7E154EA5B58CBDF300F04AC3"><enum>(iii)</enum><text display-inline="yes-display-inline">build capacity within bay-watershed
			 education communities and stakeholder groups for expanding and strengthening
			 their work;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H8A00D15A83E844E1916F62A1F36C744F"><enum>(iv)</enum><text display-inline="yes-display-inline">build bay-watershed education into
			 professional development or training activities for educators; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H715AADC446FA4D25815CDE367A55B81E"><enum>(v)</enum><text display-inline="yes-display-inline">broadly replicate existing, proven
			 bay-watershed education programs.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H71DBE0ED1BC8461C9D30026483895A85"><enum>(f)</enum><header display-inline="yes-display-inline">Non-Federal share</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H28142FB984E3472799B49245C68D2EF0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In awarding grants under this section, the
			 regional program managers shall give priority consideration to a project for
			 which the Federal share does not exceed 75 percent of the aggregate cost of
			 such project.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H19875BB1BAEA49A89FD555B7ABAD4D73"><enum>(2)</enum><header display-inline="yes-display-inline">In-kind contribution</header><text display-inline="yes-display-inline">The non-Federal share of the costs of any
			 project supported by an award of grant funding under this section may be cash
			 or the fair market value of services, equipment, donations, or any other form
			 of in-kind contribution.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8A7EA5BBA7164938A99096D6FF72A004"><enum>(3)</enum><header display-inline="yes-display-inline">Other
			 priority</header><text display-inline="yes-display-inline">The regional program
			 managers shall give priority consideration to a project that will be conducted
			 by or benefit any under-served community, any community that has an inability
			 to draw on other sources of funding because of the small population or low
			 income of the community, or any other person for any other reason the
			 Administrator considers appropriate and consistent with the purpose of this
			 Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H10DF5AAAFCC145F7BAA993DEE957FA3D"><enum>(g)</enum><header display-inline="yes-display-inline">Regional program coordination</header><text display-inline="yes-display-inline">Within the National Oceanic and Atmospheric
			 Administration, the Office of Education shall work with regional program
			 managers on the following regional B-WET Program functions:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H046AFDBA5E244E998F2A8016936E3826"><enum>(1)</enum><text display-inline="yes-display-inline">Strategic planning efforts.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7F8CF996E2A34A61B480626E35E1C0A9"><enum>(2)</enum><text display-inline="yes-display-inline">Integration and coordination of
			 programs.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5B6742E3414F456080D168F162CD48F1"><enum>(3)</enum><text display-inline="yes-display-inline">Coordination of national evaluation
			 efforts.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H61834B1732A543AFB248EE76ABC3ABB1"><enum>(4)</enum><text display-inline="yes-display-inline">Promotion of network wide
			 communications.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAB3E1A8DEB4843C6BA37B7B46C5B01EC"><enum>(5)</enum><text display-inline="yes-display-inline">Selection of new Regional Program
			 Managers.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H393E9EE72487408586C858AC1C45E8C3"><enum>(6)</enum><text display-inline="yes-display-inline">Management, tracking, and oversight of the
			 B-WET Program.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HBD6C7F0ACB884C518F1BA6C86E7B57D6"><enum>(h)</enum><header display-inline="yes-display-inline">Limitation on use of funds by
			 administrator</header><text display-inline="yes-display-inline">Of the amounts
			 made available to implement this section—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H8DE7404951324F0781D33A2E8AB71A28"><enum>(1)</enum><text display-inline="yes-display-inline">no less than 80 percent shall be used for
			 implementation of regional program activities, including the award of grants;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8BFA5B5DDDBB42C99E3D6F9C80FF7D5F"><enum>(2)</enum><text display-inline="yes-display-inline">no more than 20 percent may be used by the
			 Administrator to implement the regional programs and regional program
			 coordination.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H7FC28E84FEFA4B4499BAEF105ABECE10" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Biennial report</header><text display-inline="no-display-inline">Not later than December 31, 2011, and
			 biennially thereafter, the Administrator shall submit to Congress a report on
			 the grant programs authorized under this Act. Each such report shall include a
			 description of the eligible activities carried out with grants awarded under
			 the Act during the previous two fiscal years, an assessment of the success and
			 impact of such activities, and a description of the type of programs carried
			 out with such grant, disaggregated by State.</text>
		</section><section commented="no" display-inline="no-display-inline" id="HA577AB78C3AA4A9898E7A5B32F5191A6" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header>
			<subsection commented="no" display-inline="no-display-inline" id="H9BC7A09EC9734AA8BC85CC975561FDAD"><enum>(a)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to the Administrator—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H54A2C6E3AE364599AD3A6D2634AF2379"><enum>(1)</enum><text display-inline="yes-display-inline">to carry out the Environmental Literacy
			 Grant Program authorized by section 4 (including administrative expenses for
			 preparing the report under section 6)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HC320002B9E2149179DD283A6DBD3172A"><enum>(A)</enum><text display-inline="yes-display-inline">for fiscal year 2011, $13,200,000;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDD9CFFCF636942C6BE90BC7D5DDBB731"><enum>(B)</enum><text display-inline="yes-display-inline">for fiscal year 2012, $14,500,000;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA6655C919E8640F4BDAB372DF45A3661"><enum>(C)</enum><text display-inline="yes-display-inline">for fiscal year 2013, $16,000,000;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6F9E027522164090A3BEBEB0BAE0E189"><enum>(D)</enum><text display-inline="yes-display-inline">for fiscal year 2014, $17,600,000;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD33770C756F040548109CFD932F1DB19"><enum>(E)</enum><text display-inline="yes-display-inline">for fiscal year 2015, $19,300,000;
			 and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDA9A66C99A6247EC83FDB4AA031ABFC8"><enum>(2)</enum><text display-inline="yes-display-inline">to carry out the B-WET Program authorized
			 by section 5 (including administrative expenses for preparing the report under
			 section 6)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HD09CD8B1D099419DA11340A534415179"><enum>(A)</enum><text display-inline="yes-display-inline">for fiscal year 2011, $10,700,000;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF21496E2DCBF44F7971E01F7EFE50E11"><enum>(B)</enum><text display-inline="yes-display-inline">for fiscal year 2012, $11,700,000;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC6F8AD129D8D4E3C877CEE294DD963B0"><enum>(C)</enum><text display-inline="yes-display-inline">for fiscal year 2013, $12,900,000;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H993460C2EB1D4F8CA16EB8CFDB10B8B3"><enum>(E)</enum><text display-inline="yes-display-inline">for fiscal year 2015, $15,600,000.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HEEE6A6C3292D4156816DA362BE1C985D"><enum>(b)</enum><header display-inline="yes-display-inline">Prohibition on earmarks</header><text display-inline="yes-display-inline">None of the funds appropriated pursuant to
			 subsection (a) may be used for<linebreak></linebreak><pagebreak></pagebreak> a congressional earmark
			 as defined in clause 9(e) of rule XXI of the Rules of the House of
			 Representatives.</text>
