		<official-title>To amend the Internal Revenue Code of 1986 to extend and
		  expand the first-time homebuyers credit and to provide a loss deduction on the
		  sale of a principal residence.</official-title>

		<section id="HECE492067851414FAAB85016E4FE6F8B" section-type="section-one"><enum>1.</enum><header>Homebuyer credit allowed for
			 any purchase of principal residence</header>
			<subsection id="HDB4AA42A971749CC9B6397C58C4C6548"><enum>(a)</enum><header>In
			 general</header><text>Subsection (a) of section 36 of the Internal Revenue Code
			 of 1986 is amended by striking <quote>who is a first-time homebuyer of a
			 principal residence</quote> and inserting <quote>who purchases a principal
			 residence</quote>.</text>
			</subsection><subsection id="HE9E3522714F942E888D7D5FFF1679E46"><enum>(b)</enum><header>Application to
			 only 1 sale</header><text display-inline="yes-display-inline">Subsection (b) of
			 section 36 of such Code is amended by adding at the end the following new
			 paragraph:</text>

					<paragraph id="H7E998C722A534CFB875330E12D2BF3AA"><enum>(3)</enum><header>Application to
				only 1 sale</header>
						<subparagraph id="H28E8535F32644213ACF0E3F92B8F5246"><enum>(A)</enum><header>In
				general</header><text>Subsection (a) shall not apply to more than 1 sale or
				exchange of a principal residence by the individual.</text>
						</subparagraph><subparagraph commented="no" id="H353003D88A00404285D3574285F71D8C"><enum>(B)</enum><header>Special rule for
				joint returns</header><text display-inline="yes-display-inline">In the case of
				a joint return with respect to the sale or exchange of a principal residence,
				if a credit was allowable under subsection (a) to a spouse for a prior sale or
				exchange of a principal residence, paragraph (1) shall be applied by reducing
				the $8,000 in subparagraph (A) thereof and the $4,000 in subparagraph (B)
				thereof by the credit so allowable (one-half of such credit in the case of a
				joint
				return).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H0035185A6B904DE3B5B961063281F21D"><enum>(c)</enum><header>Conforming
			 amendments</header>
				<paragraph id="H98D372B459624D709A1EFD400418ACF3"><enum>(1)</enum><text>Subsection (c) of
			 section 36 of such Code is amended by striking paragraph (1) (defining
			 first-time homebuyer) and by redesignating paragraphs (2), (3), (4), and (5) as
			 paragraphs (1), (2), (3), and (4), respectively.</text>
				</paragraph><paragraph id="H46020A8DC6F84575A595E7FC4BCBC0E5"><enum>(2)</enum><text>The heading for
			 section 36 of such Code is amended by striking <quote>First-time</quote>.</text>
				</paragraph><paragraph id="HA4F8753AABF84C50994986DA8D6669DC"><enum>(3)</enum><text display-inline="yes-display-inline">The item in the table of sections for
			 subpart C of part IV of subchapter A of chapter 1 of such Code relating to
			 section 36 is amended to read as follows:</text>

			 date</header><text>The amendments made by this section shall apply to
			 residences purchased after the date of the enactment of this Act.</text>
			</subsection></section><section id="H1827FC6CEFD94E6490516C9E4571943C"><enum>2.</enum><header>1-Year extension
			 of homebuyer credit</header>
			<subsection id="H0C1ABA4FD3124FEC809751057496DB27"><enum>(a)</enum><header>In
			 general</header><text>Subsection (h) of section 36 of the Internal Revenue Code
			 is amended by striking <quote>December 1, 2009</quote> and inserting
			 <quote>December 1, 2010</quote>.</text>
			</subsection><subsection id="HFAEFEDC06FBC43C6989F44D530F58EAC"><enum>(b)</enum><header>Extension of
			 waiver of recapture</header><text>Subparagraph (D) of section 36(f)(4) of such
			 Code is amended—</text>
				<paragraph id="H7EC811E9357F4EDEAB11858A67262B26"><enum>(1)</enum><text>by striking
			 <quote>December 1, 2009</quote> and inserting <quote>December 1, 2010</quote>,
			 and</text>
				</paragraph><paragraph id="HFE5F6CCA483E4948BCB464302B97DCA5"><enum>(2)</enum><text>in the heading by
			 striking <quote><header-in-text level="subparagraph" style="OLC">for purchases
			 in 2009</header-in-text></quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">certain purchases</header-in-text></quote>
			 .</text>
				</paragraph></subsection><subsection id="HADA2A46401894070995DDEA40DFB77B3"><enum>(c)</enum><header>Election To
			 treat purchase in prior year</header><text>Subsection (g) of such Code is
			 amended to read as follows:</text>

					<subsection id="H487CED3E524146BD870501A5920B6681"><enum>(g)</enum><header>Election To
				treat purchase in prior year</header><text>For purposes of this section (other
				than subsections (c) and (f)(4)(D)), a taxpayer may elect to treat a purchase
				of a principal residence—</text>
						<paragraph id="H81A34CBF838143549D282C605710E734"><enum>(1)</enum><text>after December 31,
				2008, and before January 1, 2010, as made on December 31, 2008, and</text>
						</paragraph><paragraph id="HDFD2891E13564B0F96E9611D2BE4B248"><enum>(2)</enum><text>after December 31,
				2009, and before December 1, 2010, as made on December 31,
				2009.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H6562023F67FB49CB80B98CDB74B9DF92"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on the
			 date of the enactment of this Act.</text>
			</subsection></section><section display-inline="no-display-inline" id="HE375BF87EA344FBE95AAB7697AFEACB9" section-type="subsequent-section"><enum>3.</enum><header>Deduction for loss
			 from sale of principal residence</header>
			<subsection display-inline="no-display-inline" id="H74EFA0C0422C4CFB86B0655D9F957F10"><enum>(a)</enum><header>In
			 general</header><text>Part VII of subchapter B of chapter I of the Internal
			 Revenue Code of 1986 (relating to additional itemized deductions for
			 individuals) is amended by redesignating section 224 as section 225 and by
			 inserting after section 223 the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H5F207169BE9E4E86A3F785D5759009DB" style="OLC">
					<section id="H49E73E92ECBA46BE9F099F9685D56FD3"><enum>224.</enum><header>Loss from sale
				of principal residence</header>
						<subsection id="H27DA0905505045309B50D1438807FFA4"><enum>(a)</enum><header>Allowance of
				Deduction</header><text>In the case of an individual, there shall be allowed as
				a deduction for the taxable year any loss recognized on the sale or exchange of
				property during the taxable year if, during the 5-year period ending on the
				date of the sale or exchange, such property has been owned and used by the
				taxpayer as the taxpayer’s principal residence for periods aggregating 2 years
				or more.</text>
						</subsection><subsection id="H375CE3CACC8D4979973BDB5AD57FA903"><enum>(b)</enum><header>Limitations</header>
							<paragraph id="H2AE8497E6E274D029511577DF156BDD6"><enum>(1)</enum><header>Aggregate
				limitation</header><text display-inline="yes-display-inline">The aggregate
				amount allowed as a deduction under subsection (a) for all taxable years shall
				not exceed $6,000 ($12,000 in the case of a joint return).</text>
							</paragraph><paragraph id="H700A99DDC3D645EA9660185B2BCB70FD"><enum>(2)</enum><header>Annual
				limitation</header>
								<subparagraph id="H02A049797C974040B8B46CD6D249097F"><enum>(A)</enum><header>In
				general</header><text>The amount allowed to a taxpayer as a deduction under
				subsection (a) for a taxable year shall not exceed $2,000 ($4,000 in the case
				of a joint return).</text>
								</subparagraph><subparagraph id="HB85B3FF2D0964FE78BE3B799A54EEE34"><enum>(B)</enum><header>Carryforward</header><text display-inline="yes-display-inline">If the deduction allowable under subsection
				(a) for any taxable year exceeds the limitation imposed by subparagraph (A) for
				the taxable year, the excess shall be carried to each of the 2 succeeding
				taxable years and added to the deduction allowable under subsection (a) for
				such succeeding year.</text>
								</subparagraph></paragraph><paragraph id="H7A8D5CF7720E44F1B0CF56F14810DF59"><enum>(3)</enum><header>Exclusion of
				loss allocated to nonqualified use</header>
								<subparagraph id="H167F999A16AA47AA932A82F649AA898F"><enum>(A)</enum><header>In
				general</header><text>Subsection (a) shall not apply to so much of the loss
				from the sale or exchange of property as is allocated to periods of
				nonqualified use.</text>
								</subparagraph><subparagraph id="HAB5958FB5A564D509B8FD91A02C8B3F9"><enum>(B)</enum><header>Allocation</header><text>For
				purposes of subparagraph (A), loss shall be allocated to periods of
				nonqualified use based on the ratio which—</text>
									<clause id="H006D6B4675804D8D808B8A7D360E9C71"><enum>(i)</enum><text display-inline="yes-display-inline">the aggregate periods of nonqualified use
				during the period such property was owned by the taxpayer, bears to</text>
									</clause><clause id="H5EC18212361E4999A2BDF861CDCB9F42"><enum>(ii)</enum><text>the period such
				property was owned by the taxpayer.</text>
									</clause></subparagraph><subparagraph id="HD7B3F4530595496993594471DC62037A"><enum>(C)</enum><header>Period of
				nonqualified use; Coordination with recognition of gain attributable to
				depreciation</header><text>For purposes of this paragraph, rules similar to the
				rules of subparagraphs (C) and (D) of section 121(b)(5) shall apply.</text>
								</subparagraph></paragraph><paragraph id="HCA843F6B4C2A4D208834AB2EAC2506B6"><enum>(4)</enum><header>Application to
				only 1 sale</header>
								<subparagraph id="H5871F9D587E146C7ABD698B689097EDF"><enum>(A)</enum><header>In
				general</header><text>Subsection (a) shall not apply to more than 1 sale or
				exchange of a principal residence by the taxpayer.</text>
								</subparagraph><subparagraph commented="no" id="HEB4361D0E6EA4A74B540804E171154EA"><enum>(B)</enum><header>Special rule for
				joint returns</header><text>In the case of a joint return with respect to the
				sale or exchange of a principal residence, if a deduction was allowable under
				subsection (a) to a spouse for a prior sale or exchange of a principal
				residence, paragraphs (1) and (2)(A) shall be applied by reducing the dollar
				amounts therein by the deduction so allowable (one-half of such deduction in
				the case of a joint return).</text>
								</subparagraph></paragraph></subsection><subsection id="H2258E6EF3EF044C3B9F9CDB1FEBEBD33"><enum>(c)</enum><header>Applicable
				rules</header><text>For purposes of this section, rules similar to the rules of
				subsection (d) of section 121 shall apply, except that paragraph (6) thereof
				shall be applied by substituting <quote>loss</quote> for
				<quote>gain</quote>.</text>
						</subsection><subsection id="H865D126A5BC94D1C815DF4A166A8AAEB"><enum>(d)</enum><header>Election To have
				section not apply</header><text display-inline="yes-display-inline">This
				section shall not apply to any sale or exchange with respect to which the
				taxpayer elects not to have this section apply.</text>
						</subsection><subsection commented="no" id="H306DE6D9B10F4A0E8B659F23D44E658F"><enum>(e)</enum><header>Termination</header><text>The
				section shall not apply to the sale or exchange of a principal residence after
				December 31,
				2010.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection display-inline="no-display-inline" id="H51060CC08C124F8CA6383D2F925CF067"><enum>(b)</enum><header>Deduction
			 allowed in computing adjusted gross income</header><text>Subsection (a) of
			 section 62 of such Code is amended by inserting before the last sentence the
			 following new paragraph:</text>

			</subsection><subsection display-inline="no-display-inline" id="H26B7EF00EA854E179FB3CB90E53E8054"><enum>(c)</enum><header>Clerical
			 amendments</header><text>The table of sections for part VII of subchapter B of
			 chapter 1 of such Code is amended by striking the item relating to section 224
			 and inserting the following:</text>
