<official-title>To provide for the Secretary of Education to study and report on the marketing of foods and beverages in elementary and secondary schools.</official-title>

<section id="H3A5663FB0CBE46BB88AF37B713706FA8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Food Marketing in Schools Assessment Act</short-title></quote>.</text></section> 
<section display-inline="no-display-inline" id="H0608563C84E546E2ADFC163BAFC70074" section-type="subsequent-section"><enum>2.</enum><header>Study and report on food marketing</header> 
<subsection id="HC861A4D90ADF4164B967939E65FA5CA5"><enum>(a)</enum><header>Study required</header><text display-inline="yes-display-inline">The Secretary of Education shall conduct a study on the extent and types of marketing of foods and beverages in elementary and secondary schools. In carrying out the study, the Secretary shall collaborate with, and include information from, the Division of Adolescent and School Health of the Centers for Disease Control and Prevention.</text></subsection> 
<subsection id="H04FD6B14689848B68130E2BDBF8080DB"><enum>(b)</enum><header>Assessment of nutrition</header><text>The study required by subsection (a) shall assess the nutritional quality of the types of foods and beverages marketed in schools.</text></subsection> 
<subsection id="H685E4A63A7154311A0D8D7036E115024"><enum>(c)</enum><header>Assessment of media</header><text display-inline="yes-display-inline">The study required by subsection (a) shall assess all media through which foods and beverages are marketed to children in elementary and secondary schools, including—</text> 
<paragraph id="HAF4BC2773E484AF2A5FD8BEE5C3E22D5"><enum>(1)</enum><text>brand and product logos, names, or information on educational materials, book covers, school supplies, posters, vending machine exteriors, scoreboards, displays, signs, equipment, buses, buildings, and other school property;</text></paragraph> 
<paragraph id="HD383E6B202F94F8CB709ED3885998092"><enum>(2)</enum><text>educational and other incentive programs;</text></paragraph> 
<paragraph id="HF8016E192518464ABCA412DBEC9F65A7"><enum>(3)</enum><text>label redemption programs;</text></paragraph> 
<paragraph id="H4D63711E6B144B33B7398972F2FBFF54"><enum>(4)</enum><text>in-school television, radio, and print publications;</text></paragraph> 
<paragraph id="HFF0FB26F4F4D454C9B4E7178EE50E300"><enum>(5)</enum><text>free samples and coupons;</text></paragraph> 
<paragraph id="HF2B89D2C960D4324AB0197E68F8B34B1"><enum>(6)</enum><text>branded fundraising activities;</text></paragraph> 
<paragraph id="H8EECDFFED15B4F47BE514300F6FB6725"><enum>(7)</enum><text>taste-testing and other market research activities; and</text></paragraph> 
<paragraph id="H95801A69F2D84E6DB36966E87B97B584"><enum>(8)</enum><text>incidental exposure to food and beverage marketing through computer use, including computer banner and wallpaper ads, or podcasts in schools.</text></paragraph></subsection> 
<subsection id="HEE7BE4805DD34CA3B3EA6C95CA1DE8F1"><enum>(d)</enum><header>Examination of regulatory mechanisms</header><text>The study required by subsection (a) shall also examine mechanisms regulating marketing in elementary and secondary schools, including—</text> 
<paragraph id="HB2F79AD6A16543848DE6F849AFE81D02"><enum>(1)</enum><text>Federal, State, and local policies;</text></paragraph> 
<paragraph id="HCDE17D2671C0452496C18918E4A4E5C"><enum>(2)</enum><text>contracts; and</text></paragraph> 
<paragraph id="HD289D26716874B9697F9A4A567883A"><enum>(3)</enum><text>sales incentives.</text></paragraph></subsection> 
<subsection id="HEC2E9A3497BC4A02A4B66ECA6B8DF619"><enum>(e)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than July 1, 2011, the Secretary shall submit to Congress a report on the results of the study required by subsection (a).</text></subsection></section>
