		<legis-type>A BILL</legis-type>
		<official-title>To require the Secretary of the Treasury to mint coins in
		  commemoration of the 10th anniversary of the September 11, 2001, terrorist
		  attacks on the United States and the establishment of the National September 11
		  Memorial &amp; Museum at the World Trade Center.</official-title>
	</form>

		<section id="HF819D1CBEDDC427C9368B80064DEC3BE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National September 11 Memorial &amp; Museum Commemorative
			 Coin Act of 2009</short-title></quote>.</text>
		</section><section id="HF45B9B8261CE4436B898988D65091790"><enum>2.</enum><header>Coin
			 specifications</header>
			<subsection id="H172AD99118A64EAD903003303398BF"><enum>(a)</enum><header>$1 silver
			 coins</header><text display-inline="yes-display-inline">The Secretary of the
			 Treasury (hereinafter in this Act referred to as the <quote>Secretary</quote>)
			 shall mint and issue not more than 2,000,000 $1 coins in commemoration of the
			 10th anniversary of the September 11, 2001, terrorist attacks on the United
			 States and the establishment of the National September 11 Memorial &amp; Museum
			 at the World Trade Center, each of which shall—</text>
				<paragraph id="H4ECDF4F73D0345E6B93D79DDBC66CF80"><enum>(1)</enum><text>weigh 26.73
			 grams;</text>
				</paragraph><paragraph id="HA030685A444E46C8AA63C567575DFFAE"><enum>(2)</enum><text>have a diameter of
			 1.500 inches; and</text>
				</paragraph><paragraph id="H47FFBCF2FD054BFBA30085DF62304BF4"><enum>(3)</enum><text>contain 90 percent
			 silver and 10 percent copper.</text>
				</paragraph></subsection><subsection id="HE408AF3E61D64AB89C3321E34687FDCB"><enum>(b)</enum><header>Legal
			 tender</header><text>The coins minted under this Act shall be legal tender, as
			 provided in section 5103 of title 31, United States Code.</text>
			</subsection><subsection id="H7FAE94EE34A14B0AB86B65B3E720B78B"><enum>(c)</enum><header>Numismatic
			 items</header><text>For purposes of sections 5134 and 5136 of title 31, United
			 States Code, all coins minted under this Act shall be considered to be
			 numismatic items.</text>
			</subsection></section><section id="HDE61AACF4EAB42A7A300006E1524E1B1"><enum>3.</enum><header>Design of
			 coins</header>
			<subsection id="H3A906358EB7E41F0A0D6B04200E559CD"><enum>(a)</enum><header>Design
			 requirements</header>
				<paragraph id="HCC06677214684C6BBBE4C0AD1B635D00"><enum>(1)</enum><header>In
			 general</header><text>The design of the coins minted under this Act shall be
			 emblematic of the courage, sacrifice, and strength of those individuals who
			 perished in the terrorist attacks of September 11, 2001, the bravery of those
			 who risked their lives to save others that day, and the endurance, resilience,
			 and hope of those who survived.</text>
				</paragraph><paragraph id="HA2CFAA10473648DC9D8370DE3F875D8C"><enum>(2)</enum><header>Designation and
			 inscriptions</header><text>On each coin minted under this Act, there shall
			 be—</text>
					<subparagraph id="HD0662C82EA2B4C92BC26CF872B8B00"><enum>(A)</enum><text>a designation of the
			 value of the coin;</text>
					</subparagraph><subparagraph id="HEA513BDA22064A60B793B2AAD2D5038"><enum>(B)</enum><text>an inscription of
			 the year <quote>2011</quote>;</text>
					</subparagraph><subparagraph id="HCB123C20507F4BD484E64615E773DF24"><enum>(C)</enum><text display-inline="yes-display-inline">inscriptions of the words
			 <quote>Liberty</quote>, <quote>In God We Trust</quote>, <quote>United States of
			 America</quote>, and <quote>E Pluribus Unum</quote>; and</text>
					</subparagraph><subparagraph id="HFEF4EFA72D51494FB576444C9CE5943D"><enum>(D)</enum><text display-inline="yes-display-inline">an inscription of the words <quote>Always
			 Remember</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H4F4C42AEC8D74033BE389DBCAF34C792"><enum>(b)</enum><header>Selection</header><text>The
			 design for the coins minted under this Act shall be—</text>
				<paragraph id="H6D1D440AF53741CE82C7B7388C918FC5"><enum>(1)</enum><text>selected by the
			 Secretary, after consultation with the National September 11 Memorial &amp;
			 Museum at the World Trade Center and the Commission of Fine Arts; and</text>
				</paragraph><paragraph id="H4BCD1BF6299B4A41B19233E00B5D142"><enum>(2)</enum><text>reviewed by the
			 Citizens Coinage Advisory Committee.</text>
				</paragraph></subsection></section><section id="HBF8D3295F0B74DFE00DC9B9BA80000E8"><enum>4.</enum><header>Issuance of
			 coins</header>
			<subsection id="HC94E410953714F3B98BBCD5C4BEE945B"><enum>(a)</enum><header>Quality of
			 coins</header><text>Coins minted under this Act shall be issued in uncirculated
			 and proof qualities.</text>
			</subsection><subsection id="H844356976BD54ACCA56F8B941112DE49"><enum>(b)</enum><header>Mint
			 facility</header>
				<paragraph id="HD8968487413A475DA689DB8D53C024C0"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Only 2 facilities of
			 the United States Mint may be used to strike coins minted under this
			 Act.</text>
				</paragraph><paragraph id="HDC7A573159654A62B5F45F34CE20E9A3"><enum>(2)</enum><header>Use of the
			 United States Mints at West Point, New York, and Philadelphia,
			 Pennsylvania</header><text display-inline="yes-display-inline">It is the sense
			 of Congress that, to the extent possible, approximately one-half of the coins
			 to be minted under this Act should be struck at the United States Mint at West
			 Point, New York, and approximately one-half struck at the United States Mint at
			 Philadelphia, Pennsylvania.</text>
				</paragraph><paragraph id="H1E501009CCCF4ECFA99465A6039E9816"><enum>(3)</enum><header>Period of
			 issuance</header><text display-inline="yes-display-inline">The Secretary may
			 issue coins under this Act only during the calendar year beginning on January
			 1, 2011.</text>
				</paragraph></subsection></section><section id="HB6A6D974D1C24FAFAF02DF00B47CCABD"><enum>5.</enum><header>Sale of
			 coins</header>
			<subsection id="H2E529E6123CE4ED49820F183A3C7CAE3"><enum>(a)</enum><header>Sale
			 price</header><text display-inline="yes-display-inline">The coins issued under
			 this Act shall be sold by the Secretary at a price equal to the sum of—</text>
				<paragraph id="HF48346266A5C41EA88E216699B0305C1"><enum>(1)</enum><text display-inline="yes-display-inline">the face value of the coins;</text>
				</paragraph><paragraph id="H11B92CAA7F224E9B8BD62F27897AF7F"><enum>(2)</enum><text display-inline="yes-display-inline">the surcharge provided in section 6 with
			 respect to such coins; and</text>
				</paragraph><paragraph id="H8BF4CCAD923D4CBE8F6D651B4220BE03"><enum>(3)</enum><text display-inline="yes-display-inline">the cost of designing and issuing the coins
			 (including labor, materials, dies, use of machinery, overhead expenses,
			 marketing, and shipping).</text>
				</paragraph></subsection><subsection id="H2203C77B48DB4D16B1FC1C4422F43"><enum>(b)</enum><header>Bulk
			 sales</header><text display-inline="yes-display-inline">The Secretary shall
			 make bulk sales of the coins issued under this Act at a reasonable
			 discount.</text>
			</subsection><subsection id="H4499C67996CF45869B8644EF87C115AA"><enum>(c)</enum><header>Prepaid
			 orders</header>
				<paragraph id="H43CF421CF141456EB38D9195E1A13B2E"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 accept prepaid orders for the coins minted under this Act before the issuance
			 of such coins.</text>
				</paragraph><paragraph id="H1022E7919A79417C92A6AEE4964BDCCD"><enum>(2)</enum><header>Discount</header><text display-inline="yes-display-inline">Sale prices with respect to prepaid orders
			 under paragraph (1) shall be at a reasonable discount.</text>
				</paragraph></subsection></section><section id="HCFF983CA939746DAB023C9467F2EFB3C"><enum>6.</enum><header>Surcharges</header>
			<subsection id="HB1DB47C049304543A68830B234965CC0"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">All sales of coins
			 issued under this Act shall include a surcharge of $10 per coin.</text>
			</subsection><subsection id="H40EFA27247C147BE9CF8A4E659C9085"><enum>(b)</enum><header>Distribution</header><text display-inline="yes-display-inline">Subject to section 5134(f) of title 31,
			 United States Code, all surcharges received by the Secretary from the sale of
			 coins issued under this Act shall be paid to the National September 11 Memorial
			 &amp; Museum at the World Trade Center to support the operations and
			 maintenance of the National September 11 Memorial &amp; Museum at the World
			 Trade Center following its completion.</text>
			</subsection><subsection id="H3597A208DBA140FB96D8E3088A0D00"><enum>(c)</enum><header>Audits</header><text display-inline="yes-display-inline">The Comptroller General of the United
			 States shall have the right to examine such books, records, documents, and
			 other data of the National September 11 Memorial &amp; Museum at the World
			 Trade Center as may be related to the expenditures of amounts paid under
			 subsection (b).</text>
