		<official-title>To amend title 38, United States Code, to provide
		  guidelines for the establishment of new national cemeteries by the Secretary of
		  Veterans Affairs, and for other purposes.</official-title>

		<section id="H1FB3F4995F3D4454A978567A05AFBC2B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National Cemeteries Expansion Act of
			 2009</short-title></quote>.</text>
		</section><section id="H4D94ED3794E44E99945CBC32D392A1F2"><enum>2.</enum><header>Establishment of
			 new national cemeteries by the Secretary of Veterans Affairs</header><text display-inline="no-display-inline">Section 2404 of title 38, United States
			 Code, is amended by adding at the end the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="HEA4B5ED4D916482598567AB86633886A" style="USC">
				<subsection id="H8A76D246E2084E489E2000D9E38FC60A"><enum>(h)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H546ECFAC8AA046E5BC087458DF84624C"><enum>(1)</enum><text>In selecting a location
				for the establishment of a new national cemetery under this chapter, the
				Secretary shall give priority to a location where at least 110,000 veterans
				reside within a 75-mile radius of the location.</text>
					</paragraph><paragraph display-inline="no-display-inline" id="H00D1714E914C43B28EDF1739533963F1" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In conducting an annual performance measure
				of the percentage of veterans who are served by any cemetery, the Secretary
				shall—</text>
						<subparagraph id="HEF6308BD11C046808DD3C3D4C6AB713A"><enum>(A)</enum><text>use census tracts, rather than
				counties, as the primary geographic unit to test and identify potential
				locations for new national cemeteries and to determine the percentage of
				veterans served;</text>
						</subparagraph><subparagraph id="H5456DAA3CDD247298B4859553D0D31FB"><enum>(B)</enum><text>use methods to avoid the double
				counting of veterans in overlapping service areas; and</text>
						</subparagraph><subparagraph id="H597A77F1E644470799D8978EE0BB4AD5"><enum>(C)</enum><text>count veterans who reside in counties
				bisected by a service area using a proportional overlay
				method.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
