<section id="HB96886BBA9274C5AA46C85F9F4F922C2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Idaho Wilderness Water Facilities Act</short-title></quote>.</text></section>
<section id="H08A5935D5E4C451AB74CE293DD34EBFB"><enum>2.</enum><header>Treatment of existing water diversions in Frank Church-River of No Return Wilderness and Selway-Bitterroot Wilderness, Idaho</header>
<subsection id="H6057852E3F304E9D933419BA5D2160AF"><enum>(a)</enum><header>Authorization for continued use</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall issue a special use authorization to each of the 20 owners of a water storage, transport, or diversion facility (in this section referred to as a <quote>facility</quote>) located on National Forest System land in the Frank Church-River of No Return Wilderness or the Selway-Bitterroot Wilderness (as identified on the map titled <quote>Unauthorized Private Water Diversions located within the Frank Church River of No Return Wilderness</quote>, dated December 14, 2009, or the map titled <quote>Unauthorized Private Water Diversions located within the Selway-Bitterroot Wilderness</quote>, dated December 11, 2009) for the continued operation, maintenance, and reconstruction of the facility if the Secretary determines that—</text>
<paragraph id="HCEEC14C1C3EC4D368FC884244B37EF2F"><enum>(1)</enum><text>the facility was in existence on the date on which the land upon which the facility is located was designated as part of the National Wilderness Preservation System (in this section referred to as <quote>the date of designation</quote>);</text></paragraph>
<paragraph id="H6955385B2F654C9D9A6271B3AC94AD0B"><enum>(2)</enum><text>the facility has been in substantially continuous use to deliver water for the beneficial use on the owner’s non-Federal land since the date of designation;</text></paragraph>
<paragraph id="HE4D3ECE706034036812F3C78F4E2921C"><enum>(3)</enum><text>the owner of the facility holds a valid water right for use of the water on the owner’s non-Federal land under Idaho State law, with a priority date that predates the date of designation; and</text></paragraph>
<paragraph id="H21ED030644C149AC80D6EC6745CD102A"><enum>(4)</enum><text>it is not practicable or feasible to relocate the facility to land outside of the wilderness and continue the beneficial use of water on the non-Federal land recognized under State law.</text></paragraph></subsection>
<subsection id="HF0F41E13F58E434BB72EDC3A34FC82D8"><enum>(b)</enum><header>Terms and conditions</header>
<paragraph id="H72C44C4E254C465BA941F0ED24561D4F"><enum>(1)</enum><header>Equipment, transport, and use terms and conditions</header><text display-inline="yes-display-inline">In a special use authorization issued under subsection (a), the Secretary shall—</text>
<subparagraph id="HFEFFAAE226DB4C25934D1514ADB830A6"><enum>(A)</enum><text>allow use of motorized equipment and mechanized transport for operation, maintenance, or reconstruction of a facility, if the Secretary determines that—</text>
<clause id="HEBF6B7564C464389AC29F3144CDCFC2C"><enum>(i)</enum><text>the use is necessary to allow the facility to continue delivery of water to the non-Federal land for the beneficial uses recognized by the water right held under Idaho State law; and</text></clause>
<clause id="H6C337F9ADDDC4ABC82E25823A6D499B9"><enum>(ii)</enum><text display-inline="yes-display-inline">after conducting a minimum tool analysis for the facility, the use of nonmotorized equipment and nonmechanized transport is impracticable or infeasible; and</text></clause></subparagraph>
<subparagraph id="HC982276C225740C68CFB8BD2B3C27ABF"><enum>(B)</enum><text>preclude use of the facility for the storage, diversion, or transport of water in excess of the water right recognized by the State of Idaho on the date of designation.</text></subparagraph></paragraph>
<paragraph id="H0C72B8DC6D8143E1B1CA41C7C415F23D"><enum>(2)</enum><header>Additional terms and conditions</header><text>In a special use authorization issued under subsection (a), the Secretary may—</text>
<subparagraph id="HEAD82E78629D4E7598F01AB4DF678E90"><enum>(A)</enum><text>require or allow modification or relocation of the facility in the wilderness, as the Secretary determines necessary, to reduce impacts to wilderness values set forth in section 2 of the Wilderness Act (16 U.S.C. 1131) if the beneficial use of water on the non-Federal land is not diminished; and</text></subparagraph>
<subparagraph id="H422B57D66D1A4ED888A4FECF24FDC68F"><enum>(B)</enum><text>require that the owner provide a reciprocal right of access across the non-Federal property, in which case, the owner shall receive market value for any right-of-way or other interest in real property conveyed to the United States, and market value may be paid by the Secretary, in whole or in part, by the grant of a reciprocal right-of-way, or by reduction of fees or other costs that may accrue to the owner to obtain the authorization for water facilities.</text></subparagraph></paragraph></subsection></section>
