		<official-title>To authorize the Secretary of the Interior to assist in
		  the planning, design, and construction of the Tumalo Irrigation District Water
		  Conservation Project in Deschutes County, Oregon.</official-title>

		<section display-inline="no-display-inline" id="HA5C4387D7D8D45818057D88061CE0352" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Tumalo Water Conservation Project Act
			 of 2009</short-title></quote>.</text>
		</section><section id="H6F2B9AD0AD6A4DCE9B69FE1C1116FB11"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HE12B8009FAB040D8BB56F800A0317B65"><enum>(1)</enum><header>District</header><text>The
			 term <term>District</term> means the Tumalo Irrigation District, Oregon.</text>
			</paragraph><paragraph id="H10676FD5E377448891E9450045A63DF7"><enum>(2)</enum><header>Project</header><text>The
			 term <term>Project</term> means the Tumalo Irrigation District Water
			 Conservation Project authorized under section 3(a).</text>
			</paragraph><paragraph id="HC1BD764EA1A84151A735F3C106EA8F12"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph></section><section id="H2B19946DA5AB485E8C875FE9A21E0051"><enum>3.</enum><header>Authorization to
			 plan, design and construct the Tumalo Water Conservation project</header>
			<subsection id="H05501D3EA3814092BF063C00B838E23E"><enum>(a)</enum><header>Authorization</header><text>The
			 Secretary, in cooperation with the District—</text>
				<paragraph id="HB2FEBF871A404E109039AFBC9B7E48"><enum>(1)</enum><text>may
			 participate in the planning, design, and construction of the Tumalo Irrigation
			 District Water Conservation Project in Deschutes County, Oregon; and</text>
				</paragraph><paragraph id="H954DECD1E13443199DB10000FDFB0084"><enum>(2)</enum><text>for purposes of
			 planning and designing the Project, shall take into account any appropriate
			 studies and reports prepared by the District.</text>
				</paragraph></subsection><subsection id="HC4707763412D4B109B72D852EB258966"><enum>(b)</enum><header>Cost-Sharing
			 Requirement</header>
				<paragraph id="H34F7949F7A684E26003E311024F9FC5B"><enum>(1)</enum><header>Federal
			 share</header><text>The Federal share of the total cost of the Project shall be
			 25 percent, which shall be nonreimbursable to the United States.</text>
				</paragraph><paragraph id="HB3DAAD86C60341C7A111D273CD611734"><enum>(2)</enum><header>Credit toward
			 non-federal share</header><text>The Secretary shall credit toward the
			 non-Federal share of the Project any amounts that the District provides toward
			 the design, planning, and construction before the date of the enactment of this
			 Act.</text>
				</paragraph></subsection><subsection id="HDF98B8BF82B0416A98DFDF777E9874D"><enum>(c)</enum><header>Title</header><text>The
			 District shall hold title to any facilities constructed under this Act.</text>
			</subsection><subsection id="H6195FB2C95044F12AA021FFACF5DF7D"><enum>(d)</enum><header>Operation and
			 Maintenance Costs</header><text>The District shall pay the operation and
			 maintenance costs of the Project.</text>
			</subsection><subsection id="H77BF56CF69C4463D9249D48056CFAD6E"><enum>(e)</enum><header>Effect</header><text>Any
			 assistance provided under this Act shall not be considered to be a supplemental
			 or additional benefit under Federal reclamation law (the Act of June 17, 1902
			 (32 Stat. 388, chapter 1093), and Acts supplemental to and amendatory of that
			 Act (43 U.S.C. 371 et seq.).</text>
			</subsection></section><section id="HF39D13867D39496898ED0E7074FB70"><enum>4.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated to the Secretary for the Federal share of the
			 cost of the Project $4,000,000.</text>
		</section><section id="H22B6E84EF7EA4C0EB3B4A645B58156DD"><enum>5.</enum><header>Sunset</header><text display-inline="no-display-inline">The authority of the Secretary to carry out
			 this Act shall expire on the date that is 10 years after the date of the
			 enactment of this Act.</text>
