		<official-title>To amend the Internal Revenue Code of 1986 to provide for
		  the treatment of bonds issued to finance renewable energy resource facilities,
		  conservation and efficiency facilities, and other specified greenhouse gas
		  emission technologies.</official-title>

		<section id="H48E381E48D6A45558A769A61A362F7EC" section-type="section-one"><enum>1.</enum><header>Treatment of bonds issued to
			 finance renewable energy resource facilities and conservation and efficiency
			 facilities and other specified greenhouse gas emission technologies</header>
			<subsection id="HBAE3AD8FEB914FE6A498A68F59A305DD"><enum>(a)</enum><header>In
			 general</header><text>Section 142(a) of the Internal Revenue Code of 1986 is
			 amended by striking <quote>or</quote> at the end of paragraph (14), by striking
			 the period at the end of paragraph (15) and inserting a comma, and by inserting
			 after paragraph (15) the following new paragraphs:</text>

					<paragraph id="H4B42C7A67C1944A3A754798BDDB555E6"><enum>(16)</enum><text>renewable energy
				resource facilities,</text>
					</paragraph><paragraph id="H61C6E4A9BF58497999833F25576230B7"><enum>(17)</enum><text>conservation and
				efficiency facilities and projects, or</text>
					</paragraph><paragraph id="HB3B7B1A19D1A4DC48B1D47FF93D75913"><enum>(18)</enum><text>zero emission
				vehicles and related facilities or
				projects.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H17AEA7298FBD49799337E38C203DE13D"><enum>(b)</enum><header>Renewable energy
			 resource facility</header><text>Section 142 of such Code is further amended by
			 adding at the end the following new subsection:</text>
				<quoted-block id="HED612F6E0ECF49709DB9C7309592F22C" style="OLC">
					<subsection id="HEA38FF3E8FA344B2AB195E2CE117A2DA"><enum>(n)</enum><header>Renewable energy
				resource facilities</header><text display-inline="yes-display-inline">For
				purposes of subsection (a)(16)—</text>
						<paragraph id="H5B9A0A6E77874B29BDB456C0DE9F3451"><enum>(1)</enum><header>In
				general</header><text>The term <term>renewable energy resource facility</term>
				means—</text>
							<subparagraph id="H7F0850F9B95D497A87E310505B15316B"><enum>(A)</enum><text>any facility used
				to produce electric or thermal energy (including a distributed generation
				facility) from—</text>
								<clause id="H28E0514F2575482E8F408FD9084EBF04"><enum>(i)</enum><text>solar, wind, or
				geothermal energy,</text>
								</clause><clause id="H39304EB41B0641C9858D05509A23142B"><enum>(ii)</enum><text>marine and
				hydrokinetic renewable energy,</text>
								</clause><clause id="HB457397D0E83438C900FEA03EA87E574"><enum>(iii)</enum><text>incremental
				hydropower,</text>
								</clause><clause id="HF0468C334AEB417C9C00B4C2A97237D3"><enum>(iv)</enum><text>biomass (as
				defined in section 203(b) of the Energy Policy Act of 2005 (42 U.S.C.
				15852(b))), or</text>
								</clause><clause id="H02271BCCC3754ACAA41C214D052A06D6"><enum>(v)</enum><text>landfill gas,
				or</text>
								</clause></subparagraph><subparagraph id="H88AD212BB6E842D3B3CD94B1C4950E13"><enum>(B)</enum><text>any facility or
				project used for the manufacture of facilities referred to in subparagraph
				(A).</text>
							</subparagraph></paragraph><paragraph id="H70C7C7BB1DBE4053A9E516D83ABEE5FF"><enum>(2)</enum><header>Definitions</header><text>For
				purposes of paragraph (1)—</text>
							<subparagraph commented="no" id="H8053008A337F457EB38CA5285D25877F"><enum>(A)</enum><header>Geothermal
				energy</header><text>The term <term>geothermal energy</term> means energy
				derived from a geothermal deposit (within the meaning of section 613(e)(2)) or
				from geothermal heat pumps.</text>
							</subparagraph><subparagraph commented="no" id="HC5997732CFE941BABD641411A8549024"><enum>(B)</enum><header>Marine and
				hydrokinetic renewable energy</header><text>The term <term>marine and
				hydrokinetic renewable energy</term> has the meaning given such term in section
				45(c)(10).</text>
							</subparagraph><subparagraph commented="no" id="HFB4C170060A048969C69C1BD78F1BD7D"><enum>(C)</enum><header>Incremental
				hydropower</header><text>The term <term>incremental hydropower</term> means
				additional energy generated as a result of efficiency improvements or capacity
				additions to existing hydropower facilities made on or after the date of
				enactment of this subsection. The term <term>incremental hydropower</term> does
				not include additional energy generated as a result of operational changes not
				directly associated with efficiency improvements or capacity
				additions.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H72AF9C6568A8475793121552ABDC06BB"><enum>(c)</enum><header>Conservation and
			 efficiency</header><text>Section 142 of such Code is amended by adding at the
			 end the following new subsection:</text>
				<quoted-block id="HA9F2019708C24620A742A477250AF7F3" style="OLC">
					<subsection id="H1516631F568D41D8B85B44F742763632"><enum>(o)</enum><header>Conservation and
				efficiency facilities and projects</header><text display-inline="yes-display-inline">For purposes of subsection (a)(17), the
				term <term>conservation and efficiency facility and project</term>
				means—</text>
						<paragraph id="HAFB59535A5C64A1DBABBA13C4FE4CEDA"><enum>(1)</enum><text>any facility used
				for the conservation or the efficient use of energy, including energy efficient
				retrofitting of existing buildings, or for the efficient storage, transmission,
				or distribution of energy, including any facility or project designed to
				implement smart grid technologies (as described in title XIII of the Energy
				Independence and Security Act of 2007, or individual components of such
				technologies as listed in section 1301 of such Act),</text>
						</paragraph><paragraph commented="no" id="HB9FD3C98362B4750BA3094FBA52A6F67"><enum>(2)</enum><text>any facility used
				for the conservation of or the efficient use of water, including—</text>
							<subparagraph commented="no" id="H00D0F47CE2BE479991D8E1004DF5599F"><enum>(A)</enum><text>any facility or
				project designed to—</text>
								<clause id="HF56C8737AE6B46EDB3D435F3DB609F83"><enum>(i)</enum><text>reduce the demand
				for water,</text>
								</clause><clause id="HD45FBF35D47C4D1CABBF7149E760E546"><enum>(ii)</enum><text>improve
				efficiency in use and reduce losses and waste of water, and</text>
								</clause><clause id="HA1B1654791F24A3397EFCE25A0BBFA3D"><enum>(iii)</enum><text>improve land
				management practices to conserve water, or</text>
								</clause></subparagraph><subparagraph commented="no" id="H95F72B09BF144D21B951CC61B367266D"><enum>(B)</enum><text>any individual
				component of a facility or project referred to in subparagraph (A), or</text>
							</subparagraph></paragraph><paragraph id="H64E420083C444B62B3721225505F496B"><enum>(3)</enum><text>any facility or
				project used for the manufacture of facilities referred to in paragraphs (1)
				and (2).</text>
						</paragraph><continuation-text continuation-text-level="subsection">For
				purposes of paragraph (2)(A), facilities and projects does not include
				facilities or projects that store
				water.</continuation-text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HDF9D01A370D04322AACA2EE64E23585B"><enum>(d)</enum><header>Zero emission
			 vehicles and related facilities or projects</header><text>Section 142 of such
			 Code is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H50480B26EC72486E84E4A6A38F13118A" style="OLC">
					<subsection commented="no" id="HFDC468B314FC487AB9A23AAE942006AC"><enum>(p)</enum><header>Zero emission
				vehicles and related facilities or projects</header>
						<paragraph commented="no" id="H42349934C9EC4765B3E1AD2C8BFF69A8"><enum>(1)</enum><header>Zero emission
				vehicles</header><text>The term <term>zero emission vehicles</term> means
				vehicles that have no tailpipe emissions, evaporative emissions, or onboard
				emission-control systems that can deteriorate over time.</text>
						</paragraph><paragraph commented="no" id="H0CB6989F87434ABAABEE286B67E20ABF"><enum>(2)</enum><header>Facilities
				related to zero emission vehicles</header><text display-inline="yes-display-inline">A facility or project is related to a zero
				emission vehicle if the facility is any real or personal property to be used in
				the design, technology transfer, manufacture, production, assembly,
				distribution, or service of zero emission
				vehicles.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="HA964E9CC9FA846A5ACDC7F6440B110F0"><enum>(e)</enum><header>Coordination
			 with section 45</header><text>Paragraph (3) of section 45(b) of such Code is
			 amended by adding at the end the following new sentence: <quote>Clause (ii) of
			 subparagraph (A) shall not apply with respect to (I) any qualified facility
			 that is a renewable energy resource facility described in section 142(a)(16),
			 (II) any qualified facility that is a conservation and efficiency facility
			 described in section 142(a)(17), or (III) any qualified facility that is a zero
			 emission vehicle and related facility or project described in section
			 142(a)(18).</quote>.</text>
			</subsection><subsection commented="no" id="HE7027BA1D84A4BC19AA6766D344A3BB9"><enum>(f)</enum><header>Coordination
			 with section 45<enum-in-header>K</enum-in-header></header><text display-inline="yes-display-inline">Subparagraph (A) of section 45K(b)(3) of
			 such Code is amended by adding at the end the following flush sentence:
			 <quote>Clause (i)(II) shall not apply with respect to (aa) any qualified
			 facility that is a renewable energy resource facility described in section
			 142(a)(16), (bb) any qualified facility that is a conservation and efficiency
			 facility described section 142(a)(17), or (cc) any qualified facility that is a
			 zero emission vehicle and related facility or project described in section
			 142(a)(18).</quote>.</text>
			</subsection><subsection id="H85C0D02A87214EA3AC9AC7D5BD21FD98"><enum>(g)</enum><header>Coordination
			 with section 146<enum-in-header>(g)(3)</enum-in-header></header><text display-inline="yes-display-inline">Section 146(g)(3) is amended by striking
			 <quote>or (15)</quote> and all that follows through the end of the paragraph
			 and inserting <quote>(15), (16), (17), or (18)</quote>.</text>
			</subsection><subsection id="HBA1C471244084135913DE815422110DC"><enum>(h)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to obligations issued after the date of the enactment
			 of this Act.</text>
