		<official-title>To amend the Internal Revenue Code of 1986 to exclude
		  capital gains on sales and exchanges of residences purchased in a foreclosure
		  sale.</official-title>

		<section id="H9C4C2A6B98F24689BDA9A663568300E8" section-type="section-one"><enum>1.</enum><header>Exclusion of capital gain on
			 sales and exchanges of homes purchased in a foreclosure sale</header>
			<subsection id="H2054D8DE7D184DF0A08AD0EA4A36FE86"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Part I of subchapter
			 P of chapter 1 of the Internal Revenue Code of 1986 (relating to treatment of
			 capital gains) is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="H0B27C623414045F487112E81E528E5E3" style="OLC">
					<section id="HC134AB0E88AB47749B753CB793B53F33"><enum>1203.</enum><header>Gain on sales
				and exchanges of homes purchased in a foreclosure sale</header>
						<subsection id="H7FCE1CCE06094C3DB808A63E18AD6649"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Gross income shall
				not include qualified gain.</text>
						</subsection><subsection id="H047AB337079744419F5B38097C99569C"><enum>(b)</enum><header>Qualified
				gain</header><text display-inline="yes-display-inline">For purposes of
				subsection (a), the term <term>qualified gain</term> means any gain from the
				sale or exchange of any qualified residential property which is acquired after
				the date of the enactment of this section, as the result of having bid on such
				property at foreclosure, or by operation of an agreement or process of law,
				after there was a default (or a default was imminent) on indebtedness which
				such property secured.</text>
						</subsection><subsection id="H2159DA08104E4438AC7663F741FDDCD1"><enum>(c)</enum><header>Qualified
				residential property</header><text>For purposes of this section, the term
				<term>qualified residential property</term> means a residential property
				which—</text>
							<paragraph id="H258B1198A6BE4D2AACFE988F6A7F0B2F"><enum>(1)</enum><text>is a capital
				asset,</text>
							</paragraph><paragraph id="H0E6A554D51844D9FAADFADCA6920A1B5"><enum>(2)</enum><text>is located in the
				United States, and</text>
							</paragraph><paragraph id="H4E8FF04B07084657BA2661066756C947"><enum>(3)</enum><text>consists of from 1
				to 4 dwelling units.</text>
							</paragraph></subsection><subsection id="H04100E665C8441EE9C33A4967912AB49"><enum>(d)</enum><header>Basis
				reduction</header><text display-inline="yes-display-inline">The basis of any
				qualified residential property shall be reduced by the amount of any exclusion
				determined under this section with respect to such property.</text>
						</subsection><subsection id="HDEC3BF4A62674A9F921173FC156BB068"><enum>(e)</enum><header>Termination</header><text>Subsection
				(a) shall not to sales and exchanges after the end of the 18-month period
				beginning on the date of the enactment of this
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection display-inline="no-display-inline" id="HF11C5B62F28C41CCBEE709077C650F01"><enum>(b)</enum><header>Basis</header><text>Section
			 1016(a) of such Code is amended by striking <quote>and</quote> at the end of
			 paragraph (36), by striking the period at the end of paragraph (37) and
			 inserting <quote>, and</quote>, and by adding at the end the following new
			 paragraph:</text>

					<paragraph id="HF350EA7FF7634A209FC76FC2EBAF24FE"><enum>(38)</enum><text display-inline="yes-display-inline">to the extent provided in section
				1203(d).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H62AD3E86604D440D82189D8B72C8A4A0"><enum>(c)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections for part I of subchapter P of chapter 1 of such Code is amended by
			 adding at the end the following new item:</text>

					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H8171223C897C41DBAA2BF5703E258D78"><enum>(d)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply with respect to property purchased on or after the
			 date of the enactment of this Act.</text>
