<official-title display="yes">To amend the National Agricultural Research, Extension and Teaching Policy Act of 1977 to establish a grant program to promote efforts to develop, implement, and sustain veterinary services, and for other purposes.</official-title>

<legis-body id="HCD63EBD4AD0A458AB2D1E2BB27BFB83E" style="OLC"> 
<section id="H9207578DC399479A99E8A63D1F5B1F77" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterinarian Services Investment Act</short-title></quote>.</text> </section> 
<section id="HC0652CE7A39C4FADB53FC014782B2AD0"><enum>2.</enum><header>Veterinary services grant program</header><text display-inline="no-display-inline">The National Agricultural Research, Extension, and Teaching Policy Act of 1977 is amended by inserting after section 1415A (<external-xref legal-doc="usc" parsable-cite="usc/7/3151a">7 U.S.C. 3151a</external-xref>) the following new section:</text>

<section id="HF12E58479E1944A9AEE7BB3EDBE2ACBD"><enum>1415B.</enum><header>Veterinary services grant program</header> 
<subsection id="H4DCE20DBA10D4D50A2C445C5540CC2C8"><enum>(a)</enum><header>Establishment of program</header> 
<paragraph id="H75DCD88E6BAF4C76941719B60EF1DB5C"><enum>(1)</enum><header>Competitive grants</header><text display-inline="yes-display-inline">The Secretary shall carry out a program to make competitive grants to qualified entities that engage in activities described in paragraph (2) for the purpose of developing, implementing, and sustaining veterinary services.</text></paragraph> 
<paragraph id="H1D705E9DE4784135AD2AF4D9E3C683D5"><enum>(2)</enum><header>Eligibility requirements</header><text>To be eligible for a grant under this subsection, a qualified entity must carry out programs or activities that the Secretary determines will—</text> 
<subparagraph id="H79033F226DD64D8FBDC8060E69C528EC"><enum>(A)</enum><text>substantially relieve veterinarian shortage situations;</text></subparagraph> 
<subparagraph id="H8DFEA709666D49C098DCE92439653EF5"><enum>(B)</enum><text display-inline="yes-display-inline">support or facilitate private veterinary practices engaged in public health activities; or</text></subparagraph> 
<subparagraph id="H9339C12CEE654013B1EB7CF66F89D57B"><enum>(C)</enum><text>support or facilitate practices of veterinarians who are participating in or have successfully completed a service requirement under section 1415A(a)(2).</text></subparagraph></paragraph></subsection> 
<subsection id="HA469E4F01B23429985BB7477A296281A"><enum>(b)</enum><header>Award processes and preferences</header> 
<paragraph id="HB29C6383FCD44F8AA648CCE850E67833"><enum>(1)</enum><header>Application, evaluation, and input processes</header><text>In administrating the grant program under this section, the Secretary shall use an appropriate application and evaluation process and seek the input of interested persons.</text></paragraph> 
<paragraph id="HE7DFBDFF81534E5493B7081A6C31F853"><enum>(2)</enum><header>Grant preferences</header><text display-inline="yes-display-inline">In the case of grants to be used for any of the purposes described in paragraphs (2) through (6) of subsection (c), the Secretary shall give a preference to the selection of qualified entities that document coordination between or with other qualified entities regarding the applicable purpose.</text></paragraph> 
<paragraph id="H7831247929DC4E94B84D3B6E10BEBB62"><enum>(3)</enum><header>Additional preferences</header><text display-inline="yes-display-inline">When awarding grants under this section, the Secretary may develop additional preferences by taking into account the amount of funds available for grants as well as the purposes for which the grant funds will be used.</text></paragraph> 
<paragraph id="H69A566A5925F46CCB9E01A9A7D0BA2C1"><enum>(4)</enum><header>Applicability of other provisions</header><text display-inline="yes-display-inline">Sections 1413B, 1462(a), 1469(a)(3), 1469(c), and 1470 shall apply to the administration of the grant program under this section.</text></paragraph></subsection> 
<subsection id="H4CC78D43A8A744F3AFF245051FC0C215"><enum>(c)</enum><header>Use of grants to relieve veterinarian shortage situations and support veterinary services</header><text display-inline="yes-display-inline">Funds provided by grants under this section may be used for the following purposes to relieve veterinarian shortage situations and support veterinary services:</text> 
<paragraph id="HA593DD57180448BAAE0370E91F067788"><enum>(1)</enum><text>Grants to assist veterinarians with establishing or expanding practices for the purpose of equipping veterinary offices, sharing in the reasonable overhead costs of such practices (as determined by the Secretary), or establishing mobile veterinary facilities where at least a portion of such facilities will address education or extension needs.</text></paragraph> 
<paragraph id="HDBC314D0BD1446A1AC41A4EBD38F6628"><enum>(2)</enum><text display-inline="yes-display-inline">Grants to promote recruitment (including programs in secondary schools), placement, and retention of veterinarians, veterinary technicians, students of veterinary medicine, and students of veterinary technology.</text></paragraph> 
<paragraph id="H2D13F4DF75934338A01EA012DA057252"><enum>(3)</enum><text display-inline="yes-display-inline">Grants for veterinary students, veterinary interns, externs, fellows, and residents, and veterinary technician students to cover expenses (other than the types of expenses listed in 1415A(c)(5)) to attend training programs in food safety or food animal medicine.</text></paragraph> 
<paragraph id="H4FE645BA88FD45878E9D36A521606B2A"><enum>(4)</enum><text display-inline="yes-display-inline">Grants establishing or expanding accredited veterinary education programs (including faculty recruitment and retention), veterinary residency and fellowship programs, or veterinary internship and externship programs in coordination with accredited colleges of veterinary medicine.</text></paragraph> 
<paragraph id="H3470F1DB39E442488D591936BA85F69F"><enum>(5)</enum><text display-inline="yes-display-inline">Grants for the assessment of veterinarian shortage situations and preparation of applications for designation as a shortage situation.</text></paragraph> 
<paragraph id="HB9BC26ABAAC44AD880C0DA25883C310A"><enum>(6)</enum><text>Grants in continuing education and extension, including tele-veterinary medicine and other distance-based education, for veterinarians, veterinary technicians, and other health professionals needed to strengthen veterinary programs and enhance food safety.</text></paragraph></subsection> 
<subsection id="H6BAC30D398974E298EB9C72F8BC63A00"><enum>(d)</enum><header>Special requirements for certain grants</header> 
<paragraph id="H033484A2E9BE48EF8A80D2B7D24651B0"><enum>(1)</enum><header>Terms of service requirements</header><text display-inline="yes-display-inline">Grants provided under this section for the purpose specified in subsection (c)(1) shall be subject to an agreement between the Secretary and the grant recipient that includes a required term of service for the recipient, as established by the Secretary. In establishing such terms, the Secretary shall consider only—</text> 
<subparagraph id="HD70CECC361DB446390B59F4F6198FAE0"><enum>(A)</enum><text>the amount of the grant awarded; and</text></subparagraph> 
<subparagraph id="HE30B94A529EC41088E67931DBEAF40A7"><enum>(B)</enum><text>the specific purpose of the grant.</text></subparagraph></paragraph> 
<paragraph id="HFC8B4BFA69EB404FB16D17E115596505"><enum>(2)</enum><header>Breach Remedies</header><text display-inline="yes-display-inline">An agreement under paragraph (1) shall provide remedies for any breach of the agreement by the grant recipient, including repayment or partial repayment of the grant funds, with interest. The Secretary may waive the repayment obligation in the event of extreme hardship or extreme need, as determined by the Secretary.</text></paragraph> 
<paragraph id="HD1CB3C65C8044785BB3EA35BE304830D"><enum>(3)</enum><header>Treatment of Amounts Recovered</header><text>Funds recovered under paragraph (2) shall be credited to the account available to carry out this section and shall remain available until expended.</text></paragraph></subsection> 
<subsection display-inline="no-display-inline" id="H29C42CB9738E40E9A38F1C75FF8AFBE5"><enum>(e)</enum><header>Cost-Sharing requirements</header> 
<paragraph id="H86EE2DA67FA945879E392B13AA6E7AA5"><enum>(1)</enum><header>Recipient share</header><text display-inline="yes-display-inline">A grant recipient shall provide matching non-Federal funds, either in cash or in-kind support, in an amount equal to not less than 50 percent of the Federal funds provided in a grant under this section.</text></paragraph> 
<paragraph id="H0D6F2F0B2E994DF1B56D7FA69C82F35D"><enum>(2)</enum><header>Waiver</header><text display-inline="yes-display-inline">The Secretary may establish, by regulation, conditions under which the cost-sharing requirements of paragraph (1) may be reduced or waived.</text></paragraph></subsection> 
<subsection id="H166805AAB4434A05B89ED87490A2D64B"><enum>(f)</enum><header>Prohibition on use of grant funds for construction</header><text>Funds made available for grants under this section shall not be used for the construction of a new building or facility or the acquisition, expansion, remodeling, or alteration of an existing building of facility, including site grading and improvement and architect fees.</text></subsection> 
<subsection id="H3C3216133E63467480FDB5DC9D7816E9"><enum>(g)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H799E75FB43AA4CDA9A6204265B513AB8"><enum>(1)</enum><header>Veterinarian shortage situation</header><text display-inline="yes-display-inline">The term <term>veterinarian shortage situation</term> means a veterinarian shortage situation determined by the Secretary under section 1415A(b).</text></paragraph> 
<paragraph id="H12219D0334224F358991F9C667CC9DDE"><enum>(2)</enum><header>Qualified entity</header><text>The term <term>qualified entity</term> means the following:</text> 
<subparagraph id="H59F13DAF858D45E88EB0E49A8B5AA447"><enum>(A)</enum><text>A for-profit or nonprofit entity located in the United States that operates a veterinary clinic providing veterinary services—</text> 
<clause id="H3BC96E72D45740CEBF5BB0A3E00512D4"><enum>(i)</enum><text>in a rural area, as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/1393">section 1393(a)(2)</external-xref> of the Internal Revenue Code of 1986; and</text></clause> 
<clause id="H2471149FBAF647F0A30C463D4F08D2F5"><enum>(ii)</enum><text>in response to a veterinarian shortage situation.</text></clause></subparagraph> 
<subparagraph id="H783634A99C964FC08F17A50CB7DEAD35"><enum>(B)</enum><text display-inline="yes-display-inline">A State, national, allied, or regional veterinary organization or specialty board recognized by the American Veterinary Medical Association.</text></subparagraph> 
<subparagraph id="H9F98A22C4B1E4FB2B6055FA0641BDC34"><enum>(C)</enum><text>A college or school of veterinary medicine accredited by the American Veterinary Medical Association.</text></subparagraph> 
<subparagraph id="H12DEDE6B8C284870858719F739EC085E"><enum>(D)</enum><text display-inline="yes-display-inline">A university research foundation or veterinary medical foundation.</text></subparagraph> 
<subparagraph id="HEED2F67002AA44AE96B2CFF4B254B953"><enum>(E)</enum><text>A department of veterinary science or department of comparative medicine accredited by the Department of Education.</text></subparagraph> 
<subparagraph id="HCD6059D502844E129EF9FE4FAD6C5A3B"><enum>(F)</enum><text>A State agricultural experiment station.</text></subparagraph> 
<subparagraph id="HAD510C2EB04A41C19E64684CA53D5867"><enum>(G)</enum><text>A State, local, or tribal government agency.</text></subparagraph></paragraph></subsection> 
<subsection id="HDBE771B48AC742179147B6DD556AAE18"><enum>(h)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretary such sums as are necessary to carry out this section for fiscal year 2012 and each fiscal year thereafter. Amounts appropriated pursuant to this authorization of appropriations shall remain available to the Secretary for the purposes of this section until expended.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
