<official-title>To delay the implementation of agency rules adopted within the final 90 days of the final term a President serves.</official-title>

<section id="HB83CF732A96847A6BEB2A27269BD4851" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Midnight Rule Act</short-title></quote>.</text> </section> 
<section id="H27236FDD21E44C1E82E6A8D3E2CF1B5F"><enum>2.</enum><header>Restrictions on midnight rulemaking</header><text display-inline="no-display-inline">Title 5, United States Code, is amended by inserting after section 555 the following new section:</text>

<section id="HF1F38592DF6B4D2A9CD7B1879EDF850"><enum>555a.</enum><header>Restrictions on midnight rulemaking</header> 
<subsection id="HE8C0CDB167274ACBA6D8DD18D82C4B3C"><enum>(a)</enum><header>Rules adopted in the final 90 days of a presidential administration</header><text>Notwithstanding section 801, a midnight rule shall not take effect until 90 days after the agency head is appointed by the new President.</text></subsection> 
<subsection id="HD751EF2B5EF64ADEB6A8A31EB7ADC8D"><enum>(b)</enum><header>Presidential authority</header> 
<paragraph id="H49846D43C9514982B206B600913E8B6"><enum>(1)</enum><header>Notice</header><text>Notwithstanding any other provision of this section, a midnight rule that would not take effect by reason of subsection (a) may take effect if the President serving his final term makes a determination under paragraph (2) and submits written notice of such determination to the Congress.</text></paragraph> 
<paragraph id="H81E02BA13E174B7490672E7F598FC84F"><enum>(2)</enum><header>Exceptions</header><text>A determination under this paragraph is a determination made by the President by Executive Order that the midnight rule should take effect because such rule is—</text> 
<subparagraph id="H8F4EEAF7D7994B23A9E4D5F3E353DE84"><enum>(A)</enum><text>necessary because of an imminent threat to health or safety or other emergency;</text></subparagraph> 
<subparagraph id="H15CFDB9FE1984A51B9E9EEF3DA4B8D50"><enum>(B)</enum><text>necessary for the enforcement of criminal laws;</text></subparagraph> 
<subparagraph id="HD47D9C1F30E24AC9A6E72939894F2F4C"><enum>(C)</enum><text>necessary for national security; or</text></subparagraph> 
<subparagraph id="HE70031E84055440AB0332BFC7BC39B87"><enum>(D)</enum><text>issued pursuant to any statute implementing an international trade agreement.</text></subparagraph></paragraph> 
<paragraph id="HC4D7FD20C50C45029F91FDCA09709CCB"><enum>(3)</enum><header>Effect on congressional disapproval procedures</header><text>An exercise by the President of the authority under this subsection shall have no effect on congressional disapproval procedures under section 802 or congressional review under section 801.</text></paragraph></subsection> 
<subsection id="H5C8CD1DFFD0A4314A0AB37DDF299077F"><enum>(c)</enum><header>Disapproval by a new agency head</header> 
<paragraph id="H791CA047873C4B019789A14182F5F0BD"><enum>(1)</enum><header>Disapproval</header><text>The agency head appointed by the new President may disapprove of a midnight rule no later than 90 days after being appointed.</text></paragraph> 
<paragraph id="HB2477D8842C9418E92223222F743FFD2"><enum>(2)</enum><header>Procedure</header><text>The agency head appointed by the new President may disapprove a midnight rule by publishing a statement of disapproval in the Federal Register and sending a notice of disapproval to the congressional committees of jurisdiction.</text></paragraph></subsection> 
<subsection id="H39C822B20B2C4F729E55C3DAE91FE00"><enum>(d)</enum><header>Definitions</header><text>The term <term>midnight rule</term> means a rule adopted by an agency within the final 90 days a President serves in office.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </section> 
<section id="H797F6363B3D841C79F44F07BDB4C016"><enum>3.</enum><header>Clerical amendment</header><text display-inline="no-display-inline">The table of contents of chapter 5 of title 5, United States Code, is amended by inserting after the item relating to section 555 the following new item:</text>

<section id="H5730649CD8054A3DAD37BF1116F4717C"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply to any rule adopted on or after October 22, 2008.</text></section>
