		<official-title>To amend section 119 of title 17, United States Code, and
		  the Communications Act of 1934 to permit satellite carriers to retransmit the
		  signals of certain noncommercial, educational broadcast stations outside their
		  local markets, and for other purposes.</official-title>

		<section id="HA7627E742C2E46AEA566B095A605398" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Statewide PTV Access Act of
			 2009</short-title></quote>.</text>
		</section><section id="HF780957E483440D4ADE29DD1B2146E5F"><enum>2.</enum><header>Secondary
			 transmission of noncommercial stations by satellite carriers outside local
			 markets</header>
			<subsection id="H955E3650991444E8929A5D9B90D8880F"><enum>(a)</enum><header>Secondary
			 transmissions</header><text display-inline="yes-display-inline">Section
			 119(a)(2)(C) of title 17, United States Code, is amended—</text>
				<paragraph id="HB4FC168F566C448294A0375DC82DAEE3"><enum>(1)</enum><text>by redesignating
			 clauses (iii), (iv), and (v) as clauses (iv), (v), and (vi), respectively;
			 and</text>
				</paragraph><paragraph id="H63E3D3048776439AA21C1EDB6556B384"><enum>(2)</enum><text>by inserting after
			 clause (ii) the following:</text>
					<quoted-block id="H0A6AF3C8F55141369200028C561501A1" style="OLC">
						<clause id="HF07390E76E0C4D9583FB859C25ECE62F"><enum>(iii)</enum><header>Noncommercial
				educational broadcast stations</header>
							<subclause id="H01A120B2CBA148F8ACB126CFEF4CD09D"><enum>(I)</enum><header>Secondary
				transmissions within State-wide network</header><text>In the case of a
				State-wide network of noncommercial educational broadcast stations, the
				statutory license provided for in subparagraph (A) shall apply to the secondary
				transmission of any noncommercial educational broadcast station in that
				State-wide network to any subscriber in any county within that State that is
				located outside that station’s local market and is not served by a
				noncommercial educational television broadcast station that is located within
				that State.</text>
							</subclause><subclause id="H0513880CDA02455886EF7AE175DD3837"><enum>(II)</enum><header>State-wide
				network defined</header><text display-inline="yes-display-inline">In this
				clause, the term <term>State-wide network of noncommercial educational
				broadcast stations</term> is a network of three or more noncommercial
				educational broadcast stations that are licensed to a single State, political,
				educational, or special purpose subdivision of a State, or a single public
				agency.</text>
							</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H48FD4BA3F37745AF8A327F5C9D816BC7"><enum>(b)</enum><header>Royalty
			 fee</header><text display-inline="yes-display-inline">Section 119(b)(1)(B) of
			 title 17, United States Code, is amended by inserting <quote>or paragraph
			 (2)(C)(iii)</quote> after <quote>subscriber under paragraph (3)</quote>.</text>
			</subsection></section><section id="HEA7CBC12F0E54B3DB6E247156CD48ECB"><enum>3.</enum><header>Amendments to the
			 Communications Act of 1934</header>
			<subsection id="H76926F34E6C14B9BA68B8900F7764321"><enum>(a)</enum><header>In
			 general</header><text>Section 325(b)(2) of the Communications Act of 1934 (47
			 U.S.C. 325 (b)(2)) is amended—</text>
				<paragraph id="HCF3B84F52CE14B118033FE515FB83FC7"><enum>(1)</enum><text>by striking
			 <quote>or</quote> at the end of subparagraph (D);</text>
				</paragraph><paragraph id="H17DED1DD6F8045D7BEF4A6DC6E55D844"><enum>(2)</enum><text>by striking the
			 period at the end of subparagraph (E) and inserting <quote>; or</quote>;
			 and</text>
				</paragraph><paragraph id="H5B7E28A935DA43379FACDAF7B3A5EBB0"><enum>(3)</enum><text>by inserting after
			 subparagraph (E) the following new subparagraph:</text>
					<quoted-block id="H03A1326EDC6E492B87D73B8C526222CB" style="OLC">
						<subparagraph id="H71846D7CA0CC4358894501B94D3CE671"><enum>(F)</enum><text display-inline="yes-display-inline">to retransmission of the signal of a
				television broadcast station outside the station’s local market by a satellite
				carrier directly to its subscribers, if—</text>
							<clause id="H136ED0531DB64F8F82A02B8DC09281CC"><enum>(i)</enum><text display-inline="yes-display-inline">such station is a part of a network of
				three or more noncommercial educational broadcast stations that are licensed to
				a single State, political, educational, or special purpose subdivision of a
				State, or a single public agency; and</text>
							</clause><clause id="HEAF134852F6248FEB176C5D193ABCA06"><enum>(ii)</enum><text>the satellite
				carrier retransmits the secondary signal of such eligible noncommercial
				educational broadcast station only to its subscribers—</text>
								<subclause id="HB8AA7A27E38C46928DF0ED6312152DC1"><enum>(I)</enum><text display-inline="yes-display-inline">located in any county within that State
				that is located outside that station’s local market; and</text>
								</subclause><subclause id="H0260EDCB3D934F2CBAB4FF307BB68D4E"><enum>(II)</enum><text display-inline="yes-display-inline">not served by another noncommercial
				educational broadcast station that is located within that
				State;</text>
								</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H3536581668EF4D068EBC47EC19A00083"><enum>(b)</enum><header>Distant
			 Signals</header><text>Section 339(a)(1) of the Communications Act of 1934 (47
			 U.S.C. 339 (a)(1)) is amended by adding at the end the following new
			 subparagraph:</text>
				<quoted-block id="H996EEFB87F5144F095FA4E49E5F5375E" style="OLC">
					<subparagraph id="H7C85636DBE764C018902893570D1336B"><enum>(C)</enum><text display-inline="yes-display-inline">In the case of a network of three or more
				noncommercial educational broadcast stations that are licensed to a single
				State, political, educational, or special purpose subdivision of a State, or
				public agency, a satellite carrier may carry the signals of such network to all
				subscribers in any county within that State that is located outside that
				station’s designated market area and is not served by another noncommercial
				educational broadcast station located within that
				State.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section></legis-body>
