		<official-title>To amend the Internal Revenue Code of 1986 to provide tax
		  incentives for employer-provided wellness programs.</official-title>

		<section id="H4027A161D7534845A2D415E35BF24BB1" section-type="section-one"><enum>1.</enum><header>Wellness program employer
			 credit</header>
			<subsection id="HB476543C08F74231A94C820DB2C984D5"><enum>(a)</enum><header>In
			 General</header><text>Subpart D of part IV of subchapter A of chapter 1 of the
			 Internal Revenue Code of 1986 (relating to business related credits) is amended
			 by inserting after section 45Q the following new section:</text>
				<quoted-block id="H973BF17DFF4449B6BD56FEE09F3BADEC" style="OLC">
					<section id="H8F9132C2FD0940B380DB8203A2A36C0B"><enum>45R.</enum><header>Wellness
				program employer credit</header>
						<subsection id="HD2E560791AB64CA39BB97C1C2545D6A6"><enum>(a)</enum><header>General
				Rule</header><text>For purposes of section 38, the wellness program employer
				credit determined under this section for any taxable year is an amount equal to
				30 percent of the expenses paid or incurred by the eligible employer during the
				taxable year to develop and implement a qualified wellness program.</text>
						</subsection><subsection id="H8B7AB90D33E04FB8A92D9116DECB2E2D"><enum>(b)</enum><header>Dollar
				Limitation</header><text>The amount of the credit determined under this section
				for any taxable year shall not exceed $400 per qualified employee employed by
				the eligible employer during the taxable year.</text>
						</subsection><subsection id="HF58ABFA1A04F4A37AB097A08335ABF28"><enum>(c)</enum><header>Definitions</header><text>For
				purposes of this section—</text>
							<paragraph id="H46B60E3CBCE2481FB1D73CE4FE8E965E"><enum>(1)</enum><header>Eligible
				employer</header><text>With respect to a taxable year, the term <term>eligible
				employer</term> means an employer who—</text>
								<subparagraph id="H5D1C1984CFBC4CE4817FD8BE6C87254E"><enum>(A)</enum><text>develops and
				implements a qualified wellness program, and</text>
								</subparagraph><subparagraph id="HFED1D7A78B4247EF8262F5136EEA32B8"><enum>(B)</enum><text>keeps accurate
				records of the preventive services and other programs in which the eligible
				employer’s employees have participated during the taxable year.</text>
								</subparagraph></paragraph><paragraph id="HDBCA39E0908649C884FC3478C5BFBA34"><enum>(2)</enum><header>Qualified
				wellness program</header><text>With respect to an eligible employer, the term
				<term>qualified wellness program</term> means a program—</text>
								<subparagraph id="H95553C47C5C0407C8CF769376BB5073E"><enum>(A)</enum><text>that is developed
				and implemented by the eligible employer, in consultation with an individual
				who has implemented a wellness program for a different employer and who will
				ensure compliance with appropriate measures to protect the privacy of program
				participants,</text>
								</subparagraph><subparagraph id="H373A1ACCC4C2436DA24EC0863506865D"><enum>(B)</enum><text>that conducts
				health risk assessments for each of the program’s participants,</text>
								</subparagraph><subparagraph id="H1925AEEBA33848B48F0A516B042FCFD3"><enum>(C)</enum><text>that offers at
				least 2 of the preventive services strongly recommended by the U.S. Preventive
				Services Task Force on an annual basis,</text>
								</subparagraph><subparagraph id="H050E3FE2E0634FBA92606F61DF44480E"><enum>(D)</enum><text>that offers annual
				counseling sessions and seminars related to at least 4 of the following:</text>
									<clause id="HA66253B3D3334B428C205CB48D056F95"><enum>(i)</enum><text>smoking,</text>
									</clause><clause id="H7AF2A5622F4A4A0495A36F488C0510E6"><enum>(ii)</enum><text>obesity,</text>
									</clause><clause id="H4F994FF47C5B488A88748D19EFABD86C"><enum>(iii)</enum><text>stress
				management,</text>
									</clause><clause id="HAD1E251EDB984AF990EDF460F502D55E"><enum>(iv)</enum><text>physical
				fitness,</text>
									</clause><clause id="H153B0CA3113A4CB6A6BA29F383B7BC87"><enum>(v)</enum><text>nutrition,</text>
									</clause><clause id="H4E140B0CB705459E9A7B4477CA53CF49"><enum>(vi)</enum><text>substance
				abuse,</text>
									</clause><clause id="HAB610FA8D9004FF19B9BCCFC10ACAC08"><enum>(vii)</enum><text>depression,</text>
									</clause><clause id="H95FE12A5DE814D51BC4B1D7B8D07C10F"><enum>(viii)</enum><text>mental
				health,</text>
									</clause><clause id="H1DB7AB49FD164FAD85F246B75C5FEBC8"><enum>(ix)</enum><text>heart disease,
				and</text>
									</clause><clause id="H245DE82577944F0B919F9116A7D21F45"><enum>(x)</enum><text>maternal and
				infant health, and</text>
									</clause></subparagraph><subparagraph id="HF72D6E3213C548268DA15C3C97188533"><enum>(E)</enum><text>whose qualified
				participants include not less than 60 percent of the eligible employer’s
				full-time employees.</text>
								</subparagraph></paragraph><paragraph id="H067B1FFEB77148AAA3E9DA25F179461B"><enum>(3)</enum><header>Qualified
				employee</header><text>With respect to an eligible employer, the term
				<term>qualified employee</term> means an individual who is—</text>
								<subparagraph id="H0820FC626B0143FBBF5C9B466F3B5CE3"><enum>(A)</enum><text>a full-time
				employee of the eligible employer, and</text>
								</subparagraph><subparagraph id="H47E65D0AEA344BCBA5355CB8C10CD98C"><enum>(B)</enum><text>a qualified
				participant in the eligible employer’s qualified wellness program.</text>
								</subparagraph></paragraph><paragraph id="H4CCD058D11564E798822987A4454AB6E"><enum>(4)</enum><header>Qualified
				participant</header><text>With respect to a taxable year, the term
				<term>qualified participant</term> means an individual—</text>
								<subparagraph id="H754F63BA121A491C8E89EE90585867E4"><enum>(A)</enum><text>who participates
				in at least 4 of the annual preventive services or other programs offered
				through a qualified wellness program during the taxable year, and</text>
								</subparagraph><subparagraph id="H7B4E3BC4DD1E4C0CB417670974AD189B"><enum>(B)</enum><text>with respect to
				whom a health risk assessment has been conducted during the taxable
				year,</text>
								</subparagraph><continuation-text continuation-text-level="paragraph">as
				determined by the eligible employer who has developed and implemented such
				qualified wellness program.</continuation-text></paragraph></subsection><subsection id="H3A71992CB0134121AA5164F0D71BE98D"><enum>(d)</enum><header>Termination</header><text>This
				section shall not apply in taxable years beginning after December 31,
				2014.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H84E89B058E374C5CA19FD37E4874A836"><enum>(b)</enum><header>Conforming
			 Amendments</header>
				<paragraph id="H25FBE8CEA7D14192805491214A1120C9"><enum>(1)</enum><text>Section 38(b) of
			 such Code is amended by striking <quote>plus</quote> at the end of paragraph
			 (34), by striking the period at the end of paragraph (35) and inserting
			 <quote>, plus</quote>, and by adding at the end the following new
			 paragraph:</text>

						<paragraph id="H3BA1C48B0C584C359B8D610513BE04AE"><enum>(36)</enum><text>the wellness
				program employer credit determined under section
				45R(a).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H0D0707610529443585D1B84A0566CF72"><enum>(2)</enum><text>The table of
			 sections for subpart D of part IV of subchapter A of chapter 1 of such Code is
			 amended by inserting after the item relating to section 45Q the following new
			 item:</text>

				</paragraph></subsection><subsection id="HCFE739668FDF44F1BC47849426987A9F"><enum>(c)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after the date of the enactment of this Act.</text>
			</subsection></section><section id="H8EE53B3C9A4A475EB4DA0EA88807B93E"><enum>2.</enum><header>Wellness program
			 participant credit</header>
			<subsection id="H13C3ADF812CE4FD59F68B37C7A82E181"><enum>(a)</enum><header>In
			 General</header><text>Subpart A of part IV of subchapter A of chapter 1 of the
			 Internal Revenue Code of 1986 (relating to nonrefundable personal credits) is
			 amended by inserting after section 25D the following new section:</text>
				<quoted-block id="H4C8384E8209C48F29DF76CAF81B02749" style="OLC">
					<section id="HFD010D898A4040C3858653490C357DAF"><enum>25E.</enum><header>Wellness
				program participant credit</header>
						<subsection id="HF57582BC13874233ABFB300FE221C0B7"><enum>(a)</enum><header>Allowance of
				Credit</header><text>In the case of a qualified employee, there shall be
				allowed as a credit against the tax imposed by this chapter for the taxable
				year an amount equal to $400.</text>
						</subsection><subsection id="HAEDAF9D28DFC41E5A27ECF1C07A79426"><enum>(b)</enum><header>Definitions</header><text>For
				purposes of this section—</text>
							<paragraph id="H12A3416C6850452F842EA70E3EE3F155"><enum>(1)</enum><header>Qualified
				employee</header><text>With respect to an eligible employer, the term
				<term>qualified employee</term> means an individual who is—</text>
								<subparagraph id="H1109A25B160748D595926C3DBAEBA1A5"><enum>(A)</enum><text>a full-time
				employee of the eligible employer, and</text>
								</subparagraph><subparagraph id="HBF91D2F10A634138B13D0F94CEF010BF"><enum>(B)</enum><text>a qualified
				participant in the eligible employer’s qualified wellness program.</text>
								</subparagraph></paragraph><paragraph id="HE6A17146B6AA4B8F996C1DDBA0932085"><enum>(2)</enum><header>Qualified
				participant</header><text>With respect to a taxable year, the term
				<term>qualified participant</term> means an individual—</text>
								<subparagraph id="H92C887DCDF174972A8EE3767F0585AC7"><enum>(A)</enum><text>who participates
				in at least 4 of the annual preventive services or other programs offered
				through a qualified wellness program during the taxable year, and</text>
								</subparagraph><subparagraph id="H5CA563721EBC4DE6985C9F3448611978"><enum>(B)</enum><text>with respect to
				whom a health risk assessment has been conducted during the taxable
				year,</text>
								</subparagraph><continuation-text continuation-text-level="paragraph">as
				determined by the eligible employer who has developed and implemented such
				qualified wellness program.</continuation-text></paragraph><paragraph id="H7B567746A1F4443DBCB98AA1A8F56A23"><enum>(3)</enum><header>Qualified
				wellness program</header><text>With respect to an eligible employer, the term
				<term>qualified wellness program</term> means a program—</text>
								<subparagraph id="HB7C1AB7EEAD24B7399677C259161BB7B"><enum>(A)</enum><text>that is developed
				and implemented by the eligible employer, in consultation with an individual
				who has implemented a wellness program for a different employer and who will
				ensure compliance with appropriate measures to protect the privacy of program
				participants,</text>
								</subparagraph><subparagraph id="H502A456B70D148DAB1BEA2D6961B3CD0"><enum>(B)</enum><text>that conducts
				health risk assessments for each of the program’s participants,</text>
								</subparagraph><subparagraph id="H556D70F1C38D4EAF9C4EB6EEE68958E3"><enum>(C)</enum><text>that offers at
				least 2 of the preventive services strongly recommended by the U.S. Preventive
				Services Task Force on an annual basis,</text>
								</subparagraph><subparagraph id="H0D81B9AD9FD64CD799DF6E5BB4AB9AFE"><enum>(D)</enum><text>that offers annual
				counseling sessions and seminars related to at least 4 of the following:</text>
									<clause id="HC8E2D0F9A22B44D39EFF8E6A0AEFA993"><enum>(i)</enum><text>smoking,</text>
									</clause><clause id="H953637E69D5F4B6E9272EC55AB71377C"><enum>(ii)</enum><text>obesity,</text>
									</clause><clause id="H0D109730047F48A4A3F9D9DDEFC2A896"><enum>(iii)</enum><text>stress
				management,</text>
									</clause><clause id="H5E3C9A16233B459DBF29216A3410162E"><enum>(iv)</enum><text>physical
				fitness,</text>
									</clause><clause id="HB486C5184337408797506531EEE3954F"><enum>(v)</enum><text>nutrition,</text>
									</clause><clause id="HE168CE9FFEBD424B9B89E41329CE1709"><enum>(vi)</enum><text>substance
				abuse,</text>
									</clause><clause id="H6818068F204F461784B538251FB183CF"><enum>(vii)</enum><text>depression,</text>
									</clause><clause id="H1FBBE082C8854F71B8D60EA921CCCDB0"><enum>(viii)</enum><text>mental
				health,</text>
									</clause><clause id="HFDCB369A8512459FAA1912393D606B61"><enum>(ix)</enum><text>heart disease,
				and</text>
									</clause><clause id="HFD326E20FD6A409F84E5384E109CC86A"><enum>(x)</enum><text>maternal and
				infant health, and</text>
									</clause></subparagraph><subparagraph id="H178AAE1A032C4DE2A34C2B9C20DF2C81"><enum>(E)</enum><text>whose qualified
				participants include not less than 60 percent of the eligible employer’s
				full-time employees.</text>
								</subparagraph></paragraph><paragraph id="H92D4456BBF1841A2897C00BE9A999591"><enum>(4)</enum><header>Eligible
				employer</header><text>With respect to a taxable year, the term <term>eligible
				employer</term> means an employer who—</text>
								<subparagraph id="H80CC1B10A845465895D3CB98E821A406"><enum>(A)</enum><text>develops and
				implements a qualified wellness program, and</text>
								</subparagraph><subparagraph id="HCC7624824D274E769A71F8966A2F86F2"><enum>(B)</enum><text>keeps accurate
				records of the preventive services and other programs in which the eligible
				employer’s employees have participated during the taxable year.</text>
								</subparagraph></paragraph></subsection><subsection id="H4A552333F9CE4C56A8763F78A4A0D30C"><enum>(c)</enum><header>Termination</header><text>This
				section shall not apply in taxable years beginning after December 31,
				2014.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
