		  other purposes.</official-title>

		<section id="H598F4233BFCB48A8B560BFE04885B350" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Scrapping Unsustainable Redundant
			 Programs Leaves Us Solvent Act of 2009</short-title></quote> or the
			 <quote><short-title>SURPLUS Act</short-title></quote>.</text>
		</section><section id="H2A573056FD9749A6B8365674EF9101A4" section-type="subsequent-section"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are to—</text>
			<paragraph id="H919D9291B4054580A320A25132A78FF7"><enum>(1)</enum><text display-inline="yes-display-inline">reduce America’s debt, now more than
			 $11,000,000,000,000 dollars;</text>
			</paragraph><paragraph id="H7647B5A086AE4DA9994FAB440FB6E7A7"><enum>(2)</enum><text>eliminate
			 duplicative Government programs, streamlining the way Government operates;</text>
			</paragraph><paragraph id="HC7598B46B9504439B09F76CA9D6F8819"><enum>(3)</enum><text>secure, for
			 effective programs, the necessary resources; and</text>
			</paragraph><paragraph id="H7D756CC7B0AE40A09257720B705F8BD7"><enum>(4)</enum><text>reduce the overall
			 size of the Federal Government.</text>
			</paragraph></section><section id="H6B9D63A2740042CD91AF650E827DF745"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H6B2C01A4C8084083AD32E7135685ED7A"><enum>(1)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the
			 Secretary of Agriculture, the Secretary of Commerce, the Secretary of Defense,
			 the Secretary of Education, the Secretary of Energy, the Secretary of Health
			 and Human Services, the Secretary of Homeland Security, the Secretary of
			 Housing and Urban Development, the Secretary of the Interior, the Secretary of
			 Labor, the Secretary of State, the Secretary of Transportation, the Secretary
			 of the Treasury, and the Secretary of Veterans Affairs, the Attorney General,
			 and the Administrator of the Environmental Protection Agency.</text>
			</paragraph><paragraph id="HC383F971406B438C91C67AF0CA4836A2"><enum>(2)</enum><header>Program</header><text display-inline="yes-display-inline">The term <quote>program</quote> means any
			 program or initiative housed within a department or agency headed by a
			 Secretary (as defined in paragraph (1)).</text>
			</paragraph></section><section id="H25899A39BC6C4F14ADA167639E121111"><enum>4.</enum><header>Study of existing
			 Federal grant programs</header>
			<subsection id="H21C6CC6523E148A588E5DEEF513BAA78"><enum>(a)</enum><header>Study</header><text>Each
			 Secretary shall conduct a study to determine if any Federal program within the
			 department or agency concerned is duplicative of one or more other Federal
			 programs under the authority of the department or agency as of the date of the
			 enactment of this Act.</text>
			</subsection><subsection id="HC96581AB533D4409998747353D532274"><enum>(b)</enum><header>Report</header><text>Not
			 later than 12 months after the date of the enactment of this Act, each
			 Secretary shall submit to Congress and make available to the public a report
			 that contains the results of the study required under subsection (a).</text>
			</subsection></section><section commented="no" id="HE3AB6418AB1A4B3587ACAD344C123A24"><enum>5.</enum><header>Termination of
			 duplicative programs</header>
			<subsection commented="no" id="H9BFA040B089C4126A540269AE67AB1EF"><enum>(a)</enum><header>Requirement To
			 terminate duplicative programs</header><text>Except as provided in subsection
			 (b), if a Secretary determines under section 4(a) that any program is
			 duplicative of one or more other Federal programs within the department or
			 agency concerned, the Secretary shall, to the maximum extent appropriate,
			 terminate the duplicative Federal program, or consolidate the program with
			 other programs performing similar functions, not later than 180 days after the
			 date of the submission of the report under section 4(b).</text>
			</subsection><subsection commented="no" id="H61C65F7460574A2EB77B3244D4C99B27"><enum>(b)</enum><header>Exception</header><text>Subsection
			 (a) shall not apply to any program that is required or authorized by
			 statute.</text>
			</subsection><subsection commented="no" id="HEDCE3115C9854187A0DE2699CEEBB363"><enum>(c)</enum><header>Duplicative
			 program</header><text>For purposes of this section, a program shall be
			 considered duplicative of another program if—</text>
				<paragraph commented="no" id="H1C981E0811B64CF79E729D5CC8014830"><enum>(1)</enum><text>in the case of a
			 grant program, the Secretary concerned determines that the purpose of the
			 program is to benefit a specific group of persons that is identical to or
			 substantially similar to a group of persons that is eligible for another grant
			 program; and</text>
				</paragraph><paragraph commented="no" id="H1873411CFD914369A23A13D9D1ADE8F7"><enum>(2)</enum><text>in the case of any
			 other program, the Secretary concerned determines that the program is
			 performing the same essential function as another program.</text>
				</paragraph></subsection></section></legis-body>
