		<legis-type>A BILL</legis-type>
		<official-title>To repeal title II of the REAL ID Act of 2005, to
		  reinstitute section 7212 of the Intelligence Reform and Terrorism Prevention
		  Act of 2004, which provides States additional regulatory flexibility and
		  funding authorization to more rapidly produce tamper- and counterfeit-resistant
		  driver’s licenses, and to protect privacy and civil liberties by providing
		  interested stakeholders on a negotiated rulemaking with guidance to achieve
		  improved 21st century licenses to improve national security.</official-title>

		<section display-inline="no-display-inline" id="H2C40ADB6F2DE47AC81EC0905D556FFC2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>REAL ID Repeal and Identification
			 Security Enhancement Act of 2009</short-title></quote>.</text>
		</section><section id="H38109CFA511640C8B004160A993FDAA2" section-type="subsequent-section"><enum>2.</enum><header>Repeal</header><text display-inline="no-display-inline">Title II of the REAL ID Act of 2005
			 (division B of Public Law 109–13; 49 U.S.C. 30301 note) is repealed.</text>
		</section><section id="H7D32E2EED6A540E89E1F230FDE28881F"><enum>3.</enum><header>Driver’s licenses
			 and personal identification cards</header>
			<subsection id="H85106D76CA6140BEA37C3DAED8D4E7D5"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H6684B183B8D3480595C4734BBEC86BDE"><enum>(1)</enum><header>Driver’s
			 license</header><text>The term <term>driver’s license</term> means a motor
			 vehicle operator’s license (as defined in section 30301(5) of title 49, United
			 States Code).</text>
				</paragraph><paragraph id="H14D554F968E14F20AE61ED6777FB7CDF"><enum>(2)</enum><header>Personal
			 identification card</header><text>The term <term>personal identification
			 card</term> means an identification document (as defined in section 1028(d)(3)
			 of title 18, United States Code) issued by a State.</text>
				</paragraph></subsection><subsection id="H79F6C97A2A304715B2711C2C8FECB73B"><enum>(b)</enum><header>Standards for
			 acceptance by Federal agencies</header>
				<paragraph id="HEA991155966E45418197898DA1AB2BF5"><enum>(1)</enum><header>In
			 general</header>
					<subparagraph id="HECB6B1FBCEA046BF964966DA9BFEFB5C"><enum>(A)</enum><header>Limitation on
			 acceptance</header><text>No Federal agency may accept, for any official
			 purpose, a driver’s license or personal identification card newly issued by a
			 State more than 2 years after the promulgation of the minimum standards under
			 paragraph (2) unless the driver’s license or personal identification card
			 conforms to such minimum standards.</text>
					</subparagraph><subparagraph id="HBFEF7F5F878D4DA2BF89390607BAC486"><enum>(B)</enum><header>Date for full
			 conformance</header>
						<clause id="H4800B719C0FC4B6D95BC63567584C2DF"><enum>(i)</enum><header>In
			 general</header><text>Except as provided under clause (ii), beginning on the
			 date that is 5 years after the promulgation of minimum standards under
			 paragraph (2), no Federal agency may accept, for any official purpose, a
			 driver’s license or personal identification card issued by a State unless such
			 driver’s license or personal identification card conforms to such minimum
			 standards.</text>
						</clause><clause id="H7EF1092389224D09A04C0117482A46B8"><enum>(ii)</enum><header>Alternative
			 date for full conformance</header><text>If the Secretary of Homeland Security
			 determines that it is impracticable for States to replace all State-issued
			 driver’s licenses and personal identification cards before the deadline set
			 forth in clause (i), the Secretary of Homeland Security, in consultation with
			 the Secretary of Transportation, may set a later, alternative deadline to the
			 extent necessary for States to complete such replacement with reasonable
			 efforts.</text>
						</clause></subparagraph><subparagraph id="H4D202A5CCEE4407BB12EB9E7B751FFFA"><enum>(C)</enum><header>State
			 certification</header>
						<clause id="H23CF01B064C94B269AA164B05092AF0C"><enum>(i)</enum><header>In
			 general</header><text>Each State shall certify to the Secretary of Homeland
			 Security that the State is in compliance with the requirements of this
			 section.</text>
						</clause><clause id="H09D97AFA02834570AF88305C5115FEC8"><enum>(ii)</enum><header>Frequency</header><text>Certifications
			 under clause (i) shall be made at such intervals and in such a manner as the
			 Secretary of Homeland Security, with the concurrence of the Secretary of
			 Transportation, may prescribe by regulation.</text>
						</clause><clause id="H1241B0CBD33F4A269E4D6AF0E52ABA90"><enum>(iii)</enum><header>Audits</header><text>The
			 Secretary of Homeland Security may conduct periodic audits of each State's
			 compliance with the requirements of this section.</text>
						</clause></subparagraph></paragraph><paragraph id="H9FAB0E2E744D4357B49F063A5BB2DDF0"><enum>(2)</enum><header>Minimum
			 standards</header><text>Not later than 12 months after the date of enactment of
			 this Act, the Secretary of Homeland Security, in consultation with the
			 Secretary of Transportation, shall by regulation, establish minimum standards
			 for driver's licenses or personal identification cards issued by a State for
			 use by Federal agencies for identification purposes that shall include—</text>
					<subparagraph id="H11DBFB05B86244A491AB57D70CC7EA76"><enum>(A)</enum><text>standards for
			 documentation required as proof of identity of an applicant for a driver's
			 license or personal identification card;</text>
					</subparagraph><subparagraph id="H1DF16CAA530D4519AA89F9979771520E"><enum>(B)</enum><text>standards for the
			 verifiability of documents used to obtain a driver's license or personal
			 identification card;</text>
					</subparagraph><subparagraph id="H8916CB9F550440DA96D116D152A34801"><enum>(C)</enum><text>standards for the
			 processing of applications for driver’s licenses and personal identification
			 cards to prevent fraud;</text>
					</subparagraph><subparagraph id="HFCA94211B53741E59D21493F3F93D0FF"><enum>(D)</enum><text>standards for
			 information to be included on each driver’s license or personal identification
			 card, including (consistent with such regulations)—</text>
						<clause id="H89481BBE97A846F7BBEF39A4E88EFAE8"><enum>(i)</enum><text>the
			 person’s full legal name;</text>
						</clause><clause id="HFD8A144CA03F4AAE913C851DCDDF3EAB"><enum>(ii)</enum><text>the
			 person’s date of birth;</text>
						</clause><clause id="H410C50D6CA854085A6A1D2733C1C8152"><enum>(iii)</enum><text>the person’s
			 gender;</text>
						</clause><clause id="H39C72DC97FDA4A6090C72D99F684B7DD"><enum>(iv)</enum><text>the
			 person’s driver’s license or personal identification card number;</text>
						</clause><clause id="HC0B38C361A3F4986911E989827C96756"><enum>(v)</enum><text>a
			 photograph of the person;</text>
						</clause><clause id="HBFFB104E21464DFE8DA1B119C547D86C"><enum>(vi)</enum><text>the
			 person’s address of principal residence; and</text>
						</clause><clause id="H3C3F0E2775D245FDAA5F5246D989036B"><enum>(vii)</enum><text>the person’s
			 signature;</text>
						</clause></subparagraph><subparagraph id="HFAE525F2E7D24C1D8D0B8A813EB4F269"><enum>(E)</enum><text>standards for
			 common machine-readable identity information to be included on each driver’s
			 license or personal identification card, including defined minimum data
			 elements;</text>
					</subparagraph><subparagraph id="H2D1D69A446EB45D38A637FF4630B5298"><enum>(F)</enum><text>security standards
			 to ensure that driver’s licenses and personal identification cards are—</text>
						<clause id="HEC9CF6B6AE21400E9DA9BCCE53E32808"><enum>(i)</enum><text>resistant to
			 tampering, alteration, or counterfeiting; and</text>
						</clause><clause id="H0DB3E2C1EE624765B6F782FEEB0F29A1"><enum>(ii)</enum><text>capable of
			 accommodating and ensuring the security of a photograph or other unique
			 identifier; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H945DBEE84E36456D8740A0BE3690B6A4"><enum>(G)</enum><text>a requirement that
			 a State confiscate a driver’s license or personal identification card if any
			 component or security feature of the license or identification card is
			 compromised.</text>
					</subparagraph></paragraph></subsection><subsection id="HA3EB0284926048DDA28701A9E388562C"><enum>(c)</enum><header>Negotiated
			 rulemaking</header>
				<paragraph id="H9DABC18E45584A90B87719F93CDFEFFB"><enum>(1)</enum><header>In
			 general</header><text>Before publishing the proposed regulations required by
			 subsection (b)(2) to carry out this title, the Secretary of Homeland Security
			 shall establish a negotiated rulemaking process pursuant to subchapter IV of
			 chapter 5 of title 5, United States Code (5 U.S.C. 561 et seq.).</text>
				</paragraph><paragraph id="H5687C2E4CF77454A8D62C27935813FEF"><enum>(2)</enum><header>Time
			 requirement</header><text>The process described in paragraph (1) shall be
			 conducted in a timely manner to ensure that—</text>
					<subparagraph id="H1B96B72EA8AD42688B597615019B7391"><enum>(A)</enum><text>any recommendation
			 for a proposed rule or report—</text>
						<clause id="H28795A4BB24D4800B08C773B26C49FE7"><enum>(i)</enum><text>is
			 provided to the Secretary of Homeland Security not later than 9 months after
			 the date of enactment of this Act; and</text>
						</clause><clause id="HF07CE89D7FB9460CBD90DF0CC4BAD2A4"><enum>(ii)</enum><text>includes an
			 assessment of the benefits and costs of the recommendation; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H902BFF6914C8484ABBAAF0AF41C9ACCB"><enum>(B)</enum><text>a final rule is
			 promulgated not later than 12 months after the date of enactment of this
			 Act.</text>
					</subparagraph></paragraph><paragraph id="H7FF5EAF82E654263A712BADCD4E91C66"><enum>(3)</enum><header>Representation
			 on negotiated rulemaking committee</header><text display-inline="yes-display-inline">Any negotiated rulemaking committee
			 established by the Secretary of Homeland Security pursuant to paragraph (1)
			 shall include representation from—</text>
					<subparagraph id="HA1B99635059A4D34B2FD3E4896CE7643"><enum>(A)</enum><text>the Department of
			 Transportation;</text>
					</subparagraph><subparagraph id="H398EFF83FC9642FAB6C27874B6A80D79"><enum>(B)</enum><text>among State
			 elected officials;</text>
					</subparagraph><subparagraph id="H0DBAF464A9354F1C920B4B42919D61FD"><enum>(C)</enum><text>among State
			 offices that issue driver's licenses or personal identification cards;
			 and</text>
					</subparagraph><subparagraph id="H62AE79A0D72E4EC5AD30AD9C659E963A"><enum>(D)</enum><text display-inline="yes-display-inline">among interested parties, including experts
			 in privacy protection, experts in civil liberties and protection of
			 constitutional rights, experts in immigration law, experts in fraud detection,
			 and experts in vital records management.</text>
					</subparagraph></paragraph><paragraph id="H3C39416BEA854ADBB30E75C5378BE7D0"><enum>(4)</enum><header>Content of
			 regulations</header><text>The regulations required by subsection (b)(2)—</text>
					<subparagraph id="HDAF0C08C1F094CD7AD1CA53D9A0B6705"><enum>(A)</enum><text>shall facilitate
			 communication between the chief driver licensing official of a State, an
			 appropriate official of a Federal agency and other relevant officials, to
			 verify the authenticity of documents, as appropriate, issued by such Federal
			 agency or entity and presented to prove the identity of an individual;</text>
					</subparagraph><subparagraph id="H34580CC65AED43129E3749C5C2322222"><enum>(B)</enum><text>may not infringe
			 on a State’s power to set criteria concerning what categories of individuals
			 are eligible to obtain a driver’s license or personal identification card from
			 that State;</text>
					</subparagraph><subparagraph id="H0FB53E06DE054F179184106088503B0A"><enum>(C)</enum><text>may not require a
			 State to comply with any such regulation that conflicts with or otherwise
			 interferes with the full enforcement of State criteria concerning the
			 categories of individuals that are eligible to obtain a driver's license or
			 personal identification card from that State;</text>
					</subparagraph><subparagraph id="HC040F634A42A4E13B5EDB6CE8CBF8FEB"><enum>(D)</enum><text>may not require a
			 single design to which driver's licenses or personal identification cards
			 issued by all States must conform;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDB2994E4C82E4E8D9E9FDBB5FA59CF1C"><enum>(E)</enum><text>shall include
			 procedures and requirements to protect the privacy rights of individuals who
			 apply for and hold driver's licenses and personal identification cards;</text>
					</subparagraph><subparagraph id="HFCE9542E954E4DDF85367363651B42FD"><enum>(F)</enum><text>shall include
			 procedures and requirements to protect the Federal and State constitutional
			 rights and civil liberties of individuals who apply for and hold driver’s
			 licenses and personal identification cards;</text>
					</subparagraph><subparagraph id="HCC12503E1E6348958A905657036042A6"><enum>(G)</enum><text>shall not permit
			 the transmission of any personally identifiable information except for in
			 encrypted format;</text>
					</subparagraph><subparagraph id="H97C1423658344381A5F61FD4D5CC58F4"><enum>(H)</enum><text>shall provide
			 individuals with procedural and substantive due process, including promulgating
			 rules and rights of appeal, to challenge errors in data records contained
			 within the databases created to implement this Act;</text>
					</subparagraph><subparagraph id="H0535A5291C8E4B0F89C2FF11900DF3BA"><enum>(I)</enum><text display-inline="yes-display-inline">shall not permit private entities to scan
			 the information contained on the face of a license, or in the machine readable
			 component of the license, and resell, share, or trade that information with any
			 other third parties, nor shall private entities be permitted to store the
			 information collected for any other than fraud prevention purposes;</text>
					</subparagraph><subparagraph id="H90675FF68EF844F39DA80F2E86236E62"><enum>(J)</enum><text>shall not preempt
			 State privacy laws that are more protective of personal privacy than the
			 standards, or regulations promulgated to implement this Act;</text>
					</subparagraph><subparagraph id="HE588CA4D27E0460C90E685BE6AB43C1F"><enum>(K)</enum><text>may provide for
			 excluding from a driver’s license or personal identification card an address of
			 principal residence in circumstances which justify such an exclusion, such as
			 for reasons of personal security of domestic violence victims or judges or
			 other law enforcement officials;</text>
					</subparagraph><subparagraph id="HC83234271D074253BF50436C091805EB"><enum>(L)</enum><text>shall not infringe
			 on a State’s power to reasonably accommodate a person’s sincerely held
			 religious belief in granting a driver’s license or personal identification
			 card; and</text>
					</subparagraph><subparagraph id="H80206E49FBB941E4885412E8D310196F"><enum>(M)</enum><text>shall not require
			 verification of birth certificates until a nationwide system is designed and
			 implemented to facilitate such verification.</text>
					</subparagraph></paragraph></subsection><subsection id="HDD8F1E36E757435FA24341699B6D986D"><enum>(d)</enum><header>Grants to
			 States</header>
				<paragraph id="H3045E4F3E71A486F8255EF997553D6F0"><enum>(1)</enum><header>Assistance in
			 meeting Federal standards</header><text>Beginning on the date a final
			 regulation is promulgated under subsection (b)(2), the Secretary of Homeland
			 Security shall award grants to States to assist them in conforming to the
			 minimum standards for driver's licenses and personal identification cards set
			 forth in the regulation.</text>
				</paragraph><paragraph id="H5E6F5AA737A144B99D192F96F2A93BAC"><enum>(2)</enum><header>Allocation of
			 grants</header><text>The Secretary of Homeland Security shall award grants to
			 States under this subsection based on the proportion that the estimated average
			 annual number of driver's licenses and personal identification cards issued by
			 a State applying for a grant bears to the average annual number of such
			 documents issued by all States.</text>
				</paragraph><paragraph id="H97E78024052E45B08B77A7B9A2549583"><enum>(3)</enum><header>Minimum
			 allocation</header><text>Notwithstanding paragraph (2), each State shall
			 receive not less than 0.5 percent of the grant funds made available under this
			 subsection.</text>
				</paragraph><paragraph id="H17380C36E9FD4C688079E205B5F56735"><enum>(4)</enum><header>Separate
			 funding</header><text>Funds appropriated for grants under this section may not
			 be commingled with other grant funds administered by the Department of Homeland
			 Security and may not be used for any purpose other than the purpose set forth
			 in paragraph (1).</text>
				</paragraph></subsection><subsection id="HF913981AF3B048D0B164AAD883621FC7"><enum>(e)</enum><header>Extension of
			 effective date</header><text>The Secretary of Homeland Security may extend the
			 date specified under subsection (b)(1)(A) for up to 2 years for driver’s
			 licenses issued by a State if the Secretary determines that the State made
			 reasonable efforts to comply with the date under such subsection but was unable
			 to do so.</text>
			</subsection></section><section id="H4A2A55A20191410EA66BCDAB28B97E1D"><enum>4.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to the Secretary of Homeland Security
			 $300,000,000 for each of the fiscal years 2010 through 2017 to carry out this
			 Act.</text>
