		<section id="H07559EA5A2714A96BF1BE53461E627D2" section-type="section-one"><enum>1.</enum><header>Short title;
			 findings</header>
			<subsection id="H8647923483714837915E0B7D6F66AE9D"><enum>(a)</enum><header>Short
			 title</header><text display-inline="yes-display-inline">This Act may be cited
			 as the <quote><short-title>Small Business Credit Card Act
			 of 2009</short-title></quote>.</text>
			</subsection><subsection id="HCA472EB7909F47C2B8ABAF372DD4BFE2"><enum>(b)</enum><header>Findings</header><text>The
			 Congress finds as follows:</text>
				<paragraph id="H5897DEDA139C418BB7B722C90CB29E5B"><enum>(1)</enum><text display-inline="yes-display-inline">In past recessions, economic recovery has
			 frequently been led by the creation of millions of new, small
			 businesses.</text>
				</paragraph><paragraph id="H2C18F775EAE04F55A450E9DC3AD60DFA"><enum>(2)</enum><text>Today, however,
			 small business owners are severely limited in their ability to finance new
			 business ventures because their access to capital through their usual resources
			 has dried up, and the lack of access continues to grow.</text>
				</paragraph><paragraph id="HA02DE8447B204816AD34D9E5D5D16651"><enum>(3)</enum><text>Small businesses
			 are being pushed into using credit cards as their primary source of working
			 capital.</text>
				</paragraph><paragraph id="HE335B24D567B45599671B3E3AE8682D2"><enum>(4)</enum><text>This use of credit
			 card credit is especially true for rapidly growing businesses that are not
			 traditional brick and mortar operations, and lack the assets necessary for a
			 traditional loan.</text>
				</paragraph><paragraph id="HACCF0A6951514C57817022023477FCB6"><enum>(5)</enum><text>Yet, 28 percent of
			 businesses surveyed recently said they had been subject to a decrease in their
			 line of credit or a credit card limit in the past 6 months.</text>
				</paragraph><paragraph id="HC7F729F02477486C907241E6B8B299B8"><enum>(6)</enum><text>And, this decrease
			 in credit card limits occurred despite the fact that 69 percent of the small
			 businesses in the survey cited worsening credit card terms.</text>
				</paragraph><paragraph id="H5D0331C95BEE43CD8243EED63D54083B"><enum>(7)</enum><text>In 2008, 44
			 percent of the small businesses surveyed used credit cards to finance their
			 business.</text>
				</paragraph><paragraph id="H9BD288AE6A2045AA969CDD6F6400B1B4"><enum>(8)</enum><text>In 1993, only 16
			 percent of small businesses used credit cards as a source of financing.</text>
				</paragraph><paragraph id="H825086B6B09C43888299F1766FFCE919"><enum>(9)</enum><text>One-third of small
			 businesses using credit cards carry a monthly balance in excess of
			 $10,000.</text>
				</paragraph></subsection></section><section id="HDDBBBF162AD246C5BBA7D9E9B54813B8"><enum>2.</enum><header>Extending credit
			 card protections under the Truth in Lending Act to small businesses</header>
			<subsection id="HA2E622ED3DF441CABF20DAF6F35ADA4B"><enum>(a)</enum><header>Definition of
			 consumer</header><text display-inline="yes-display-inline">Section 103(h) of
			 the Truth in Lending Act (15 U.S.C. 1602(h)) is amended—</text>
				<paragraph id="H426E8EBD89B64AA98FC0203544AA81DB"><enum>(1)</enum><text>by striking
			 <quote>(h) The adjective <quote>consumer</quote>, used with reference to a
			 credit transaction, characterizes the transaction as one in which the party to
			 whom credit is offered or extended is</quote> and
			 inserting</text>
					<quoted-block display-inline="yes-display-inline" id="H2783403908574453A2D19809EDEA66FF" style="OLC">
						<text>(h)
			 <header-in-text level="subsection" style="OLC">Consumer</header-in-text>.—</text><paragraph id="H65B25C2CFEA248548E1A2B1D0C304BD2"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided in
				paragraph (2), the term <quote>consumer</quote>, when used as a adjective to
				describe or modify a credit transaction or credit plan, means a transaction or
				credit plan under which credit is offered or extended
				to</text>
						</paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H1BF14CDE03B9498C946881A3D3E7D51C"><enum>(2)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H0342C3FAC382483FACAE88EFBB21A965" style="OLC">
						<paragraph id="H7889F09D71994308AA631DCB2FAC46F3"><enum>(2)</enum><header>Small business
				included under certain circumstances</header>
							<subparagraph id="H51833F8C8BA548DF92C3246D624AA924"><enum>(A)</enum><header>In
				general</header><text>For purposes of any provision of this title relating to a
				credit card account under an open end credit plan, the term ‘consumer’ includes
				any qualified small business.</text>
							</subparagraph><subparagraph id="H52E33ADC58D1406FABAC285F282CF26C"><enum>(B)</enum><header>Qualified small
				business</header><text>For purposes of subparagraph (A), the term
				<quote>qualified small business</quote> means, with respect to any credit card
				account under an open end credit plan, any business concern having 50 or fewer
				employees, whether or not—</text>
								<clause id="H5C2027B6262542539E67DB839A1833FD"><enum>(i)</enum><text>the credit card
				account is in the name of an individual or a business entity; and</text>
								</clause><clause id="HC50768F133574EA7B04337020146B434"><enum>(ii)</enum><text>any credit
				transaction involving such account is for business or personal purposes.</text>
								</clause></subparagraph><subparagraph id="H4BCE3E490C804C80B2B90C47BB2BF654"><enum>(C)</enum><header>Exclusion of
				small business after <quote>opt out</quote> effective date</header><text>The
				term <quote>qualified small business</quote> shall not include any business
				concern described in subparagraph (A) after the effective date of any election
				under section 135(b) by the individual or business for which the credit card
				account referred to in such subparagraph has been established, so long as such
				election remains in
				effect.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HC3B6D1EBE86646D3BDA68B5802C81B77"><enum>(b)</enum><header>Amendments to
			 exemptions</header><text>Section 104 of the Truth in Lending Act (15 U.S.C.
			 1603) is amended—</text>
				<paragraph id="H535AF319E071484387D5F5F3CE84FEC4"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="H4BFB90DD159D47ADA2AFF365244B66FA"><enum>(A)</enum><text>by inserting
			 <quote>other than a credit transaction under an open end consumer credit plan
			 in which the consumer is a qualified small business</quote> after
			 <quote>agricultural purposes</quote>; and</text>
					</subparagraph><subparagraph id="H4688EA9CD673462CB480001D10290541"><enum>(B)</enum><text>by inserting
			 <quote>other than qualified small businesses</quote> after
			 <quote>organizations</quote>; and</text>
					</subparagraph></paragraph><paragraph id="H2A3E1CC40ED64D5E93903FAB360685F1"><enum>(2)</enum><text>in paragraph (3),
			 by striking <quote>$25,000</quote> and inserting <quote>$50,000</quote>.</text>
				</paragraph></subsection><subsection id="H47579A2160AF4D60A242125132EFE651"><enum>(c)</enum><header>Business credit
			 card amendments</header><text>Section 135 of the Truth in Lending Act (15
			 U.S.C. 1645) is amended—</text>
				<paragraph id="HCD380CCC1E6C47CEBB90D8D0E801FF36"><enum>(1)</enum><text>by striking
			 <quote>The exemption provided by</quote> and inserting <quote>(a)
			 <header-in-text level="subsection" style="OLC">In general</header-in-text>.—The
			 exemption provided by</quote>; and</text>
				</paragraph><paragraph id="H4BC95720E80745E2B643D822FD5A021A"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H52D969FA1DB740B992466FCDED0738D6" style="OLC">
						<subsection id="H4DF13049794E47F49282AAA7B67C9602"><enum>(b)</enum><header>Qualified small
				business opt out from coverage</header>
							<paragraph id="H94CEC54E3D544A238AA38AB1200B7C4E"><enum>(1)</enum><header>Notice of
				coverage</header><text display-inline="yes-display-inline">The disclosures
				under section 127(a) before opening a credit card account under an open end
				credit plan for a qualified small business shall include a clear and
				conspicuous disclosure—</text>
								<subparagraph id="HDBBCD9EA637548C4B98FA2EE47A4FD61"><enum>(A)</enum><text display-inline="yes-display-inline">that the qualified small business is
				treated as a consumer under this title and is subject to the requirements of
				this title as a consumer;</text>
								</subparagraph><subparagraph id="HF5C377CDB4934D2E893BB76DA2A6CDC7"><enum>(B)</enum><text display-inline="yes-display-inline">that the business may elect, in accordance
				with this subsection, to be exempt, under section 104(1), from this title to
				the same extent as any business other than a qualified small business;
				and</text>
								</subparagraph><subparagraph id="H714D90E195F841FEB221F4F3B3C4F0AA"><enum>(C)</enum><text>of the procedures
				for making the election and for subsequently revoking any such election.</text>
								</subparagraph></paragraph><paragraph id="H8D68A96CBE3A4C8A90060B0EB9FE15A7"><enum>(2)</enum><header>Election</header><text>The
				Board shall prescribe procedures for making an effective election under this
				subsection and for revoking any such election.</text>
							</paragraph><paragraph id="H7ECA1F3D4D7C4898A45600502946543B"><enum>(3)</enum><header>Prohibition on
				discrimination against qualified small business</header><text display-inline="yes-display-inline">No creditor may—</text>
								<subparagraph id="H73475F353FE24F6EA5EFE97F9E18D4CB"><enum>(A)</enum><text>discriminate
				against any business concern having 50 or fewer employees in connection with
				any credit card account of, or any application for a credit card account by
				such business, under an open end credit plan on any basis; or</text>
								</subparagraph><subparagraph id="HA1EFEA57185E475A8C9A64B16EB1389B"><enum>(B)</enum><text>require any
				qualified small business to make an election under this subsection as a
				condition for opening a credit card account, or for providing more advantageous
				terms for any credit card account, under an open end credit
				plan.</text>
