		<official-title>To amend the Post-Katrina Emergency Management Reform Act
		  of 2006 to direct the Administrator of the Federal Emergency Management Agency
		  to develop lifecycle plans and tracking procedures for housing units provided
		  to individuals and households to respond to disaster-related housing needs, and
		  for other purposes.</official-title>

		<section id="H97394A30B20E44658DB6C4C3CFA4FDB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Smart Housing in Disasters Act of
			 2009</short-title></quote>.</text>
		</section><section id="H5B1C0023120444E3B9E47E88C961BFB"><enum>2.</enum><header>Definition of
			 major disaster</header><text display-inline="no-display-inline">Section 102(2)
			 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42
			 U.S.C. 5122(2)) is amended by inserting <quote>catastrophic incident (as
			 defined in section 501 of the Homeland Security Act (6 U.S.C. 311),</quote>
			 before <quote>, or, regardless of cause</quote>.</text>
		</section><section id="H8781B60729174E16962E1EC49D3C0000"><enum>3.</enum><header>Lifecycle and
			 tracking plan</header><text display-inline="no-display-inline">Section 683 of
			 the Post-Katrina Emergency Management Reform Act of 2006 (6 U.S.C. 772) is
			 amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H3ADD617E0B2D4B6B86A4117605B9ADD" style="OLC">
				<subsection id="HF38D18F335D84FFA004FB3DEB4659127"><enum>(e)</enum><header>Annex to
				National Disaster Housing Strategy</header>
					<paragraph id="H7102EE5D488B40F58355891B8F009463"><enum>(1)</enum><header>Development of
				lifecycle and tracking plan</header><text>The Administrator shall develop a
				lifecycle and tracking plan for housing units provided to individuals and
				households affected by an emergency or major disaster under the Robert T.
				Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5121 et seq.)
				that establishes polices for procurement, delivery, installation, maintenance,
				deactivation, and disposal of the units.</text>
					</paragraph><paragraph id="H3E8CE0E93E3648949493A53751E22C7B"><enum>(2)</enum><header>Contents</header><text>The
				plan shall—</text>
						<subparagraph id="HBC6AF70D4BA14E38BB88F267ABE0DA58"><enum>(A)</enum><text>emphasize the
				acquisition of housing units that can be recycled and reused for multiple
				emergencies or major disasters; and</text>
						</subparagraph><subparagraph id="HFFC4894985504F279787C718CAD72A6"><enum>(B)</enum><text>include a process
				for the Administrator to track each housing unit from the date of acquisition
				of the unit through the date of disposal of the unit.</text>
						</subparagraph></paragraph><paragraph id="H606D6E1041DB48428F5823D96000804B"><enum>(3)</enum><header>Report to
				Congress</header><text>Not later than 180 days after the date of enactment of
				this subsection, the Administrator shall submit to the Committee on Homeland
				Security of the House of Representatives a report containing the plan.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H763C13C0B66443818C00F89501F936EA"><enum>4.</enum><header>Disposal of
			 housing units unsuitable for habitation</header><text display-inline="no-display-inline">Section 408(d)(2) of the Robert T. Stafford
			 Disaster Relief and Emergency Assistance Act (42 U.S.C. 5174(d)(2)) is amended
			 by adding at the end the following:</text>

				<subparagraph id="HDDF37E260AEE4CE1009C027B197BFF3E"><enum>(C)</enum><header>Disposal of
				housing units unsuitable for habitation</header>
					<clause id="HF831C54445B9414CA395594EE6A0A3AF"><enum>(i)</enum><header>In
				general</header><text>If the President determines that a housing unit is
				unsuitable for habitation, before disposal of the unit through sale to a
				recycler or other purchaser, the President shall alter the unit in a manner
				that will prevent the unit from being used for habitation.</text>
					</clause><clause id="HE8C76D365EA842B1A89EF7B923C2EF43"><enum>(ii)</enum><header>Relationship to
				other laws</header><text>Nothing in this subparagraph shall affect the
				President’s ability to dispose of surplus real property in accordance with
				section 545(b)(8) of title 40, United States Code.</text>
