		<official-title>To amend title XVIII of the Social Security Act to make
		  temporary improvements to the Medicare inpatient payment adjustment for
		  low-volume hospitals, and for other purposes.</official-title>

		<section id="H5B9F9569BEDB4E3C9B4957867216AE54" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Medicare Support for Rural Hospitals
			 Act</short-title></quote>.</text>
		</section><section id="idBD18CE53596443C793C3950C96059A01"><enum>2.</enum><header>Temporary
			 improvements to the medicare inpatient hospital payment adjustment for
			 low-volume hospitals</header>
			<subsection id="H714F415C0BC343AB85D03BE4D7BCF55"><enum>(a)</enum><header>In
			 General</header><text>Section 1886(d)(12) of the Social Security Act (42 U.S.C.
			 1395ww(d)(12)) is amended—</text>
				<paragraph id="HD0BF200054864937AEAF442BA6D8A07C"><enum>(1)</enum><text>in subparagraph
			 (A), by inserting <quote>or (D) (for discharges occurring in fiscal year
			 2010)</quote> after <quote>subparagraph (B)</quote>;</text>
				</paragraph><paragraph id="H760E4F96EC17449D00376021E719AFCE"><enum>(2)</enum><text>in subparagraph
			 (B), by striking <quote>The Secretary</quote> and inserting <quote>Except as
			 provided in subparagraph (D), the Secretary</quote>;</text>
				</paragraph><paragraph id="HBE5D32A4DA094B29A083AB9BEC855987"><enum>(3)</enum><text>in subparagraph
			 (C)(i)—</text>
					<subparagraph id="H99568A72F4C04F55AF0000D1D41ECFBD"><enum>(A)</enum><text>by inserting
			 <quote>(or, with respect to fiscal year 2010, 15 road miles)</quote> after
			 <quote>25 road miles</quote>; and</text>
					</subparagraph><subparagraph id="H84A9C6DEE6B64B078F00AF42DCDA9D83"><enum>(B)</enum><text>by inserting
			 <quote>(or, with respect to fiscal year 2010, 1,500 discharges of individuals
			 entitled to, or enrolled for, benefits under part A)</quote> after <quote>800
			 discharges</quote>; and</text>
					</subparagraph></paragraph><paragraph id="H59748995807C461E8CB17400D1738BFF"><enum>(4)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block id="H28FD0F19E4C14631B9F05E03601C72A3" style="OLC">
						<subparagraph id="H6B0F053093644D5F80DF1C769D12431"><enum>(D)</enum><header>Temporary
				applicable percentage increase</header><text>For discharges occurring in fiscal
				year 2010, the Secretary shall determine an applicable percentage increase for
				purposes of subparagraph (A) using a continuous linear sliding scale ranging
				from 25 percent for low-volume hospitals with 200 or fewer discharges of
				individuals entitled to, or enrolled for, benefits under part A in the fiscal
				year to 0 percent for low-volume hospitals with greater than 1,500 discharges
				of such individuals in the fiscal
				year.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H3771EA924DB747ED91B888A60608AB5B"><enum>(b)</enum><header>Implementation</header><text>Notwithstanding
			 any other provision of law, the Secretary of Health and Human Services may
			 implement the amendments made by subsection (a) by program instruction or
			 otherwise.</text>
			</subsection></section><section id="H12D4D531381D4963829163FFB61FB48"><enum>3.</enum><header>Use
			 of non-wage adjusted pps rate under the medicare-dependent hospital (mdh)
			 program</header>
			<subsection id="HF197A1EA42324276BC9BA618D927009B"><enum>(a)</enum><header>In
			 General</header><text>Section 1886(d)(5)(G) of the Social Security Act (42
			 U.S.C. 1395ww(d)(5)(G)) is amended by adding at the end the following new
			 clause:</text>
				<quoted-block id="H642A831421DF43269D00DD037E80CAE0" style="OLC">
					<subsection id="HC4DF8B3A80224BD086B2CBB4968BA8F8"><enum>(v)</enum><text>In the case of
				discharges occurring on or after October 1, 2009, and before October 1, 2010,
				in determining the amount under paragraph (1)(A)(iii) for purposes of clauses
				(i) and (ii)(II), such amount shall, if it results in greater payments to the
				hospital, be determined without regard to any adjustment for different area
				wage levels under paragraph
				(3)(E).</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5977E7374C2040CEBDF30966CCEEA4E6"><enum>(b)</enum><header>Implementation</header><text>Notwithstanding
			 any other provision of law, the Secretary of Health and Human Services may
			 implement the amendment made by subsection (a) by program instruction or
			 otherwise.</text>
			</subsection></section><section id="HBAC95C44ECEA466EA44B88CBEE08CC99"><enum>4.</enum><header>Repeal of section
			 211 of Public Law 111–3</header><text display-inline="no-display-inline">Section 211 of Public Law 111–3 is
			 repealed.</text>
