		<official-title>To authorize the National Telecommunications and
		  Information Administration of the Department of Commerce to make grants for the
		  establishment of information technology centers in rural
		  areas.</official-title>

		<section id="HB990C63B84844A689F0A9185CF1401C4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Rural Information Technology
			 Investment Act</short-title></quote>.</text>
		</section><section id="HEC3E1B4DB9CC48A1821BB035F7BBC7FA"><enum>2.</enum><header>Grants for rural
			 information technology centers</header><text display-inline="no-display-inline">Part C of the National Telecommunications
			 and Information Administration Organization Act is amended by inserting after
			 section 158 (47 U.S.C. 942) the following new section:</text>

				<section id="H4F73649015384AF09149E991E74F415D"><enum>159.</enum><header>Grants for
				rural information technology centers</header>
					<subsection id="H40BAF2563D1846F39BFCE49EB7469B24"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">The NTIA shall make grants to eligible
				entities, and determine (subject to
				<internal-xref idref="H06A692E60B5A45C2AA3766C7E38ACADC" legis-path="159.(e)">subsection (e)</internal-xref>) the amount of such grants,
				for the establishment of information technology centers in rural areas.</text>
					</subsection><subsection id="H060043F7E9254BDB8E373E1A49CAA9EC"><enum>(b)</enum><header>Eligible
				entities</header><text>Eligible entities may be—</text>
						<paragraph id="HCA45558DEAE5414BA1F1CAA9CCC49576"><enum>(1)</enum><text display-inline="yes-display-inline">any small business or not-for-profit
				organization or business operating in a rural area, as determined by the NTIA;
				and</text>
						</paragraph><paragraph id="H8D09FC2AAE9E4080A81057D949DA51B2"><enum>(2)</enum><text>any State, local,
				or tribal government serving such an area.</text>
						</paragraph></subsection><subsection id="H0C4474D8DC314C46BC74085D615A1E6B"><enum>(c)</enum><header>Application</header>
						<paragraph id="HA5F0507E6BB343298944118E0EDEBE92"><enum>(1)</enum><header>In
				general</header><text>To receive a grant under this Act, an eligible entity
				shall submit an application to the NTIA in such time and manner, and having
				such content, as the NTIA may by rule require.</text>
						</paragraph><paragraph id="H4085F69212B344E9A0B314BD9CB2443B"><enum>(2)</enum><header>Matching
				required</header><text>An eligible entity shall include in the application an
				assurance that the entity will provide, from State, local, or tribal government
				sources, an amount equal to not less than 15 percent of the grant amount in
				order to carry out the establishment of the information technology center under
				the grant.</text>
						</paragraph></subsection><subsection id="H2803EE4475A147BAB640724BF99CA42D"><enum>(d)</enum><header>Priority</header><text>In
				making grants under this Act, the NTIA shall—</text>
						<paragraph id="H8149054941E0462583265965A85645E0"><enum>(1)</enum><text>give priority to
				eligible entities that—</text>
							<subparagraph id="H09D3C859E4914B30B864DB251CDE6CF6"><enum>(A)</enum><text display-inline="yes-display-inline">promote information technology research and
				development at any institution of higher education (as such term is defined in
				section 102 of the Higher Education Act of 1965 (20 U.S.C. 1002)) serving a
				rural area;</text>
							</subparagraph><subparagraph id="HAC2DE3A9D1434AD399EDDBA189EF3095"><enum>(B)</enum><text>are located in a
				county with an unemployment rate, as determined on the basis the most recent
				data available from the Bureau of Labor Statistics, of at least 1.1 times the
				national unemployment rate for the period to which such data relate;</text>
							</subparagraph><subparagraph commented="no" id="H4D47A7E4B4524356BB98FAD977F53E8C"><enum>(C)</enum><text>are certified by
				the Small Business Administration as qualified HUBZone small businesses;
				or</text>
							</subparagraph><subparagraph commented="no" id="H860D0E18B00549C183A00122D0FF2657"><enum>(D)</enum><text>work in
				conjunction with a local Workforce Investment Board (established pursuant to
				section 117 of the Workforce Investment Act of 1998 (29 U.S.C. 2832));
				and</text>
							</subparagraph></paragraph><paragraph id="H17585C3AA0A74F09A49263654B6B446F"><enum>(2)</enum><text display-inline="yes-display-inline">take into consideration—</text>
							<subparagraph id="H49C701C8BB5147149C5236C1BEC734BF"><enum>(A)</enum><text>the comprehensive
				nationwide inventory map of existing broadband service capability and
				availability in the United States developed and maintained pursuant to section
				6001(<italic>l</italic>) of division B of the American Recovery and
				Reinvestment Act of 2009 (PL 111–5; 123 Stat. 516) or any other applicable data
				administered by a State, local, or tribal agency; and</text>
							</subparagraph><subparagraph id="HE2339C5297394C51A98399CDC9380E4E"><enum>(B)</enum><text display-inline="yes-display-inline">the availability of service capabilities in
				the area for which the eligible entity is applying for with reference to such
				map, and the speed of Internet service, and other relevant factors.</text>
							</subparagraph></paragraph></subsection><subsection id="H06A692E60B5A45C2AA3766C7E38ACADC"><enum>(e)</enum><header>Determination of
				amounts</header><text display-inline="yes-display-inline">In determining the
				amount of each grant awarded for a fiscal year under this section, the NTIA
				shall specify a minimum amount and such amount may be renewed for up to one
				year upon a finding by the NTIA that the grant recipient has satisfied
				<internal-xref idref="HF7AF345BD9744B8F80C3ACF86A0291E9" legis-path="159.(f)">subsection (f)</internal-xref>.</text>
					</subsection><subsection id="HF7AF345BD9744B8F80C3ACF86A0291E9"><enum>(f)</enum><header>Audits</header><text display-inline="yes-display-inline">Each grant recipient under this section
				shall undergo an audit administered by the NTIA. The NTIA shall report findings
				of the audits to Congress on an annual basis.</text>
					</subsection><subsection id="HD401F590D27F41EDAEDC9AFA041B6280"><enum>(g)</enum><header>Authorization of
				Appropriations</header><text>There is authorized to be appropriated $10,000,000
				for each of fiscal years 2010 through 2012 to carry out this section.</text>
					</subsection><subsection id="H6764D42A40C14FFC8088DF0236B07A25"><enum>(h)</enum><header>Definitions</header><text>As
				used in this section—</text>
						<paragraph id="HAA38B948D2FD45C184324FF855D48D7B"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>information
				technology</term> means the use of hardware, software, services, and supporting
				infrastructure to manage and deliver information using voice, data, and video
				by means of a computer or data network or networks;</text>
						</paragraph><paragraph id="H7A6E8802DE4E428BB5D27D3FF3BC29E6"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>information technology
				center</term> means a for-profit or not-for-profit business venture that offers
				information technology services including application maintenance and support,
				application development, help desk services, personal computer maintenance and
				support, network management, data center management, database management,
				server management, or web hosting, and is designed to expand high tech job
				opportunities in rural areas; and</text>
						</paragraph><paragraph commented="no" id="HC1E832A8F9E74AE18323F50CDFF905B0"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>rural area</term> means the
				terms ‘rural' and ‘rural area' mean any area other than—</text>
							<subparagraph id="HD5BB7A358A7240D892A14450A66E0BEF"><enum>(A)</enum><text>a city or town
				that has a population of greater than 50,000 inhabitants; and</text>
							</subparagraph><subparagraph id="H5F77A40FFDCF41C1B6B26680B6789EC3"><enum>(B)</enum><text>the urbanized area
				contiguous and adjacent to such a city or
				town.</text>
							</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
