		  Omnibus Crime Control and Safe Streets Act of 1968 to improve assistance to
		  domestic and sexual violence victims and provide for technical

		<section id="H8F79CDCFCA974449A6312BD4E214AB1E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Improving Assistance to Domestic and
			 Sexual Violence Victims Act of 2009</short-title></quote>.</text>
		</section><section commented="no" id="HE5E00664FA564C9EB93EAB33311D7A7D"><enum>2.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">Except as otherwise
			 provided in this Act, this Act and the amendments made by this Act shall take
			 effect at the beginning of fiscal year 2010.</text>
		</section><section id="H795950DDF90B4CA2ADAAAE1900FEDFFF"><enum>3.</enum><header>Definitions and
			 universal grant conditions under VAWA</header>
			<subsection id="H1B530F03DA994CEE8688DB07485CBFF9"><enum>(a)</enum><header>Youth
			 definition</header><text>Section 40002(a)(37) of the Violence Against Women Act
			 of 1994 (42 U.S.C. 13925(a)(37)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HC6BFCBC316A34BF88C4C57A75376FAF0" style="OLC">
					<paragraph id="HF2F02D11342D41CEB9B7D30538D5CA1C"><enum>(37)</enum><header>Youth</header><text>The
				term <term>youth</term> means an individual who is between 12 and 24 years of
				age.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD725121516454BD283AF282E1A2EDACF"><enum>(b)</enum><header>Trained examiner
			 definition</header><text>Section 40002(a) of the Violence Against Women Act of
			 1994 (42 U.S.C. 13925(a)) is amended by inserting at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H3EE182C48D0148FE8EA2F6E3E873B01A" style="OLC">
					<paragraph id="H92EF2F62190E475BBEB363F6B05F3A96"><enum>(38)</enum><header>Trained
				examiner</header><text>The term <term>trained examiner</term> means a health
				care professional who has received specialized training specific to sexual
				assault victims which includes both gathering forensic evidence and medical
				needs.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HBFC5E360EB414847BA10099B28DB34B2"><enum>(c)</enum><header>Personal
			 information</header><text>Section 40002(a)(18) of the Violence Against Women
			 Act of 1994 (42 U.S.C. 13925(a)(18)) is amended by inserting after
			 <quote>stalking,</quote> the following: <quote>regardless of whether the
			 information is encoded, encrypted, hashed, or otherwise
			 protected,</quote>.</text>
			</subsection><subsection id="HC2E1274486C144EC96E9CC9924C5B3B8"><enum>(d)</enum><header>Expertise
			 requirement</header><text>Section 40002(b)(11) of the Violence Against Women
			 Act of 1994 (42 U.S.C. 13925(b)(11)) is amended by adding at the end the
			 following: <quote>The Director of the Office on Violence Against Women shall
			 ensure that training or technical assistance will be developed and provided by
			 entities having demonstrated expertise in the purposes, uses of funds, and
			 other aspects of the grant program for which such training or technical
			 assistance is provided.</quote>.</text>
			</subsection><subsection id="HA065A884E5EB41E2B10AB08F4B6404E9"><enum>(e)</enum><header>Matching
			 requirement</header><text>Section 40002(b)(1) of the Violence Against Women Act
			 of 1994 (42 U.S.C. 13925(b)(1)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HD7A286890D7B4EC18AF7CF87B28314F2" style="OLC">
					<paragraph id="H1ECEA270100A4AC5B125AA9DF2CF396B"><enum>(1)</enum><header>Match</header><text display-inline="yes-display-inline">No matching funds shall be required for a
				grant or subgrant made under this title for—</text>
						<subparagraph id="H2025EEFADFBD49FCBC757D3E61F4DC9F"><enum>(A)</enum><text>any tribe,
				territory, or victim service provider; or</text>
						</subparagraph><subparagraph id="H564BA4A569674C2BA5A5ACEC7502CF7D"><enum>(B)</enum><text>any other entity,
				including a State, that the Attorney General determines has adequately
				demonstrated financial
				need.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H09E9867EAA2B4ABBAF7D63CD988AEF22"><enum>(f)</enum><header>Treatment of
			 confidential information</header><text>Section 40002(b)(2) of the Violence
			 Against Women Act of 1994 (42 U.S.C. 13925(b)(2)) is amended—</text>
				<paragraph id="HA4B744E5F86445AA87F6AB684F14393C"><enum>(1)</enum><text>in subparagraph
			 (A), by inserting <quote>privacy and</quote> before
			 <quote>safety</quote>;</text>
				</paragraph><paragraph id="H47237BB1F94A49FE921DEA80D6E1FF38"><enum>(2)</enum><text>in subparagraph
			 (B)—</text>
					<subparagraph id="H74FFE108EE7E4B3AA3B158F7C55D7AC7"><enum>(A)</enum><text>by striking
			 <quote>and (D)</quote> and inserting <quote>, (D), (E), (F), (G), and
			 (H)</quote>;</text>
					</subparagraph><subparagraph id="HAB0DD8A1FD054D8A9C184179AC47F42E"><enum>(B)</enum><text>in clause
			 (i)—</text>
						<clause id="HB832C79C44404A8FA9A16E082DD3934C"><enum>(i)</enum><text>by
			 inserting <quote>, reveal, or release</quote> after <quote>disclose</quote>;
			 and</text>
						</clause><clause id="H35E2685C283E4F41A2408485ADA28988"><enum>(ii)</enum><text>by
			 inserting <quote>, regardless of whether the information is encoded, encrypted,

			 (ii)—</text>
						<clause id="H2C0ECE32DFA34370AB7A7B8553E7FE92"><enum>(i)</enum><text>by
			 striking <quote>reveal</quote> and inserting <quote>disclose, reveal, or
			 release</quote>;</text>
						</clause><clause id="HFF575B2E8DF547F79209B205E11C439F"><enum>(ii)</enum><text>by
			 striking <quote>consent</quote> each place it appears and inserting
			 <quote>consent or authorization</quote>; and</text>

						</clause></subparagraph></paragraph><paragraph id="H05F8722D6CDD4F79BE489AF10EA4913A"><enum>(3)</enum><text>in subparagraph
			 (C)—</text>
					<subparagraph id="H54106047541E4B1798BFAA7E5E575F6D"><enum>(A)</enum><text>by inserting
			 <quote>disclosure, revelation, or</quote> after <quote>If</quote>;</text>
					</subparagraph><subparagraph id="HEB3F7B2D53D94A938713AE7387E558BA"><enum>(B)</enum><text>in clause (i), by
			 inserting <quote>, revelation, or release</quote> after

					</subparagraph></paragraph><paragraph id="H78633E3BDE3048068A2F0F6B20B133FA"><enum>(4)</enum><text>by redesignating
			 subparagraph (E) as subparagraph (H); and</text>
				</paragraph><paragraph id="HFA56591EDE1C41A2AF6FAA37774CF37B"><enum>(5)</enum><text>by inserting after
			 subparagraph (D) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HEC46AE4AFF744F3E8AF756B59B01ED74" style="OLC">
						<subparagraph id="H857423AC51884A45B246DAA5B174661F"><enum>(E)</enum><header>Statutorily
				permitted reports of abuse or neglect</header><text>Nothing in this paragraph
				shall prohibit a grantee or subgrantee from reporting abuse and neglect, as
				those terms are defined by law, and where mandated or expressly permitted by
				the State, tribe, or territory involved.</text>
						</subparagraph><subparagraph id="H83F15BAC932842A5B846CD54A6F9FB41"><enum>(F)</enum><header>Preemption</header><text>This
				paragraph shall not supersede any other provision of Federal, State, tribal,
				territorial, or local law relating to the privacy or confidentiality of
				information to the extent to which such other provision provides greater
				privacy or confidentiality protection than this paragraph for victims of
				domestic violence, dating violence, sexual assault, or stalking.</text>
						</subparagraph><subparagraph id="H90EDF7BD00F442EB9867300372C08898"><enum>(G)</enum><header>Certain minors
				and persons with guardians</header><text>If a minor or a person with a
				court-appointed guardian is permitted by law to receive services without the
				parent’s or guardian’s consent or authorization, the minor or person with a
				court-appointed guardian may consent to a disclosure, revelation, or release of
				information. In no case may consent or authorization for release of information
				be given by the abuser of the minor, or person with a court-appointed guardian,
				or the abuser of the other parent of the
				minor.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H52C0703CAB9D4F32978E6C2ACDAD4BA5"><enum>4.</enum><header>Criminal
			 justice</header>
			<subsection id="H83FAE670B5074E00BBE8EA87A6CEF977"><enum>(a)</enum><header>Application
			 requirements</header>
				<paragraph id="H2B673529A0C24BDC849B8829539994DF"><enum>(1)</enum><header>In
			 general</header><text>Section 2007(d) of the Omnibus Crime Control and Safe
			 Streets Act of 1968 (42 U.S.C. 3796gg–1(d)) is amended—</text>
					<subparagraph id="H779CCDE62F494DB49A52A6A0540C384F"><enum>(A)</enum><text>in paragraph (3),
			 by striking <quote>and</quote> after the semicolon;</text>
					</subparagraph><subparagraph id="H9AE6794456A341C1A41AC3EB6D640458"><enum>(B)</enum><text>in paragraph (4),
			 by striking the period and inserting <quote>; and</quote>; and</text>
					</subparagraph><subparagraph id="H6C32684BFC04448388303F739A080843"><enum>(C)</enum><text>by inserting at
			 the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H77568BF17ED84AE8BF0A089EAD58CBCC" style="OLC">
							<paragraph id="H76F56AB39385487C879223293C992989"><enum>(5)</enum><text>proof of
				compliance with the requirements prohibiting the publication of protection
				order information on the Internet under section
				2013A.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H1770D87229A042BAB1F0E033FE064E91"><enum>(2)</enum><header>Effective
			 date</header><text>The amendments made by paragraph (1) shall apply to grants
			 awarded for periods beginning on or after October 1, 2009.</text>
				</paragraph></subsection><subsection id="HCD3AE389C2F34C0CA7CE3D40687F32FB"><enum>(b)</enum><header>State and
			 Federal obligations</header><text display-inline="yes-display-inline">Section
			 2007(f) of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C.
			 3796gg–1(f)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H2530D738969943029C668ED8C943B614" style="OLC">
					<subsection id="HA3AD8121B46548AA867CAD28F3099417"><enum>(f)</enum><header>Federal
				share</header>
						<paragraph id="H7FA8106EB8A042B485B209E7A166FE8F"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided
				under paragraph (2), the Federal share of a grant made under this part may not
				exceed 75 percent of the total costs of the projects described in the
				application submitted.</text>
						</paragraph><paragraph id="H9FE1CE68DBB04FE79CDC0D577A0CB10B"><enum>(2)</enum><header>Exemption from
				matching funds</header><text>No matching funds shall be required for that
				portion of a grant under this part that is subgranted to any Indian tribal
				government for victims
				services.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H890D8CCA7DA44A8BA561B58534DB77BA"><enum>(c)</enum><header>Limits on
			 internet publication of protection order information</header><text>Section
			 2265(d) of title 18, United States Code, is amended by striking paragraph
			 (3).</text>
			</subsection><subsection id="H5E07C064B8724F02897C9CA66DAE62EA"><enum>(d)</enum><header>State
			 certification</header><text>Part T of the Omnibus Crime Control and Safe
			 Streets Act of 1968 (42 U.S.C. 3796gg et seq.) is amended by inserting after
			 section 2013 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H89A318A4DA9441DB92D0B1E835C0CA2F" style="OLC">
					<section id="H4E18D6A46D6E49D7B654DBA913EA568E"><enum>2013A.</enum><header>Limits on
				internet publication of protection order information</header>
						<subsection id="H9FEDFD83E774448CBC7BB084FE2EFE87"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">A State, Indian
				tribal government, or unit of local government shall not be eligible to receive
				funds under this part unless the State, Indian tribal government, or unit of
				local government certifies that it does not make available publicly on the
				Internet any information regarding the filing for or issuance, modification,
				registration, extension, or enforcement of a protection order, restraining
				order, or injunction in the issuing or enforcing State, tribal, or territorial
				jurisdiction, if such publication would be likely to publicly reveal the
				identity or location of the party protected under such order or
				injunction.</text>
						</subsection><subsection id="H397E78CC1C45477AAF435DBE855AE58C"><enum>(b)</enum><header>Exception</header><text>A
				State, Indian tribe, or territory may share court-generated and law
				enforcement-generated information about an order or injunction described in
				subsection (a) for purposes of enforcing such orders and injunctions, if such
				information is contained in a secure, governmental registry.</text>
						</subsection><subsection id="H3FA9E668D37449C3BBD15407FC8B6320"><enum>(c)</enum><header>Effective
				date</header><text>A State, Indian tribal government, or unit of local
				government shall meet the requirements of subsections (a) and (b) by not later
				than the later of—</text>
							<paragraph id="H38608351219C4480B1457F82D01D3CBC"><enum>(1)</enum><text>2 years after the
				date of enactment of the <short-title>Improving Assistance
				to Domestic and Sexual Violence Victims Act of 2009</short-title>; or</text>
							</paragraph><paragraph id="H48C6D9FF297D4820870DB3CFC6AAA9C5"><enum>(2)</enum><text>the date on which
				the next session of the State legislature
				ends.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="HFDF8709D7977420CAE714BD2CF812A7B"><enum>(e)</enum><header>Territory</header><text>Section
			 2010 of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C.
			 3796gg–4) is amended—</text>
				<paragraph commented="no" id="H2BB6F19E5161425FA658AD9C374F05C9"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph commented="no" id="H2B7E622C90A2439BA95845C6B59BA6EA"><enum>(A)</enum><text>in paragraph (1),
			 by inserting <quote>Territory,</quote> after <quote>State,</quote>, both places
			 it appears; and</text>

				</paragraph></subsection><subsection id="HD1AB10F04B2C46868E9BC43CC6DA8065"><enum>(f)</enum><header>Rural
			 State</header><text>Section 40002(a)(22) of the Violence Against Women Act of
			 1994 (42 U.S.C. 13925 (a)(22)) is amended by striking <quote>150,000</quote>
			 and inserting <quote>200,000</quote>.</text>
			</subsection><subsection id="H3D5E05D7CC5542139EA4DA434446C81E"><enum>(g)</enum><header>Costs for
			 criminal charges and protection orders</header><text>Section 2011(a)(1) of the
			 Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3796gg–5(a)(1))
			 is amended by inserting <quote>dating violence,</quote> before
			 <quote>stalking</quote>.</text>
			</subsection><subsection id="H786A4308FEDF4D01851829F5F02E3EBB"><enum>(h)</enum><header>Grants To
			 encourage arrest policies and enforcement of protection
			 orders</header><text>Section 2101(c)(4) of the Omnibus Crime Control and Safe
			 Streets Act of 1968 (42 U.S.C. 3796hh(c)(4)) is amended by inserting
			 <quote>dating violence,</quote> before <quote>stalking</quote>.</text>
			</subsection><subsection id="H0EF85893B5AD4676B395091DB4B8D7D7"><enum>(i)</enum><header>Effective
			 date</header><text>The amendments made by subsections (g) and (h) shall take
			 effect 2 years after the date of enactment of this Act.</text>
			</subsection></section><section id="HDF6C0C44115642EFB894E4A11DEFECD3"><enum>5.</enum><header>Families</header>
			<subsection id="H100492DEA9634CB9A7CC53482852BF8E"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 41304 of the
			 Violence Against Women Act of 1994 (42 U.S.C. 14043d–3) is amended—</text>
				<paragraph id="HA1D139B2B1B24738B6AE5E4A070CFF9B"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="H79107161CCD741698EA4F819FCBC2F96"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>Attorney General, acting through the Director of the Office
			 on Violence Against Women, and in collaboration with the Department of Health
			 and Human Services</quote> and inserting <quote>Secretary of Health and Human
			 Services (in this section referred to as the <quote>Secretary</quote>), acting
			 through the Administration for Children, Youth and Families</quote>;</text>
					</subparagraph><subparagraph id="HCC0AFEF7D8DA4B41BB22F359C1DADF59"><enum>(B)</enum><text>in paragraph (2),
			 by striking <quote>Director</quote> and inserting <quote>Secretary</quote>;
			 and</text>
					</subparagraph><subparagraph id="H6D9327C53602480A93D401503FE7EC25"><enum>(C)</enum><text>in paragraph (3),
			 by striking <quote>Director</quote> and inserting <quote>Secretary</quote>;

				assistance</header><text>The resource center established under paragraph (1)
				shall provide information and assistance to—</text>
							<subparagraph id="H6CCC2B22BD314945B1E6706A52EC0982"><enum>(A)</enum><text>employers and
				labor organizations to aid in their efforts to develop and implement responses
				to such violence; and</text>
							</subparagraph><subparagraph id="H91F045598A0C486EAD34FFF71F8F366F"><enum>(B)</enum><text>victim service
				providers, including community-based organizations, State domestic violence
				coalitions, State sexual assault coalitions, and tribal coalitions, to enable
				to the providers to provide resource materials or other assistance to
				employers, labor organizations, or
				employees.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" id="H968BF2C122564FBD8BF7CCABCCA5684C"><enum>(b)</enum><header>Entities
			 providing assistance</header><text>Section 41501(c)(1) of the Violence Against
			 Women Act of 1994 (42 U.S.C. 14043f(c)(1)) is amended by striking <quote>and
			 labor organizations</quote> and inserting <quote>, labor organizations, victim
			 service providers, community-based organizations, State domestic violence
			 coalitions, State sexual assault coalitions, and tribal
			 coalitions,</quote>.</text>
			</subsection></section><section id="H5D21B2AA96514FFCA44FA460A490DC81"><enum>8.</enum><header>Tribal
			 issues</header><text display-inline="no-display-inline">Section 2015 of the
			 Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3796gg–10) is
			 amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HFD2C17648BC64311B182AE39C60BA4EB" style="OLC">
				<subsection id="H2633D910C0E5444B9C14BB09D269558B"><enum>(c)</enum><header>Availability</header><text>Funds
				available under this section shall remain available until expended and may only
				be used for the activities described in this section.</text>
				</subsection><subsection id="H9A6BF2335B1D4491B5A3E9CEDAD86770"><enum>(d)</enum><header>Duration</header><text>A
				grant made under this section shall be for a period of 24
				months.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HEED33348584A4EE3AF890893D3F3E917"><enum>9.</enum><header>Sexual assault
			 nurse examiners</header><text display-inline="no-display-inline">Section
			 2101(b) of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C.
			 3796hh(b)) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HA71A38EF85114D53A04C1C94A99544B4" style="OLC">
				<paragraph id="HD56870A71BBD41698BE02A5E939AC95C"><enum>(14)</enum><text>To provide for
				sexual assault forensic medical personnel examiners in the collection and
				preservation of evidence, expert testimony, and treatment of trauma related to
				sexual
				assault.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H456B0FFA76764339805C8461DBCC4607"><enum>10.</enum><header>Sexually
			 transmitted infection testing and treatment</header><text display-inline="no-display-inline">Section 2101 of the Omnibus Crime Control
			 and Safe Streets Act of 1968 (42 U.S.C. 3796hh) is amended—</text>
			<paragraph id="H96F6D5ACA4DF4C0E9CFDDF766525A4C9"><enum>(1)</enum><text>in subsection (b),
			 as amended by
			 <internal-xref idref="HEED33348584A4EE3AF890893D3F3E917" legis-path="9.">section 9</internal-xref> of this Act, by adding at the end the
			 following new paragraph:</text>
				<quoted-block id="HEB565BEC47A249189733D209465A950B" style="OLC">
					<paragraph id="H58391DF4E7F24AFC89E1BECCCBB9D2E4"><enum>(15)</enum><text>To develop human
				immunodeficiency virus, Hepatitis B, Hepatitis C, and sexually transmitted
				infection testing and treatment programs for sexual assault victims that
				include notification, treatment, counseling, and confidentiality
				protocols.</text>
					</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H7FBDFB7D8B7548DC809947D2A0AB2A23"><enum>(2)</enum><text>by striking
			 subsection (d) and inserting the following:</text>
				<quoted-block id="H08A89D93A28D45F280E8FA46842BCB7B" style="OLC">
					<subsection id="H1DC6E04208EA42BEAEC45C099E907A96"><enum>(d)</enum><header>HIV testing and
				prophylaxis</header><text>A State or unit of local government shall not be
				entitled to 5 percent of the funds allocated under this part unless the State
				or unit of local government—</text>
						<paragraph id="H9B70008F148F475BAC90E7359FC6F188"><enum>(1)</enum><text>certifies that it
				has a law or regulation that requires—</text>
							<subparagraph id="H94C0673A84094A6D88314DC6DDC5E047"><enum>(A)</enum><text>the State or unit
				of local government to administer HIV testing to an offender not later than 48
				hours after a request by a victim of a sexual assault that carries the risk of
				transmission of HIV if—</text>
								<clause id="HE5BC316434F44E668158CF87D1C63A0A"><enum>(i)</enum><text>there has been a
				judicial finding of probable cause that the offender committed the sexual
				assault or an information or indictment is presented against the offender for
				the sexual assault; and</text>
								</clause><clause id="H3D4B7D831A254AB1993CB474F4BE8D1C"><enum>(ii)</enum><text>the offender is
				in custody or otherwise available for testing;</text>
								</clause></subparagraph><subparagraph id="HF9E3C9FA607F433FA99846FF4DBA63A6"><enum>(B)</enum><text>notification as
				soon as practicable of the results of testing described in
				<internal-xref idref="H94C0673A84094A6D88314DC6DDC5E047" legis-path="(d)(2)(A)">subparagraph (A)</internal-xref> to the victim or parent
				and guardian of the victim, if the victim is a minor or has a court-appointed
				guardian, and to the offender; and</text>
							</subparagraph><subparagraph id="H771EDAF35CE44995AE23AAA62E8BEF90"><enum>(C)</enum><text>followup tests for
				HIV of such offender as may be medically appropriate and that, as soon as
				practicable after each such test, the results be made available in accordance
				with
				<internal-xref idref="HF9E3C9FA607F433FA99846FF4DBA63A6" legis-path="(d)(2)(B)">subparagraph (B)</internal-xref>; and</text>
							</subparagraph></paragraph><paragraph id="H765B9385F1FB4749AFB7FF4CDA897F47"><enum>(2)</enum><text display-inline="yes-display-inline">gives the Attorney General assurances that
				its laws and regulations will be in compliance with the requirements of
				paragraph (1) not later than the later of—</text>
							<subparagraph id="H6A7DB54994A3426E80956BB4D2E960A8"><enum>(A)</enum><text>the date on which
				the next session of the State legislature ends; or</text>
							</subparagraph><subparagraph id="H6D075A1E5B07470B92AC442A35F9BA0E"><enum>(B)</enum><text>2 years after the
				date of enactment of the Improving Assistance to Domestic and Sexual Violence
				Victims Act of
				2009.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H3FB5A88D2E7B43B08FF3D7411823E70E"><enum>11.</enum><header>Clarification of
			 the term <term>culturally and linguistically specific</term></header>
			<subsection id="H9155C584E933468B9F153B3A88EF2174"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 40002(a) of the Violence Against
			 Women Act of 1994 (42 U.S.C. 13925(a)) is amended—</text>
				<paragraph id="H38184104B1784B379458FEBFA9F00340"><enum>(1)</enum><text>by striking
			 paragraph (17);</text>
				</paragraph><paragraph id="H96C4F55AAD644D15AE5ABECCA2E5D009"><enum>(2)</enum><text>by redesignating
			 paragraphs (18) through (37) as paragraphs (19) through (38),
			 respectively;</text>
				</paragraph><paragraph id="H4B33A6F2226F473CB47FD903A2AF07C8"><enum>(3)</enum><text>by redesignating
			 paragraphs (6) through (16) as paragraphs (8) through (18), respectively;
			 and</text>
				</paragraph><paragraph id="H1563C8828D1945859BE7B42E0B15DC84"><enum>(4)</enum><text>by inserting after
			 paragraph (5) the following new paragraphs:</text>

						<paragraph id="HD3B327CB815B420A8466D5DE311042C2"><enum>(6)</enum><header>Culturally
				specific</header><text display-inline="yes-display-inline">The terms
				<term>culturally specific</term> and <term>culturally and linguistically
				specific</term> mean specific to racial and ethnic minority groups (as defined
				in section 1707(g) of the Public Health Service Act (42 U.S.C.
				300u–6(g))).</text>
						</paragraph><paragraph id="HD9A4FF46343640599CCE70186E5C5647"><enum>(7)</enum><header>Culturally and
				linguistically specific services</header><text>The terms <term>culturally and
				linguistically specific services</term> and <term>culturally specific
				services</term> mean community-based services that offer full linguistic access
				and culturally specific services and resources, including outreach,
				collaboration, and support mechanisms primarily directed toward culturally
				specific
				communities.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H3C116DD4CB3043CAAA7D193D3E8FF75B"><enum>(b)</enum><header>Collaborative
			 grants To increase the long-term stability of victims</header><text>Section
			 41404(f)(1) of the Violence Against Women Act of 1994 (42 U.S.C.
			 14043e–3(f)(1)) is amended by striking <quote>linguistically and
			 culturally</quote> and inserting <quote>culturally and
			 linguistically</quote>.</text>
			</subsection><subsection id="HC38F35429D48496CB7357277B08A98B4"><enum>(c)</enum><header>Grants To combat
			 violence against women in public and assisted housing</header><text>Section
			 41405(c)(2)(D) of the Violence Against Women Act of 1994 (42 U.S.C.
			 14043e–4(c)(2)(D)) is amended by striking <quote>linguistically and
			 culturally</quote> and inserting <quote>culturally and
			 linguistically</quote>.</text>
			</subsection><subsection id="H4A358A11D6394BA998100C09883AB25D"><enum>(d)</enum><header>State
			 grants</header><text>Section 2007(e)(2)(D) of the Omnibus Crime Control and
			 Safe Streets Act of 1968 (42 U.S.C. 3796gg–1(e)(2)(D)) is amended by striking
			 <quote>linguistically and culturally</quote> and inserting <quote>culturally
			 and linguistically</quote>.</text>
			</subsection><subsection commented="no" id="HBD0AFCDEC49E44F5A6A3853C63C773CB"><enum>(e)</enum><header>Sexual assault
			 services</header><text>Section 2014 of the Omnibus Crime Control and Safe
			 Streets Act of 1968 (42 U.S.C. 3796gg–9) is amended—</text>
				<paragraph commented="no" id="H87F656BDA10643C594536FB2ED4DEE04"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)—</text>
					<subparagraph commented="no" id="H656294E143494603AA9B067C214A87D3"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>and
			 other programs and projects</quote>;</text>
					</subparagraph><subparagraph commented="no" id="H2A92D454CEEC474C8687DEE7A2C58F1E"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2)(B)—</text>

				<paragraph id="HD93CA4FEFABA48348D3A38F9D26C9B61"><enum>(1)</enum><text>in subsection
			 (b)(1)(A) by inserting <quote>for culturally and linguistically specific
			 populations</quote> after <quote>resources</quote>;</text>
				</paragraph><paragraph id="H7FFB4246C5AA40A3A5D3B24895571544"><enum>(2)</enum><text>in subsection
			 (b)(1)(B) by inserting <quote>culturally and linguistically specific</quote>
			 before <quote>resources for</quote>; and</text>

			 Resource Center grants technical amendment</header><text display-inline="no-display-inline">Section 41501(b)(3) of the Violence Against
			 Women Act of 1994 (42 U.S.C. 14043f(b)(3)) is amended by striking <quote>for
			 materials</quote>.</text>
		</section><section id="HF4A1E08296F64480BBFAF16AD7868806"><enum>13.</enum><header>Analysis and
			 research on violence against Indian women</header><text display-inline="no-display-inline">Section 904(a) of the Violence Against Women
			 and Department of Justice Reauthorization Act of 2005 (42 U.S.C. 3796gg–10
			 note) is amended—</text>
			<paragraph id="HFBBCA6DA9C4B4291A3D9CB1FD4C03E10"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking all after
			 <quote>Indian women</quote> and inserting a period; and</text>
			</paragraph><paragraph id="H54449179252049EA857B4B6B5696D757"><enum>(2)</enum><text>by striking
			 paragraph (4) and inserting the following:</text>

				subsection to the Committee on Indian Affairs of the Senate, the Committee on
				the Judiciary of the Senate, and the Committee on the Judiciary of the House of
				Representatives.</text>

			</paragraph></section><section display-inline="no-display-inline" id="HC927E2219E544D0AA34654E6D41FFCC8"><enum>14.</enum><header>U nonimmigrant
			 adjustment of status</header><text display-inline="no-display-inline">Section
			 245(m)(3) of the Immigration and Nationality Act (8 U.S.C. 1255(m)(3)) is
			 amended by inserting <quote>or an unmarried sibling under 18 years of age on
			 the date of such application for adjustment of status under paragraph
			 (1),</quote> after <quote>a parent</quote>.</text>
		</section><section commented="no" id="H3A0F05DEBB7E43B594A72DADF591A8FB"><enum>15.</enum><header>Processing of
			 certain visas</header><text display-inline="no-display-inline">Section
			 238(b)(5) of the William Wilberforce Trafficking Victims Protection
			 Reauthorization Act of 2008 (Public Law 110–457; 122 Stat 5085) is amended to
			 read as follows:</text>

		</section><section id="HC60ADF81C8CC448897886AD64DA6067C"><enum>16.</enum><header>Conforming
			 amendment confirming housing assistance for qualified aliens</header>
			<subsection id="H88BA2344985E4A67ACFF22AAE806EA3D"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 214 of the
			 Housing and Community Development Act of 1980 (42 U.S.C. 1436a) is
			 amended—</text>
				<paragraph id="H529DDB5E7F3A4E73BD5E6B01B423038F"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="H4484720B112A44D886007E51BCBCDC4C"><enum>(A)</enum><text>in paragraph (6),

			 applications for public benefits and public benefits provided on or after the
			 date of the enactment of this Act without regard to whether regulations to
			 carry out such amendments have been implemented.</text>
			</subsection></section><section id="H9B3467D6A55F47349284007A261120EC"><enum>17.</enum><header>Funding
			 clarification for STOP grants</header><text display-inline="no-display-inline">Section 2007(c)(3) of the Omnibus Crime
			 Control and Safe Streets Act of 1968 (42 U.S.C. 3796gg–1(c)(3)) is
			 amended—</text>
			<paragraph id="HD97DAE8EF5EB456385493FEB82159EC4"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking
			 <quote>and</quote> after the semicolon; and</text>
			</paragraph><paragraph id="H22162FF3DED3424D9CFC27AFDCD38B72"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H287D9D4A178F437CB023EA5C19496CC7" style="OLC">
