		<official-title>To amend the Federal Food, Drug, and Cosmetic Act
		  concerning claims about the effects of foods and dietary supplements on
		  health-related conditions and disease, and for other purposes.</official-title>

		<section id="H2F36C6FB21924FB0B4523351E4ACB357" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Health Freedom
			 Act</short-title></quote>.</text>
		</section><section id="H9001F1FB23DB4CFB8B0AFE7C222E0B35"><enum>2.</enum><header>Limitation on
			 suppression by Federal Government of claims in food and dietary
			 supplements</header><text display-inline="no-display-inline">The Federal
			 Government may not take any action to prevent use of a claim describing any
			 nutrient in a food or dietary supplement (as such terms are defined in section
			 201 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 321)) as mitigating,
			 treating, or preventing any disease, disease symptom, or health-related
			 condition, unless in a final order of a Federal court following a trial on the
			 merits finds clear and convincing evidence based on qualified expert opinion
			 and published peer-reviewed scientific research that—</text>
			<paragraph id="H4D844DA7C7454E939427F6047F694AC8"><enum>(1)</enum><text>the claim is false
			 and misleading in any material respect; and</text>
			</paragraph><paragraph id="H8C01553662DD4C4EA82C4F2B1C2C1C9E"><enum>(2)</enum><text>there is no less
			 speech restrictive alternative to claim suppression, such as use of disclaimers
			 or qualifications, that can render the claim non-misleading.</text>
			</paragraph></section><section id="H448A8625BC7145DFAEAD7893A726E492"><enum>3.</enum><header>Definition of
			 drug</header>
			<subsection id="HDE8607E0231C4CDA9429712B8EF30D24"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subparagraph (1) of
			 section 201(g) of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 321(g))
			 is amended by striking the second and third sentences and inserting the
			 following: <quote>A food or dietary supplement for which a claim is made in
			 accordance with section 403(r)(1)(B) is not a drug solely because of such
			 claim.</quote>.</text>
			</subsection><subsection id="HB9FDA7AA0117408390A1C8348EEEC278"><enum>(b)</enum><header>Rules</header><text>All
			 rules of the Food and Drug Administration in existence on the date of the
			 enactment of this Act prohibiting nutrient-disease relationship claims are
			 revoked.</text>
			</subsection></section><section id="H712753E29F7049548889702F14EA9802"><enum>4.</enum><header>Misbranded
			 food</header><text display-inline="no-display-inline">Section 403(r) of the
			 Federal Food, Drug, and Cosmetic Act (21 U.S.C. 343(r)) is amended—</text>
			<paragraph id="H0F0F469300A847EAACBDF75BD48C6919"><enum>(1)</enum><text>by striking clause
			 (B) of subparagraph (1) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H3357E3D8532C41B79B234CAC905E6D04" style="OLC">
					<subparagraph id="H9B3BFE270F39440584F2661DBEBD048E" indent="up1"><enum>(B) describes any nutrient as mitigating, treating, or
				preventing any disease, disease symptom, or health-related condition if, and
				only if, the claim has been adjudicated false and misleading in any material
				respect by final order of a Federal court of competent jurisdiction in
				accordance with section 2 of the Health Freedom Protection
				Act.</enum>
					</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H3450468C0D7C410E8A63588CC63B144B"><enum>(2)</enum><text>by striking
			 subparagraph (3);</text>
			</paragraph><paragraph id="H1F916550198F493989124A4A6CC3C589"><enum>(3)</enum><text>in the first
			 sentence of subparagraph (4)(A)(i)—</text>
				<subparagraph id="H47D50500635C460BABA4463D5C7D5A8A"><enum>(A)</enum><text>by striking
			 <quote>or (3)(B)</quote>; and</text>
				</subparagraph><subparagraph id="HB364E22B49114428BCD228BFE4089EDA"><enum>(B)</enum><text>by striking
			 <quote>or (1)(B)</quote>;</text>
				</subparagraph></paragraph><paragraph id="HFF993D482FFB4E239222BF402C13370A"><enum>(4)</enum><text>by striking clause
			 (C) of subparagraph (4);</text>
			</paragraph><paragraph id="H57720DFF10F54CD48B31DB0B1873F5FF"><enum>(5)</enum><text>by striking clause
			 (D) of subparagraph (5); and</text>
			</paragraph><paragraph id="HF96F23F65E6A40688FCD245B3E7986A0"><enum>(6)</enum><text>in subparagraph
			 (6), by striking the second sentence.</text>
			</paragraph></section><section id="H69D6EA91B2E644CC83BAE46824C04F93"><enum>5.</enum><header>Dietary
			 supplement labeling exemptions</header><text display-inline="no-display-inline">Section 403B of the Federal Food, Drug, and
			 Cosmetic Act (21 U.S.C. 343–2) is amended to read as follows:</text>
			<quoted-block id="HA554D6458E8F4E12AE15F56BD9BD670F" style="traditional">
				<section id="HD94F93A21BCB4C7898B03D491CF04591"><enum>403B.</enum><header>Food and dietary supplement labeling</header><text display-inline="yes-display-inline">The Federal Government shall take no action
				to prevent distribution of any publication in connection with the sale of a
				food or dietary supplement to consumers unless it establishes that a claim
				contained in the publication—</text>
					<paragraph id="H301C04EDB1634DCFAC177C4C88670AAF"><enum>(1)</enum><text>names the specific
				food or dietary supplement sold by the person causing the publication to be
				distributed;</text>
					</paragraph><paragraph id="H00C229E3DC3C4147A813D563F26C2A00"><enum>(2)</enum><text>represents that
				the specific food or dietary supplement mitigates, treats, or prevents a
				disease; and</text>
					</paragraph><paragraph id="HB4462FD9596B48F183382F1ADBB79733"><enum>(3)</enum><text display-inline="yes-display-inline">proves the claim to be false and misleading
				in any material respect by final order of a Federal court of competent
				jurisdiction in accordance with section 2 of the Health Freedom Protection
				Act.</text>
