		<official-title>To amend title 37, United States Code, to ensure that
		  members of the Armed Forces stationed outside the United States during 2009 can
		  take full advantage of the credits available for first-time home buyers, to
		  provide for the waiver of recapture of the credit for members who are
		  restationed, and for other purposes.</official-title>

		<section id="H7F6CBAFA159B4C9DA40114060CCF76E6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Bring Assistance to Heroes Act of
			 2009</short-title></quote>.</text>
		</section><section id="HF6CC934DB7744E5A9BFD736E541AEB03"><enum>2.</enum><header>Modifications of
			 first-time homebuyer credit for military personnel</header>
			<subsection id="HD2D0F9862A294F2782AD38D42353A285"><enum>(a)</enum><header>Extension of
			 first-time homebuyer credit for military personnel stationed outside the United
			 States; waiver of recapture of credit</header><text display-inline="yes-display-inline">Section 403 of title 37, United States
			 Code, is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H51EB11D5F2824F5A93422477C504786C" style="OLC">
					<subsection id="H022B14D6FC594539AD2E383C00B033CC"><enum>(p)</enum><header>Application of
				first-time homebuyer credit for military personnel</header><paragraph commented="no" display-inline="yes-display-inline" id="H89DD4FBC5CA14530B877506AB3884C6A"><enum>(1)</enum><text display-inline="yes-display-inline">Section 36(h) of the Internal Revenue Code
				of 1986, relating to termination of first-time homebuyer credit, shall be
				applied by substituting <quote>December 1, 2010</quote> for <quote>December 1,
				2009</quote> if the taxpayer (or the spouse of the taxpayer) serves on
				qualified official extended duty (as defined in section 121(d)(9)(C) of the
				Internal Revenue Code of 1986) outside the United States at any time during the
				1st 11 months of 2009.</text>
						</paragraph><paragraph id="H2C80FAB61324489183B644133504EEE0" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H803BE48163304237B21F6A39B6F1CBCA"><enum>(A)</enum><text display-inline="yes-display-inline">In the case of a member of the Armed
				Forces—</text>
								<clause id="H943B58FC7CED41F6A7142E6E835E789F" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">paragraph (1) of section 36(f) of the
				Internal Revenue Code of 1986, shall not apply; and</text>
								</clause><clause id="H7B02B26798B0481893639E8923C02EA4" indent="up1"><enum>(ii)</enum><text>paragraph (2) of such section shall
				not apply if—</text>
									<subclause id="HAB8C8F6881494AB796E5AD2D16C5F56A"><enum>(I)</enum><text display-inline="yes-display-inline">such member receives Government orders for
				service on qualified official extended duty (as defined in section 121(d)(9)(C)
				of the Internal Revenue Code of 1986); and</text>
									</subclause><subclause id="H194AD93DF1D945E38F7F75E8E9F89713"><enum>(II)</enum><text>such orders are received after the
				date of the purchase of the principal residence and before the date that
				paragraph (2) of such section 36(f) would otherwise apply.</text>
									</subclause></clause></subparagraph><subparagraph id="H6BA6E1624B1F4ACE909DCF4922EB5591" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Subparagraph (A) applies regardless of
				whether the Government orders provide for the return of the member to the
				original duty station at the end of such extended
				duty.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H18C3EFE7E989433B88C46E0F5099702B"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 subsection (a) shall take effect as if included in the amendments made by
			 section 1006 of the American Recovery and Reinvestment Tax Act of 2009.</text>
