		<legis-type>A BILL</legis-type>
		<official-title>To amend the Fish and Wildlife Act of 1956 to establish
		  additional prohibitions on shooting wildlife from aircraft, and for other
		  purposes.</official-title>
	</form>
	<legis-body id="H3C12D3779E0242F4910179E194CA98D0" style="OLC">
		<section id="HDBF4FF982C7F47A482C4B5D51499EBC5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Protect America’s Wildlife Act of
			 2009</short-title></quote>.</text>
		</section><section id="H78F309E1B1814FA9AF94CC45B93508F3"><enum>2.</enum><header>Additional
			 prohibitions</header><text display-inline="no-display-inline">Section 13(a) of
			 the Fish and Wildlife Act of 1956 (16 U.S.C. 742j–1(a)) is amended—</text>
			<paragraph id="H73FDF33509C84E5D85A8DDC01072C5D2"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>or</quote> after the semicolon;</text>
			</paragraph><paragraph id="H90AF9B38E745444A99133226D0FC98DA"><enum>(2)</enum><text>in paragraph (2),
			 by striking <quote>or</quote> after the semicolon;</text>
			</paragraph><paragraph id="HE0A1C1E8D8A343068648C16858B2B000"><enum>(3)</enum><text>in paragraph (3),
			 by adding <quote>or</quote> after the semicolon;</text>
			</paragraph><paragraph id="H3DAA7B6A2B0F40CF9A0D3F200393328F"><enum>(4)</enum><text>by inserting after
			 paragraph (3) the following:</text>
				<quoted-block id="H8D935A3AA5DD4070A06ED07EBB124904" style="OLC">
					<paragraph id="HC098D504DA7140978D2666A49A02D108"><enum>(4)</enum><text>knowingly violates
				any regulation promulgated under this
				Act;</text>
					</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H1736CD050F0E41DB9C380BF81E8313D7"><enum>(5)</enum><text>in the matter
			 following paragraph (4) (as inserted by this section), by striking
			 <quote>$5,000</quote> and inserting <quote>$50,000</quote>.</text>
			</paragraph></section><section id="HF12CA2CA8CF8485C9F3581060FFD9677"><enum>3.</enum><header>Exceptions to
			 prohibitions</header><text display-inline="no-display-inline">Section 13(b) of
			 the Fish and Wildlife Act of 1956 (16 U.S.C. 742j–1(b)) is amended—</text>
			<paragraph id="H6ED114A8C4E949629843CF8781AF543A"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>This section</quote> and inserting <quote>Subject to
			 paragraph (3), this section</quote>;</text>
			</paragraph><paragraph id="HA7F1F0FE9DA3425EB4A1342DBDDE761F"><enum>(2)</enum><text>in paragraph
			 (2)—</text>
				<subparagraph id="H14A70746C9A845B584440C6880EE48DC"><enum>(A)</enum><text>in the matter
			 preceding subparagraph (A), by striking <quote>issues a permit referred to
			 in</quote> and inserting <quote>authorizes an employee, agent, or person
			 operating under a license or permit to take an action under</quote>;</text>
				</subparagraph><subparagraph id="HCAF1BA5CDCC24EB082CDF633ACCAC69B"><enum>(B)</enum><text>in subparagraph
			 (A), by striking <quote>to whom a permit was issued</quote> and inserting
			 <quote>so authorized</quote>;</text>
				</subparagraph><subparagraph id="HF627F27EF9C941E2BCF36566FD21217E"><enum>(C)</enum><text>in subparagraph
			 (B), by striking <quote>thereunder</quote>;</text>
				</subparagraph><subparagraph id="H7A84C40934C84DF9A0B6722275304A39"><enum>(D)</enum><text>in subparagraph
			 (C), by striking <quote>to whom a permit was issued</quote>; and</text>
				</subparagraph><subparagraph id="HA7F44A3255B3426198763B966CEB7A64"><enum>(E)</enum><text>in subparagraph
			 (D), by striking <quote>issuing the permit</quote> and inserting
			 <quote>authorizing the action, including, for actions intended to protect land,
			 water, or wildlife, the scientific basis for the actions so authorized</quote>;
			 and</text>
				</subparagraph></paragraph><paragraph id="HB0CA15D11EA04911BAE9B7BC6C8D73C0"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block id="H8CBF3B12A0A142E58E7DFD1D8BB620B6" style="OLC">
					<paragraph id="H997B3A8A1EFD47E8BB40049B49E7637D"><enum>(3)</enum><header>Enhancing the
				propagation and survival of wildlife</header><text>No person exempted under
				paragraph (1) may shoot, attempt to shoot, or harass any wolf, bear, or
				wolverine for the purpose of enhancing the propagation and survival of
				wildlife, including game populations, unless—</text>
						<subparagraph id="H798722A768754795929D866D643B1A14"><enum>(A)</enum><text>the head of the
				fish and wildlife agency of the State and, for game populations on land under
				the jurisdiction of the Department of the Interior, the Secretary of the
				Interior, or for game populations on land under the jurisdiction of the
				Department of Agriculture, the Secretary of Agriculture, determines, based on
				the best scientific data available, that—</text>
							<clause id="H5A1EB4EE249F4A179F2ED5B14E680133"><enum>(i)</enum><text>a
				biological emergency is imminent; and</text>
							</clause><clause id="HB63E55579A284E7F9858CEA2DAD246F7"><enum>(ii)</enum><text>all other
				practicable means to prevent the biological emergency, including stopping
				regulated takes of the declining population, have been implemented;</text>
							</clause></subparagraph><subparagraph id="H9A505B6ADB574E1E9DDC50D8AE70F8CE"><enum>(B)</enum><text>the action is
				carried out—</text>
							<clause id="H2DD371F1629847069EDE6102C3F5CC60"><enum>(i)</enum><text>by
				an officer or employee of—</text>
								<subclause id="HAFAAB246680D44A880D7CAC4BB5CB0D1"><enum>(I)</enum><text>the fish and
				wildlife agency of the State; or</text>
								</subclause><subclause id="H9AA2C230BF5445B79FD93F37B5579242"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="HA5458363FEB54704AE8BAF33475C6DCD"><enum>(aa)</enum><text>for game populations on
				land under the jurisdiction of the Department of the Interior, the Department
				of the Interior; or</text>
									</item><item id="H0FD2A901A5B941188382BB4E58C245E6" indent="up1"><enum>(bb)</enum><text>for game populations on land under
				the jurisdiction of the Department of Agriculture, the Department of
				Agriculture; and</text>
									</item></subclause></clause><clause id="H280DB299EE9A4AE98AB1AE97B9CA3F85"><enum>(ii)</enum><text>only in the
				specific geographical area in which the imminent biological emergency is
				located; and</text>
							</clause></subparagraph><subparagraph id="H56D6A6995EC44301A586F94ADB99A0B7"><enum>(C)</enum><text>the action results
				in the removal of not more than the minimum number of predators necessary to
				prevent the biological emergency.</text>
						</subparagraph></paragraph><paragraph id="H6EC2CF7D19CE4874B1B372476C2B6E02"><enum>(4)</enum><header>Exception
				relating to actions authorized by secretary of the interior</header><text>The
				Secretary of the Interior may authorize any action described in subsection
				(a)—</text>
						<subparagraph id="HB25E8840DB304F3DA30C2987CFC3DEBB"><enum>(A)</enum><text>to prevent the
				extinction of a species that is listed as a threatened species or endangered
				species under section 4(c)(1) of the Endangered Species Act of 1973 (16 U.S.C.
				1533(c)(1)); and</text>
						</subparagraph><subparagraph id="HD382F6B6E3274EED84A5865AFE679E13"><enum>(B)</enum><text>if the Secretary
				of the Interior determines that there is no other means available to address
				the threat of extinction of the species described in subparagraph
				(A).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HD51B8E7CB0C547A6921FBBC7EE920AAA"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 13 of the Fish and Wildlife Act of
			 1956 (16 U.S.C. 742j–1) is amended by striking subsection (c) and inserting the
			 following:</text>
			<quoted-block id="H5FDBCAB570814B11AB78F580E0BC46A4" style="OLC">
				<subsection id="H8E58B25F99C2449096C57F8466675890"><enum>(c)</enum><header>Definitions</header><text>In
				this section:</text>
					<paragraph id="HE1AE2AB3359147299A2EBB90BD56E9F6"><enum>(1)</enum><header>Aircraft</header><text>The
				term <quote>aircraft</quote> means any contrivance used for flight in the
				air.</text>
					</paragraph><paragraph id="H5E21BAD9851B4D53B05F9AE371A3812E"><enum>(2)</enum><header>Biological
				emergency</header><text>The term <quote>biological emergency</quote> means the
				likely extirpation or a significant and imminent threat to the sustainability
				of a wildlife population due to predation by wolves, bears, or wolverines (or
				any combination thereof).</text>
					</paragraph><paragraph id="H4111991AF7FD45BCBC847A049C4D20BB"><enum>(3)</enum><header>Harass</header><text>The
				term <quote>harass</quote> means—</text>
						<subparagraph id="H5A4C2D43A23C48C3A0B159F3255BF9D8"><enum>(A)</enum><text>chasing or
				exhausting an animal; and</text>
						</subparagraph><subparagraph id="HBBAF549808544551B511E79BFC0531C9"><enum>(B)</enum><text>such other
				activities as are determined by the
				Secretary.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
