		<official-title>To require the Secretary of the Treasury to mint coins in
		  commemoration of Ronald Wilson Reagan, the 40th President of the United
		  States.</official-title>

		<section display-inline="no-display-inline" id="H6F078DE55BA04801A0B0628FE04CE652" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Ronald Reagan Commemorative Coin Act of
			 2009</short-title></quote> .</text>
		</section><section id="H1EF837CDC725452E82FC265795BEA4E"><enum>2.</enum><header>Coin
			 specifications</header>
			<subsection id="H18198CA1137D4EB18BD5754713BD08CB"><enum>(a)</enum><header>Denominations</header><text display-inline="yes-display-inline">The Secretary of the Treasury (hereafter in
			 this Act referred to as the <quote>Secretary</quote>) shall mint and issue the
			 following coins:</text>
				<paragraph id="HEAAE9918BAE64031BBF1EFC0CDBC1AED"><enum>(1)</enum><header>$5 gold
			 coin</header><text display-inline="yes-display-inline">Not more than 50,000 $5
			 coins, which shall—</text>
					<subparagraph id="HFAF66FCC67A5499B98D298659204AE68"><enum>(A)</enum><text>weigh 8.359
			 grams;</text>
					</subparagraph><subparagraph id="HCCC9089B8FCB41D084D5D7DC49344D57"><enum>(B)</enum><text>have a diameter of
			 0.850 inches; and</text>
					</subparagraph><subparagraph id="HD6DC26485C0D4B8791EC9C8F691C93AD"><enum>(C)</enum><text>contain 90 percent
			 gold and 10 percent alloy.</text>
					</subparagraph></paragraph><paragraph id="HA74AD7CD76544CEC86CCACF3B3C33A39"><enum>(2)</enum><header>$1 silver
			 coin</header><text display-inline="yes-display-inline">Not more than 300,000 $1
			 coins, which shall—</text>
					<subparagraph id="H28002106541A44D9A8C20844DF95EB44"><enum>(A)</enum><text>weigh 26.73
			 grams;</text>
					</subparagraph><subparagraph id="HEF75B5446AF544B0B45F237E6B1A4B8B"><enum>(B)</enum><text>have a diameter of
			 1.500 inches; and</text>
					</subparagraph><subparagraph id="H8C7F56F7CEE04EC6BC713EA73B34A5C4"><enum>(C)</enum><text>contain 90 percent
			 silver and 10 percent copper.</text>
					</subparagraph></paragraph></subsection><subsection id="H9AA2C9554C8C480296A1817B80999635"><enum>(b)</enum><header>Legal
			 tender</header><text>The coins minted under this Act shall be legal tender, as
			 provided in section 5103 of title 31, United States Code.</text>
			</subsection><subsection id="HEB6E5A12366241D2AD7B72ABD2E7FD29"><enum>(c)</enum><header>Numismatic
			 items</header><text>For purposes of sections 5134 and 5136 of title 31, United
			 States Code, all coins minted under this Act shall be considered to be
			 numismatic items.</text>
			</subsection></section><section id="HBF0BB32BA9E74A3590D13BEC8F8597"><enum>3.</enum><header>Design of
			 coins</header>
			<subsection id="HEA3070E5159B46709C66C4C11C2BE26E"><enum>(a)</enum><header>Design
			 requirements</header>
				<paragraph id="H9A2219A8A1034D31B2CA955D9BE09FC0"><enum>(1)</enum><header>In
			 general</header><text>The design of the coins minted under this Act
			 shall—</text>
					<subparagraph id="H4D7C79CF0D92486AA42C103DA312BBE5"><enum>(A)</enum><text display-inline="yes-display-inline">bear an image of former President Ronald
			 Wilson Reagan on the obverse side; and</text>
					</subparagraph><subparagraph id="H1F4DB45327AB4F35BA4CE9D82C864CF4"><enum>(B)</enum><text>bear a design on
			 the reverse side that is similar to the depiction of an American eagle carrying
			 an olive branch, flying above a nest containing another eagle and
			 hatchlings.</text>
					</subparagraph></paragraph><paragraph id="H9D61A2FC7D2545DB8E71B5763965DC44"><enum>(2)</enum><header>Designation and
			 inscriptions</header><text>On each coin minted under this Act, there shall
			 be—</text>
					<subparagraph id="HEBF896AE492541158400FB1E9C7E372E"><enum>(A)</enum><text>a designation of
			 the value of the coin;</text>
					</subparagraph><subparagraph id="H7A7FD4D0B66B4DC58EAE06818EE2068C"><enum>(B)</enum><text>an inscription of
			 the year <quote>2013</quote>; and</text>
					</subparagraph><subparagraph id="HB458616F41E34C3F854FBA001995BCD3"><enum>(C)</enum><text>inscriptions of
			 the words <quote>Liberty</quote>, <quote>In God We Trust</quote>, <quote>United
			 States of America</quote>, and <quote>E Pluribus Unum</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H307B41A907564F919006DCBE6C9BBED7"><enum>(b)</enum><header>Design
			 selection</header><text>The design for the coins minted under this Act shall
			 be—</text>
				<paragraph id="HD167B5263E334A85BFD5F0203D04E41C"><enum>(1)</enum><text>selected by the
			 Secretary, after consultation with the Commission of Fine Arts; and</text>
				</paragraph><paragraph id="HEAE8594D57DC4477A5D2007350654E73"><enum>(2)</enum><text>reviewed by the
			 Citizens Commemorative Coin Advisory Committee.</text>
				</paragraph></subsection></section><section id="H60361624BC844DFBBC87107701883465"><enum>4.</enum><header>Issuance of
			 coins</header>
			<subsection id="H89C25844B1DF40A29F214986488EDE27"><enum>(a)</enum><header>Quality of
			 coins</header><text>Coins minted under this Act shall be issued in uncirculated
			 and proof qualities.</text>
			</subsection><subsection id="HAE2FCBB2848045A9B8BE13BFCEEC0DDE"><enum>(b)</enum><header>Mint
			 facility</header><text display-inline="yes-display-inline">Only 1 facility of
			 the United States Mint may be used to strike any particular quality of the
			 coins minted under this Act.</text>
			</subsection><subsection id="HC289EB9DFC21492BB20063EE000BDA7"><enum>(c)</enum><header>Commencement of
			 issuance</header><text display-inline="yes-display-inline">The Secretary may
			 issue coins minted under this Act beginning on January 1, 2013, except that the
			 Secretary may initiate sales of such coins, without issuance, before such
			 date.</text>
			</subsection><subsection id="H8FD0AB1312E0421C9F0322D39F736CA1"><enum>(d)</enum><header>Termination of
			 minting authority</header><text display-inline="yes-display-inline">No coins
			 shall be minted under this Act after December 31, 2013.</text>
			</subsection></section><section display-inline="no-display-inline" id="HD1419F91DEF8442CB1972429F4FC8B00" section-type="subsequent-section"><enum>5.</enum><header>Sale of coins</header>
			<subsection id="HA816944699B947E5ABA707B66C8EEB2B"><enum>(a)</enum><header>Sale
			 price</header><text>The coins issued under this Act shall be sold by the
			 Secretary at a price equal to the sum of—</text>
				<paragraph id="H650B3311EC1B4E4B9C75CD61C2E623AA"><enum>(1)</enum><text>the face value of
			 the coins;</text>
				</paragraph><paragraph id="H094FE2DA37FC47B580AD1300B4004DC5"><enum>(2)</enum><text>the surcharge
			 provided in section 6(a) with respect to such coins; and</text>
				</paragraph><paragraph id="H292AA34C20B34667A1C8B3EA8FFABEEA"><enum>(3)</enum><text>the cost of
			 designing and issuing the coins (including labor, materials, dies, use of
			 machinery, overhead expenses, marketing, and shipping).</text>
				</paragraph></subsection><subsection id="H7650157531994FCEBC50D46F238CD3EB"><enum>(b)</enum><header>Bulk
			 sales</header><text>The Secretary shall make bulk sales of the coins issued
			 under this Act at a reasonable discount.</text>
			</subsection><subsection id="HDEA660CE9DF24D4894F7CCC9109F21F3"><enum>(c)</enum><header>Prepaid
			 orders</header>
				<paragraph id="H59E242809B7141D3B8A2C456B4A7370"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall accept prepaid orders for the coins
			 minted under this Act before the issuance of such coins.</text>
				</paragraph><paragraph id="HC8C23D37BF514E48AFE93DBCE57E669E"><enum>(2)</enum><header>Discount</header><text>Sale
			 prices with respect to prepaid orders under paragraph (1) shall be at a
			 reasonable discount.</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="H4C9ACE3318334125935DF2A734B1B3D" section-type="subsequent-section"><enum>6.</enum><header>Surcharges</header>
			<subsection id="HE62BBBDC356B416E937439FD82625F00"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">All sales of coins
			 minted under this Act shall include a surcharge as follows:</text>
				<paragraph id="HC384616CADDC41BB93C8DDD5F07B657C"><enum>(1)</enum><text>A
			 surcharge of $35 per coin for the $5 coin.</text>
				</paragraph><paragraph id="HFF6B4072CF934FAC802CD4CCCB5F9D14"><enum>(2)</enum><text>A
			 surcharge of $10 per coin for the $1 coin.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="HC7686CA6744546A8BCE2E535A43B609E"><enum>(b)</enum><header>Distribution</header><text display-inline="yes-display-inline">Subject to section 5134(f) of title 31,
			 United States Code, the proceeds from the surcharges received by the Secretary
			 from the sale of coins issued under this Act shall be paid promptly by the
			 Secretary to the Army Emergency Fund to be used by the Army Emergency Fund for
			 the purposes of providing financial assistance to any of the following
			 individuals:</text>
				<paragraph id="HD5D2B60050A04540916DAC8C0501593E"><enum>(1)</enum><text display-inline="yes-display-inline">An individual who is an Army active duty
			 soldier, single or married, or a dependent of such a soldier.</text>
				</paragraph><paragraph id="H9330EF0AEB7042B884C62854A0F5D777"><enum>(2)</enum><text display-inline="yes-display-inline">A member of the Army National Guard or Army
			 Reserve on continuous active duty under title 10, United States Code, for more
			 than 30 consecutive days, or a dependent of such a member.</text>
				</paragraph><paragraph id="H60D3587AA58F4E8D847C73462D94DC27"><enum>(3)</enum><text display-inline="yes-display-inline">A soldier retired from active duty because
			 of longevity or physical disability, including any Army National Guard or Army
			 Reserve soldier who is in receipt of Army retired pay, or any authorized
			 dependent of such soldier.</text>
				</paragraph><paragraph id="HA5CAA7346C05413B97E351859482B85B"><enum>(4)</enum><text>A
			 surviving spouse or dependent child of a soldier who died while on active duty
			 or after retirement.</text>
				</paragraph></subsection><subsection id="HD07D5D28D4AB450A82FA53CE629F9927"><enum>(c)</enum><header>Audits</header><text display-inline="yes-display-inline">The Army Emergency Fund shall be subject to
			 the audit requirements of section 5134(f)(2) of title 31, United States Code,
			 with regard to such funds.</text>
			</subsection><subsection display-inline="no-display-inline" id="HF8A946674ED14D8E842DBEE157AADB7C"><enum>(d)</enum><header>Limitation</header><text>Notwithstanding
			 subsection (a), no surcharge may be included with respect to the issuance under
			 this Act of any coin during a calendar year if, as of the time of such
			 issuance, the issuance of such coin would result in the number of commemorative
			 coin programs issued during such year to exceed the annual 2 commemorative coin
			 program issuance limitation under section 5112(m)(1) of title 31, United States
			 Code (as in effect on the date of the enactment of this Act). The Secretary of
			 the Treasury may issue guidance to carry out this subsection.</text>
			</subsection></section></legis-body>
