		<legis-type>A BILL</legis-type>
		<official-title>To amend title 10, United States Code, to permit retired
		  members of the Armed Forces who have a service-connected disability rated less
		  than 50 percent to receive concurrent payment of both retired pay and veterans’
		  disability compensation, to eliminate the phase-in period for concurrent
		  receipt, to extend eligibility for concurrent receipt to chapter 61 disability
		  retirees with less than 20 years of service, and for other
		  purposes.</official-title>

		<section display-inline="no-display-inline" id="HA7FA7A4D3230482BBC41EFA6724AB8F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Disabled Veterans Tax Termination
			 Act</short-title></quote>.</text>
		</section><section id="HACA07BF1BBE74ABE8B99BF03E980546C"><enum>2.</enum><header>Concurrent
			 receipt of both retired pay and veterans’ disability compensation for military
			 retirees with compensable service-connected disabilities</header>
			<subsection id="HDCA4BF4F8A3B4801B438FA1CE987A082"><enum>(a)</enum><header>Inclusion of
			 Retirees With Service-Connected Disabilities Rated Less Than 50
			 Percent</header><text>Subsection (a) of section 1414 of title 10, United States
			 Code, is amended—</text>
				<paragraph id="HDEFB4131D0DD408894E671997ED2B2F"><enum>(1)</enum><text>by
			 striking <quote><header-in-text level="subsection" style="OLC">Compensation</header-in-text></quote> in the subsection heading and
			 all that follows through <quote>Subject</quote> and inserting
			 <quote><header-in-text level="subsection" style="OLC">Compensation</header-in-text>.—Subject</quote>;</text>
				</paragraph><paragraph id="H77E34CE739C4402894E4E700A7AAB27B"><enum>(2)</enum><text>by striking
			 <quote>qualifying service-connected disability</quote> and inserting
			 <quote>service-connected disability</quote>; and</text>
				</paragraph><paragraph id="HEA07403EE6604B99864560F4E5C3161C"><enum>(3)</enum><text>by striking
			 paragraph (2).</text>
				</paragraph></subsection><subsection id="H14A3F40A575043D1B4429B1F4662F4DA"><enum>(b)</enum><header>Repeal of
			 Phase-In of Concurrent Receipt of Retired Pay and Veterans’ Disability
			 Compensation</header><text>Such section is further amended—</text>
				<paragraph id="H03DB3A175292464EAD204618F8BE983E"><enum>(1)</enum><text>in subsection (a),
			 as amended by subsection (a) of this section, by striking the final
			 sentence;</text>
				</paragraph><paragraph id="H7E767C89E7A141B192170034969EF001"><enum>(2)</enum><text>by striking
			 subsection (c) and redesignating subsections (d) and (e) as subsections (c) and
			 (d), respectively; and</text>
				</paragraph><paragraph id="HCCBB086FBCD742EB8CDE00D9687B0027"><enum>(3)</enum><text>in subsection (d),
			 as so redesignated, by striking paragraphs (3) and (4).</text>
				</paragraph></subsection><subsection id="HED3364A63D2145B5AF20A49E7FE200C3"><enum>(c)</enum><header>Inclusion of
			 disability retirees with less than 20 years of service</header><text display-inline="yes-display-inline">Subsection (b) of such section is
			 amended—</text>
				<paragraph id="HE496E1CDA39D42E7B9724004B604FF76"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>member retired</quote> and inserting <quote>qualified
			 retiree who is retired</quote>; and</text>
				</paragraph><paragraph id="HE64CCE49190043568469B6D2965963B1"><enum>(2)</enum><text>by striking
			 paragraph (2) and inserting the following new paragraph:</text>

						<paragraph id="HED489A704B8245C7B85047B2959BC009"><enum>(2)</enum><header>Disability
				retirees with less than 20 years of service</header><text display-inline="yes-display-inline">The retired pay of a qualified retiree who
				is retired under chapter 61 of this title with fewer than 20 years of
				creditable service is subject to reduction under sections 5304 and 5305 of
				title 38, but only by the amount (if any) by which the amount of the member’s
				retired pay under such chapter exceeds the amount equal to 2½ percent of the
				member’s years of creditable service multiplied by the member’s retired pay
				base under section 1406(b)(1) or 1407 of this title, whichever is applicable to
				the
				member.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HE3C15CD21D65497FB4EC0818E42037CE"><enum>(d)</enum><header>Clerical
			 Amendments</header>
				<paragraph id="HB123DD2D40124B22A05E092CE732893D"><enum>(1)</enum><header>Section
			 heading</header><text>The heading for such section is amended to read as
			 follows:</text>

			 sections at the beginning of chapter 71 of such title is amended to read as
			 follows:</text>

			 amendment</header><text display-inline="yes-display-inline">Section 1413a(f) of
			 such title is amended by striking <quote>Subsection (d)</quote> and inserting
			 <quote>Subsection (c)</quote>.</text>
			</subsection><subsection id="H7E230E585BA14533AA2D388E65890673"><enum>(f)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall take effect on the
			 first day of the first month beginning after the date of the enactment of this
			 Act and shall apply to payments for months beginning on or after that
			 date.</text>
			</subsection></section><section id="H40A1BB56BB1A4DC29C2700CB59732B1E"><enum>3.</enum><header>Combat-related
			 special compensation technical corrections regarding amount of monthly payments
			 for chapter 61 disability retirees</header>
			<subsection id="HE0C1E2D251764650B8F7D03C0768866C"><enum>(a)</enum><header>Technical
			 corrections</header><text display-inline="yes-display-inline">Section
			 1413a(b)(3) of title 10, United States Code, is amended—</text>
				<paragraph id="H444594148C694239B127CE884F2CF128"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>shall be reduced</quote> and all that follows through
			 <quote>exceeds</quote> and inserting <quote>may not, when combined with the
			 amount of retired pay payable to the retiree after any reduction under sections
			 5304 and 5305 of title 38, cause the total of such combined payment to
			 exceed</quote>; and</text>
				</paragraph><paragraph id="H24B23DA1EA4B4E65003363E8F6D7E219"><enum>(2)</enum><text>in subparagraph
			 (B), by striking <quote>shall be reduced</quote> and all that follows through
			 <quote>exceeds</quote> and inserting <quote>may not, when combined with the
			 amount of retired pay payable to the retiree after any reduction under sections
			 5304 and 5305 of title 38, cause the total of such combined payment to
			 exceed</quote>.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="H4CF0500C18C64E6FA419C6A13EA586CB"><enum>(b)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall take effect on the
			 first day of the first month beginning after the date of the enactment of this
			 Act and shall apply to payments for months beginning on or after that
			 date.</text>
