		<official-title>To amend title 18, United States Code, to prevent unjust
		  and irrational criminal punishments.</official-title>

		<section id="H21FD29E9AD9D4BFA92856036E654BECE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Ramos-Compean Justice Act of
			 2009</short-title></quote>.</text>
		</section><section id="H3209A3EB9B394D179A38BCB77F5747C7"><enum>2.</enum><header>Authority to
			 impose a sentence below a statutory minimum</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/3553">Section 3553</external-xref> of
			 title 18, United States Code, is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H9F82C57541AB4927AD3572093502D566" style="USC">
				<subsection id="H6EC7A9599CC443EEBF4A00230C207874"><enum>(g)</enum><header>Authority To
				impose a sentence below a statutory minimum To prevent an unjust
				sentence</header>
					<paragraph id="HB53B4853011545C78BEEC40F615F024D"><enum>(1)</enum><header>General
				rule</header><text>Notwithstanding any provision of law other than this
				subsection, the court may impose a sentence below a statutory minimum if the
				court finds that it is necessary to do so in order to avoid violating the
				requirements of subsection (a).</text>
					</paragraph><paragraph id="HB475A00966C449E58AE671FEF5EA23FE"><enum>(2)</enum><header>Court to give
				parties notice</header><text>Before imposing a sentence under paragraph (1),
				the court shall give the parties reasonable notice of the court’s intent to do
				so and an opportunity to respond.</text>
					</paragraph><paragraph id="HD1B5315C5D1741BCA6A3BECC03096697"><enum>(3)</enum><header>Statement in
				writing of factors</header><text display-inline="yes-display-inline">The court
				shall state, in the written statement of reasons, the factors under subsection
				(a) that require imposition of a sentence below the statutory minimum.</text>
					</paragraph><paragraph id="H3509D321C48D4BB1B4BC3CD1E6D172B1"><enum>(4)</enum><header>Appeal rights
				not limited</header><text>This subsection does not limit any right to appeal
				that would otherwise exist in its
				absence.</text>
