		<official-title>To respond to the current over-supply of milk by
		  temporarily increasing the payment rate for payments under the milk income loss
		  contract program and by directing the Secretary of Agriculture to facilitate
		  the efforts of producer associations and other third parties to remove dairy
		  cows from production, and for other purposes.</official-title>

		<section id="H24197B3797CC497C8C8B6EDEC920EA88" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Dairy Relief and Market Stabilization
			 Act</short-title></quote>.</text>
		</section><section id="H0E6CFA806A38426B8C2A341BBE659B77"><enum>2.</enum><header>Temporary
			 increase in payment rate for milk income loss contract program</header><text display-inline="no-display-inline">Section 1506(c)(3) of the Food,
			 Conservation, and Energy Act of 2008 (7 U.S.C. 8773(c)(3)) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="HCD4E19D123B948288220DC604F3B7ACC"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (C) as
			 subparagraph (E); and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF239A7F7AA1E49378CB36A0E6BFD15D8"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subparagraph (B) and inserting
			 the following new subparagraphs:</text>
				<quoted-block display-inline="no-display-inline" id="HCCC2509929534CBB95228ECF43DC8742" style="OLC">
					<subparagraph commented="no" display-inline="no-display-inline" id="H15691E257D2142449CCE7838D47D14D5"><enum>(B)</enum><text>for the period
				beginning on October 1, 2008, and ending on February 28, 2009, 45
				percent;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H56D30B7EBE914A2BB9644D35CF9E09F3"><enum>(C)</enum><text>for the period
				beginning on March 1, 2009, and ending on November 30, 2009, 90 percent;
				and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H46051D673A0A4DD0847F6938A0365C7C"><enum>(D)</enum><text>for the period
				beginning on December 1, 2009, and ending on August 31, 2012, 45 percent;
				and</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H37D67C65DA5D4FFFB4A24152467586AC" section-type="subsequent-section"><enum>3.</enum><header>Contracts to reduce
			 number of dairy cows in production</header>
			<subsection id="H64E6638DD6024C02ABDC8314B7A9597F"><enum>(a)</enum><header>Contracts
			 required</header><text display-inline="yes-display-inline">The Secretary of
			 Agriculture shall use amounts in the fund established under section 32 of the
			 Act of August 24, 1935 (7 U.S.C. 612c), to enter into a contract with a
			 producer association or other third party that has a program in operation to
			 encourage dairy producers to remove dairy cows from production. Under the
			 contract, the Secretary may pay all or a portion of the costs incurred by the
			 party to compensate dairy producers for removing dairy cows from
			 production.</text>
			</subsection><subsection id="HF342C0ED75A54283BDAD354BB98BFA58"><enum>(b)</enum><header>Determination of
			 size of needed herd reduction</header><text display-inline="yes-display-inline">Not later than 30 days after the date of
			 the enactment of this Act, the Secretary shall determine the number of dairy
			 cows that would be need to be removed from production nationwide to bring the
			 national supply of milk in line with national demand.</text>
			</subsection><subsection id="H3C0D9CDFA2A545BD90EB3142248A3691"><enum>(c)</enum><header>Implementation</header><text>The
			 Secretary shall begin to enter into contracts under subsection (a) as soon as
			 possible after making the determination under subsection (b).</text>
			</subsection><subsection id="HC763DC93F7394B64801E73EA33901AC2"><enum>(d)</enum><header>Regulations</header><text display-inline="yes-display-inline">The promulgation of any regulations to
			 carry out this section shall be made without regard to—</text>
				<paragraph id="HBFC890A494AB437487FEF9CEE9B1E616"><enum>(1)</enum><text>the notice and
			 comment provisions of section 553 of title 5, United States Code;</text>
				</paragraph><paragraph id="HA772500E17C345738B86BA7ED67CB769"><enum>(2)</enum><text>the Statement of
			 Policy of the Secretary of Agriculture effective July 24, 1971 (36 Fed. Reg.
			 13804), relating to notices of proposed rulemaking and public participation in
			 rulemaking; and</text>
				</paragraph><paragraph id="HC111938DDD0441EF8091CA7D45D1584E"><enum>(3)</enum><text>chapter 35 of
			 title 44, United States Code (commonly known as the Paperwork Reduction
			 Act).</text>
				</paragraph></subsection><subsection id="HEF88D5C22435499C8CEA5234ECC94B0B"><enum>(e)</enum><header>Congressional
			 Review of Agency Rulemaking</header><text>In carrying out this section, the
			 Secretary shall use the authority provided under section 808 of title 5, United
			 States Code.</text>
			</subsection><subsection id="H5FE6D3244B5C49D68CA27006D3816E43"><enum>(f)</enum><header>Duration of
			 contracts</header><text>Any contract entered into under subsection (a) shall
			 expire one year after the date of the enactment of this Act.</text>
			</subsection></section></legis-body>
