		<official-title display="yes">To direct the Commissioner of Food and
		  Drugs to revise the Federal regulations applicable to the declaration of the
		  trans fat content of a food on the label and in the labeling of the food when
		  such content is less than 0.5 gram.</official-title>

		<section id="H35923CC7699E424DAFD396687E3A8DE3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Trans Fat Truth in Labeling Act of
			 2009</short-title></quote>.</text>
		</section><section id="id23347EF697E441E3A85C821043B0E596"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds as follows:</text>
			<paragraph id="id3E607C8A025D4B0BBE0A2CDC3B89D413"><enum>(1)</enum><text>The Institute of
			 Medicine of the National Academies advises the United States Government on
			 nutritional science for use in public policy and product labeling
			 programs.</text>
			</paragraph><paragraph id="idB10304C5E0F24E35A2E50CE113897E95"><enum>(2)</enum><text>In 2002, the
			 Institute of Medicine issued dietary reference intakes for energy,
			 carbohydrate, fiber, fat, fatty acids, cholesterol, protein, and amino acids
			 and made recommendations regarding consumption of trans fat.</text>
			</paragraph><paragraph id="id5FEA8A8348FE486DA7758EB24C5DBF77"><enum>(3)</enum><text>These
			 recommendations included a statement that <quote>trans fatty acids are not
			 essential and provide no known benefit to human health</quote>.</text>
			</paragraph><paragraph id="idEB84133615154E67918C6530F839C932"><enum>(4)</enum><text>The Institute of
			 Medicine concluded that both saturated and trans fats increase levels of LDL
			 cholesterol and trans fats may also lower levels of HDL cholesterol.</text>
			</paragraph><paragraph id="id7F277CD45ACB4F0F9DF0D39239AEEDD0"><enum>(5)</enum><text>A 2006 New
			 England Journal of Medicine scientific review stated that <quote>from a
			 nutritional standpoint, the consumption of trans fatty acids results in
			 considerable potential harm but no apparent benefit</quote>.</text>
			</paragraph></section><section id="id331066FE8C7B492A88DA97EC7F9B79FA"><enum>3.</enum><header>Declaration of
			 trans fat content of less than 0.5 gram per serving on the label or in the
			 labeling of food</header>
			<subsection id="idE32D3C2E7DE144978B816D64CD6373A0"><enum>(a)</enum><header>Requirement</header><text>Not
			 later than 6 months after the date of the enactment of this Act, the
			 Commissioner of Food and Drugs shall promulgate a final regulation revising
			 section 101.9(c)(2)(ii), and such other provisions as may be necessary, of the
			 Code of Federal Regulations to require that—</text>
				<paragraph id="idD06FFB8D27D24046A549EB440336B9D0"><enum>(1)</enum><text>if the trans fat
			 content of a serving of a food is less than 0.5 gram, and</text>
				</paragraph><paragraph id="id0F8E9F7FA1AE4E30B30854DDD0639198"><enum>(2)</enum><text>if the trans fat
			 content of a serving of the food is declared in the nutrition information on
			 the label or in the labeling of the food,</text>
				</paragraph><continuation-text continuation-text-level="subsection">the trans
			 fat content of a serving of the food shall be expressed through the use of an
			 asterisk or other notation stating that the trans fat content of a serving is
			 less than 0.5 gram (instead of expressing the trans fat content as
			 zero).</continuation-text></subsection><subsection id="id446867163C5948C89BBEE2FB42C49CA1"><enum>(b)</enum><header>Effective
			 date</header><text>The regulation promulgated under subsection (a) shall take
			 effect on the date that is 18 months after the date of the enactment of this
			 Act.</text>
