		<official-title>To amend the Child Care and Development Block Grant Act
		  of 1990 to require criminal background checks of child care
		  providers.</official-title>

		<section id="H51D3299304B844679315B2FF17D7C550" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Child Care Criminal Background Check
			 Act of 2009</short-title></quote>.</text>
		</section><section id="H53CBB080FD904DAF9CA34738A562CA68"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to assist States
			 in improving the overall quality of child care services in the State by
			 requiring national criminal background checks of child care providers that are
			 licensed by the State or that receive funds under the Child Care and
			 Development Block Grant Act of 1990.</text>
		</section><section id="H87A4C266ADEE456489EED03DF3FFAD05"><enum>3.</enum><header>Amendments</header>
			<subsection id="H0D221D19077148EB9861619B6AFCBD4E"><enum>(a)</enum><header>State
			 plan</header><text display-inline="yes-display-inline">Section 658E(c)(2) of
			 the Child Care and Development Block Grant Act of 1990 (42 U.S.C. 9858c(c)(2))
			 is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H51D2407B354440458ECAF9DAE3599650" style="OLC">
					<subparagraph id="HE55C153CA1584976A77E3023486B4BA8"><enum>(I)</enum><header>Criminal
				background check</header><text display-inline="yes-display-inline">Certify that
				the State will—</text>
						<clause id="H49C5C7801F20424BB8FF4FBBAA698927"><enum>(i)</enum><text display-inline="yes-display-inline">require each eligible child care provider
				(excluding an eligible child care provider described in section 658P(5)(B))
				that is licensed by the State or receives funds provided under this
				subchapter—</text>
							<subclause id="H3842446C9CC04066961E0A1E4C454E0D"><enum>(I)</enum><text display-inline="yes-display-inline">to obtain from the State a comprehensive
				criminal background check of—</text>
								<item id="H5032C81E8B094240847862519DC35A74"><enum>(aa)</enum><text>each employee who
				provides child care services;</text>
								</item><item id="H32FBFFFCD4A8444CAFE505CB0A9984A1"><enum>(bb)</enum><text>each applicant
				for employment to provide such services; and</text>
								</item><item id="HD3A628BD1D964839BA2A765871C62D8E"><enum>(cc)</enum><text>each family child
				care provider who provides or applies to provide such services;</text>
								</item></subclause><subclause id="H1EB8793C48F64798AEDF85C33C12624A"><enum>(II)</enum><text>to refuse to
				employ an individual to provide such services—</text>
								<item id="H16EAC7E81AE349D0A475FAD281D1D319"><enum>(aa)</enum><text display-inline="yes-display-inline">if such individual was convicted, in the
				then most recent 5-year period ending on the date of receipt of such a criminal
				background check, of—</text>
									<subitem id="H77B795CEFB014F1FB3B79DAA2D0BE509"><enum>(AA)</enum><text display-inline="yes-display-inline">a crime of violence (as defined in section
				20101 of subtitle A of title II of the Violent Crime Control and Law
				Enforcement Act of 1994 (42 U.S.C. 13701)); or</text>
									</subitem><subitem id="H891D59C07DA3436DA2966E93F4AD29D7"><enum>(BB)</enum><text>a crime against a
				child for which the penalty exceeds imprisonment for a term exceeding 1
				year;</text>
									</subitem></item><item id="HE20142CAC6604078AA3B15B0A3BBEA9F"><enum>(bb)</enum><text display-inline="yes-display-inline">to an eligible child without the
				supervision of an employee whose criminal background check satisfies the
				requirements of the subparagraph, pending receipt of such a criminal background
				check of such individual; and</text>
								</item><item id="HB7F14E4C2A664D528FDBA3BB7CF2E2E1"><enum>(cc)</enum><text display-inline="yes-display-inline">to an eligible child with the supervision
				of an employee whose criminal background check satisfies the requirements of
				the subparagraph and for a period exceeding 90 days, pending receipt of such a
				criminal background check of such individual; and</text>
								</item></subclause></clause><clause id="H75353E2A37004DDE90CEC4EA5794CD71"><enum>(ii)</enum><text display-inline="yes-display-inline">carry out at the request of an eligible
				child care provider, as soon as practicable, a comprehensive criminal
				background check (at the State option for a fee not to exceed the actual cost
				to the State) of each employee of, and each applicant for employment by, a
				child care provider that is licensed by the State or receives funds provided
				under this subchapter by the State, and make the results of such check
				available to such provider and to such employee or applicant.</text>
						</clause><continuation-text continuation-text-level="subparagraph">At the
				request of a State, the Secretary may waive for 1 fiscal year the application
				of this subparagraph to the State if the State demonstrates a good faith effort
				to comply with the requirements specified in this subparagraph and its
				inability to so
				comply.</continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H06DB07F7A12940E39F824FD9E0E72DFC"><enum>(b)</enum><header>Enforcement</header><text display-inline="yes-display-inline">Section 658I(b)(2) of the Child Care and
			 Development Block Grant Act of 1990 (42 U.S.C. 9858g(i)(b)(2)) is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H5412B2597B124521A4C1EBA4DF8AB834" style="OLC">
					<quoted-block-continuation-text quoted-block-continuation-text-level="subparagraph">If a
				State fails to comply substantially with the requirements specified in section
				658e(c)(2)(I), the Secretary shall reduce by 10 percent the State allotment for
				the fiscal year following the fiscal year with respect to which noncompliance
				is
				found.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H368A08CCA5C74DEA95CD459D2BCC689C"><enum>4.</enum><header>Effective date;
			 application of amendments</header><text display-inline="no-display-inline">This
			 Act and the amendments made by this Act shall take effect 2 years after the
			 date of the enactment of this Act.</text>
