		  aliens who perished in the September 11 terrorist attacks an opportunity to
		  adjust their status to that of an alien lawfully admitted for permanent
		  residence.<pagebreak></pagebreak></official-title>

		<section id="H25FEA2F19EC9476EA2DDD89CC9BD578B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>September 11 Family Humanitarian
			 Relief and Patriotism Act of 2009</short-title></quote>.</text>
		</section><section id="H47A8C93DB4FD4071A6DAD62955219D77"><enum>2.</enum><header>Adjustment of
			 status for certain victims of terrorism</header>
			<subsection id="H02280BE13DD24D448A046202D9A6BE43"><enum>(a)</enum><header>Adjustment of
			 status</header><text display-inline="yes-display-inline">The status of any
			 alien described in subsection (b) may be adjusted by the Secretary of Homeland
			 Security to that of an alien lawfully admitted for permanent residence, if the
			 alien—</text>
				<paragraph id="HB35B842D8C074803BBE40A2BAAD436B7"><enum>(1)</enum><text display-inline="yes-display-inline">applies for such adjustment not later than
			 1 year after the date of the enactment of this Act;</text>
				</paragraph><paragraph id="H2285A757A56545D8ACB6DC779F3A1BB9"><enum>(2)</enum><text display-inline="yes-display-inline">is not inadmissible to the United States
			 under paragraph (2) or (3) of section 212(a) of the Immigration and Nationality
			 Act (8 U.S.C. 1182(a)), or deportable under paragraph (2) or (4) of section
			 237(a) of such Act (8 U.S.C. 1227(a)); and</text>
				</paragraph><paragraph id="HC69F778C0F2D43448224DC50757480C1"><enum>(3)</enum><text display-inline="yes-display-inline">not later than the date on which the
			 application under paragraph (1) is submitted, satisfies any applicable Federal
			 tax liability by establishing that—</text>
					<subparagraph id="HCC4F4ABCA940433B95A7EB5B06069DEE"><enum>(A)</enum><text>no such tax
			 liability exists; or</text>
					</subparagraph><subparagraph id="HA08DA3DBAA3B4E7AAA2798B90AA47A99"><enum>(B)</enum><text>all outstanding
			 liabilities have been paid.</text>
					</subparagraph></paragraph></subsection><subsection id="H21E24EECD58848FF9D25F77EE535E711"><enum>(b)</enum><header>Aliens eligible
			 for adjustment of status</header>
				<paragraph id="H003081ED6C614D45B28B0F87AA37A624"><enum>(1)</enum><header>In
			 general</header><text>The benefit provided by subsection (a) shall apply to any
			 alien who—</text>
					<subparagraph id="H55B304706851403BA5B36E4207597FE9"><enum>(A)</enum><text>was, on September
			 10, 2001, the spouse, child, unmarried son, or unmarried daughter of an alien
			 who died as a direct result of the terrorist activity conducted against the
			 United States on September 11, 2001;</text>
					</subparagraph><subparagraph id="H329B17B2E98B4E2A90AD134D46BEAC80"><enum>(B)</enum><text display-inline="yes-display-inline">was deemed to be a beneficiary of, and by,
			 the September 11th Victim Compensation Fund of 2001 (49 U.S.C. 40101);
			 and</text>
					</subparagraph><subparagraph id="HA1E667F64840408491EFCCA43272DDAC"><enum>(C)</enum><text display-inline="yes-display-inline">made a proffer of information to the
			 Secretary of Homeland Security between April 24, 2008, and August 15, 2008, in
			 connection with a request for immigration relief.</text>
					</subparagraph></paragraph><paragraph id="H4249102DB2D0428C82CD03FD8B354570"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">An alien shall not be provided any benefit
			 under this section if the Secretary of Homeland Security determines that the
			 alien has willfully made a material misrepresentation or material omission in
			 the proffer of information described in paragraph (1)(C).</text>
				</paragraph></subsection><subsection id="H6031F63FE5E5467BB7405AE9CEC5493E"><enum>(c)</enum><header>Work
			 authorization</header><text display-inline="yes-display-inline">The Secretary
			 of Homeland Security may authorize an alien who has applied for adjustment of
			 status under subsection (a) to engage in employment in the United States during
			 the pendency of such application.</text>
			</subsection><subsection id="H7F1B185F01404FBF89AEBB9B19708706"><enum>(d)</enum><header>Construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed
			 to limit the existing authority of the Secretary of Homeland Security on the
			 date of the enactment of this Act to require any form or other submission of
			 information or to perform any background or security check for the purpose of
			 determining the admissibility, or eligibility under this section, of any
			 alien.</text>
			</subsection><subsection id="H421524935DA5420F9BBBC068209D4ADB"><enum>(e)</enum><header>Waiver of
			 regulations</header><text display-inline="yes-display-inline">The Secretary of
			 Homeland Security shall issue guidance to carry out this section not later than
			 6 months after the date of the enactment of this Act, but is not required to
			 promulgate regulations prior to implementing this section.</text>
			</subsection><subsection id="HF3D272EDA9AC498AB19D83921F47DE06"><enum>(f)</enum><header>No offset in
			 number of visas available</header><text display-inline="yes-display-inline">When an alien is granted the status of
			 having been lawfully admitted for permanent residence under this section, the
			 Secretary of State shall not be required to reduce the number of immigrant
			 visas authorized to be issued under the Immigration and Nationality Act (8
			 U.S.C. 1101 et seq.).</text>
			</subsection><subsection id="H423420829BE14F2BBCA5DFBFD902A6E7"><enum>(g)</enum><header>Definitions</header><text>For
			 purposes of this section:</text>
				<paragraph id="H5A447E0D702B49D0824E86D5E65BAB07"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>applicable Federal tax
			 liability</quote> means liability for Federal taxes, including penalties and
			 interest, owed for any year for which the statutory period for assessment of
			 any deficiency for such taxes has not expired.</text>
				</paragraph><paragraph id="H1B3C15CC7A224EDE8D78062615518D3D"><enum>(2)</enum><text display-inline="yes-display-inline">Except as otherwise specifically provided
			 in this section, the definitions used in the Immigration and Nationality Act (8
			 U.S.C. 1101 et seq.) (excluding the definitions applicable exclusively to title
			 III of such Act) shall apply in the administration of this section.</text>
				</paragraph></subsection></section></legis-body>
