			 dollar limitation for all types of transportation fringe benefits</header>
			<subsection id="HF22CD56CD6744CE485F674429910F46C"><enum>(a)</enum><header>In
			 general</header><text>Paragraph (2) of section 132(f) of the Internal Revenue
			 Code of 1986 (relating to limitation on exclusion) is amended—</text>
				<paragraph id="HE80A79FFB6C24A7F00F5658961AE1EA"><enum>(1)</enum><text>by
			 striking <quote>$100</quote> in subparagraph (A) and inserting
			 <quote>$230</quote>, and</text>
				</paragraph><paragraph id="H74D41A193D9441598143EA180818A000"><enum>(2)</enum><text>by striking
			 <quote>$175</quote> in subparagraph (B) and inserting
			 <quote>$230</quote>.</text>
				</paragraph></subsection><subsection id="H58EEE6D33FD54246A26F86D68A1E1FA"><enum>(b)</enum><header>Inflation
			 adjustment conforming amendments</header><text>Subparagraph (A) of section
			 132(f)(6) of the Internal Revenue Code of 1986 (relating to inflation
			 adjustment) is amended—</text>
				<paragraph id="H3F9FE7A76699488EA232E240702FE12C"><enum>(1)</enum><text>by striking the
			 last sentence,</text>
				</paragraph><paragraph id="H68520B35715A4A4FA6B1CFEDC96100CA"><enum>(2)</enum><text>by striking
			 <quote>1999</quote> and inserting <quote>2010</quote>, and</text>
				</paragraph><paragraph id="HA343E1DF5F0349EB0000EECBD789D700"><enum>(3)</enum><text>by striking
			 <quote>1998</quote> and inserting <quote>2009</quote>.</text>
				</paragraph></subsection><subsection id="H499F0DEDB5004D14A0258B672EE0E288"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after December 31, 2009.</text>
			</subsection></section><section id="HE023DDC5A53A4EE9B45527279260169C"><enum>3.</enum><header>Clarification of
			 Federal employee benefits</header><text display-inline="no-display-inline">Section 7905 of title 5, United States Code,
			 is amended—</text>
			<paragraph id="HBAB0D99BAEF047FE8B9EFDEEAB7663D8"><enum>(1)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="H5C773266A9A942DE8D00937871F2304F"><enum>(A)</enum><text>in paragraph
			 (2)(C) by inserting <quote>and</quote> after the semicolon;</text>
				</subparagraph><subparagraph id="HAEB20D00AE804748BC8F93C42D2485EB"><enum>(B)</enum><text>in paragraph (3)
			 by striking <quote>; and</quote> and inserting a period; and</text>
				</subparagraph><subparagraph id="HA42EF6325A064994BAA6D5992D3CEEC3"><enum>(C)</enum><text>by striking
			 paragraph (4); and</text>
				</subparagraph></paragraph><paragraph id="H57A0811303C2494EBF1DA376AD85256F"><enum>(2)</enum><text>in subsection

			 self-employed individuals to receive transit fringe benefits</header>
			<subsection id="H13880F817EE64D888D3493B0B97E9747"><enum>(a)</enum><header>In
			 general</header><text>Subparagraph (E) of section 132(f)(5) is amended—</text>
				<paragraph id="HDBB2A7F278A04663945335DEDB72E32E"><enum>(1)</enum><text>by striking
			 <quote>For purposes of this subsection, the term</quote> and inserting the
			 following:</text>

				the meaning of section
				401(c)(1).</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H6325C786026B45DCA7592EBAB79F9496"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after December 31, 2009.</text>
			</subsection></section><section id="HADBB45C3A65149C08600F7092C007EC9"><enum>5.</enum><header>Parking cash-out
			 programs</header>
			<subsection id="HCD7FF34908A64752B72D919085575800"><enum>(a)</enum><header>In
			 general</header><text>Subparagraph (C) of section 132(f)(5) is amended—</text>
				<paragraph id="HFAB0532F495040D489DAD748538B4016"><enum>(1)</enum><text>by striking
			 <quote>The term</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="HC3F141E9EB32498AA93C7B110105EC8F" style="OLC">
						<clause id="H7F35CEDE87F54E3282C1C661BE15A7E8"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">The
				term</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H1CE878AB2E3440D68DF7EE71FB9E7D"><enum>(2)</enum><text>by
			 adding at the end of clause (i), as amended by paragraph (1), the following:
			 <quote>Such term shall not include any parking with respect to any specified
			 employer unless such employer establishes a parking cash-out program.</quote>,
			 and</text>
				</paragraph><paragraph id="H5AF27505F7724A02AF33AC0000363DAB"><enum>(3)</enum><text>by adding at the
			 end the following new clauses:</text>
					<quoted-block display-inline="no-display-inline" id="H03EF759E124B4DC18F20E7F6008E71F4" style="OLC">
						<clause id="H1082636A2FE84C07B29D3187A1E5EFA7"><enum>(ii)</enum><header>Specified
				employer</header><text display-inline="yes-display-inline">For purposes of this
				subparagraph, the term <term>specified employer</term> means any employer
				who—</text>
							<subclause id="H96994BC455CF4ED3A917896DCBBEEF96"><enum>(I)</enum><text display-inline="yes-display-inline">employs on average 50 or more employees
				during the calendar year,</text>
							</subclause><subclause id="HE338302333D748AEB85E3B7CE6D13491"><enum>(II)</enum><text>leases the
				parking facilities referred to in clause (i),</text>
							</subclause><subclause id="HF28900D5727D49EF855D7512E2EE4E7"><enum>(III)</enum><text>can separately
				determine the amount paid per parking space leased, and</text>
							</subclause><subclause id="H8F6913006C7349C5BD009B02BAE6C37C"><enum>(IV)</enum><text>can reduce the
				number of parking space leased (on a basis not less frequently than monthly)
				without penalty.</text>
							</subclause></clause><clause id="HFCEF41E74956496FBEABC2BB8186DACB"><enum>(iii)</enum><header>Parking
				cash-out program</header><text display-inline="yes-display-inline">For purposes
				of this subparagraph, the term <term>parking cash-out program</term> means a
				program established by the employer under which—</text>
							<subclause id="HAA3E7AF844FA438286C4B1A42C442E23"><enum>(I)</enum><text>the employer
				offers employees a cash allowance equal to the regular amount paid by the
				employer for parking for a single employee under clause (i) in lieu of the
				parking referred to in clause (i), and</text>
							</subclause><subclause id="H199A304EB80640F78653F8293F6BB362"><enum>(II)</enum><text>any employee
				electing the cash allowance shall certify to the employer that the employee
				will comply with guidelines established by the employer to avoid neighborhood
				parking problems and violation of such guidelines are enforced by the employer
				by termination of eligibility of such employee for such cash allowance and
				employer sponsored
				parking.</text>
							</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H7F6DBCCD12AA49B5B52395881C488E52"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to parking provided during calendar years beginning
			 after December 31, 2009.</text>
			</subsection></section><section id="HD127BE30FECE497E8D05D11200A59E61"><enum>6.</enum><header>Vanpool
			 investment credit</header>
			<subsection id="HDF3E98E9F713416AAC7B3CD3C75C8C6"><enum>(a)</enum><header>In
			 general</header><text>Subpart D of part IV of subchapter A of chapter 1 of the
			 Internal Revenue Code of 1986 is amended by adding at the end the following new
			 section:</text>
				<quoted-block id="HB3618A66BAA345EBB5183BC14FA3FCC" style="OLC">
					<section id="H3F3D72EA4F384C7EB492B603D4F029CD"><enum>45R.</enum><header>Qualifying
				vanpool investment credit</header>
						<subsection id="HFE5F567F760443AC9BCD15CA216BFFCE"><enum>(a)</enum><header>General
				rule</header><text display-inline="yes-display-inline">For purposes of section
				38, the qualifying vanpool investment credit for any taxable year is an amount
				equal to 10 percent of the basis of a qualified commuter van placed in service
				by the taxpayer during the taxable year.</text>
						</subsection><subsection id="HCCB92B1B19684EAC8102FE226FCAAF62"><enum>(b)</enum><header>Qualified
				commuter van</header><text display-inline="yes-display-inline">For purposes of
				this section, the term <term>qualified commuter van</term> means a
				vehicle—</text>
							<paragraph id="H6C00C2D5CAED4AD78AA5392D337AB58D"><enum>(1)</enum><text>the seating
				capacity of which is at least 8, but not more than 15, adults (not including
				the driver),</text>
							</paragraph><paragraph id="HA2D41526C51E4B43B2CD524DECCADEF3"><enum>(2)</enum><text>which has a 3-year
				class life,</text>
							</paragraph><paragraph id="HDA5F5288CBFC49328C32164B3FF2F004"><enum>(3)</enum><text>at least 80
				percent of the mileage use of which can reasonably be expected to be for
				transportation described in section 132(f)(1)(A),</text>
							</paragraph><paragraph id="HF68CD7EA8C664FFEA7526F30988DA58D"><enum>(4)</enum><text display-inline="yes-display-inline">with respect to which depreciation (or
				amortization in lieu of depreciation) is allowable, and</text>
							</paragraph><paragraph id="HB12B54BAD9C74E3BB1F410C37F1DB6EE"><enum>(5)</enum><text>is originally
				placed in service by the taxpayer before January 1, 2013.</text>
							</paragraph></subsection><subsection id="H293D9CAF82864166B8D2F1CED09B6C94"><enum>(c)</enum><header>Contracting for
				services exception</header>
							<paragraph id="H68762E2DD3C84EC89CD917F5497ECCD"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the case of an
				employer who contracts with an unrelated person for the provision of
				transportation described in section 132(f)(1)(A) and who makes an election
				under this subsection for a taxable year (in such form and manner as the
				Secretary may by regulation prescribe), in lieu of the amount determined under
				subsection (a), the qualifying vanpool investment credit with respect to the
				taxpayer for the taxable year shall be an amount equal to 10 percent of the
				amounts paid or incurred by the employer for the taxable year pursuant to such
				contract for the provision of such transportation.</text>
							</paragraph><paragraph commented="no" id="HBFDD2C96F94F4BE48EFFC008C9FAF81C"><enum>(2)</enum><header>Related
				persons</header><text>All persons treated as a single employer under subsection
				(a) or (b) of section 52 shall be treated as related persons for purposes of
				this subsection.</text>
							</paragraph><paragraph id="HAB4D886B3E80478890A88DCB994CD62"><enum>(3)</enum><header>Termination</header><text>This
				subsection shall not apply to any amounts paid or incurred after December 31,
				2012.</text>
							</paragraph></subsection><subsection id="H5399DC277D5C400693A5C3241EB6DC00"><enum>(d)</enum><header>Basis
				reduction</header><text>For purposes of this subtitle, the basis of any
				property for which a credit is allowable under subsection (a) shall be reduced
				by the amount of such
				credit.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H8C95023B2F774C7D8F16C81B13020033"><enum>(b)</enum><header>Credit treated
			 as part of general business credit</header><text>Section 38(b) of such Code is
			 amended by striking <quote>plus</quote> at the end of paragraph (34), by
			 striking the period at the end of paragraph (35) and inserting <quote>,
			 plus</quote>, and by adding at the end of following new paragraph:</text>
				<quoted-block id="HDB5E682A88224156AFF1B29CF7557E43" style="OLC">
					<paragraph id="H1228CB6FBDA64345A129DEFF0068161D"><enum>(36)</enum><text display-inline="yes-display-inline">the qualifying vanpool investment credit
				determined under section
				45R(a).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H619A563047184807B440895F34E1F782"><enum>(c)</enum><header>Conforming
			 amendment</header><text>Subsection (a) of section 1016 of such Code is amended
			 by striking <quote>and</quote> at the end of paragraph (36), by striking the
			 period at the end of paragraph (37) and inserting <quote>, and</quote>, and by
			 adding at the end the following new paragraph:</text>
				<quoted-block id="H151974AB37BB4DFA829215087EC3E700" style="OLC">
					<paragraph id="H91DA941B7DA04201AAF5EB0349FC114E"><enum>(38)</enum><text>to the extent
				provided in section 45R(e), in the case of amounts with respect to which a
				credit has been allowed under section
				45R.</text>
					</paragraph><after-quoted-block></after-quoted-block></quoted-block>
			</subsection><subsection id="H34F0C162C64E4C9199A43CCD7782DED5"><enum>(d)</enum><header>Clerical
			 amendment</header><text>The table of sections for subpart D of part IV of
			 subchapter A of chapter 1 of such Code is amended by adding at the end the
			 following new item:</text>

						<toc-entry level="section">Sec. 45R. Qualifying vanpool investment

			</subsection><subsection id="H1CBF464E5FD64E3EB22F98C7BE5B59BE"><enum>(e)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to property
			 placed in service, and amounts paid or incurred, after December 31,
			 2009.</text>
			</subsection></section><section id="H40A95F0B37DA4876A59C0067F4AB7133"><enum>7.</enum><header>Refundable
			 employer credit for providing tax-free transit passes to employees</header>
			<subsection id="H1DE39BBAE3CA4356B95CCD23D7E0528B"><enum>(a)</enum><header>In
			 General</header><text>Subpart C of part IV of subchapter A of chapter 1 of the
			 Internal Revenue Code of 1986 (relating to refundable credits) is amended by
			 inserting after section 36A the following new section:</text>
				<quoted-block id="HFF45B219A1D04234B0FAB32EF82089BE" style="OLC">
					<section id="H552929F394A444BC8DBA993FAF50ED72"><enum>36B.</enum><header>Employers
				providing tax-free transit passes to employees</header>
						<subsection id="H5F666BCB9B964DA7B58FB569C32D3C67"><enum>(a)</enum><header>In
				General</header><text>In the case of an employer, there shall be allowed as a
				credit against the tax imposed by this subtitle for the taxable year an amount
				equal to 50 percent of the amount paid or incurred by the taxpayer during the
				taxable year—</text>
							<paragraph id="H556CCD2154174D69B07D87B624E87BB2"><enum>(1)</enum><text>for transit passes
				provided to employees of such employer, and</text>
							</paragraph><paragraph id="H94337492F4A941C7852675C15DE03509"><enum>(2)</enum><text>as cash
				reimbursements made to such employees for transit passes purchased by such
				employees.</text>
							</paragraph></subsection><subsection id="HC78082A8603643E4ADA774644FACE0F3"><enum>(b)</enum><header>Limitation to
				Tax-Free Transit Passes</header><text>Subsection (a) shall apply to a transit
				pass (or reimbursement) provided to an employee only to the extent that the
				employer reasonably expects that the value of such pass (or the amount of such
				reimbursement) is excludable from such employee’s income under section
				132.</text>
						</subsection><subsection id="HF3B27832184A49FE83F3BCCDFB5B58B0"><enum>(c)</enum><header>Exclusion of
				Nontaxpayers</header><text>Subsection (a) shall not apply to any employer which
				is exempt from the tax imposed by this chapter with respect to the activity in
				which the employee is performing services for the employer.</text>
						</subsection><subsection id="H3D821D0C724E4CE0A3E600169CE6FEAE"><enum>(d)</enum><header>Definitions</header><text>Terms
				used in this section shall have the respective meanings given such terms by
				section
				132.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H8E5E6752BA8047119B05FC8069922105"><enum>(b)</enum><header>Denial of Double
			 Benefit</header><text>Section 280C of such Code is amended by adding at the end
			 the following new subsection:</text>
				<quoted-block id="HF3640A41FA8F4B4996335962C400CDC0" style="OLC">
					<subsection id="H8001700C36ED4E0A00FE9951DE8C00C9"><enum>(g)</enum><header>Employer Credit
				for Providing Tax-Free Transit Passes to Employees</header><text>No deduction
				shall be allowed for that portion of the expenses (otherwise allowable as a
				deduction) taken into account in determining the credit under section 36B for
				the taxable year which is equal to the amount of the credit allowable for such
				taxable year under section
				36B(a).</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HB76A8F845D4C45A7A0692093F1B5E619"><enum>(c)</enum><header>Clerical
			 Amendment</header><text>The table of sections for such subpart C is amended by
			 inserting after the item relating to section 36A the following new item:</text>

			 Date</header><text>The amendments made by this section shall apply to transit
			 passes provided after the date of the enactment of this Act.</text>
			</subsection></section><section id="H3EB11C3AC8E54DF6AD4407B030051A7"><enum>8.</enum><header>Expenditures to
			 provide bicycle access</header>

			 general</header><text display-inline="yes-display-inline">Subpart D of part IV
			 of subchapter A of chapter 1 of the Internal Revenue Code of 1986, as amended
			 by this Act, is amended by adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H64B2025DF3754E7D8E1313DBD039152C" style="OLC">
					<section id="HAD2EED46F040490F99426462AA80CD28"><enum>45S.</enum><header>Expenditures to
				provide bicycle access</header>
						<subsection id="H98CB0EF331BF44CEAF2EF12918E0E538"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">For purposes of
				section 38, the amount of the bicycle access credit determined under this
				section for any taxable year shall be an amount equal to 50 percent of so much
				of the eligible bicycle access expenditures for the taxable year as exceed $250
				but do not exceed $10,250.</text>
						</subsection><subsection id="H35428ABD5B3D4636BDA2B084D6B7B02"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section—</text>
							<paragraph id="HD7A6F1E542114A84986DE8A05E10F6FE"><enum>(1)</enum><header>Eligible bicycle
				access expenditures</header>
								<subparagraph id="H629B35C4FA674B50AB5C8BCA4831DD67"><enum>(A)</enum><header>In
				general</header><text>The term <term>eligible bicycle access
				expenditures</term> means amounts paid or incurred for the purpose of improving
				access, security, or convenience with respect to bicycle travel to or from a
				business of the taxpayer.</text>
								</subparagraph><subparagraph id="HD4A20151ECA94940A6001BD8F0BA164D"><enum>(B)</enum><header>Expenditures
				must be reasonable</header><text display-inline="yes-display-inline">Amounts
				paid or incurred for the purposes described in subparagraph (A) shall include
				only expenditures which are reasonable and shall not include expenditures which
				are unnecessary to accomplish such purposes.</text>
								</subparagraph><subparagraph id="HFED5E12A7A544EC3B0ADD699CA6F1D42"><enum>(C)</enum><header>Expenses in
				connection with new construction not eligible</header><text display-inline="yes-display-inline">The term <term>eligible bicycle access
				expenditures</term> shall not include amounts which are paid or incurred in
				connection with any facility first placed in service after the date of the
				enactment of this section.</text>
								</subparagraph></paragraph><paragraph id="H366DDF4B63FC44E681F7A9A9AB1F3376"><enum>(2)</enum><header>Eligible small
				business</header><text display-inline="yes-display-inline">For purposes of this
				section, the term <term>eligible small business</term> shall have the meaning
				given such term by section 44(b).</text>
							</paragraph></subsection><subsection id="H710293F35C32438AA7B477BC003CD292"><enum>(c)</enum><header>Special
				rules</header><text>Rules similar to the rules of paragraphs (2), (3), (4),
				(6), and (7) of section 44(d) shall apply for purposes of this section.</text>
						</subsection><subsection id="H2A7AA48D50F24C7A9085D85DB271EC97"><enum>(d)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary shall prescribe regulations
				necessary to carry out the purposes of this
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H811D51D1563544A0BE765B6973E200B1"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="HA8946EBC4FAF49F88FE5776CD61E957F"><enum>(1)</enum><text>Subsection (b) of
			 section 38 of such Code, as amended by this Act, is amended by striking
			 <quote>plus</quote> at the end of paragraph (35), by striking the period at the
			 end of paragraph (36) and inserting <quote>, plus</quote>, and by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HB09BD08680184E8692FC8216647CBDE4" style="OLC">

			</subsection></section><section id="HD2DF7D7D8E0741AB985E17D64620AD81"><enum>9.</enum><header>Employees may
			 receive transit passes and reimbursement of bicycle commuting expenses as
			 excludable fringe benefits for the same month</header>
			<subsection id="HB2F18075544C40F0A420B93900CD4300"><enum>(a)</enum><header>In
			 general</header><text>Subclause (II) of section 132(f)(5)(F)(iii) of the
			 Internal Revenue Code of 1986 (defining qualified bicycling month) is amended
			 by striking <quote>, (B),</quote>.</text>
			</subsection><subsection id="HE8AD9CBDE1B445CC8C70C5498FE9CC1"><enum>(b)</enum><header>Limitation</header><text>Subparagraph
			 (A) of section 132(f)(2) of such Code (relating to limitation on exclusions) is
			 amended by striking <quote>and (B)</quote> and inserting <quote>, (B), and
			 (D)</quote>.</text>
			</subsection><subsection id="HB3C75EBD976144F599034DD15915378D"><enum>(c)</enum><header>Repeal of
			 constructive receipt treatment of bicycle commuting
			 reimbursements</header><text>Paragraph (4) of section 132(f) of such Code is
			 amended by striking <quote>(other than a qualified bicycle commuting
			 reimbursement)</quote>.</text>
			</subsection><subsection id="HC99358389A0B4C838FE4426EBF2DD1ED"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after December 31, 2008.</text>
			</subsection></section><section id="H468A1B1C239D4301A4166B349C5C1B97"><enum>10.</enum><header>Deduction for
			 expenditures to remove architectural and transportation barriers to bicycle
			 access</header>
			<subsection id="H01B0D52EAC3B47D9A1178E2B8004847D"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Part VI of subchapter
			 B of chapter 1 of the Internal Revenue Code of 1986 is amended by inserting
			 after section 190 the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H71683E2A7CB3414AA776872CA4A45152" style="OLC">
					<section id="H895881ACDADB41558FAE7DDF677DF94F"><enum>190A.</enum><header>Expenditures
				to remove architectural and transportation barrier to bicycle access</header>
						<subsection id="H3FDBBB5448A649AAB1006B09961E9200"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">A taxpayer may elect
				(at such time and in such manner as the Secretary shall by regulation
				prescribe) to treat architectural and transportation barrier removal expenses
				of the taxpayer for the taxable year as expenses which are not chargeable to
				capital account. The expenditures so treated shall be allowed as a
				deduction.</text>
						</subsection><subsection id="H28C226802E554DB4BFAAA5474FFF67C7"><enum>(b)</enum><header>Architectural
				and transportation barrier removal expenses</header><text display-inline="yes-display-inline">For purposes of this section, the term
				<term>architectural and transportation barrier removal expenses</term> means
				amounts paid or incurred for the purpose of making any facility or public
				transportation vehicle owned or leased by the taxpayer for use in connection
				with his trade or business more secure, accessible to, and convenient for use
				by individuals traveling by bicycle.</text>
						</subsection><subsection id="H1A33C9D1BC734D3C86604E928066D4B4"><enum>(c)</enum><header>Limitation</header><text>The
				deduction allowed by subsection (a) for any taxable year shall not exceed
				$15,000.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H94429255392D4FBB817F03ABF4E28CC7"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="HB750542EADAD451DA975A604E0F7A147"><enum>(1)</enum><text>Paragraph (1) of
			 section 263(a) of such Code is amended by striking <quote>or</quote> at the end
			 of subparagraph (K), by striking the period at the end of subparagraph (L) and
			 inserting <quote>, or</quote>, and by adding at the end the following new
			 subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H3FA9D87223FF4A11B3B97F4DE451FBF2" style="OLC">
						<subparagraph id="H7A3CA6EB00874B3BAFB9C08E45859CA5"><enum>(M)</enum><text display-inline="yes-display-inline">expenditures for which a deduction is
				allowed under section
				190A.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HFCA71C94373C45208BC91E63FD9446C1"><enum>(2)</enum><text>Section
			 1245(a)(2)(C) of such Code is amended by inserting <quote>190A,</quote> after
			 <quote>190,</quote>.</text>
				</paragraph><paragraph id="H1C7C592B0D7E45F88083CD9DDCE0B608"><enum>(3)</enum><text>The table of
			 sections for part VI of subchapter B of chapter 1 of such Code is amended by
			 inserting after the item relating to section 190 the following new item:</text>

			 this section shall apply to taxable years beginning after the date of the
			 enactment of this Act.</text>
			</subsection></section><section display-inline="no-display-inline" id="HED660AAAB56441BFAD53540D66412083" section-type="subsequent-section"><enum>11.</enum><header>Credit for
			 teleworking</header>
			<subsection id="H1B51A7DA3E0E43F0831EF7100FF66325"><enum>(a)</enum><header>In
			 General</header><text>Subpart B of part IV of subchapter A of chapter 1 of the
			 Internal Revenue Code of 1986 (relating to foreign tax credit, etc.) is amended
			 by adding at the end the following new section:</text>
				<quoted-block id="H09B2B832D572454A8A5B5A9876BBF55C" style="OLC">
					<section id="H2D45F92E5F634A1CBAA29250183327C7"><enum>30E.</enum><header>Telework
				credit</header>
						<subsection id="H0F72C27C15A441A6B84311391EAF6A14"><enum>(a)</enum><header>Allowance of
				Credit</header><text>In the case of an eligible taxpayer, there shall be
				allowed as a credit against the tax imposed by this chapter for the taxable
				year an amount equal to the qualified teleworking expenses paid or incurred by
				the taxpayer during such year.</text>
						</subsection><subsection id="HE2CD1850E5DB40958EBBFAA1CDEAE8D9"><enum>(b)</enum><header>Maximum
				Credit</header>
							<paragraph id="HFEA8FF91C7444DDBB0ED047A69F5BE19"><enum>(1)</enum><header>Per teleworker
				limitation</header><text>The credit allowed by subsection (a) for a taxable
				year with respect to qualified teleworking expenses paid or incurred by or on
				behalf of an individual teleworker shall not exceed $400.</text>
							</paragraph><paragraph id="H6519D471CCDF493A9F1570C6389DC9F2"><enum>(2)</enum><header>Reduction for
				teleworking less than full year</header><text>In the case of an individual who
				is in a teleworking arrangement for less than a full taxable year, the amount
				referred to paragraph (1) shall be reduced by an amount which bears the same
				ratio to $400 as the number of months in which such individual is not in a
				teleworking arrangement bears to 12. For purposes of the preceding sentence, an
				individual shall be treated as being in a teleworking arrangement for a month
				if the individual is subject to such arrangement for any day of such
				month.</text>
							</paragraph></subsection><subsection id="HEE31C2AEBA28450795487A93810D8CC1"><enum>(c)</enum><header>Definitions</header><text>For
				purposes of this section—</text>
							<paragraph id="HAEC5613D078448F189467AC9AE7E6CB6"><enum>(1)</enum><header>Eligible
				taxpayer</header><text>The term <term>eligible taxpayer</term> means—</text>
								<subparagraph id="HA03E61ADCD2241D7840705DC29695618"><enum>(A)</enum><text>in the case of an
				individual, an individual who performs services for an employer under a
				teleworking arrangement, or</text>
								</subparagraph><subparagraph id="HE21D3E38A50641C1860020A81F3FB8C1"><enum>(B)</enum><text>in the case of an
				employer, an employer for whom employees perform services under a teleworking
				arrangement.</text>
								</subparagraph></paragraph><paragraph id="H4CE7A56158D14040B7BCB1D8FFA85100"><enum>(2)</enum><header>Teleworking
				arrangement</header><text>The term <term>teleworking arrangement</term> means
				an arrangement under which an employee teleworks for an employer at least 1 day
				per week.</text>
							</paragraph><paragraph id="H37436EC9BC294924A57694ACDC5526D3"><enum>(3)</enum><header>Qualified
				teleworking expenses</header><text>The term <term>qualified teleworking
				expenses</term> means expenses paid or incurred under a teleworking
				arrangement—</text>
								<subparagraph id="H0BF28640C62844B9B18C3268DCF4DCBC"><enum>(A)</enum><text>for purchase or
				installation of any electronic information or telecommunication equipment which
				is used to enable an individual to telework, or</text>
								</subparagraph><subparagraph id="H50132680E3364F049FD18C4F812F2B76"><enum>(B)</enum><text>for any
				telecommunications service, or Internet access (or related services), relating
				to the use of such equipment.</text>
								</subparagraph></paragraph><paragraph id="HA882B344F43F4A52ABB58DCBF89AC169"><enum>(4)</enum><header>Telework</header><text>The
				term <term>telework</term> means to perform work functions, using electronic
				information and communication technologies, thereby reducing or eliminating the
				physical commute to and from the traditional worksite.</text>
							</paragraph></subsection><subsection id="H7569E3B3C3934F6482C180AF6FD05A55"><enum>(d)</enum><header>Limitation Based
				on Amount of Tax</header>
							<paragraph id="HB77D7B9C45F94EFC9746BCB1496EE46B"><enum>(1)</enum><header>Liability for
				tax</header><text>The credit allowable under subsection (a) for any taxable
				year shall not exceed the excess (if any) of—</text>
								<subparagraph id="H05A5987F2A5A45F0814410E4B92F11F6"><enum>(A)</enum><text>the regular tax
				for the taxable year, reduced by the sum of the credits allowable under subpart
				A and the preceding sections of this subpart, over</text>
								</subparagraph><subparagraph id="HA087F72BDCB0452EBFFA52FAC1981232"><enum>(B)</enum><text>the tentative
				minimum tax for the taxable year.</text>
								</subparagraph></paragraph><paragraph id="H755AA0FCBF664BE389D4FDBD8587A55C"><enum>(2)</enum><header>Carryforward of
				unused credit</header><text>If the amount of the credit allowable under
				subsection (a) for any taxable year exceeds the limitation under paragraph (1)
				for the taxable year, the excess shall be carried to the succeeding taxable
				year and added to the amount allowable as a credit under subsection (a) for
				such succeeding taxable year.</text>
							</paragraph></subsection><subsection id="H088D7FCF4EC14074A0A98B00443EF5B9"><enum>(e)</enum><header>Special
				Rules</header>
							<paragraph id="H5DC5ECEDE00242A682F7F5410553CBE2"><enum>(1)</enum><header>Basis
				reduction</header><text>For purposes of this subtitle, the basis of any
				property for which a credit is allowable under subsection (a) shall be reduced
				by the amount of such credit (determined without regard to subsection
				(d)).</text>
							</paragraph><paragraph id="H2E789551877E495EA1E315C5914B11A1"><enum>(2)</enum><header>Recapture</header><text>The
				Secretary shall, by regulations, provide for recapturing the benefit of any
				credit allowable under subsection (a) with respect to any property which ceases
				to be property eligible for such credit.</text>
							</paragraph><paragraph id="H968EA45100C84302A0B78D43A336D895"><enum>(3)</enum><header>Property used
				outside United States, etc., not qualified</header><text>No credit shall be
				allowed under subsection (a) with respect to any property referred to in
				section 50(b) or with respect to the portion of the cost of any property taken
				into account under section 179.</text>
							</paragraph><paragraph id="H1EAD0A25330F4FD18083BAA326C060D5"><enum>(4)</enum><header>Election not to
				take credit</header><text>No credit shall be allowed under subsection (a) for
				any expense if the taxpayer elects to have this section not apply with respect
				to such expense.</text>
							</paragraph><paragraph id="H0DED56FA3299440CAE339CED4DAB0623"><enum>(5)</enum><header>Denial of double
				benefit</header><text>No deduction or credit (other than under this section)
				shall be allowed under this chapter with respect to any expense which is taken
				into account in determining the credit under this section.</text>
							</paragraph></subsection><subsection id="H0D822F378F124C4CAD75BC61ABDC7C14"><enum>(f)</enum><header>Reporting
				requirement</header>
							<paragraph id="H26F09F25C7ED4FA088364FE28618684D"><enum>(1)</enum><header>In
				general</header><text>In the case of an eligible taxpayer who is an employer,
				no credit shall be allowed under this section for qualified teleworking
				expenses of the employer with respect to such employer’s employees unless the
				taxpayer submits to the Secretary (in such form and manner as the Secretary may
				prescribe)—</text>
								<subparagraph id="H2607D40FEBBA4B9B8F9A401AA20F94DA"><enum>(A)</enum><text>the survey
				described in paragraph (2), and</text>
								</subparagraph><subparagraph id="H1F3A4F48907941F3A1979634F1FA4756"><enum>(B)</enum><text>a detailed
				description of the teleworking policies of the employer, including a
				description of—</text>
									<clause id="HCAD743574724445B9254C9AADAFE8A45"><enum>(i)</enum><text>which employees of
				the employer are eligible to telework,</text>
									</clause><clause id="H8D9BCF036C0D4B108FC856E9B9EEB270"><enum>(ii)</enum><text>any employer
				goals relating to teleworking, and any progress with respect to such goals,
				and</text>
									</clause><clause id="H55ACAD66098A4AE8997DA2CAB3A13CBD"><enum>(iii)</enum><text>any materials or
				resources of the employer intended to promote or enable teleworking.</text>
									</clause></subparagraph></paragraph><paragraph id="HB8B7FCFA94204654AF69C0428495D675"><enum>(2)</enum><header>Call for
				Telework Data Survey</header><text>The Secretary shall, in consultation with
				the Office of Personnel Management, establish, make publicly available to
				taxpayers, and update as appropriate, a survey designed to track teleworking
				trends among employers allowed credits under this section.</text>
							</paragraph><paragraph id="H4BCCFF72288D4D0DBDBA83D37F54EF8B"><enum>(3)</enum><header>Report to
				Congress</header><text display-inline="yes-display-inline">Not later than
				October 15 of each calendar year, the Secretary shall submit to the Congress,
				and make publicly available on the Internet and at the offices of the Internal
				Revenue Service, a report, which shall include a summary of the information
				contained in the submissions under paragraph (1) for taxable years ending in
				the previous calendar
				year.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HFCFF4286671B4C6D89BEF2F1DFF68EEA"><enum>(b)</enum><header>Conforming
			 Amendment</header><text>Subsection (a) of section 1016 of such Code, as amended
			 by this Act, is amended by striking <quote>and</quote> at the end of paragraph
			 (37), by striking the period at the end of paragraph (38) and inserting
			 <quote>, and</quote>, and by adding at the end the following new
			 paragraph:</text>
				<quoted-block id="HD5006C5696B141AB88295A54BF1A4050" style="OLC">
					<paragraph id="HCD15B39EC7274DFCAB1D9B33FCB5615A"><enum>(39)</enum><text>to the extent
				provided in section 30E(e), in the case of amounts with respect to which a

			</subsection><subsection id="H477ECCDD22254B84808CA4FCFBBD3C9B"><enum>(c)</enum><header>Clerical
			 Amendment</header><text>The table of sections for subpart B of part IV of
			 subchapter A of chapter 1 of such Code is amended by adding at the end the
			 following new item:</text>
