		<section id="H6FD44A2CC8A34B26A4F25072CEAB9435" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Military Family Leave Act of
			 2009</short-title></quote>.</text>
		</section><section id="HCFEBCFB3DF6147A4A8523976F89A83EA"><enum>2.</enum><header>Annual leave for
			 family of deployed members of the uniformed services</header>
			<subsection id="HD0D9DFB2F144418993E86D4D6B857E3E"><enum>(a)</enum><header>In
			 general</header><text>Part III of title 38, United States Code, is amended by
			 adding at the end the following new chapter:</text>

						<section id="HA39709F411E14E1C9D2B458A0C8D2F89"><enum>4401.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter:</text>
							<paragraph id="H49B0AE35964041668CC4F3935540F239"><enum>(1)</enum><text>The terms
				<term>benefit</term>, <term>rights and benefits</term>, <term>employee</term>,
				<term>employer</term>, and <term>uniformed services</term> have the meaning
				given such terms in section 4303 of this title.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H99820F8F634E457D968654FE44C55373"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>contingency operation</term>
				has the same meaning given such term in section 101(a)(13) of title 10.</text>
							</paragraph><paragraph id="H9495E5579F654E5DBDA4EBCFB5F1F0F7"><enum>(3)</enum><text>The term
				<term>eligible employee</term> means an individual who is—</text>
								<subparagraph id="HD2E0543C6C904C018EFE46B926346BD2"><enum>(A)</enum><text>a family member of
				a member of a uniformed service; and</text>
								</subparagraph><subparagraph id="H652C1AF6F280407AA291E7A729899D0A"><enum>(B)</enum><text>an employee of the
				employer with respect to whom leave is requested under section 4402 of this
				title.</text>
								</subparagraph></paragraph><paragraph id="HC48D6BD6BC954E5FA6E658E2AA9F2B11"><enum>(4)</enum><text>The term
				<term>family member</term> means an individual who is, with respect to another
				individual, one of the following:</text>
								<subparagraph id="HA95FCF25C600425E8E4A555A7F1F8488"><enum>(A)</enum><text>The spouse of the
				other individual.</text>
								</subparagraph><subparagraph id="HB87BB5EF73B042CDABC3CC04FBBF9D8A"><enum>(B)</enum><text>A son or daughter
				of the other individual.</text>
								</subparagraph><subparagraph id="HC298F4A5A9024378B63A3493264BBEEB"><enum>(C)</enum><text>A parent of the
				other individual.</text>
								</subparagraph></paragraph><paragraph commented="no" id="H65C8C7C8A80046A4905E294F6356EEFE"><enum>(5)</enum><text>The term
				<term>reduced leave schedule</term> means a leave schedule that reduces the
				usual number of hours per workweek, or hours per workday, of an
				employee.</text>
							</paragraph><paragraph commented="no" id="H155DB6280B1C41ACA90904957DBBA6C4"><enum>(6)</enum><text>The terms
				<term>spouse</term>, <term>son or daughter</term>, and <term>parent</term> have
				the meaning given such terms in section 101 of the Family and Medical Leave Act
				of 1993 (29 U.S.C. 2611).</text>
							</paragraph></section><section id="H1036DDBE21D346F39AFC83EF3FA25640"><enum>4402.</enum><header>Leave
				requirement</header>
							<subsection id="H3142B24F25114B9F91D6923AB13EA3FC"><enum>(a)</enum><header>Entitlement to
				leave</header><text display-inline="yes-display-inline">In any 12-month period,
				an eligible employee shall be entitled to two workweeks of leave for each
				family member of the eligible employee who, during such 12-month period—</text>
								<paragraph id="HDC1B3630D2A94746A6A93BFF22B888AC"><enum>(1)</enum><text display-inline="yes-display-inline">is in the uniformed services; and</text>
								</paragraph><paragraph id="H21BE83346BB2406BBCD30A5BDC86FD18"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H245057A8518345F0BBB44FC660802A5A"><enum>(A)</enum><text display-inline="yes-display-inline">receives notification of an impending call
				or order to active duty in support of a contingency operation; or</text>
									</subparagraph><subparagraph id="H324A2AEA997E4823AC9B77AD9B62844D" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">is
				deployed in connection with a contingency operation.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H515246AE953D42199E3FAF6C45F4F5C1"><enum>(b)</enum><header display-inline="yes-display-inline">Leave taken intermittently or on reduced
				leave schedule</header><paragraph commented="no" display-inline="yes-display-inline" id="H77CAFC66F8FF444C823AD6C9A689AF2C"><enum>(1)</enum><text>Leave under subsection
				(a) may be taken by an eligible employee intermittently or on a reduced leave
				schedule as the eligible employee considers appropriate.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0572FDDAC1AA4D78A91220AB9F762E76" indent="up1"><enum>(2)</enum><text>The taking of leave intermittently or
				on a reduced leave schedule pursuant to this subsection shall not result in a
				reduction in the total amount of leave to which the eligible employee is
				entitled under subsection (a) beyond the amount of leave actually taken.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3D38A913C73A435EA2BBE8DE938B3D53"><enum>(c)</enum><header display-inline="yes-display-inline">Paid leave permitted</header><text display-inline="yes-display-inline">Leave granted under subsection (a) may
				consist of paid leave or unpaid leave as the employer of the eligible employee
				considers appropriate.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="HCF9DF870636F459CA5C289B8430649FE"><enum>(d)</enum><header display-inline="yes-display-inline">Relationship
				to paid leave</header><paragraph commented="no" display-inline="yes-display-inline" id="H4948030B99AF49528AFD90BACADA7B75"><enum>(1)</enum><text>If an employer provides
				paid leave to an eligible employee for fewer than the total number of workweeks
				of leave that the eligible employee is entitled to under subsection (a), the
				additional amount of leave necessary to attain the total number of workweeks of
				leave required under subsection (a) may be provided without
				compensation.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6E3AB11640654A0092B3A222846C45C3" indent="up1"><enum>(2)</enum><text>An eligible employee may elect, and
				an employer may not require the eligible employee, to substitute any of the
				accrued paid vacation leave, personal leave, or family leave of the eligible
				employee for leave provided under subsection (a) for any part of the total
				period of such leave the eligible employee is entitled to under such
				subsection.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8D521DFDD9AB449BA498D3D027886C0C"><enum>(e)</enum><header display-inline="yes-display-inline">Notice for leave</header><text>In any case
				in which an eligible employee chooses to use leave under subsection (a), the
				eligible employee shall provide such notice to the employer as is reasonable
				and practicable.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="HCD26F21F4DBE4FB3AFCAD871D58D1591"><enum>4403.</enum><header display-inline="yes-display-inline">Certification</header>
							<subsection commented="no" display-inline="no-display-inline" id="H0556BDF770664683853DCA9D6B1F1A71"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">An employer may
				require that a request for leave under section 4402(a) of this title be
				supported by a certification of entitlement to such leave.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="HD7DB7223F8EE4F9C862CEA1C3B61EB09"><enum>(b)</enum><header>Timeliness of
				certification</header><text display-inline="yes-display-inline">An eligible
				employee shall provide, in a timely manner, a copy of the certification
				required by subsection (a) to the employer.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H0F233EA671BD4A6488387CF14E23F8DB"><enum>(c)</enum><header>Sufficient
				certification</header><text>A copy of the notification, call, or order
				described in section 4402(a)(2) of this title shall be considered sufficient
				certification of entitlement to leave for purposes of providing certification
				under this section. The Secretary may prescribe such additional forms and
				manners of certification as the Secretary considers appropriate for purposes of
				providing certification under this section.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="H5F38A7C8FA164786AF4405421F7BB136"><enum>4404.</enum><header display-inline="yes-display-inline">Employment and benefits protection</header>
							<subsection commented="no" display-inline="no-display-inline" id="HE8C425D4B0824704AC6259BF84D17FB8"><enum>(a)</enum><header>In
				general</header><text>An eligible employee who takes leave under section 4402
				of this title for the intended purpose of the leave shall be entitled, on
				return from such leave—</text>
								<paragraph id="H341D37E9639B4672BC60BFFF54EA28EE"><enum>(1)</enum><text>to be restored by
				the employer to the position of employment held by the eligible employee when
				the leave commenced; or</text>
								</paragraph><paragraph id="HB546E6CD485A4DE38A449E09F34AF3D9"><enum>(2)</enum><text>to be restored to
				an equivalent position with equivalent rights and benefits of
				employment.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H87C8B68E8C4D466983129F2AD4357AC9"><enum>(b)</enum><header>Loss of
				benefits</header><text>The taking of leave under section 4402 of this title
				shall not result in the loss of any employment benefit accrued prior to the
				date on which the leave commenced.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H49E29B0E4E794216B9AEA672D6F60067"><enum>(c)</enum><header>Limitations</header><text>Nothing
				in this section shall be construed to entitle any restored employee to—</text>
								<paragraph id="H7BF86CE7D10746F1BE16B9B0B5DF5B87"><enum>(1)</enum><text>the accrual of any
				seniority or employment benefits during any period of leave; or</text>
								</paragraph><paragraph id="H79F8A588516940CEAAA5D2F4F2784309"><enum>(2)</enum><text>any right,
				benefit, or position of employment other than any right, benefit, or position
				to which the employee would have been entitled had the employee not taken the
				leave.</text>
								</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H3DD8DB0CB74E47ED95387DA892DAECB7"><enum>4405.</enum><header>Prohibited
				acts</header>
							<subsection commented="no" display-inline="no-display-inline" id="HCD990E0E08F64BC19987E8951EECD765"><enum>(a)</enum><header>Exercise of
				rights</header><text>It shall be unlawful for any employer to interfere with,
				restrain, or deny the exercise of or the attempt to exercise, any right
				provided under this chapter.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="HF330AE232AB54BD0B4AE6DF1B0D22F7A"><enum>(b)</enum><header>Discrimination</header><text>It
				shall be unlawful for any employer to discharge or in any other manner
				discriminate against any individual for opposing any practice made unlawful by
				this chapter.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="H7B4CB385788140BEBBB56CB2EA365209"><enum>4406.</enum><header>Enforcement</header><text display-inline="no-display-inline">The provisions of subchapter III of chapter
				43 of this title shall apply with respect to the provisions of this chapter as
				if such provisions were incorporated into and made part of this chapter.</text>
						</section><section commented="no" display-inline="no-display-inline" id="H31291138D76744AB9EFAC55C7C1BA08C"><enum>4407.</enum><header>Miscellaneous
				provisions</header><text display-inline="no-display-inline">The provisions of
				subchapter IV of chapter 43 of this title shall apply with respect to the
				provisions of this chapter as if such provisions were incorporated into and
				made part of this
				chapter.</text>
						</section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H10B008106177413690479CE7C11058E3"><enum>(b)</enum><header>Clerical
			 amendments</header><text>The table of chapters at the beginning of title 38,
			 United States Code, and at the beginning of part III of such title, are each
			 amended by inserting after the item relating to chapter 43 the following new
			 item:</text>
