2.The purposes of this Act are—
(1)to meet the
growing need for English literacy, U.S. history, and civics education programs
for new Americans in the United States; and
(2)to encourage
proactive policies to introduce new Americans into the Nation in order to
maximize the benefits provided to these individuals and to the
community.

<section id="HAEBEAF24B3A7453F8BDF9A2AB4293691"><enum>101.</enum><header>Increased
investment in English literacy, U.S. history, and civics education under the
Adult Education and Family Literacy Act</header>
<subsection id="H3CA50D70A3D248CE9E00B64BBCC55D71"><enum>(a)</enum><header>Integrated
english literacy and civics education program</header><text>Section 203 of the
Adult Education and Family Literacy Act (20 U.S.C. 9202) is amended—</text>
<paragraph id="HF98B556B7BF1451B814D2B0310B9DCE7"><enum>(1)</enum><text>by redesignating
paragraphs (12) through (18) as paragraphs (13) through (19), respectively;
and</text>
</paragraph><paragraph id="H9FBF0A532F9942608FB61A1E8D6EBEE4"><enum>(2)</enum><text>by inserting after
paragraph (11), the following:</text>

program</term> means a program of instruction designed to help an English
language learner achieve competence in English through contextualized
instruction on the rights and responsibilities of citizenship, naturalization
procedures, civic participation, and United States history and government to
help such learner acquire the skills and knowledge to become an active and
informed parent, worker, and community
member.</text>

</paragraph></subsection><subsection id="H83B17CB8A8C3475BAF6E5B532BCB372D"><enum>(b)</enum><header>State leadership
activities</header><text>Section 223(a) of the Adult Education and Family
Literacy Act (20 U.S.C. 9223(a)) is amended by inserting after paragraph (11)
the following:</text>

institute for literacy</header><text>Section 242(c)(1) of the Adult Education
and Family Literacy Act (20 U.S.C. 9252(c)(1)) is amended—</text>

subparagraphs (G), (H), and (I), as subparagraphs (I), (J), and (K),
respectively; and</text>

subparagraph (F) the following:</text>

242(k) of the Adult Education and Family Literacy Act (20 U.S.C. 9252(k)) is
amended—</text>
<paragraph id="HD25B84481B2E4C1DA799C8F66C284B63"><enum>(1)</enum><text>in paragraph (2),
by striking <quote>and</quote> after the semicolon;</text>
</paragraph><paragraph id="HD530C1C711E94CF29906CE5D282EF67F"><enum>(2)</enum><text>by redesignating
paragraph (3) as paragraph (4); and</text>
</paragraph><paragraph id="HFF9F1F3C671547EB85184D20702BA81C"><enum>(3)</enum><text>by inserting after

</clause></subparagraph></paragraph></subsection><subsection id="H895F4BF02290473FAAE14A34F9E37979"><enum>(f)</enum><header>Integrated
english literacy, U.S. history, and civics education</header><text>Chapter 4 of
subtitle A of the Adult Education and Family Literacy Act (20 U.S.C. 9251 et
seq.) is amended by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="HE6F548FA0D764A46A60091D08CA711D6" style="OLC">
<section id="H1FFF0DCBBBB3469FBD27C1C2F1843C25"><enum>244.</enum><header>Integrated
english literacy, U.S. history, and civics education programs</header>
<subsection id="H376890881E3245BB971CB8AE7AFD4456"><enum>(a)</enum><header>Program
authorized</header><text>From funds appropriated to carry out this section, the
Secretary shall award grants to States, from allocations under subsection (b),
for integrated English literacy, U.S. history, and civics education
programs.</text>
</subsection><subsection id="HF5C325078DB64FBDB8E46C8AE02D4E48"><enum>(b)</enum><header>Allocations</header>
<paragraph id="H9267D45A8BA64B15A51431B7E2F8F49D"><enum>(1)</enum><header>In
general</header><text>Subject to paragraph (2), from the amount appropriated
under subsection (c) for a fiscal year, the Secretary shall allocate—</text>
<subparagraph id="HE69F1129542B43DBB401425C8C22073D"><enum>(A)</enum><text>65 percent of such
amount to States on the basis of a State's need for integrated English, U.S.
history, and civics education programs, as determined by calculating each
State's share of a 10-year average of the data compiled by the Office of
Immigration Statistics of the Department of Homeland Security, for immigrants
admitted for lawful permanent residence for the 10 most recent years;
and</text>
</subparagraph><subparagraph id="H838C8DC0702E487E9A94EA2799AD1CF6"><enum>(B)</enum><text>35 percent of such
amount to the States on the basis of whether the State experienced growth, as
measured by the average of the 3 most recent years for which data compiled by
the Office of Immigration Statistics of the Department of Homeland Security are
available, for immigrants admitted for lawful permanent residence.</text>
</subparagraph></paragraph><paragraph id="HCA846A73295C4402AF33CDF4002FC863"><enum>(2)</enum><header>Minimum</header><text>No
State shall receive an allocation under paragraph (1) in an amount that is less
than $60,000.</text>
</paragraph></subsection><subsection id="H00CEB2C7C0C049828BFBAD595F429F94"><enum>(c)</enum><header>Authorization of
appropriation</header><text>For the purpose of carrying out this section, there
are authorized to be appropriated $200,000,000 for fiscal year 2010,
$250,000,000 for fiscal year 2011, and $300,000,000 for fiscal year
2012.</text>

</subsection></section><section id="H20BF1CD9D6BF4DE69BF8009D95DE1EAF"><enum>102.</enum><header>Definitions of
English language learner</header>
<subsection id="H91D6F360BEB7447CBBD04D68ADC3ED27"><enum>(a)</enum><header>Adult education
and family literacy Act</header><text>The Adult Education and Family Literacy
Act (20 U.S.C. 9201 et seq.) is amended—</text>
<paragraph id="H06DB3FB3904842E8896D444E9CA99DB8"><enum>(1)</enum><text>in section 203(6)
(20 U.S.C. 9202(6)), by striking <quote>individuals of limited English
proficiency</quote> and inserting <quote>English language
learners</quote>;</text>
</paragraph><paragraph id="H3D460C9AB44849FE84365FC32DD06553"><enum>(2)</enum><text>in section 203 (20
U.S.C. 9202)—</text>

9101(25) of the Elementary and Secondary Education Act of 1965 (20 U.S.C.
7801(25)) is amended by striking the matter preceding subparagraph (A) and
inserting the following:</text>

reference in the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6301
et seq.) to an individual who is limited English proficient shall be construed
to refer to an English language learner.</text>
</paragraph></subsection></section><section id="H885D4248723C4601B25F7CFA6FF7631A"><enum>103.</enum><header>Credits for
teachers of English language learners</header>
<subsection id="H89F2E4845F2F45188935FE959B3B330C"><enum>(a)</enum><header>In
general</header><text>Subpart A of part IV of subchapter A of chapter 1 of the
Internal Revenue Code of 1986 (relating to nonrefundable personal credits) is
amended by inserting after section 25D the following new section:</text>

<section id="HA436FB8D0CF24AD38078976D4DAF1B91"><enum>25E.</enum><header>Teachers of
English language learners</header>
<subsection id="HDBA455B1B4984E2D8083C4F5D53C97F4"><enum>(a)</enum><header>In
general</header><text>In the case of an eligible teacher, there shall be
allowed a credit against the tax imposed by this chapter for the taxable year
an amount equal to—</text>
<paragraph id="HF7A7C5540EDB4ED2B558C7D3747C68B7"><enum>(1)</enum><text>$1500, for each of
the first 5 taxable years for which the taxpayer is allowed a credit under this
section; and</text>
</paragraph><paragraph id="H2D5D466026234085B4548FFBCA5BADA2"><enum>(2)</enum><text>$1000, for any
other taxable year.</text>
</paragraph></subsection><subsection id="H317616263EA24FE588529E0EEA252B2E"><enum>(b)</enum><header>Credit allowed
only for 10 taxable years</header><text>No credit shall be allowed under this
section with respect to a taxpayer for any taxable year after the 10th taxable
year for which such taxpayer is allowed a credit under this section.</text>
</subsection><subsection id="H18DE3E20D4B34337AA1277CAA9640563"><enum>(c)</enum><header>Eligible
teacher</header><text>For purposes of this section—</text>
<paragraph id="H55717B17CD9F4B4581A1B07E130D98EE"><enum>(1)</enum><header>In
general</header><text>Except as provided in paragraph (2), the term
<term>eligible teacher</term> means, with respect to a taxable year, any
individual who is—</text>
<subparagraph id="H835BC0D78E6A4EDBA02453C7829B4FA9"><enum>(A)</enum><text>a full-time
teacher of English as a second language or bilingual instruction for the
academic year ending in such taxable year, or</text>
</subparagraph><subparagraph id="HE90B9DA3C10745E394FA580E278E38F1"><enum>(B)</enum><text>an eligible
part-time teacher of English as a second language or bilingual instruction for
the academic year ending in such taxable year.</text>
</subparagraph></paragraph><paragraph id="H7E8A074FFBEB4E3EB377D53E3D93AD1A"><enum>(2)</enum><header>Eligible
part-time teacher</header><text>The term <term>eligible part-time
teacher</term> means, with respect to a taxable year, an individual who teaches
at least 20 hours per week during the academic year ending in such taxable
year. Such term does not include any individual who is a full-time teacher of
English as a second language during such academic year.</text>
</paragraph><paragraph id="H74C0A25CD66F47BF91018A64CC8484B1"><enum>(3)</enum><header>Special
rule</header><text>In the case of an eligible part-time teacher, subsection (a)
shall be applied by substituting <quote>$375</quote> for <quote>$750</quote>
and by substituting <quote>$250</quote> for
<quote>$500</quote>.</text>
</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection id="H0DBE743449824C9281C5FC4F3F12CBDF"><enum>(b)</enum><header>Clerical
amendment</header><text>The table of sections for such subpart is amended by
inserting after the item relating to section 25D the following new item:</text>

</subsection><subsection id="H355A023216154F66B371A5EE2476DB4B"><enum>(c)</enum><header>Teacher
certification expenses</header><text>Part VII of subchapter B of chapter 1 of
the Internal Revenue Code of 1986 (relating to additional itemized deductions
for individuals) is amended by redesignating section 224 as section 225 and by
inserting after section 223 the following new section:</text>

<section id="H46C84D8A5C894F9DAB9D4B338996E258"><enum>224.</enum><header>Certification
expenses for teachers of English language learners</header>
<subsection id="H843451D645984E6580477A91C1900DB0"><enum>(a)</enum><header>In
general</header><text>In the case of an individual, there shall be allowed a
deduction for eligible teacher certification expenses paid or incurred by the
taxpayer for the taxable year.</text>
</subsection><subsection id="H673B6397B65840F18040B8C0CF7A0F12"><enum>(b)</enum><header>Eligible teacher
certification expenses</header><text>The term <quote>eligible teacher
certification expenses</quote>—</text>
<paragraph id="H1FE2BDC9274A40B5914CAC24CE567C37"><enum>(1)</enum><text>means the tuition
and fees required for the enrollment or attendance of the taxpayer at an
eligible educational institution (as defined in section 25A) for a course which
is required for certification or licensure of such individual as qualified to
provide English as a second language or bilingual instruction to elementary or
secondary school students who are limited English proficient (as defined in
section 9901 of the Elementary and Secondary Education Act of 1965); and</text>
</paragraph><paragraph id="HEBEC64D998954890A22EB4C4A106D4F4"><enum>(2)</enum><text>shall not include
any amounts that are—</text>
<subparagraph id="HEDA185D00CE74A45BC9F2582A82AD185"><enum>(A)</enum><text>used for a course
that is part of the individual's degree program; or</text>
</subparagraph><subparagraph id="H7199BAF377834F9382DC69A2080D760E"><enum>(B)</enum><text>funded by another
person or any governmental entity.</text>
</subparagraph></paragraph></subsection><subsection id="H64C65B7B933444369D3E6224CDA13B8C"><enum>(c)</enum><header>Denial of double
benefit</header><text>No deduction shall be allowed under this section for any
expense for which a deduction or credit is allowed under any other provision of
this chapter.</text>
</subsection><subsection id="HE36E1F1ADA98494E8156D31D2617BFA4"><enum>(d)</enum><header>Termination</header><text>This
section shall not apply to expenses paid or incurred after December 31,
2014.</text>

</subsection><subsection id="H23C9FCD059E144179E6B911137CB6EF2"><enum>(f)</enum><header>Regulations</header><text>Not
later than 180 days after the date of the enactment of this Act, the Secretary
of the Treasury shall promulgate regulations implementing the provisions of
this section.</text>

</subsection></section><section id="HB47EC9F0D0504043A80AF1094E38AC0D"><enum>104.</enum><header>Research in
adult education</header>
<subsection id="H2558C9DD346D4F008113F05DD15FAA83"><enum>(a)</enum><header>In
general</header><text>Section 133(c)(2)(A) of the Education Sciences Reform Act
of 2002 (20 U.S.C. 9533(c)(2)(A)) is amended by inserting <quote>education
and</quote> before <quote>literacy</quote>.</text>
</subsection><subsection id="H9AB1B4549E52420591EACF0502A51A61"><enum>(b)</enum><header>National
research and development center</header>
<paragraph id="H9FC3CA71AFCA48859648D119B068869B"><enum>(1)</enum><header>In
general</header><text>The Secretary of Education shall direct the Commissioner
for Education Research of the National Center for Education Research
established pursuant to section 131 of the Education Sciences Reform Act of
2002 (20 U.S.C. 9531) to establish a national research and development center
for adult education and literacy as described in section 133(c)(2)(A) of such
Act (20 U.S.C. 9533(c)(2)(A)) (as amended by subsection (a)).</text>
</paragraph><paragraph id="HEA922FEBE235413CBEBD03F57141BCBA"><enum>(2)</enum><header>Provision for
expansion of research</header><text>If, as of the date of enactment of this
Act, the Commissioner has established a center for adult literacy in accordance
with section 133(c)(2)(A) of the Education Sciences Reform Act of 2002, the
Commissioner shall expand the topic of research of such center to include adult
education, in accordance with the amendment made by subsection (a).</text>
</paragraph></subsection></section><enum>II</enum><header>Supporting
English language acquisition and adult education in the workforce</header>
<section id="H1AE8004DC1E54AF3B39213D59485A403"><enum>201.</enum><header>Credit for
employer-provided adult English literacy and basic education programs</header>
<subsection id="HB3608709BE9D4C92A5A9D19E3B4AD609"><enum>(a)</enum><header>In
general</header><text>Subpart D of part IV of subchapter A of chapter 1 of the
Internal Revenue Code of 1986 (relating to business related credits) is amended
by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="HBE6718E426BA45E8BDB37B828611342D" style="OLC">
<section id="H441F2B2DE0E744EAA077851C94D94ACE"><enum>45R.</enum><header>Employer-provided
adult english literacy and basic education programs</header>
<subsection id="H181F6C6D97D24BA79F4F318F94C7C10B"><enum>(a)</enum><header>In
general</header><text>For the purposes of section 38, the credit determined
under this section with respect to any employer for the taxable year is an
amount equal to 20 percent of qualified education program expenses, but in no
case shall the employer receive a credit in an amount of more than $1,000 per
full-time employee participating in the qualified education program.</text>
</subsection><subsection id="H3B6C9EC4E3A14DF29271F064841D69AA"><enum>(b)</enum><header>Qualified
education program expenses</header><text>For purposes of this section—</text>
<paragraph id="H03DFC9C9346944EB8293CA09B5B1CF3E"><enum>(1)</enum><header>In
general</header><text>The term <term>qualified education program
expenses</term> means expenses paid or incurred by an employer to make
available qualified education to employees of the employer, who—</text>
<subparagraph id="HD65A6CBA5CD940FAB33FADEA6BED7B47"><enum>(A)</enum><text>are English
language learners; and</text>
</subparagraph><subparagraph id="H718158AD487A481D927AF917523C74CD"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H6A9347FD9E24413B8CE1C6DDC325BB34"><enum>(i)</enum><text>have not received a
secondary school diploma, or its recognized equivalent; or</text>
</clause><clause id="HC61747C1AB2445FE9223C181DFBB439A" indent="up1"><enum>(ii)</enum><text>lack sufficient mastery of basic
educational skills, including financial literacy, to enable the individuals to
function effectively in society.</text>
</clause></subparagraph></paragraph><paragraph id="H2D3371C8AEDE4FE481F68D3891AFE733"><enum>(2)</enum><header>Qualified
education</header><text>The term <term>qualified education</term> means adult
education and literacy activities provided—</text>
<subparagraph id="H65BD9551EFB348F1AF99E8F3C110F44E"><enum>(A)</enum><text>by an eligible
provider which for the fiscal year ending during the employer's taxable year
receives or is eligible to receive Federal funds under section 231 of the Adult
Education and Family Literacy Act for adult education and literacy activities;
or</text>
</subparagraph><subparagraph id="H0AFDA41757A64DFC94DC83CA30A24FF5"><enum>(B)</enum><text>in curriculum
approved by the Department of Education, the Employment and Training
Administration of the Department of Labor, or in current use by a Federal
agency.</text>
</subparagraph></paragraph><paragraph id="H7FE45F3F631F470C8AC858AF53B0C178"><enum>(3)</enum><header>Eligible
provider; adult education and literacy activities</header><text>The terms
<term>eligible provider</term> and <term>adult education and literacy
activities</term> shall have the respective meanings given to such terms in
section 203 of the Adult Education and Family Literacy Act.</text>
</paragraph><paragraph id="HBDCEEE8555304AAEB2720A72B0FB2064"><enum>(4)</enum><header>English language
learner</header><text>The term <term>English language learner</term> shall have
the same meaning given to such term in section 9101(25) of the Elementary and
Secondary Education Act of 1965.</text>
</paragraph></subsection><subsection id="HF5161AE1FD81447DBA98859D0B81FB92"><enum>(c)</enum><header>Special
rules</header><text>For purposes of this section—</text>
<paragraph id="H15ECF39F20B64C43BFE2679984083F2C"><enum>(1)</enum><header>Full-time
employment</header><text>An employee shall be considered full-time if such
employee is employed at least 30 hours per week for 25 or more calendar weeks
in the taxable year.</text>
</paragraph><paragraph id="H97B97C3E1D5E416CB1FF33AD90C5B97A"><enum>(2)</enum><header>Aggregation
rule</header><text>All persons treated as a single employer under subsection
(a) or (b) or section 52, or subsection (m) or (o) of section 414, shall be
treated as 1 person.</text>
</paragraph></subsection><subsection id="H579559C68B544193ADACF869CE82515A"><enum>(d)</enum><header>Denial of double
benefit</header><text>No deduction or credit shall be allowed under any other
provision of this chapter for any amount taken into account in determining the
credit under this section.</text>
</subsection><subsection id="H17FB10629B2A4FB8B27B1CE14CC448DC"><enum>(e)</enum><header>Termination</header><text>This
section shall not apply to expenses paid or incurred after December 31,
2014.</text>
</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection id="H86AF82FD880842E2A798718FB3521D63"><enum>(b)</enum><header>Credit To be
part of general business credit</header><text>Subsection (b) of section 38 of
such Code (relating to the current year business credit) is amended—</text>
<paragraph id="HA078EB04C0D84EAE8BD10AD7D546E0A8"><enum>(1)</enum><text>by striking
<quote>plus</quote> at the end of paragraph (34);</text>
</paragraph><paragraph id="H74C53F6D17D34469A98769A6430E01AD"><enum>(2)</enum><text>by striking the
period at the end of paragraph (35) and inserting <quote>, plus</quote>;
and</text>

award for business leadership in promoting United States citizenship</header>
<subsection id="HBCE452297633481395E72B52EDCE4E17"><enum>(a)</enum><header>Establishment</header><text>There
is established the Presidential Award for Business Leadership in Promoting
United States Citizenship (referred to in this section as the
<quote>Presidential Citizenship Award</quote>), which shall be awarded to
companies and other organizations that make extraordinary efforts in assisting
their employees and members to learn English and increase their understanding
of United States history and civics.</text>
</subsection><subsection id="H5E711A65D6E841E5AD6A95A8F9085364"><enum>(b)</enum><header>Selection and
presentation of award</header>
<paragraph id="H1809B5D2F53F4E6B9E81365E7584331B"><enum>(1)</enum><header>Selection</header><text>The
President shall periodically award the Presidential Citizenship Award to large
and small companies and other organizations described in subsection (a) after
reviewing recommendations to the President with respect to such award by the
Secretary of Homeland Security.</text>
</paragraph><paragraph id="H3476D3ED7BC141C7A0AE4304428F2317"><enum>(2)</enum><header>Presentation</header><text>The
presentation of the Presidential Citizenship Award shall be made by the
President, or a designee of the President, in conjunction with an appropriate
ceremony.</text>
</paragraph></subsection></section><enum>III</enum><header>Building
stronger communities</header>
<section id="HB681E89AC34C4A84A28C05CB42A62C3F"><enum>301.</enum><header>Office of
Citizenship and Immigrant Integration</header>
<subsection id="H33B548A8205240148DC15C44A7362BFF"><enum>(a)</enum><header>Renaming of the
office of citizenship and immigrant integration</header>
<paragraph id="H09D07F9A6E964FC8A71DD422701CC3DE"><enum>(1)</enum><header>In
general</header><text>The Office of Citizenship within United States
Citizenship and Immigration Services of the Department of Homeland Security
shall be renamed the <quote>Office of Citizenship and Immigrant
Integration</quote>.</text>
</paragraph><paragraph id="H78080621E27D4768AF7FA7F565173BDA"><enum>(2)</enum><header>Conforming
amendment</header><text>Section 451(f) of the Homeland Security Act of 2002 (6

liaison and intermediary with State and local governments and other entities to
assist in establishing local goals, task forces, and councils to assist in
introducing immigrants to the United States;</text>
</subparagraph><subparagraph id="HE9B4B23C429A4983B0DE3210A69DC044"><enum>(E)</enum><text>coordinating with
other Federal agencies to provide information to State and local governments on
the demand for English acquisition programs and best practices in place on the
Federal and State level for aliens who have recently arrived in the United
States;</text>
</subparagraph><subparagraph id="H6DB7CEFF803F4442B6D2550E01C59C6D"><enum>(F)</enum><text>assisting States
in coordinating activities with the grant program carried out under title III
of the Strengthen and Unite Communities with Civics Education and English
Skills Act of 2009; and</text>
</subparagraph><subparagraph id="H93CACC2B70EF4305BCEF9382D887A8B6"><enum>(G)</enum><text>promoting
instruction and training on citizenship responsibilities for aliens interested
in becoming naturalized citizens of the United States, including the
development of educational materials for such
aliens.</text>
</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection id="H9B29074087824CB3804FA16DA79BE069"><enum>(c)</enum><header>Donations</header><text>Section
451(f) of the Homeland Security Act of 2002 (6 U.S.C. 271(f)), as amended by
this section, is further amended by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="H25D9032BF8E84312A086B975B640678C" style="OLC">
<paragraph id="HA0F88A91D2A54F34B57E626EDE55A42F"><enum>(3)</enum><header>Donations</header>
<subparagraph id="H360B7C80A35D493099968CD97489633D"><enum>(A)</enum><header>Acceptance of
donations</header><text display-inline="yes-display-inline">The Chief of the
Office of Citizenship and Immigrant Integration may accept monetary and in-kind
donations to support the activities described in paragraph (2).</text>
</subparagraph><subparagraph id="H8F016C75747D4506B62FD3C32FCCFB5C"><enum>(B)</enum><header>Dedication of
funds</header><text>Notwithstanding any other provision of law—</text>
<clause id="HC5447511FBD444BC82E384F913EE357A"><enum>(i)</enum><text display-inline="yes-display-inline">any funds donated to the Office of
Citizenship and Immigrant Integration to support the activities described in
paragraph (2) shall be deposited entirely into an account established for such
purpose;</text>
</clause><clause id="H3E38BC4626024BFE8D1A82C7D6262A74"><enum>(ii)</enum><text>the funds
contained in such account shall be used solely to support such activities;
and</text>
</clause><clause id="HA702F0423895484FB620494024AB5791"><enum>(iii)</enum><text>funds that were
not donated for the exclusive purpose of supporting such activities may not be
deposited into such
account.</text>
</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection id="H16774538039C44CB9C839E6E694E8983"><enum>(d)</enum><header>Report to
Congress</header><text display-inline="yes-display-inline">The Chief of the
Office of Citizenship and Immigrant Integration shall submit a biennial report
to the authorizing Committees in Congress that describes the activities of the
office.</text>
</subsection></section><section id="HCE411BDDAB6E4C1398AA6E717753F76C"><enum>302.</enum><header>Grants to
States</header>
<subsection id="HE8910F9F83E745909A5DE92439B98CB3"><enum>(a)</enum><header>Authority To
provide grants</header><text display-inline="yes-display-inline">Subject to
subsections (c) and (d), the Chief of the Office of Citizenship and Immigrant
Integration is authorized to provide competitive grants to States to form State
New American Councils as described in subsection (b) to carry out activities
described in section 303.</text>
</subsection><subsection id="H1D8C50952CC14804A6531022CDA006A1"><enum>(b)</enum><header>State new
American councils</header><text>A State New American Council shall consist of
not less than 15 and not more than 19 individuals from the State and shall
include, to the extent practicable, representatives from the following
sectors:</text>
<paragraph id="H7DBCB62E57F74C69A4FFC035E71BFB05"><enum>(1)</enum><text>Business.</text>
</paragraph><paragraph id="H598E90FA15E1453BA840FE2F18827A0A"><enum>(2)</enum><text>Faith-based
organizations.</text>
</paragraph><paragraph id="H4DE4A47468B64CA8AC6284FF3100670A"><enum>(3)</enum><text>Civic
organizations.</text>
</paragraph><paragraph id="H05E3930FEA2E4A20ACF89AE6B094B12D"><enum>(4)</enum><text>Philanthropic
leaders.</text>
</paragraph><paragraph id="H082231ECE0B84A34B56FEF29072062D9"><enum>(5)</enum><text>Nonprofit
organizations, including those with experience working with immigrant
communities.</text>
</paragraph><paragraph id="HA20C84182486496588F851BE62AD1D49"><enum>(6)</enum><text>Representatives
from key education stakeholders, such as State educational agencies, local
educational agencies, community colleges, teachers, or organizations
representing teachers and other employees.</text>
</paragraph><paragraph id="HBB9B113CEA654DEBB23CB0E6752FE8FB"><enum>(7)</enum><text>Representatives of
State adult education offices.</text>
</paragraph><paragraph id="HB3EBD295C4C9461ABD39DCBA8F78FA71"><enum>(8)</enum><text>Representatives of
State or local public libraries.</text>
</paragraph><paragraph id="HD4D1372C7F1E4A44B9349B3A015CF149"><enum>(9)</enum><text>Representatives of
statewide or local government officials.</text>
</paragraph></subsection><subsection id="H48BD055238FE4E319B358909F942839A"><enum>(c)</enum><header>Waiver of
requirement</header>
<paragraph id="H010C082F2E434937A54A7EB114AB9A33"><enum>(1)</enum><header>Authority to
grant</header><text display-inline="yes-display-inline">The Chief of the Office
of Citizenship and Immigrant Integration may award a grant under subsection (a)
to a State without requiring the State to form a State New American Council if
the Chief determines that the State is carrying out similar statewide
initiatives to introduce immigrants into the State and into the United
States.</text>
</paragraph><paragraph id="H5D0AA44C3E63472A9DBA5A4783802448"><enum>(2)</enum><header>Guidelines</header><text>The
Chief shall establish guidelines for awarding grants to States described in
paragraph (1).</text>
</paragraph></subsection><subsection id="H4238B4691E004084836EEF9BE7E877BE"><enum>(d)</enum><header>Grants to local
governments</header><text display-inline="yes-display-inline">The Chief of the
Office of Citizenship and Immigrant Integration may provide a grant under
subsection (a) to a local government at the discretion of the Chief.</text>
</subsection><subsection id="H53F70FB54C42421EA95BBFD1257E0C96"><enum>(e)</enum><header>Application</header><text display-inline="yes-display-inline">To be eligible to receive a grant under
this section, an applicant shall submit an application to the Chief of the
Office of Citizenship and Immigrant Integration at such time, in such manner,
and containing such information as the Chief may reasonably require. Such
application shall include—</text>
<paragraph id="H976E3EBA486C45EC9C8BDD4B6C87C29F"><enum>(1)</enum><text>if the applicant
is a State seeking to form a State New American Council, an assurance that such
State New American Council will meet the requirements of subsection (b);</text>
</paragraph><paragraph id="H0828D7EF7E754DE88BDB1F1020B676ED"><enum>(2)</enum><text>the number of
immigrants in the State in which the applicant is located;</text>
</paragraph><paragraph id="HFC5C5A6306D343F8A69624F24E2573B6"><enum>(3)</enum><text>a
description of the challenges in introducing new Americans in the State and
local community; and</text>
</paragraph><paragraph id="H3FD26AFF45364BD699554BEE0453A14B"><enum>(4)</enum><text>any other
information that the Chief may reasonably require.</text>
</paragraph></subsection><subsection id="H6AB994C4348B476AA212998912C24F36"><enum>(f)</enum><header>Duration</header><text>A
grant awarded under subsection (a) shall be for a period of 5 years.</text>
</subsection><subsection id="HB64132FC34D746D5828EA6919C7275BA"><enum>(g)</enum><header>Priority</header><text>Priority
shall be given to grant applications that—</text>
<paragraph id="HE8AF07C821864B67840D8ADFDEC2C396"><enum>(1)</enum><text>use matching
funds, from non-Federal sources, which may include in-kind contributions;
and</text>
</paragraph><paragraph id="H880EB0458D904064BFA6D5159FF199C4"><enum>(2)</enum><text>demonstrate
collaboration with private entities to achieve the goals of their comprehensive
plan.</text>
</paragraph></subsection><subsection id="H7BE9C2E2E1EE4571BC33BDE8752B9E0C"><enum>(h)</enum><header>Additional
consideration</header><text>Additional consideration shall be given to grant
applications submitted by States with a large increase in the population of
immigrants over the previous 10 years relative to past migration patterns,
based on data compiled by the Office of Immigration Statistics of the
Department of Homeland Security.</text>
</subsection><subsection id="H64AD6F974368404E8B96A37C6D3DCCB0"><enum>(i)</enum><header>Grant
amount</header><text>The amount of a grant awarded under subsection (a) shall
be not less than $500,000 and not more than $5,000,000 for each fiscal
year.</text>
</subsection><subsection id="H7224FA3672344A908BC24987EF3A534E"><enum>(j)</enum><header>Reservations</header>
<paragraph id="HFF19B933F9EF4434993E154C3832DAEB"><enum>(1)</enum><header>National</header><text display-inline="yes-display-inline">The Chief of the Office of Citizenship and
Immigrant Integration shall reserve not more than 1 percent of the amount
appropriated to carry out this section for such Office, including the
evaluation of funds distributed.</text>
</paragraph><paragraph id="HF0AD5E0013094503B268F7A5418326F7"><enum>(2)</enum><header>States</header><text>A
State awarded a grant under subsection (a) may reserve not more than 10 percent
of such grant amount for the creation and operation of the State New American
Council.</text>
</paragraph></subsection></section><section id="HCE3A578D29334BB38E03119A89DB0DB9"><enum>303.</enum><header>Authorized
activities</header>
<subsection id="H3A8BD333BBD14E97AF023D1CAA209EAE"><enum>(a)</enum><header>Mandatory
activities</header><text>A grant awarded under section 302(a) shall be
used—</text>
<paragraph id="H603C5D4AD30545F29EFDDD6779BF5918"><enum>(1)</enum><text>to develop,
implement, expand, or enhance a comprehensive plan to introduce new immigrants
into the State, including the increase in English literacy, U.S. history, and
civics education;</text>
</paragraph><paragraph id="HA36FA3A1DCB04410918FC6E67F67C1FC"><enum>(2)</enum><text>to provide
subgrants to local communities as described in subsection (c);</text>
</paragraph><paragraph id="HA0C30031BBB84362B813BBA12E52698A"><enum>(3)</enum><text>if the grant is
awarded to a State to form a State New American Council, to convene meetings of
the State New American Council not less frequently than once each
quarter;</text>
</paragraph><paragraph id="HCDF6127FE0754FD2B2C368AD28DB942A"><enum>(4)</enum><text display-inline="yes-display-inline">to disseminate best practices and other
information compiled by the Office of Citizenship and Immigrant Integration
that pertains to effective programs for English acquisition and civics
education; and</text>
</paragraph><paragraph id="H7529D297589C4F97A9F7705B90A64501"><enum>(5)</enum><text>to convene public
hearings not less frequently than once each year to report on the activities
carried out by such grant.</text>
</paragraph></subsection><subsection id="H3126FF0416AC4A0183E4AFDA24432BDB"><enum>(b)</enum><header>Permissible
activities</header><text>A grant awarded under section 302(a) may be
used—</text>
<paragraph id="H191B11183D35419E9FA24A2F8C41F8CD"><enum>(1)</enum><text>to solicit and
disseminate solutions and remedies to the challenges of introducing new
Americans in the State or municipality in which the grant is awarded;</text>
</paragraph><paragraph id="H54094C64AA2C49AAA0899C2F8112C30A"><enum>(2)</enum><text>to provide
technical assistance, training, or coordination for State or local agencies to
improve programs to introduce new Americans into the United States, such as
English literacy, U.S. history, and civics education;</text>
</paragraph><paragraph id="H3394C4051BE641E181C7C9B002EBBDC3"><enum>(3)</enum><text>to review and
develop strategies to expand distance learning as a method of instruction for
English literacy, U.S. history, and civics education and available
technological programs that may supplement or supplant quality classroom
instruction;</text>
</paragraph><paragraph id="H2144CC53C4CA473E8ED28B9EF7FB4E9E"><enum>(4)</enum><text>to coordinate with
entities of other States engaged in activities under this title or other
activities to introduce new Americans into the State or community; and</text>
</paragraph><paragraph id="H5C0BF033AF32486A9DA020E6F6454431"><enum>(5)</enum><text>to develop
materials focused on preparation for the naturalization test, engage in
outreach and educational activities on the naturalization process, and provide
assistance to immigrants with the naturalization application, where
appropriate.</text>
</paragraph></subsection><subsection id="H2DFD02904C23454BA8B0A92780139E75"><enum>(c)</enum><header>Subgrants to
local communities</header>
<paragraph id="HB3144798D13B41F3BA91E9FEEB9DB84C"><enum>(1)</enum><header>Requirement to
award</header><text>A grant under section 302(a) shall be used to award
subgrants to entities of local governments to assist communities with local
efforts to introduce new Americans into the community.</text>
</paragraph><paragraph id="H5860F97E82A84FB88AFD2D0C83C12753"><enum>(2)</enum><header>Authorized
activities</header><text>Subgrants shall be awarded under paragraph (1) to
entities of local governments for use to carry out activities in accordance
with—</text>
<subparagraph id="H8DC0B08E3BD9401E973E5ACC21BDCEE8"><enum>(A)</enum><text>a comprehensive
plan described in subsection (a)(1); and</text>
</subparagraph><subparagraph id="HF433CC47C30948CBB06207EF601D1960"><enum>(B)</enum><text display-inline="yes-display-inline">any guidance provided by the Chief of the
Office of Citizenship and Immigrant Integration.</text>
</subparagraph></paragraph><paragraph id="H3D22BF6047B24E7B93A8A8467D062096"><enum>(3)</enum><header>Subgrant
amount</header><text>The amount of a subgrant awarded under this subsection
shall be not less than $100,000 and not more than $600,000 for a fiscal
year.</text>
</paragraph></subsection></section><section id="H6ACAD80BE8564AECBD5BE77AF8AA461D"><enum>304.</enum><header>Reporting and
evaluation</header>
<subsection id="H535F41112848448EA03F2EE3AC482158"><enum>(a)</enum><header>Reporting
requirement</header>
<paragraph id="H52CB3A16E5D84BCA99D70259F2551F82"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">Each entity awarded a
grant under section 302(a) shall submit a report annually to the Office of
Citizenship and Immigrant Integration that—</text>
<subparagraph id="HD4B149AF2A864330B6F6B76C8FBB327F"><enum>(A)</enum><text>describes the
activities of the State New American Council and subgrant recipients and how
these activities meet the goals of—</text>
<clause id="HC0DD9261A2D74319B075DDD80260C670"><enum>(i)</enum><text display-inline="yes-display-inline">the Chief of the Office of Citizenship and
Immigrant Integration; and</text>
</clause><clause id="H85AF0084898D4018A0DF58D9A96CADBD"><enum>(ii)</enum><text>the
comprehensive plan described in section 303(a)(1); and</text>
</clause></subparagraph><subparagraph id="HC5538569E4BF4E528DFC1FBC253941BE"><enum>(B)</enum><text>describes the
geographic areas being served, the number of immigrants in such areas, and the
primary languages spoken there.</text>
</subparagraph></paragraph><paragraph id="HB7378D16AC774C2B89C39365ECF49320"><enum>(2)</enum><header>Other
requirements</header><text display-inline="yes-display-inline">The Chief of the
Office of Citizenship and Immigrant Integration may set out other requirements
as the Chief sees fit in order to—</text>
<subparagraph id="H1A7C635F97F64C6BBE5285F792F11EEF"><enum>(A)</enum><text>impose
accountability; and</text>
</subparagraph><subparagraph id="H7105CF65667C4730A3A344640FEAF875"><enum>(B)</enum><text>measure the
outcomes of the activities carried out with grants awarded under section
302(a).</text>
</subparagraph></paragraph></subsection><subsection id="HD8D8332400824DB0AF94BDCE049713DF"><enum>(b)</enum><header>Annual
evaluation</header><text display-inline="yes-display-inline">The Chief of the
Office of Citizenship and Immigrant Integration shall conduct an annual
evaluation of the grant program established under this title and use such
evaluation—</text>
<paragraph id="H0201063A317A4745B999F3CF69222A40"><enum>(1)</enum><text>to improve the
effectiveness of programs carried out by the Chief;</text>
</paragraph><paragraph id="H2F39A3D6F8524EB8886F5379E4BDCAC4"><enum>(2)</enum><text>to assess future
needs of immigrants and of State and local governments related to
immigrants;</text>
</paragraph><paragraph id="H1B0A9B78DF5B4FD88B773467EC67F2DF"><enum>(3)</enum><text>to determine the
effectiveness of such grant program; and</text>
</paragraph><paragraph id="HF2C1EBF47F9F432F84F0120D62C44B94"><enum>(4)</enum><text>to ensure that the
grantees and subgrantees are acting within the scope and purpose of this
title.</text>
</paragraph></subsection></section><section id="HE3A56C54021B4CDD9538A16EC25EA8D6"><enum>305.</enum><header>New citizens
award program</header>
<subsection id="HE84CF5ED67424302BD1F232452E85D5E"><enum>(a)</enum><header>Establishment</header><text>There
is established a new citizens award program to recognize citizens who—</text>
<paragraph id="HDB8A684B169047F88CCEB19CED0C285F"><enum>(1)</enum><text>have made an
outstanding contribution to the United States; and</text>
</paragraph><paragraph id="H0D6561F1A2B64548BE5CEF00BF4115F2"><enum>(2)</enum><text>are naturalized
during the 10-year period ending on the date of such recognition.</text>
</paragraph></subsection><subsection id="H034A552320B8473DB7D076F70E55D38E"><enum>(b)</enum><header>Presentation
authorized</header>
<paragraph id="HB03BC23B79F845E09C356D7CCC4B2917"><enum>(1)</enum><header>In
general</header><text>The President is authorized to present a medal, in
recognition of outstanding contributions to the United States, to citizens
described in subsection (a).</text>
</paragraph><paragraph id="H2622CB3E734D4D6E9B6747ECA8A9497F"><enum>(2)</enum><header>Maximum number
of awards</header><text>Not more than 10 citizens may receive a medal under
this section in any calendar year.</text>
</paragraph></subsection></section><section id="H8C50DC9538E54E5B912E8DDD7BD933C7"><enum>306.</enum><header>Rule of
construction</header><text display-inline="no-display-inline">Nothing in this
title shall be construed to limit the authority of the Secretary of Homeland
Security, acting through the Director of United States Citizenship and
Immigration Services or such other officials of the Department of Homeland
Security as the Secretary of Homeland Security may direct, to manage, direct,
and control the activities of the Chief of the Office of Citizenship and
Immigrant Integration.</text>
</section><section id="H1B2D7D234C3B4E0DA52056F9E56E8472"><enum>307.</enum><header>Authorization
of appropriations</header><text display-inline="no-display-inline">There are
authorized to be appropriated to carry out this title $100,000,000 for each of
the fiscal years 2010 through 2015.</text>
</section>
