		<section id="HF8C037C3E7044813B0538B479E9DA2BB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Adult Education and Economic Growth
			 Act of 2009</short-title></quote>.</text>
		</section><section id="HF8E3EE42124C46B4A24C64DD3BBDDDBA"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="H9DF3678F413247E6AD683C0C0E5EBF47"><enum>(1)</enum><text>In order to remain
			 competitive in today’s global economy, the United States must reverse the trend
			 of underinvestment in adult education and workforce development and empower its
			 workforce through adequate resources and effective and innovative educational
			 and workforce programs. Since 1979, investments in adult education and
			 workforce development programs have declined in real terms by more than 70
			 percent.</text>
			</paragraph><paragraph id="HEFEA1DADF0E042F383D784AC6EF73BD0"><enum>(2)</enum><text>Current Federal
			 adult basic education programs serve less than 3,000,000 individuals a year.
			 Some States have experienced difficulties integrating adult education public
			 job training and career and technical education programs that could help these
			 individuals meet specific industry demand while advancing along a career
			 path.</text>
			</paragraph><paragraph id="H5C3EFA813B4945F19A4763806417410F"><enum>(3)</enum><text display-inline="yes-display-inline">In 2007, more than 25,000,000 adults age 18
			 through 64 had no high school credential. Every year, 1 in 3 young adults—more
			 than 1,200,000 people—drop out of high school.</text>
			</paragraph><paragraph id="H38CD0F1D2FCC4BF3BA5C920C77D24B32"><enum>(4)</enum><text>Employers need
			 highly skilled workers to be able to compete globally. Between 2004 and 2014,
			 24 of the 30 fastest-growing occupations are projected to demand workers with
			 some form of postsecondary education or training. Yet nearly half of the United
			 States workforce has a high school diploma or less.</text>
			</paragraph><paragraph id="H08A8185AC9C74F348EF40ACDE7041DB8"><enum>(5)</enum><text>Technology and
			 globalization, coupled with the unfolding economic recession, are rendering
			 low-wage and low-skill workers particularly vulnerable. Unemployment is highest
			 among those without a college degree and has grown at a faster rate among this
			 group since the start of the economic recession in December 2007.</text>
			</paragraph><paragraph id="H4D45E1CFEF43477995130D14F04C4B43"><enum>(6)</enum><text>According to the
			 Bureau of Labor Statistics, the unemployment rate for individuals age 25 and
			 older who have less than a high school diploma has risen from 7.5 percent in
			 December 2007 to 14.8 percent in April 2009. The unemployment rate for high
			 school graduates with no college degree has increased from 4.6 percent to 9.3
			 percent. The unemployment rate for high school graduates with some college
			 experience or an associate degree has risen from 3.7 percent to 7.4
			 percent.</text>
			</paragraph><paragraph id="HCAFFC1ED7966435CAC49369A08B46BB8"><enum>(7)</enum><text display-inline="yes-display-inline">The U.S. ranks 11th among OECD countries in
			 percent of young adults with a high school diploma—the only country in which
			 younger adults are less educated than the previous generation.</text>
			</paragraph><paragraph id="HA46D571C1DD246C5A1D822ABF2CD9A06"><enum>(8)</enum><text>In 2006,
			 18,400,000 adults spoke English <quote>less than very well</quote>, according
			 to the United States Census Bureau (2006 American Community Survey). Of these
			 adults, 8,200,000 held no high school credential and 5,000,000 had completed
			 high school but were not college or job ready.</text>
			</paragraph><paragraph id="H4B283EED2A7744E38558DEC751432EE8"><enum>(9)</enum><text>Although
			 88,000,000 adults ages 18 to 64 have a high school diploma or less, or limited
			 English proficiency, funding for programs authorized under the Workforce
			 Investment Act of 1998 for adults, dislocated workers, and youth declined by
			 about 12 percent between 2000 and 2007.</text>
			</paragraph><paragraph id="HB0D74470B87941B9B58718BC52A9B2B4"><enum>(10)</enum><text display-inline="yes-display-inline">According to the National Commission on
			 Adult Literacy, one in every 100 U.S. adults 16 and older is in prison or jail
			 in America. About 43 percent do not have a high school diploma or equivalent,
			 and 56 have very low literacy skills. Ninety-five percent of incarcerated
			 individuals return to our communities.</text>
			</paragraph><paragraph id="H67706B9A9BAF46E69CFB78BE17E3E405"><enum>(11)</enum><text display-inline="yes-display-inline">In order to meet the needs of the
			 workforce, there must be a strong connection between the adult education and
			 workforce development system, in order to better meet the needs of limited
			 English proficient job seekers and those with basic skills deficiencies. For
			 example, in program year 2006, less than 11 percent of individuals who exited
			 the title I adult program under the Workforce Investment Act of 1998 were
			 co-enrolled in adult education.</text>
			</paragraph><paragraph id="H726011BF88FA4A16AD17BBC41A460348"><enum>(12)</enum><text>Workforce
			 development programs, including adult education, throughout the Federal
			 Government and the States are not aligned well, limiting their capacity to
			 leverage resources, to provide full and appropriate access to services, and to
			 provide reliable and comparable data related to activities and outcomes across
			 the programs.</text>
			</paragraph><paragraph id="H0632F92BC8A5414C814C855E6B02E111"><enum>(13)</enum><text>In the current
			 economic climate, it is imperative that the United States invest in the
			 education, training, and development of all workers in the United States who
			 are unemployed or underemployed, to help fill the labor demands of the United
			 States so that they do not look elsewhere to find skilled workers.</text>
			</paragraph></section><section id="H15CA1B305AB74B8FACCE32259A09575D"><enum>3.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are the
			 following:</text>
			<paragraph id="H978E083449A043C8AABEBDD10953ABB2"><enum>(1)</enum><text>To increase access
			 substantially to adult education, literacy, and workplace skills services for
			 adults who have limited basic skills, lack a high school diploma or its
			 equivalent, or are limited English proficient.</text>
			</paragraph><paragraph id="HE8B27638A6894E75BDDBA1B1A72581A6"><enum>(2)</enum><text>To create seamless
			 pathways from adult education and occupational skills development to
			 postsecondary education or training and workforce development programs and
			 services that help adult learners persist throughout the pipeline from the
			 lowest levels of basic literacy or English language proficiency to the
			 achievement of a level of proficiency that will enable the adult learner to
			 successfully transition to family-sustaining jobs in careers with the promise
			 of advancement.</text>
			</paragraph><paragraph id="HF28AB56FA0444DD0A32D2F383E5AFC7F"><enum>(3)</enum><text>To develop an
			 adult education, literacy, and work skills system that coordinates and
			 integrates adult education, literacy, and workplace skills services with
			 workforce development and postsecondary education and training opportunities
			 across agencies and programs.</text>
			</paragraph><paragraph id="HF1E5FF519D1E4541AFCDAFE5D120632C"><enum>(4)</enum><text>To greatly improve
			 outcomes for adults receiving adult education, literacy, and workplace skills
			 services in terms of learning gains, acquisition of basic workforce skills,
			 accelerated learning, acquisition of a high school diploma or its equivalent,
			 or successful transition to postsecondary education or training or to
			 family-sustaining jobs in the workplace.</text>
			</paragraph></section><title id="H4ACDA2AAD0B94136B8CD407C18FE0F09"><enum>I</enum><header>Workforce
			 Investment Systems</header>
			<section id="HF3B850A330274DD79F06FEF8DA37106D"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 101 of the Workforce Investment Act
			 of 1998 (29 U.S.C. 2801) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H2DCFCA30F37E4A47AC6E4CA05EF12A27" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="HD7C364F527444609A4ABA80578D34060"><enum>(54)</enum><header display-inline="yes-display-inline">Integrated education and
				training</header><text display-inline="yes-display-inline">The term
				<term>integrated education and training</term> means training that combines
				education or training for a specific occupation or occupational cluster with
				English literacy instruction or other adult education, literacy, and workplace
				skills activities, including programs that provide for dual or concurrent
				enrollment.</text>
					</paragraph><paragraph id="HD3175E274F5940D5946DBF0A6A242359"><enum>(55)</enum><header>Career
				pathway</header><text>The term <term>career pathway</term> means a high
				quality, rigorous, engaging set of education, training, and workplace
				experiences that—</text>
						<subparagraph id="H1EF68B7F754F430CB4647473B141C6C1"><enum>(A)</enum><text>align adult
				education, job training, postsecondary education, or occupational training to
				create a pathway to attaining a recognized postsecondary education credential
				that will qualify an individual for career advancement in projected employment
				opportunities identified in the State plan under section 112;</text>
						</subparagraph><subparagraph id="H3D88EC5BA0DF413191A57535829CC4E2"><enum>(B)</enum><text>include advising
				and counseling to support the development of individual education and career
				plans; and</text>
						</subparagraph><subparagraph commented="no" id="HF0639ECA2A5E4B5599EEF9B2ED1FC3AC"><enum>(C)</enum><text>lead to a
				secondary school diploma or its recognized equivalent (for individuals who have
				not completed secondary school), a postsecondary degree, a registered
				apprenticeship or another recognized occupational certification, a certificate,
				or a license.</text>
						</subparagraph></paragraph><paragraph id="HB8191ED470A14624A147A4ADE76FA2E5"><enum>(56)</enum><header>Workplace
				skills</header><text>The term <term>workplace skills</term> means the
				combination of basic skills, critical thinking skills, and self management
				skills with competency in utilizing resources, using information, working with
				others, understanding systems, working with technology, and other skills
				necessary for success in the workplace.</text>
					</paragraph><paragraph commented="no" id="H8751772229BA4093BF2B31C03FFCF4B0"><enum>(57)</enum><header>Registered
				apprenticeship program</header><text>The term <term>registered apprenticeship
				program</term> means an industry skills training program at the postsecondary
				level that combines technical and theoretical training through structured
				on-the-job learning with related instruction (in classrooms or through distance
				learning) while an individual is employed, working under the direction of
				qualified personnel or a mentor, and earning incremental wage increases aligned
				to enhanced job proficiency, resulting in the acquisition of a nationally
				recognized and portable certificate, under a plan approved by the Office of
				Apprenticeship or a State agency recognized by the Department of
				Labor.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HD2FFAB4F3E91482CA33855FA387E3C7C"><enum>102.</enum><header>Purpose</header><text display-inline="no-display-inline">Section 106 of the Workforce Investment Act
			 of 1998 (29 U.S.C. 2811) is amended by inserting <quote>adult education
			 and</quote> before <quote>workforce investment systems</quote>.</text>
			</section><section id="HF31626B692764DA782E66B6CA1AA3AFD"><enum>103.</enum><header>State workforce
			 investment boards</header><text display-inline="no-display-inline">Section 111
			 of the Workforce Investment Act of 1998 (29 U.S.C. 2821) is amended—</text>
				<paragraph id="H8C8D283C7E774E969A4C9ECE7917F2AB"><enum>(1)</enum><text>in subsection
			 (b)(1)(C)—</text>
					<subparagraph id="H3FA0CB5606AC418BA057C996D27E33CD"><enum>(A)</enum><text>in clause
			 (vi)(II), by striking <quote>and</quote> after the semicolon;</text>
					</subparagraph><subparagraph id="HF91D6F8DC4F648D19793D6C080E233E5"><enum>(B)</enum><text>by redesignating
			 clause (vii) as clause (viii); and</text>
					</subparagraph><subparagraph id="HD3080E67B54A4751BB8EACEAAD8E8B87"><enum>(C)</enum><text>by inserting after
			 clause (vi) the following:</text>

				</paragraph></section><section id="H25DDA6D9997D465D8B80508B2BBB076C"><enum>104.</enum><header>State
			 plan</header><text display-inline="no-display-inline">Section 112 of the
			 Workforce Investment Act of 1998 (29 U.S.C. 2822) is amended—</text>
				<paragraph id="HF5CF1193DDA74DFEAFFEA7EFC0DB592E"><enum>(1)</enum><text>in subsection (a),
			 by inserting <quote>and aligns with the State plan described in section
			 224</quote> before the period at the end; and</text>
				</paragraph><paragraph id="H2165D9C75D9E4EE49DDCBF50D656AFF5"><enum>(2)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="HF0A30EE65AB24A299BA9B13D7738FBE0"><enum>(A)</enum><text>in paragraph

			 (B), by striking <quote>and</quote> after the semicolon;</text>

			 for youth activities</header><text display-inline="no-display-inline">Section
			 129 of the Workforce Investment Act of 1998 (29 U.S.C. 2854) is amended—</text>
				<paragraph id="H4BECC7A3A88043C5B76D493181F9E925"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="H278B414EF4DA467FB795BFCC4420199E"><enum>(A)</enum><text>in paragraph (5),

				under section 222(a)(2) for the following adult education, literacy, and work
				readiness skills activities:</text>
							<subparagraph id="H6BEBC8B1681B418C9ACF7B339C981100"><enum>(A)</enum><text>The establishment
				or operation of professional development programs to improve the quality of
				instruction provided pursuant to local activities required under section
				231(b).</text>
							</subparagraph><subparagraph id="HFBAD60056EB24E5BB5D551C9112B4320"><enum>(B)</enum><text>The provision of
				technical assistance to eligible providers of adult education, literacy, and
				workplace skills activities to enable them to fulfill the purpose of this
				title, as described in section 202.</text>
							</subparagraph><subparagraph id="H2B6DD59D360945108792CFA70CAA4ECB"><enum>(C)</enum><text>The monitoring and
				evaluation of adult education and related activities to determine what works
				and broadly disseminate information about models and best practices and tools
				within the State.</text>
							</subparagraph><subparagraph id="H04D604F15CF348DFACE9D92A9369F69E"><enum>(D)</enum><text>The provision of
				technology assistance, including staff training, to eligible providers of adult
				education, literacy, and workplace skills activities to enable the eligible
				providers to improve the quality of such activities.</text>
							</subparagraph><subparagraph id="HC9FC3C8B937D4449B3D9D9726DF67E5E"><enum>(E)</enum><text>Coordination with
				the workforce investment systems supported under title I.</text>
							</subparagraph></paragraph><paragraph id="H36321F527F4747A0BF5E4031CCCF0D57"><enum>(2)</enum><header>Permissible
				activities</header><text>Each eligible agency may use funds made available
				under section 222(a)(2) for 1 or more of the following adult education,
				literacy, and workplace skills activities:</text>
							<subparagraph id="HEDA5549B16B54961B9736B13B68419D7"><enum>(A)</enum><text>The support for
				State or regional networks of literacy resource centers.</text>
							</subparagraph><subparagraph id="HE958FC79CD9B408B96F053C9B5DDD6FD"><enum>(B)</enum><text>Incentives for
				program coordination and integration, and performance awards.</text>
							</subparagraph><subparagraph id="H132A2F62E6894A329C832B22406223E0"><enum>(C)</enum><text>Developing and
				disseminating curricula for postsecondary and job training readiness, including
				curricula for using technology for distance learning and for instructional and
				teacher training purposes.</text>
							</subparagraph><subparagraph id="H59209740C888402E93E5B5CE0E43D2F4"><enum>(D)</enum><text>Coordination with
				existing support services, such as transportation, child care, and other
				assistance designed to increase rates of enrollment in, and successful
				completion of, adult education, literacy, and workplace skills activities, to
				adults enrolled in such activities.</text>
							</subparagraph><subparagraph id="H4D6F9F2A70074474A6E5C8B4A18E1727"><enum>(E)</enum><text>Developing
				innovative content and models for integrated education and training
				programs.</text>
							</subparagraph><subparagraph id="H0DB5FA9E9A5C43F6936B1F25C180021C"><enum>(F)</enum><text>Developing
				innovative content and models to foster the transition to postsecondary
				education and career pathways.</text>
							</subparagraph><subparagraph id="H4514034E1AC641B6AAF0DD02269A0AE5"><enum>(G)</enum><text>Linkages with
				postsecondary educational institutions.</text>
							</subparagraph><subparagraph id="H4FC6EF7F6DF742F4A86136025460008F"><enum>(H)</enum><text>Linkages with
				community-based organizations.</text>
							</subparagraph><subparagraph id="H0E586E186F0C43E29045231201989D1B"><enum>(I)</enum><text>Support for
				recruitment and outreach for instructors, students, and
				employers.</text>

				skills providers in the State;</text>
							</paragraph><paragraph id="H38BBAC64DC48435B8A8B0303769C29D9"><enum>(16)</enum><text>a description of
				how the State will—</text>
								<subparagraph id="H5A2A05AD15364C0FB772FC6C3AEECE4C"><enum>(A)</enum><text>use technology to
				improve the quality of adult education, literacy, and workplace skills
				services; and</text>
								</subparagraph><subparagraph id="HB57313E374FE4B26B5A34A510402F88B"><enum>(B)</enum><text>expand access to
				such services for workers and students;</text>
								</subparagraph></paragraph><paragraph id="H6EDAD5C1F13A4F3EA3F20275AD011E82"><enum>(17)</enum><text>a description of
				how the State will carry out programs described in section 244;</text>
							</paragraph><paragraph id="H78062EDDC7774F93B45C210222D4DE51"><enum>(18)</enum><text>a description of
				the data system that the State will use to track over time student outcomes on
				the performance measures described in section 212;</text>
							</paragraph><paragraph id="H0B964AC2BFF24117B56D47519A772571"><enum>(19)</enum><text>a description of
				the State’s program to invest in the skills of workers, including plans for
				involving business as an active partner in the effort; and</text>
							</paragraph><paragraph id="HBE7F06E627C44ADD88F2CFDEDE008304"><enum>(20)</enum><text>a description of
				how the adult education programs will be integrated with occupational skills
				programs and aligned with postsecondary education, career, and technical
				education, workforce development programs, and other Federal funds available
				under title I and other relevant Federal
				programs.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H24064E5476B640F896AA8E77C1ED8A99"><enum>(2)</enum><text>by striking
			 subsection (e) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H2630ABFDD59C4AD38711FBDC87F7C8E4" style="OLC">
						<subsection id="HD8EAACE48B4B4802904FFE786EE97EF4"><enum>(e)</enum><header>Peer review and
				plan approval</header><text display-inline="yes-display-inline">The Secretary
				shall—</text>
							<paragraph id="HD3151C1DF4344FDB92AF7604D91A95C2"><enum>(1)</enum><text>establish a peer
				review process to assist in the review and approval of State plans;</text>
							</paragraph><paragraph id="H046B7D7F63BE43B78B780B9DF7CC0000"><enum>(2)</enum><text>in consultation
				with the National Institute for Adult Education, Literacy, and Workplace
				Skills, appoint individuals, representing the range of stakeholders, to the
				peer-review process, including—</text>
								<subparagraph id="HF2C7162B41AD4471BBD57F622398C280"><enum>(A)</enum><text>representatives of
				adult learners, adult education, literacy, and workplace skills providers,
				eligible agencies, State educational agencies, institutions of higher
				education, representatives of local or State workforce investment boards;
				and</text>
								</subparagraph><subparagraph id="HAC53F4CA0C31495CBE26A73A5DDC8882"><enum>(B)</enum><text>experts in the
				fields of adult education, literacy, and workplace skills;</text>
								</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H57CD6BBDB5F1472EAC3BD46F339A1E78"><enum>(3)</enum><text display-inline="yes-display-inline">approve a State plan within 120 days after
				receiving the plan, unless the Secretary makes a written determination, within
				30 days after receiving the plan, that the plan does not meet the requirements
				of this section or is inconsistent with specific provisions of this subtitle;
				and</text>
							</paragraph><paragraph id="H063B5E00BA434BD6921B18B7D31C0565"><enum>(4)</enum><text display-inline="yes-display-inline">not finally disapprove of a State plan
				before offering the eligible agency the opportunity, prior to the expiration of
				the 30-day period beginning on the date on which the eligible agency received
				the written determination described in paragraph (3), to revise the plan, and
				providing technical assistance in order to assist the eligible agency in
				meeting the requirements of this
				subtitle.</text>
							</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HE9111C1FF3464880AA6663EF7096D26C"><enum>(3)</enum><text>by striking
			 subsections (f) and (g).</text>
				</paragraph></section><section id="H060E8AB9E5464C109CAF1F21BDCA00C6"><enum>209.</enum><header>Programs for
			 corrections education and other institutionalized individuals</header><text display-inline="no-display-inline">Section 225 of the Adult Education and
			 Family Literacy Act (20 U.S.C. 9225) is amended—</text>

					</subparagraph></paragraph><paragraph id="H761CF178C68B42A2AF9960B2127A0D3F"><enum>(2)</enum><text>by redesignating
			 subsection (d) as subsection (e); and</text>

				</paragraph></section><section id="HC27D49A8EDC84B19A2EDC391C1FE9C87"><enum>210.</enum><header>Grants and
			 contracts for eligible providers</header><text display-inline="no-display-inline">Section 231(b)(1) of the Adult Education and
			 Family Literacy Act (20 U.S.C. 9241(b)(1)) is amended to read as
			 follows:</text>

			 inserting <quote>the measurable goals to be accomplished as a result of the

				general</header><text>The Secretary shall issue such regulations as are
				necessary to reasonably ensure compliance with this title.</text>

				publishing in the Federal Register proposed regulations to carry out this

				State and local workforce investment boards;</text>

				creation of new ways to offer adult education, literacy, and workplace skills
				services of proven effectiveness.</text>

					<section id="H20007B14CC214AB0A15E570CDCE6107B"><enum>243.</enum><header>National
				leadership activities</header><text display-inline="no-display-inline">The
				Secretary shall establish and carry out a program of national leadership
				activities to improve the quality and outcomes of adult education, literacy,
				and workplace skills programs nationwide. Such activities shall include the
				following:</text>
						<paragraph id="HCE991D99BD1D490DBB24A55E4E35F332"><enum>(1)</enum><text>Technical
				assistance, which may include—</text>
							<subparagraph id="H15AD9535081C4826AB31FCDE57C6C1BB"><enum>(A)</enum><text>assistance to
				eligible providers in developing and using certification systems, performance
				measures, and data systems for the improvement of adult education, literacy,
				and workplace skills activities, including family literacy services, transition
				to postsecondary education or career pathways, and integrated English literacy
				and civics education programs;</text>
							</subparagraph><subparagraph id="HAEB27DE217FD4349A4680FFBC683E275"><enum>(B)</enum><text>assistance related
				to professional development activities and assistance for the purpose of
				developing, improving, identifying, and disseminating the most successful
				methods and techniques for providing adult education, literacy, and workplace
				skills activities, including family literacy services, transition to
				postsecondary education or career pathways, and integrated English literacy and
				civics education programs, based on scientific evidence where available;
				or</text>
							</subparagraph><subparagraph id="HE404699A20F647CEA936D8F126FFCAB8"><enum>(C)</enum><text>assistance in
				distance learning and promoting and improving the use of technology in the
				classroom.</text>
							</subparagraph></paragraph><paragraph id="HAB028259774F4C84A1C49A7B0F0D9D20"><enum>(2)</enum><text>National
				demonstration projects for improving adult education, literacy, and workplace
				skills services, which may include projects that—</text>
							<subparagraph id="H69166DF38F9E4068A3BA56ED11C7681B"><enum>(A)</enum><text>accelerate
				learning outcomes for adult learners with the lowest literacy levels;</text>
							</subparagraph><subparagraph id="HED047B542FE14737A08D594CCBEA8572"><enum>(B)</enum><text>promote career
				pathways;</text>
							</subparagraph><subparagraph id="H8B0452813EEF4C6AACE74AEE25D8A04D"><enum>(C)</enum><text>allow dual
				enrollment in adult secondary education and credit bearing postsecondary
				coursework;</text>
							</subparagraph><subparagraph id="H64669EE2B93B42E7A86CD96DF4661F91"><enum>(D)</enum><text>provide integrated
				education and training services;</text>
							</subparagraph><subparagraph id="H3F8EDE6EB252498EA8CA140D4BA0FB50"><enum>(E)</enum><text>build capacity to
				enhance the intensity of adult education, literacy, and workplace skills
				services;</text>
							</subparagraph><subparagraph id="H0828D0F8D07146B4B706059E679D8C51"><enum>(F)</enum><text>establish
				partnerships to improve the quality of and expand adult education, literacy,
				and workplace skills services to more adults;</text>
							</subparagraph><subparagraph id="HC30C5D2A2233453CABCFFEB5F24D7EB9"><enum>(G)</enum><text>provide
				professional development opportunities to adult education, literacy, and
				workplace skills service providers;</text>
							</subparagraph><subparagraph id="H23DE4D0658D543DCA93B4B9D41797253"><enum>(H)</enum><text>develop new
				curricula and methods of instruction that improve learning outcomes in adult
				education, literacy, and workplace skills programs; and</text>
							</subparagraph><subparagraph id="H8E757DD399C141C583BC29512B70CAAA"><enum>(I)</enum><text>provide integrated
				English literacy and civics education program instruction.</text>
							</subparagraph></paragraph><paragraph id="HBC8EC5F8589844D69DC99A87DDED60F7"><enum>(3)</enum><text>Dissemination of
				the results and best practices identified in the national demonstration
				projects described in paragraph (2).</text>
						</paragraph><paragraph id="HF1DF8E0774674862ACA37249E75AB42A"><enum>(4)</enum><text>Program evaluation
				and data collection and
				reporting.</text>
						</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H1DC4C77C2C9F4A5883D611CCFBF533BA"><enum>215.</enum><header>Integrated
			 English literacy and civics education programs</header><text display-inline="no-display-inline">Chapter 4 of subtitle A of the Adult
			 Education and Family Literacy Act (20 U.S.C. 9251 et seq.) is amended by adding
			 at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HC2D1E4C81F59401A9C5AD0A787A65AAA" style="OLC">
					<section id="H36A6E5DBCA8045D0BC2477A8B843D24D"><enum>244.</enum><header>Integrated
				English literacy and civics education programs</header>
						<subsection id="HC4990C18B61B4CC5B0396FBE88752C7E"><enum>(a)</enum><header>In
				general</header><text>From funds reserved under section 211(a)(4) for each
				fiscal year, the Secretary shall award grants to States, in accordance with the
				allocations under subsection (b), for integrated English literacy and civics
				education programs.</text>
						</subsection><subsection id="HEAE5CD4627CD4C9481E75784981BCCB3"><enum>(b)</enum><header>Allocations</header>
							<paragraph id="HA906D52AEA50418BA782FF27FAF76D75"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), of the funds described in
				subsection (a), the Secretary shall allocate—</text>
								<subparagraph id="H1BA693FB4AF849A99855A5CB6F0A8A07"><enum>(A)</enum><text>65 percent to
				States on the basis of a State's need for integrated English and civics
				education programs, as determined by calculating each State's share of a
				10-year average of the data compiled by the Office of Immigration Statistics of
				the Department of Homeland Security, for immigrants admitted for lawful
				permanent residence for the 10 most recent years; and</text>
								</subparagraph><subparagraph id="H5185B226B65C472AAC173FA11D349B9B"><enum>(B)</enum><text>35 percent to
				States on the basis of whether the State experienced growth, as measured by the
				average of the 3 most recent years for which data compiled by the Office of
				Immigration Statistics of the Department of Homeland Security are available,
				for immigrants admitted for lawful permanent residence.</text>
								</subparagraph></paragraph><paragraph id="H2DBD7DE9AEBC4BD0BD44FB5078A94CC6"><enum>(2)</enum><header>Minimum</header><text>No
				State shall receive an allocation under paragraph (1) for a fiscal year in an
				amount that is less than
				$60,000.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title commented="no" id="H7C899185A4CE4CFBBBC56C0DFD65D6BE"><enum>III</enum><header>21st Century
			 Technology and Skills for Adult Learners</header>
			<section commented="no" id="HCEE8D1CC3CE84BBDB839FB04842F283D"><enum>301.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this title are the
			 following:</text>
				<paragraph commented="no" id="H4B0263B6737A41C4B82EFA645DDD9E0F"><enum>(1)</enum><text>To expand access
			 to adult education services through the use of technology.</text>
				</paragraph><paragraph commented="no" id="H2CCB413E13A041E18BA4949C3BA71EE1"><enum>(2)</enum><text>To provide
			 professional development for providers of adult education, literacy, and
			 workplace skills services so that they are able to—</text>
					<subparagraph commented="no" id="HEDA91CAC05B04CAFB364E9E79B083874"><enum>(A)</enum><text>effectively use
			 technology in the delivery of adult education, literacy, and workplace skills
			 services; and</text>
					</subparagraph><subparagraph commented="no" id="H1CE34F8880D0440487BB3FC0A381CCB6"><enum>(B)</enum><text>improve the
			 quality of instruction and accelerate the—</text>
						<clause commented="no" id="H149135DE3B2E4541BBA95577AC3A6562"><enum>(i)</enum><text>achievement of
			 basic educational skills, English language literacy, and secondary school
			 equivalency or postsecondary education; and</text>
						</clause><clause commented="no" id="H3AE8D06A98054F6BA18A35368FCA96D3"><enum>(ii)</enum><text>training
			 readiness for adult learners.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" id="HF691668029D64FC5B7321AE6E1ED9ECE"><enum>(3)</enum><text>To assist States
			 in developing a 21st century delivery system for adult education, literacy, and
			 workplace skills services.</text>
				</paragraph><paragraph commented="no" id="HF5D9A7B99D8F49B78F8E7628652F4906"><enum>(4)</enum><text>To assist adults
			 in developing technology literacy.</text>
				</paragraph></section><section commented="no" id="H46EE8EC8A95F4839972D0FE50C6A520F"><enum>302.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph commented="no" id="HDA104F9DAE0542ABA547989382965AC0"><enum>(1)</enum><header>Adult education
			 terms</header><text display-inline="yes-display-inline">The terms <term>adult
			 education</term>, <term>eligible agency</term>, <term>eligible provider</term>,
			 <term>Secretary</term>, and <term>State</term> have the meanings given the
			 terms in section 203 of the Adult Education and Family Literacy Act (20 U.S.C.
			 9202).</text>
				</paragraph><paragraph commented="no" id="HE1B3C79095CF43A99499B3C4E2E069D1"><enum>(2)</enum><header>Distance
			 education</header><text display-inline="yes-display-inline">The term
			 <term>distance education</term> has the meaning given the term in section 103
			 of the Higher Education Act of 1965 (20 U.S.C. 1003).</text>
				</paragraph><paragraph commented="no" id="HB4647D1A9847431E9A8E15DDB9C37559"><enum>(3)</enum><header>Institute</header><text display-inline="yes-display-inline">The term <term>Institute</term> means the
			 National Institute for Adult Education, Literacy, and Workplace Skills
			 established under section 242 of the Adult Education and Family Literacy Act
			 (20 U.S.C. 9252).</text>
				</paragraph><paragraph commented="no" id="H43F19FCC6A7F45F6BB6E25F0972FC1BB"><enum>(4)</enum><header>Technology
			 literacy</header><text display-inline="yes-display-inline">The term
			 <term>technology literacy</term> means the knowledge and skills in using
			 contemporary information, communication and learning technologies in a manner
			 necessary for successful lifelong learning and citizenship in the
			 knowledge-based, digital, and global 21st century, which includes the
			 abilities—</text>
					<subparagraph commented="no" id="H20E630769997440B91D70C0A0040712D"><enum>(A)</enum><text display-inline="yes-display-inline">to effectively communicate and
			 collaborate;</text>
					</subparagraph><subparagraph commented="no" id="HDF605E3DC08348E5807D6BAFFC543D13"><enum>(B)</enum><text display-inline="yes-display-inline">to analyze and solve problems;</text>
					</subparagraph><subparagraph commented="no" id="H6114CAC7AAFD4540A948F9FDE923A796"><enum>(C)</enum><text display-inline="yes-display-inline">to access, evaluate, manage, and create
			 information and otherwise gain information literacy; and</text>
					</subparagraph><subparagraph commented="no" id="H902734C5A2814411AD23E01EC72DB021"><enum>(D)</enum><text display-inline="yes-display-inline">to do so in a safe and ethical
			 manner.</text>
					</subparagraph></paragraph></section><section commented="no" id="H66FEA2F61B5B45E8A09CEC2419766D1B"><enum>303.</enum><header>Reservation of
			 funds and allotments</header>
				<subsection commented="no" id="H4A061D53164140AE8987416FB6ABBAC9"><enum>(a)</enum><header>Reservation of
			 funds</header><text>From the sums appropriated under section 307 for a fiscal
			 year, the Secretary shall reserve 3 percent or $7,500,000 to carry out section
			 306, whichever amount is less.</text>
				</subsection><subsection commented="no" id="H78F8D1EDFA804317B6ED3741449CA6A1"><enum>(b)</enum><header>Allotment of
			 remainder</header><text>From the sums remaining for a fiscal year after making
			 the reservation under subsection (a), the Secretary shall allot—</text>
					<paragraph commented="no" id="HA4DA912B67494F0BB1F9430040713CDB"><enum>(1)</enum><text>75 percent to
			 carry out section 305;</text>
					</paragraph><paragraph commented="no" id="H31420585876643ACAFDE52896B573EBA"><enum>(2)</enum><text>20 percent to
			 carry out section 304; and</text>
					</paragraph><paragraph commented="no" id="H0F19176A479541FBBD7A677B49A0006B"><enum>(3)</enum><text>5 percent for
			 administrative costs in carrying out section 304.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H5BE2B8DD617A4D2A97488334860127D3"><enum>(c)</enum><header>Allotments to
			 eligible agencies</header>
					<paragraph commented="no" display-inline="no-display-inline" id="HA0137966DA674A42B2074CA5E069EE6F"><enum>(1)</enum><header>In
			 general</header><text>From the sums available to carry out section 304 for a
			 fiscal year, the Secretary shall allot to each eligible agency with an approved
			 application an amount that bears the same relationship to such sums as the
			 amount received under section 211(c)(2) of the Adult Education and Family
			 Literacy Act (20 U.S.C. 9211(c)(2)) by such eligible agency bears to the amount
			 received under such section for such fiscal year by all eligible
			 agencies.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF88074DD574942BCB115521912111E25"><enum>(2)</enum><header>Minimum
			 allotment</header><text>No eligible agency shall receive an allotment under
			 paragraph (1) for a fiscal year in amount that is less than $100,000. If the
			 amount appropriated to carry out section 304 for a fiscal year is not
			 sufficient to pay such minimum allotment, the amount of such minimum allotments
			 shall be ratably reduced.</text>
					</paragraph></subsection></section><section commented="no" id="H19E768E0D4134598A37DE4CBE8C63334"><enum>304.</enum><header>Grants to
			 eligible agencies</header>
				<subsection commented="no" id="H3DA96740A95947D39527EC3A312163C3"><enum>(a)</enum><header>Authorization of
			 grants</header><text>The Secretary shall award grants to eligible agencies from
			 allotments under section 303(b).</text>
				</subsection><subsection commented="no" id="H566B838394C84D779DAB8783C5557287"><enum>(b)</enum><header>Application</header>
					<paragraph commented="no" id="HCB2168DF9475483D876E3B563E402844"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Each eligible agency
			 that desires to receive a grant under this title shall submit an application to
			 the Secretary at such time, in such manner, and accompanied by such information
			 as the Secretary may require.</text>
					</paragraph><paragraph commented="no" id="H22014BB7F42A4ECFB00A5221FD2B9A34"><enum>(2)</enum><header>Contents</header><text>An
			 application submitted under paragraph (1) shall contain the following:</text>
						<subparagraph commented="no" id="H9999C5B5713D45C09115BC52ABEF88F4"><enum>(A)</enum><text>A description of
			 the eligible agency's technology plan for the adult education system, including
			 measurable goals to be achieved.</text>
						</subparagraph><subparagraph commented="no" id="H56B44C02A9E94CF1B7CFEDCF2BB318D8"><enum>(B)</enum><text>A description of
			 how the eligible agency will provide technical assistance and support to local
			 programs.</text>
						</subparagraph><subparagraph commented="no" id="H2DB4C7988A004A82BE8B55AA38C6F15F"><enum>(C)</enum><text>A description of
			 how the eligible agency will use technology to expand adult education,
			 literacy, and workplace skills services to more adults, including those in
			 rural areas.</text>
						</subparagraph><subparagraph commented="no" id="H32F464F1E2CB4ADDBBA56C009C37CA19"><enum>(D)</enum><text>A description of
			 the long-term goals and strategies for improved outcomes for adult
			 learners.</text>
						</subparagraph><subparagraph commented="no" id="HD9CD2AC555FD47AE8ED1AEF74AE9FC1C"><enum>(E)</enum><text>A description of
			 the professional development activities to be undertaken.</text>
						</subparagraph><subparagraph commented="no" id="HE744FE8EC4734E53B8866214D62BAA0B"><enum>(F)</enum><text>A description of
			 the performance benchmarks and how data will be collected.</text>
						</subparagraph><subparagraph commented="no" id="H0C95127BB0794188BF62A8A715F0831C"><enum>(G)</enum><text>A description of
			 how the eligible agency will ensure that grants or contracts to eligible
			 providers are of sufficient size and scope to achieve the purposes of this
			 title.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" id="H91BDAD0C44A84E0E9972D05CA82C8FE2"><enum>(c)</enum><header>Activities</header><text display-inline="yes-display-inline">An eligible agency that receives a grant
			 under this title shall carry out the following:</text>
					<paragraph commented="no" id="HE5FE98BC81974912B1481F9A6DB9E791"><enum>(1)</enum><text>Developing a
			 statewide technology plan for the adult education system.</text>
					</paragraph><paragraph commented="no" id="HFC0E2D42D3BD4FACAF7448A61155C219"><enum>(2)</enum><text>Providing
			 professional development for adult education, literacy, and workplace skills
			 service providers.</text>
					</paragraph><paragraph commented="no" id="HA02BF3E7543E4D5E83326FB6B077E91D"><enum>(3)</enum><text>Providing access
			 to curricula, instruction, and assessment for adult learners and eligible
			 providers.</text>
					</paragraph><paragraph commented="no" id="H1EBBF3605CB147F59918D851C45A16DE"><enum>(4)</enum><text>Supporting the
			 development of curricula and assessment tools for adult education, literacy,
			 and workplace skills service providers.</text>
					</paragraph><paragraph commented="no" id="H203894ECDCB340E8B3D3B288C53BDA05"><enum>(5)</enum><text>Providing guidance
			 and technical assistance to eligible providers.</text>
					</paragraph><paragraph id="H6AADA17321234091AF4D202ABF458761"><enum>(6)</enum><text>Supporting
			 innovative pilot projects such as the use of assistive technology to deliver
			 content to adult learners.</text>
					</paragraph></subsection></section><section commented="no" id="H6E7B605C2E894C48B0DC53CBC20AB280"><enum>305.</enum><header>Grants and
			 contracts to eligible providers</header>
				<subsection commented="no" id="HC36EB82CE45846089E9C7ED4FA97E17E"><enum>(a)</enum><header>Authorization of
			 grants and contracts</header><text>An eligible agency that receives a grant
			 under this title shall award grants and contracts to eligible providers to
			 carry out activities described in this section.</text>
				</subsection><subsection commented="no" id="HB6F9AEB1F293404DBFECC8BC6EAA6745"><enum>(b)</enum><header>Eligible
			 provider application</header><text>An eligible provider that desires to receive
			 a grant or contract under this title shall submit an application to an eligible
			 agency, which shall include—</text>
					<paragraph commented="no" id="H50AF408B75F34917A16C0BE2D81C7927"><enum>(1)</enum><text>a description of
			 how the eligible provider will integrate technology into the eligible
			 provider's delivery of adult education, literacy, and workplace skills
			 services;</text>
					</paragraph><paragraph commented="no" id="HFCE1EB4BD78246BB941CB6E4AEA76A3C"><enum>(2)</enum><text>a description of
			 professional development activities to be undertaken; and</text>
					</paragraph><paragraph commented="no" id="H219B415DA7A14C439C68C9D4E06ACB28"><enum>(3)</enum><text>a description of
			 plans to regularly replace computers and servers that lack the functional
			 capabilities to process new online applications and services, including video
			 conferencing, video streaming, virtual simulations, and distance education
			 courses.</text>
					</paragraph></subsection><subsection commented="no" id="HE55D22EEB249404194F4ADC82E3BF3CF"><enum>(c)</enum><header>Eligible
			 provider activities</header><text display-inline="yes-display-inline">An
			 eligible provider that receives a grant or contract under this title shall
			 carry out the following:</text>
					<paragraph commented="no" id="H5471415951514D99842F1FA7A6C9535A"><enum>(1)</enum><text>Acquiring and
			 effectively implementing technology tools, applications, and other resources in
			 conjunction with enhancing or redesigning adult education, literacy, and
			 workplace skills curricula to increase adult learning outcomes and improve
			 adult technology literacy.</text>
					</paragraph><paragraph commented="no" id="H0DD69D7827994CEF8FBC5FC74F9F70A0"><enum>(2)</enum><text>Acquiring and
			 effectively implementing technology tools, applications, and other resources
			 to—</text>
						<subparagraph commented="no" id="H2C128E5A04054E9FB4A96F22BFA79ACC"><enum>(A)</enum><text>conduct on-going
			 assessments and use other timely data systems to more effectively identify
			 individual learning needs and guide personalized instruction, learning, and
			 appropriate interventions that address those personalized student learning
			 needs; and</text>
						</subparagraph><subparagraph commented="no" id="H1F793DEFB12E4B5F8500DC01D4C40020"><enum>(B)</enum><text>support
			 individualized learning, including through instructional software and digital
			 content that support the learning needs of each student or through providing
			 access to high quality courses and instructors, especially in rural
			 areas.</text>
						</subparagraph></paragraph><paragraph commented="no" id="HC3B072380D864674B81DC43692DE7822"><enum>(3)</enum><text>Providing
			 professional development activities for providers of adult education, literacy,
			 and workplace skills services that includes—</text>
						<subparagraph commented="no" id="HEE81447BABC34401B271D892DC3C9FD2"><enum>(A)</enum><text>training that is
			 on-going, sustainable, timely, and directly related to delivering adult
			 education, literacy, and workplace skills services;</text>
						</subparagraph><subparagraph commented="no" id="HBD4F6C61540142EBA3D2E4473E3297A8"><enum>(B)</enum><text>training in
			 strategies and pedagogy in the delivery of adult education, literacy, and
			 workplace skills services that involves the use of technology and curriculum
			 redesign as key components of changing teaching and learning and improving
			 outcomes for adult learners;</text>
						</subparagraph><subparagraph commented="no" id="HC48D9DC63E8F476DBEC3726DB8FD84E3"><enum>(C)</enum><text>training in the
			 use of technology to ensure that providers of adult education, literacy, and
			 workplace skills services are able to use technology for data analysis to
			 enable individualized instruction and to use technology to improve technology
			 literacy for adult learners; and</text>
						</subparagraph><subparagraph commented="no" id="H65789C058EB1427A93E281F6FF2FCE19"><enum>(D)</enum><text>training that
			 includes on-going communication and follow-up with instructors, facilitators,
			 and peers.</text>
						</subparagraph></paragraph><paragraph commented="no" id="H101ABAC8E603499E8E35DEA68A272518"><enum>(4)</enum><text>Acquisition and
			 implementation of technology tools, applications, and other resources to be
			 employed in professional development activities.</text>
					</paragraph></subsection></section><section commented="no" id="H5000354680B24F8885442917053D5CC4"><enum>306.</enum><header>National Adult
			 Learning and Technology Resource Center</header>
				<subsection commented="no" id="HEB3A8A41CC654A6AA6C455B2D1E30A23"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Institute shall
			 establish and maintain the National Adult Learning and Technology Resource
			 Center (referred to in this section as the <quote>Center</quote>).</text>
				</subsection><subsection commented="no" id="HC41FDBA1D7C14530A08C04F93B49A8BF"><enum>(b)</enum><header>Duties of the
			 Center</header><text>The Center shall—</text>
					<paragraph commented="no" id="HEF9628719B144F3CADC00A1C27E7A5F7"><enum>(1)</enum><text>develop frameworks
			 for technology-based learning and professional development materials for adult
			 education, literacy, and workplace skills;</text>
					</paragraph><paragraph commented="no" id="H13E44BB0B3584607882C5233664447E9"><enum>(2)</enum><text>develop frameworks
			 for performance measures for technology literacy;</text>
					</paragraph><paragraph commented="no" id="H1677AAADBDF643F6967A6A75D6DF9F26"><enum>(3)</enum><text display-inline="yes-display-inline">provide technical assistance to eligible
			 entities and eligible providers of adult education, literacy, and workplace
			 skills;</text>
					</paragraph><paragraph commented="no" id="H664D382502324C93A1F5522CF5EAA397"><enum>(4)</enum><text>support distance
			 education for professional development for eligible entities and eligible
			 providers of adult education, literacy, and workplace skills services;</text>
					</paragraph><paragraph commented="no" id="H7F8B168D42B14C1882D3D6D4D4992C31"><enum>(5)</enum><text>support the
			 innovative uses of technology, such as the use of assistive technology, to
			 deliver content to adult learners; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBBD730855AEA49F895088D637846FAB0"><enum>(6)</enum><text>be accessible to
			 the public through the website of the Institute.</text>
					</paragraph></subsection></section><section commented="no" id="HD6EF9D7F68C740AE9750CBD54EFF8A97"><enum>307.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to carry out this title $250,000,000 for fiscal
			 year 2010 and such sums as may be necessary for each succeeding fiscal
			 year.</text>
			</section></title><title id="H03A6C689C8654A4A84783B01E56E18C5"><enum>IV</enum><header>Research in adult
			 education</header>
			<section id="H410D2C452F3D4AC5ABF384545598ABDE"><enum>401.</enum><header>Research in
			 adult education</header>
				<subsection id="HB5C298F57C534F779D47DDE66ADE4F70"><enum>(a)</enum><header>In
			 general</header><text>Section 133(c)(2)(A) of the Education Sciences Reform Act
			 of 2002 (20 U.S.C. 9533(c)(2)(A)) is amended by inserting <quote>education
			 and</quote> before <quote>literacy</quote>.</text>
				</subsection><subsection id="H185BF06747B24C2F882A318D634C1F40"><enum>(b)</enum><header>National
			 research and development center</header>
					<paragraph id="H2395E6801916486E8F028FB794607CD2"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Education shall direct the Commissioner
			 for Education Research of the National Center for Education Research
			 established pursuant to section 131 of the Education Sciences Reform Act of
			 2002 (20 U.S.C. 9531) to establish a national research and development center
			 for adult education, literacy, and workplace skills as described in section
			 133(c)(2)(A) of such Act (20 U.S.C. 9533(c)(2)(A)).</text>
					</paragraph><paragraph id="H99B1BFF2D292416B89B181FA74863C66"><enum>(2)</enum><header>Provision for
			 expansion of research</header><text>If, as of the date of the enactment of this
			 Act, the Commissioner for Education Research of the National Center for
			 Education Research has established a center for adult literacy in accordance
			 with section 133(c)(2)(A) of the Education Sciences Reform Act of 2002 (20
			 U.S.C. 9533(c)(2)(A)), the Commissioner shall expand the topic of research of
			 such center to include adult education, in accordance with the amendment made
			 by subsection (a).</text>
					</paragraph></subsection></section></title><title id="HAE7A77C666E64502A60677BD3855A2B6"><enum>V</enum><header>Employer
			 Incentives</header>
			<section id="HBC8832B6B54B43E6A761BCFA45175650"><enum>501.</enum><header>Credit for
			 employer educational assistance programs</header>
				<subsection id="H66BA3638E77F4238931B5D7758ACE1E8"><enum>(a)</enum><header>In
			 general</header><text>Subpart D of part IV of subchapter A of chapter 1 of the
			 Internal Revenue Code of 1986 is amended by adding at the end the following new
			 section:</text>
					<quoted-block act-name="" id="H47A9FE41A0B74C45B09F9A006D99E84F" style="OLC">
						<section id="HF40D402128CA43B09A847ED0D00F7C75"><enum>45R.</enum><header>Credit for
				employer educational assistance programs</header>
							<subsection id="HD71DF7784D3E4D34AF8F938C6F8929C6"><enum>(a)</enum><header>General
				rule</header><text>For purposes of section 38, in the case of an employer, the
				employer educational assistance program credit determined under this section
				for the taxable year is an amount equal to 50 percent of the qualified
				educational assistance expenses paid or incurred by the taxpayer to or on
				behalf of any employee of the taxpayer during the taxable year, regardless if
				the program is provided at the workplace or outside of the workplace.</text>
							</subsection><subsection id="H68F96B85908F4E0EBA9FF30C4DCA6262"><enum>(b)</enum><header>Limitations</header>
								<paragraph id="HF45796EB4AF94CDBBCF02D1BEF93A393"><enum>(1)</enum><header>Per employee
				limitation</header><text>The amount of the qualified educational assistance
				expenses taken into account under subsection (a) with respect to any employee
				for the taxable year shall not exceed $5,250.</text>
								</paragraph><paragraph id="H1FA10CA6E77A4B51A51EB4DB420D107B"><enum>(2)</enum><header>Total
				limitation</header><text>The aggregate amount of the qualified educational
				assistance expenses taken into account under subsection (a) with respect to all
				employees of the taxpayer for the taxable year shall not exceed the average of
				the aggregate qualified educational assistance expenses with respect to all
				employees of the taxpayer taken into account under subsection (a) in the 3
				taxable years preceding such taxable year.</text>
								</paragraph><paragraph commented="no" id="H8B5A2D9673654F95AE6E724C2F30C2A2"><enum>(3)</enum><header>Transition
				rule</header>
									<subparagraph commented="no" id="H7B922B2A1CA540AB8D473C445DDBB311"><enum>(A)</enum><header>In
				general</header><text>In the case of a taxable year in which qualified
				educational assistance expenses of the taxpayer have not been taken into
				account under subsection (a) for each of the 3 taxable years preceding such
				taxable year, the aggregate amount of the qualified educational assistance
				expenses taken into account under subsection (a) with respect to all employees
				of the taxpayer for such taxable year shall not exceed the average of the sum
				of—</text>
										<clause commented="no" id="HF2798EB600084B90A395B4230BB696BD"><enum>(i)</enum><text>the aggregate
				qualified educational assistance expenses with respect to all employees of the
				taxpayer taken into account under subsection (a) in any of the 3 taxable years
				preceding such taxable year, plus</text>
										</clause><clause commented="no" id="HC56A4B83A18A4312A947DBC5BFFA979F"><enum>(ii)</enum><text>the aggregate
				amount of amounts paid or expenses incurred by the employer, for which an
				exclusion was allowable to any employee of the employer under section 127, in
				any of such 3 taxable years in which no expenses were taken into account under
				subsection (a), plus</text>
										</clause><clause commented="no" id="HDDD4424D14134D378F61199EC5AD1D86"><enum>(iii)</enum><text>in the case of a
				taxable year in which expenses have not been taken into account under
				subsection (a) or section 127 for each of the 3 taxable years preceding such
				taxable year, an amount equal to—</text>
											<subclause commented="no" id="HCAF3FB7724ED454997CDB7D37366114A"><enum>(I)</enum><text>$5,250, multiplied
				by</text>
											</subclause><subclause commented="no" id="HE9526068248845E9B0A277E8DD25C21E"><enum>(II)</enum><text>the number of
				employees of the taxpayer with respect to which the taxpayer has qualified
				educational assistance expenses in such taxable year.</text>
											</subclause></clause></subparagraph></paragraph></subsection><subsection id="H7281DF157BB24610B79E7571A61E9431"><enum>(c)</enum><header>Qualified
				educational assistance expenses</header><text>For purposes of this
				section—</text>
								<paragraph id="H4514D3E012FA423E9E14C00F04F5EB64"><enum>(1)</enum><header>In
				general</header><text>The term <term>qualified educational assistance
				expenses</term> means expenses paid for educational assistance pursuant to an
				educational assistance program (within the meaning of section 127(b)).</text>
								</paragraph><paragraph id="H231C9838561B469683E78D5780C1EA50"><enum>(2)</enum><header>Educational
				assistance</header><text>The term <term>educational assistance</term> has the
				meaning given such term by section 127(c)(1), applied without regard to
				subparagraph (B) thereof, except that such term includes a payment only if such
				payment is made with respect to an employee enrolled in a program provided at
				the workplace or outside of the workplace—</text>
									<subparagraph id="HD6DE61A5277E40E0B90E304206903C61"><enum>(A)</enum><text>leading to a
				sub-baccalaureate degree or career technical certificate awarded by an
				accredited postsecondary institution; or</text>
									</subparagraph><subparagraph id="H5E520E9D8EA24500A33855CB646E855F"><enum>(B)</enum><text>in basic
				education, workplace skills, or English language training leading to a
				nationally recognized certificate of proficiency.</text>
									</subparagraph></paragraph></subsection><subsection id="HC94C4A55CA334BDA884D42B467C0E8F2"><enum>(d)</enum><header>Other
				definitions and special rules</header><text>Rules similar to the rules of
				paragraphs (2) through (5) of section 127(c) shall apply for purposes of this
				section.</text>
							</subsection><subsection id="HEEFD62CCFE8A48989FA96B89AF9434E9"><enum>(e)</enum><header>Denial of double
				benefit</header><text>No deduction or other credit shall be allowed under this
				chapter to an employer for any amount taken into account in determining the
				credit under this
				section.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HB1F140756D114409A197D2E431FD3AAE"><enum>(b)</enum><header>Credit included
			 in general business credit</header><text>Section 38(b) of the Internal Revenue
			 Code of 1986 is amended by striking <quote>plus</quote> at the end of paragraph
			 (34), by striking the period at the end of paragraph (35) and inserting
			 <quote>, plus</quote>, and by adding at the end the following new
			 paragraph:</text>

				</subsection><subsection id="HE26D1D29D8A74BD3AB3D918030391BE4"><enum>(c)</enum><header>Clerical
			 amendment</header><text>The table of sections for subpart D of part IV of
			 subchapter A of chapter 1 of the Internal Revenue Code of 1986 is amended by
			 adding at the end the following new item:</text>

			 date</header><text>The amendments made by this section shall apply to expenses
			 relating to courses of instruction beginning after December 31, 2009.</text>
