		<section id="HAE579FAA013A4CEB940D6247D1B85FCE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Community-Based Health Care Retraining
			 Act</short-title></quote>.</text>
		</section><section id="HC19DDEA1C8FE4B19B2FD31A7BD94D3FD"><enum>2.</enum><header>Health
			 professions training demonstration project</header><text display-inline="no-display-inline">Section 171 of the Workforce Investment Act
			 of 1998 (29 U.S.C. 2916) is amended by adding at the end the following:</text>
			<quoted-block id="H5DE5636EAC6340C5B75D985D0C15F925" style="OLC">
				<subsection id="H2B90BD0CE09242058145BE1BB9A31349"><enum>(f)</enum><header>Health
				Professions Training Demonstration Project</header>
					<paragraph id="H969EF2EAFA8045A98B0BDD6DCDFD097B"><enum>(1)</enum><header>Definitions</header><text>In
				this subsection the following definitions apply:</text>
						<subparagraph id="H3D0DF9EDE80F407B8E99072581C556F2"><enum>(A)</enum><header>Covered
				community</header><text>The term <term>covered community</term> means a
				community or region—</text>
							<clause id="H50E803518FC6457E9C90F41B59F2BB5B"><enum>(i)</enum><text>that has
				experienced a significant percentage decline in rates of employment; and</text>
							</clause><clause id="HA53703607EB94AC9BC920C6B1C6B40E7"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="HF59ED0B8CD9C4461962DC9CE9AF96E97"><enum>(I)</enum><text>that is determined by
				the Secretary of Health and Human Services (in consultation with the medical
				community) to be an area with a shortage of health care professionals described
				in subparagraph (C)(i); or</text>
								</subclause><subclause id="HB93C0D890E404D50A30E9662412F424C" indent="up1"><enum>(II)</enum><text>that is underserved by the health care
				structure, such as a rural community, a community with a significant minority
				population, or a community for which an applicant can otherwise demonstrate
				need for increased training for health care professionals.</text>
								</subclause></clause></subparagraph><subparagraph id="H7171CBA73F4A4614BE19FE19A967B16E"><enum>(B)</enum><header>Covered
				worker</header><text>The term <term>covered worker</term> means an individual
				who—</text>
							<clause id="H048DC2CB81B949D1A062FE500B41C638"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="H67390D1534944691BACD399CAFBD6607"><enum>(I)</enum><text>has been terminated or
				laid off, or who has received a notice of termination or layoff;</text>
								</subclause><subclause id="H78FA23EB45634C1C8E257D246370B4DA" indent="up1"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="HFB3187A4A3F34959B8C1E687BE827B6C"><enum>(aa)</enum><text>is eligible for or has
				exhausted entitlement to unemployment compensation; or</text>
									</item><item id="H825B11990AAE4E1DA6BCBE41A6BB8FC8" indent="up1"><enum>(bb)</enum><text>has been employed for a duration
				sufficient to demonstrate, to the appropriate entity at a one-stop center
				referred to in section 134(c), attachment to the workforce, but is not eligible
				for unemployment compensation due to insufficient earnings or having performed
				services for an employer that were not covered under a State unemployment
				compensation law; and</text>
									</item></subclause><subclause id="HBC475C93E0EE4B6981D52D894090BA10" indent="up1"><enum>(III)</enum><text>is unlikely to return to a previous
				industry or occupation;</text>
								</subclause></clause><clause id="H16CC6862F28747AAA0BBEF5D97FD21CF"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H87D3742B5BD6408E82A759E47D97EC66"><enum>(I)</enum><text>has been terminated or
				laid off, or has received a notice of termination or layoff, as a result of any
				permanent closure of, or any substantial layoff at, a plant, facility, or
				enterprise; or</text>
								</subclause><subclause id="H61F98F89E2E34A708E306A250A85C821" indent="up1"><enum>(II)</enum><text>is employed at a facility at which the
				employer has made a general announcement that such facility will close within
				180 days; or</text>
								</subclause></clause><clause id="H877A27E78433403F8AF6D427BD69C1A5"><enum>(iii)</enum><text>is an incumbent
				worker employed in a health care profession, and whose training will provide an
				opportunity for employment of other individuals by increasing—</text>
								<subclause id="H57D2894BC9B54028A7B7657955118650"><enum>(I)</enum><text>the number of
				instructors serving the covered community; or</text>
								</subclause><subclause id="HD70F917BC857401B86E6C3497789D455"><enum>(II)</enum><text>the number of
				vacant positions in the covered community.</text>
								</subclause></clause></subparagraph><subparagraph id="H703803585D88466A94B96F18BBF112D1"><enum>(C)</enum><header>Health care
				professional</header><text>The term <term>health care
				professional</term>—</text>
							<clause id="HB4E385153E04472A8C4339C5E3CEC259"><enum>(i)</enum><text>means an
				individual who is involved with—</text>
								<subclause id="HE91E64FAD9BC48F2B1C49472F0797ECE"><enum>(I)</enum><text>the delivery of
				health care services, or related services, pertaining to—</text>
									<item id="H489FD3576EEC46C489CC4D9BE3C06148"><enum>(aa)</enum><text>the
				identification, eval­u­a­tion, management, and prevention of diseases,
				disorders, or injuries; or</text>
									</item><item id="H6AC23005CA0842569DEEB75B71A795D3"><enum>(bb)</enum><text>home-based or
				community-based long-term care;</text>
									</item></subclause><subclause id="H44977E9DC9CE496D97CE7108BBC1ABF3"><enum>(II)</enum><text>the delivery of
				dietary and nutrition services;</text>
								</subclause><subclause id="H077D663FBF6B4F3B8BD07BE8B8C02A4B"><enum>(III)</enum><text>the delivery of
				dental services; or</text>
								</subclause><subclause id="H15A669EF6148484291E3D8A58B98313D"><enum>(IV)</enum><text>rehabilitation
				and health systems management; and</text>
								</subclause></clause><clause id="HFE08AC9754764811A312FF96CDD95FFE"><enum>(ii)</enum><text>includes
				individuals in health care professions for which there is a shortage in the
				community involved, as determined by the Secretary of Health and Human Services
				(in consultation with the medical community) or as otherwise demonstrated by
				the applicant.</text>
							</clause></subparagraph><subparagraph id="H28F4B236A6FD420982C32F3299C1D5D2"><enum>(D)</enum><header>Tribal college
				or university</header><text>The term <term>tribal college or university</term>
				means a Tribal College or University, as defined in section 316(b) of the
				Higher Education Act of 1965 (20 U.S.C. 1059c(b)).</text>
						</subparagraph></paragraph><paragraph id="H3825BDC610F843ABBCFAFFA37976C6BB"><enum>(2)</enum><header>Establishment of
				project</header><text>In accordance with subsection (b), the Secretary shall
				establish and carry out a health professions training demonstration
				project.</text>
					</paragraph><paragraph id="H595AF26F84064F738D0D9C743AC964D1"><enum>(3)</enum><header>Grants</header><text>In
				carrying out the project, the Secretary, after consultation with the Secretary
				of Health and Human Services, shall make grants to eligible entities to pay for
				the Federal share of the cost of enabling the entities to carry out programs in
				covered communities to train covered workers for employment as health care
				professionals (referred to in this subsection as <quote>training
				programs</quote>). The Secretary shall make each grant in an amount of not less
				than $100,000 and not more than $500,000, and each such grant shall be for a
				period of 5 years.</text>
					</paragraph><paragraph id="HAD49CD173D2D42FBAF4A3B4D6843E0BF"><enum>(4)</enum><header>Eligible
				entities</header><text>Notwithstanding subsection (b)(2)(B), to be eligible to
				receive a grant under this subsection to carry out a training program in a
				covered community, an entity shall be a partnership that consists of—</text>
						<subparagraph id="H746673D09DE7468A84FC59CC3E7E8CC7"><enum>(A)</enum><text>a local workforce
				investment board established under section 117 that is serving the covered
				community; and</text>
						</subparagraph><subparagraph id="HA003F58ABC9B45D9A692DB07415D8422"><enum>(B)</enum><text>an institution of
				higher education, as defined in sections 101 and 102 of the Higher Education
				Act of 1965 (20 U.S.C. 1001, 1002), in partnership with at least 1 of the
				following:</text>
							<clause id="H6A664D2DB6284A3387FFC62A60BD1D48"><enum>(i)</enum><text>A
				health clinic or hospital.</text>
							</clause><clause id="HEF5353B43A374AC6BED78E3B473DE914"><enum>(ii)</enum><text>A
				home-based or community-based long-term care facility or program.</text>
							</clause><clause id="HF0C992304C8446EDA3F27F9180A831F9"><enum>(iii)</enum><text>A health care
				facility administered by the Secretary of Veterans Affairs.</text>
							</clause><clause id="HE78DAEDE3E01405DB90DDC619210FE05"><enum>(iv)</enum><text>A
				tribal college or university.</text>
							</clause><clause id="H5EF3896A7D7B436F9F7B6905E7B02C2C"><enum>(v)</enum><text>A
				labor organization, or an industry or industry group.</text>
							</clause><clause id="H4730A9912C2947E7829BBD7EF70A1FB2"><enum>(vi)</enum><text>A
				local economic development entity serving the covered community.</text>
							</clause><clause id="HFEF1271B3E434CE2AB25D1CFB1AC1570"><enum>(vii)</enum><text>A joint
				labor-management partnership.</text>
							</clause></subparagraph></paragraph><paragraph id="H2735AB827F704DCAB64CCD247E401396"><enum>(5)</enum><header>Applications</header><text>To
				be eligible to receive a grant under this subsection, an entity shall submit an
				application to the Secretary at such time, in such manner, and containing such
				information as the Secretary may require, including, at a minimum—</text>
						<subparagraph id="H3EE7F6A858624DFBA6612FC66181ADB8"><enum>(A)</enum><text>a proposal to use
				the grant funds to establish or expand a training program in order to train
				covered workers for employment as health care professionals, including
				information that demonstrates the long-term viability of the training program
				beyond the period of the grant;</text>
						</subparagraph><subparagraph id="HA40BDD59250049FE80C4BF44FD59C3DF"><enum>(B)</enum><text>information
				demonstrating the need for the training and support services to be provided
				through the training program;</text>
						</subparagraph><subparagraph id="H9132C929268241709022CBE49A3F9C1E"><enum>(C)</enum><text>information
				describing the manner in which the entity will expend the grant funds, and the
				activities to be carried out with the funds;</text>
						</subparagraph><subparagraph id="H73577C9C56374952AAF2B0253BB0B66D"><enum>(D)</enum><text>information
				demonstrating that the entity meets the requirements of paragraph (4);</text>
						</subparagraph><subparagraph id="HFF0DB088FAD54A92846CE25FB4A2C742"><enum>(E)</enum><text>with respect to
				training programs carried out by the applicant, information—</text>
							<clause id="H38876FA920324A348B2887A6668A9789"><enum>(i)</enum><text>on
				the graduation rates of the training programs involved;</text>
							</clause><clause id="HABF8AB2712474DF5AA46549CEB85815D"><enum>(ii)</enum><text>on the retention
				measures carried out by the applicant;</text>
							</clause><clause id="H9C9E03EF9620470CA418BADC8105CB8D"><enum>(iii)</enum><text>on the length of
				time necessary to complete the training programs of the applicant; and</text>
							</clause><clause id="H75E7C32B692740CBA5FFAEB09D4FC4A6"><enum>(iv)</enum><text>on the number of
				qualified covered workers that are refused admittance into the training
				programs because of lack of capacity; and</text>
							</clause></subparagraph><subparagraph id="H9CEA324A2B224BA098679D1797142555"><enum>(F)</enum><text>a description of
				how the applicant has engaged all relevant stakeholders, including the health
				care industry to be served by the training program, local labor organizations
				and other workforce groups, and local industry, in the design of the training
				program to be served with grant funds.</text>
						</subparagraph></paragraph><paragraph id="H32A66C8CC4D342A8B7078490A93D4A36"><enum>(6)</enum><header>Selection</header><text>In
				making grants under paragraph (3), the Secretary, after consultation with the
				Secretary of Health and Human Services, shall—</text>
						<subparagraph id="H6D10EDB24436469EAEBA555981B11ABE"><enum>(A)</enum><text>consider the
				information submitted by the eligible entities under paragraph (5)(E);</text>
						</subparagraph><subparagraph id="HC6143BBFD0804E3A8F3A0C8EEC7EDD83"><enum>(B)</enum><text>select—</text>
							<clause id="HF8ACBADEF17B4ADD95E67668F8F0C86C"><enum>(i)</enum><text>eligible entities
				submitting applications that meet such criteria as the Secretary of Labor
				determines to be appropriate; and</text>
							</clause><clause id="H698B28D2A82149B79D7B894202EC20FE"><enum>(ii)</enum><text>among such
				entities, the eligible entities serving the covered communities with the
				greatest need for the grants and the greatest potential to benefit from the
				grants; and</text>
							</clause></subparagraph><subparagraph id="H659C1A5283664A50A4D5D4FA1EC20878"><enum>(C)</enum><text>give preference to
				eligible entities—</text>
							<clause id="HD5397CEB6D6448EEA4CDFECA81F46E69"><enum>(i)</enum><text>submitting
				applications to serve covered workers who have been terminated or laid off or
				have received a notice of termination or layoff from a manufacturing, service,
				or construction industry, or another industry with significant decline in
				employment as determined by the Secretary; and</text>
							</clause><clause id="HBAAFE6F491D449A0BD155C40DAAB1EB7"><enum>(ii)</enum><text>with a
				demonstrated history of similar and successful partnerships with State boards
				or local boards, institutions of higher education (as defined in paragraph
				(4)(B)), industry groups, and labor organizations.</text>
							</clause></subparagraph></paragraph><paragraph id="H8CF340A69D614BF48723B46E7F7944D7"><enum>(7)</enum><header>Use of
				funds</header>
						<subparagraph id="H14FFEB7163064A3F86B2C6A1BA777030"><enum>(A)</enum><header>In
				general</header><text>An entity that receives a grant under this subsection
				shall use the funds made available through the grant for training and support
				services that meet the needs described in the application submitted under
				paragraph (5), which may include—</text>
							<clause id="H2C2CE8E74E304947A65326B640A5EEFF"><enum>(i)</enum><text>implementing
				training programs for covered workers;</text>
							</clause><clause id="HC198101378B640189D9F74AF9AFDDBB5"><enum>(ii)</enum><text>providing support
				services for covered workers participating in the training programs, such
				as—</text>
								<subclause id="HB273C2A90BBD4CF5BFF996A97FB42FC0"><enum>(I)</enum><text>providing tuition
				assistance;</text>
								</subclause><subclause id="H1A1C3166BF1044F1906A18EDBE3E0D17"><enum>(II)</enum><text>establishing or
				expanding distance education programs;</text>
								</subclause><subclause id="HB0A2E84FE07D443EAD33294A754ACD9A"><enum>(III)</enum><text>providing
				transportation assistance; or</text>
								</subclause><subclause id="HEBFD3F1184674B5DB82B4BF563B5EC02"><enum>(IV)</enum><text>providing child
				care; or</text>
								</subclause></clause><clause id="H2E0E930CA9CC475FAD5684C1696B0FA1"><enum>(iii)</enum><text>increasing
				capacity, subject to subparagraph (B), at an educational institution or
				training center to train individuals for employment as health professionals,
				such as by—</text>
								<subclause id="HD0773B3FDF7240B9972000806883A2CC"><enum>(I)</enum><text>expanding a
				facility, subject to subparagraph (B);</text>
								</subclause><subclause id="HF281D216EF7846AD9D124F3FF14825E2"><enum>(II)</enum><text>expanding course
				offerings;</text>
								</subclause><subclause id="H64531EAA4B2241DE8A4BB02CCA33553B"><enum>(III)</enum><text>hiring
				faculty;</text>
								</subclause><subclause id="H5D23B09503CB41AFB9D36B225BB1FE6D"><enum>(IV)</enum><text>providing a
				student loan repayment program for the faculty;</text>
								</subclause><subclause id="H50991C0154C44A279556A46F5CB515FF"><enum>(V)</enum><text>establishing or
				expanding clinical education opportunities;</text>
								</subclause><subclause id="H3DE99E4A8E1143589A88E22EFE5F8F70"><enum>(VI)</enum><text>purchasing
				equipment, such as computers, books, clinical supplies, or a patient simulator;
				or</text>
								</subclause><subclause id="HCCAEBA320DC549D48B2AE77A76BFC89B"><enum>(VII)</enum><text>conducting
				recruitment.</text>
								</subclause></clause></subparagraph><subparagraph id="H7A19FA15B60542CC87ABBAFE2510D913"><enum>(B)</enum><header>Limitation</header><text>Any
				such grant funds that are used to expand facilities may only be used to rent or
				modernize existing facilities, not to build additional facilities. The entity
				shall use not less than 50 percent of the grant funds to carry out activities
				described in clause (i) or (ii) of subparagraph (A), unless the entity
				demonstrates, in the application submitted under paragraph (5), a need to spend
				more than 50 percent of the grant funds on activities described in subparagraph
				(A)(iii).</text>
						</subparagraph></paragraph><paragraph id="H75DF379410124817B1A121DE3CE82DE4"><enum>(8)</enum><header>Federal
				share</header>
						<subparagraph id="H4570C36CFE5D4D9E8A3E0BC15167C88A"><enum>(A)</enum><header>In
				general</header><text>The Federal share of the cost described in paragraph (3)
				shall be—</text>
							<clause id="H9155DCE9CAFB429685F3C9FD6C25ABE2"><enum>(i)</enum><text>for the first year
				of the grant period, 95 percent;</text>
							</clause><clause id="H51F38E4D51814C948FFA1085780CC898"><enum>(ii)</enum><text>for the second
				such year, 85 percent;</text>
							</clause><clause id="H9290A4FA564645A6A48649A22EC4C59F"><enum>(iii)</enum><text>for the third
				such year, 75 percent;</text>
							</clause><clause id="H38752668A0DC4814BDEEB536B0E0C783"><enum>(iv)</enum><text>for the fourth
				such year, 65 percent; and</text>
							</clause><clause id="HE94EC49DCFE44119AE15BAA791F5B080"><enum>(v)</enum><text>for the fifth such
				year, 55 percent.</text>
							</clause></subparagraph><subparagraph id="HA69ECC3AC6CD4756AE54D5F0C24729DE"><enum>(B)</enum><header>Non-federal
				share</header><text>The eligible entity shall provide the non-Federal share of
				the cost in cash or in kind, fairly evaluated, including plant, equipment, or
				services.</text>
						</subparagraph></paragraph><paragraph id="H55A4AA7D6CD541EBB3BB93F5860FCDA9"><enum>(9)</enum><header>Evaluation</header>
						<subparagraph id="H261B8F33C8F34880ABEB3F0B36719CC7"><enum>(A)</enum><header>In
				general</header><text>Under the Secretary’s existing authority under section
				172, not more than 1 percent of the funds provided under this subsection shall
				be used for evaluation of the training programs described in paragraph (3).
				Eligible entities receiving grants under this section shall use not more than 1
				percent of the grant funds for purposes of evaluation or documentation of the
				training programs.</text>
						</subparagraph><subparagraph id="HD9F519CEDB0D488EAB8902A0246239AC"><enum>(B)</enum><header>Contents</header><text>In
				conducting an evaluation under subparagraph (A), an eligible entity shall
				provide data detailing the success of the training program carried out by the
				entity under paragraph (3), including—</text>
							<clause id="H0A776C65894843BF97943B166FC80D83"><enum>(i)</enum><text>information on the
				number and percentage of participating covered workers who complete a training
				program, including those who earn a degree or certificate through such training
				programs;</text>
							</clause><clause id="H2702CDB52CB34BE3850740FA56800065"><enum>(ii)</enum><text>information on
				the rate of employment of covered workers who have completed the training
				program;</text>
							</clause><clause id="H5C8B498E0AB84D89AF7EB801B35CAAEB"><enum>(iii)</enum><text>an assessment of
				how well the needs of the health care community were addressed by the training
				program; and</text>
							</clause><clause id="HC253BA756BBD4F21A4310B90BC1042F0"><enum>(iv)</enum><text>any other data
				determined to be relevant by the entity to demonstrate the success of the
				training program.</text>
							</clause></subparagraph><subparagraph id="HAE1DE30EBF664238A025943D1ACC6562"><enum>(C)</enum><header>Report</header><text>The
				Secretary shall compile the information resulting from the evaluation or
				documentation conducted under subparagraph (A), and shall submit a report to
				Congress containing the information.</text>
						</subparagraph></paragraph><paragraph id="HF8C4A44BB2CE47B2ACDEEFD3C9557473"><enum>(10)</enum><header>Funding</header><text>Of
				the amounts appropriated to, and available at the discretion of, the Secretary
				or the Secretary of Health and Human Services for programmatic and
				administrative expenditures, a total of $25,000,000 shall be used to establish
				and carry out the demonstration project described in paragraph (2) in
				accordance with this
				subsection.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
