		<official-title>To help provide funds for community gardens, and for
		  other purposes.</official-title>

		<section id="H8037256DFA3D41E18290DD716E59EF1C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Community Gardens Act of
			 2009</short-title></quote>.</text>
		</section><section id="H96535616309F41DDB96BF9EC102176CA"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to establish a
			 program to—</text>
			<paragraph id="H97935FE16C2D4ADB84D42808FC83F623"><enum>(1)</enum><text>establish
			 community gardens to enhance the availability of fresh fruits and vegetables
			 and help reduce greenhouse gas emissions;</text>
			</paragraph><paragraph id="HBEB318711896412F946633ADD83C9424"><enum>(2)</enum><text>promote healthy
			 lifestyles; and</text>
			</paragraph><paragraph id="H9BAC98154F12464280E561D2E5014BAD"><enum>(3)</enum><text>educate and train
			 the public on the importance and value of community gardening.</text>
			</paragraph></section><section id="HB8A6130B91814D4F879FD3E8D1E07B59"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H1B729A093745427CB94D3056F5AB52E3"><enum>(1)</enum><text>The term
			 <quote>community garden</quote> means a garden for individuals in a local
			 community.</text>
			</paragraph><paragraph id="H2DA15B19CE1549A880A849156E8677D0"><enum>(2)</enum><text>The term
			 <quote>eligible entity</quote> means—</text>
				<subparagraph id="H46573E1E7E2C4A2293AFAA69C4D681E8"><enum>(A)</enum><text>a non-profit
			 organization;</text>
				</subparagraph><subparagraph id="HAB1B899BB330475BA3003AF41AD9850F"><enum>(B)</enum><text>a public
			 entity;</text>
				</subparagraph><subparagraph id="HADB01EEA648045C287BAF803C06B3741"><enum>(C)</enum><text>a community
			 development organization;</text>
				</subparagraph><subparagraph id="H712CE85582B7409589DB9F06FAD50318"><enum>(D)</enum><text>a Native American
			 or tribal group;</text>
				</subparagraph><subparagraph id="H00B58B938C4841AEA6DC685BFBA2EB0D"><enum>(E)</enum><text>a technical,
			 educational, or outreach institution;</text>
				</subparagraph><subparagraph id="HC9D1F7CC81B7437FACD8EC16F9D80129"><enum>(F)</enum><text>a State or local
			 government; or</text>
				</subparagraph><subparagraph id="H92C56634FFBD44DCAF6EB94BBDC32161"><enum>(G)</enum><text>a State or local
			 governmental organization.</text>
				</subparagraph></paragraph></section><section id="H8BACF9585EEE49928F5C936EA311D1E2"><enum>4.</enum><header>Grants for
			 Community Gardens</header><text display-inline="no-display-inline">The
			 Secretary of Agriculture (hereinafter in this Act referred to as the
			 <quote>Secretary</quote>) may make grants, with such terms and conditions as
			 the Secretary determines appropriate, to eligible entities for activities under
			 section 6.</text>
		</section><section id="H3A02BA7C492C4F459F9D4E56A4847878"><enum>5.</enum><header>Applications</header><text display-inline="no-display-inline">In order to receive a grant under this Act,
			 an eligible entity shall submit an application in such form and containing such
			 information as the Secretary may require, including the costs associated with a
			 community garden for which the eligible entity will use the grant.</text>
		</section><section id="HBF01945A70E34DCB92A71A6F891E1459"><enum>6.</enum><header>Activities</header><text display-inline="no-display-inline">An eligible entity that receives a grant
			 under this Act may use that grant to engage in activities to establish, build,
			 or operate community gardens. Such activities may include any or all of the
			 following:</text>
			<paragraph id="HB05FAF0231B9409384DE010824CF6339"><enum>(1)</enum><text>Acquiring any
			 interest in real property.</text>
			</paragraph><paragraph id="HC79E25A7A95E4379B9FADCA73499FE19"><enum>(2)</enum><text>Construction.</text>
			</paragraph><paragraph id="H304F70C8897C4744A13FD6E8C1B67D1C"><enum>(3)</enum><text>Community
			 outreach.</text>
			</paragraph><paragraph id="H5ED6F8F80A0347DC8512F04E4122BD2A"><enum>(4)</enum><text>Operations.</text>
			</paragraph><paragraph id="H8A4B9C7CDC314C53BB1CBBF98938CFBF"><enum>(5)</enum><text>Any other
			 appropriate activity.</text>
			</paragraph></section><section id="H2E13A5C6FF044DB59D829F8FE2EC7986"><enum>7.</enum><header>Allocation of
			 grants</header><text display-inline="no-display-inline">In making a grant under
			 this Act, the Secretary shall consider the following:</text>
			<paragraph id="HDFD5B20E4E9141D9911D11E99E860800"><enum>(1)</enum><text display-inline="yes-display-inline">Geographic diversity among grantees.</text>
			</paragraph><paragraph id="H6B0DD46E88AC4786A1E8C5A6CD150864"><enum>(2)</enum><text>The number of
			 individuals in a local community that are likely to participate in a community
			 garden.</text>
			</paragraph></section><section id="H80B3676DEBCB47F98AE41A8B177C3C06"><enum>8.</enum><header>Grant recipient
			 to ensure timely opening of community garden</header>
			<subsection id="H9D03AD0796C54B60BBF1D8436975EB7A"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The eligible entity
			 that receives the last grant made under this Act for a community garden shall
			 ensure that the community garden is operational not later than an opening date
			 that is 2 years after the grant, unless the Secretary provides an
			 exception.</text>
			</subsection><subsection id="HAF350398DB7A4D3F9A1F728BBBF6CBBB"><enum>(b)</enum><header>Subsequent
			 grants to violators</header><text>The Secretary shall treat as an exception a
			 failure by the eligible entity to ensure that the community garden is
			 operational not later than the opening date if the eligible entity receives a
			 grant under this Act for the community garden on or after the opening
			 date.</text>
			</subsection></section><section id="HDF873FD0378F4FD393AFA39050B22BC4"><enum>9.</enum><header>Limitation on use
			 of real property acquired with grant</header><text display-inline="no-display-inline">An eligible entity receiving a grant under
			 this Act that acquires an interest in real property for a community garden
			 using the grant shall ensure that the interest in real property is used for the
			 community garden for a period of not less than 10 consecutive years, beginning
			 on the opening date.</text>
		</section><section id="H9514EEF183E04485B46E612FEBCBCA69"><enum>10.</enum><header>Federal share of
			 costs</header>
			<subsection id="H9FE56CA4F97A46D09E612CAE6B3FAE2D"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">A grant under this
			 section may not exceed 80 percent of the costs specified in the application and
			 associated with all community gardens assisted with the grant.</text>
			</subsection><subsection commented="no" id="H145D07154B1C475D884E88C2586EF3FE"><enum>(b)</enum><header>Eligible entity
			 contributions</header><text display-inline="yes-display-inline">An eligible
			 entity may cover any of those costs that are not covered by the grant using
			 cash or an in-kind contribution.</text>
