<subsection id="H394832E5F6DA4757BCB435AD7A27D472"><enum>(a)</enum><header>Extension</header><text display-inline="yes-display-inline">Paragraph (4) of section 3485(a) is amended by striking <quote>June 30, 2010</quote> each place it appears and inserting <quote>June 30, 2013</quote>.</text></subsection>

<subsection id="HA89603679D074541963A781166B3FAFC"><enum>(a)</enum><header>18-month period</header><text display-inline="yes-display-inline">Section 4102A(c)(8)(A) is amended by striking <quote>three-year period</quote> and inserting <quote>18-month period</quote>.</text></subsection>
<subsection id="HF6D49AF39B414D5191DE76EB82FBC64F"><enum>(b)</enum><header>Effective date</header>
<paragraph id="H509536179A664D9B9E30A1C20300D54D"><enum>(1)</enum><header>Applicability to new employees</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply with respect to a State employee assigned to perform the duties of a disabled veterans’ outreach program specialist or a local veterans’ employment representative under chapter 41 of title 38, United States Code, who is so assigned on or after the date of the enactment of this Act.</text></paragraph>
<paragraph id="H277170411E1D42CEA6E061A51DB383C1"><enum>(2)</enum><header>Applicability to previously-hired employees</header><text display-inline="yes-display-inline">In the case of such a State employee who is so assigned on or after January 1, 2006, and before the date of the enactment of this Act, the Secretary of Labor shall require the State to require, as a condition of a grant or contract under which funds are made available to the State in order to carry out section 4103A or 4104 of title 38, United States Code, each such employee to satisfactorily complete the training described in section 4102A(c)(8)(A) of such title by not later than the date that is 18 months after the date of the enactment of this Act.</text></paragraph></subsection></section>
<section display-inline="no-display-inline" id="H59EC042CD451425698C722772D3B0CC7" section-type="subsequent-section"><enum>104.</enum><header>Clarification of responsibility of Secretary of Veterans Affairs to verify small business ownership</header>
<subsection id="H491C7EE2F3174B5DA006DA146FC04E36"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This section may be cited as the <quote><short-title>Veterans Small Business Verification Act</short-title></quote>.</text></subsection>
<subsection id="H6FE36DDDD7984FC18548D12237AD6806"><enum>(b)</enum><header>Clarification of responsibility of Secretary of Veterans Affairs to verify small business ownership</header>
<paragraph id="HF89253DC929D411DA27112752E1E05E9"><enum>(1)</enum><header>Clarification</header><text display-inline="yes-display-inline">Section 8127(f) is amended—</text>
<subparagraph id="HE6AB3595F6D04C49A69E44E4243E398C"><enum>(A)</enum><text>in paragraph (2)—</text>
<clause id="HCF655675C4514CD89656A27BB5724807"><enum>(i)</enum><text>by inserting <quote>(A)</quote> before <quote>To be eligible</quote>;</text></clause>
<clause id="H09DA2B258C25446C966B93DF43D04829"><enum>(ii)</enum><text>by inserting after <quote>or the veteran.</quote> the following new sentence: <quote>Application for inclusion in the database shall constitute permission under section 552a of title 5 (commonly referred to as the Privacy Act) for the Secretary to access such personal information maintained by the Secretary as may be necessary to verify the information contained in the application.</quote>; and</text></clause>
<clause id="HE9D2042634414E1A81A5C8F7D1584484"><enum>(iii)</enum><text>by inserting after the sentence added by clause (ii) the following new subparagraph:</text>
<quoted-block display-inline="no-display-inline" id="H1A095E7736C941F687370406202351A5" style="OLC">
<subparagraph id="HCBCF74AC8A4146238C539DDE3E3B68CE" indent="up2"><enum>(B)</enum><text display-inline="yes-display-inline">If the Secretary receives an application for inclusion in the database from an individual whose status as a veteran cannot be verified because the Secretary does not maintain information with respect to the veteran status of the individual, the Secretary may not include the small business concern owned and controlled by the individual in the database maintained by the Secretary until the Secretary receives such information as may be necessary to verify that the individual is a veteran.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph>
<subparagraph id="H8E26EF7535D7423482EB0C8D5A359DDA"><enum>(B)</enum><text>by striking paragraph (4) and inserting the following new paragraph (4):</text>
<quoted-block display-inline="no-display-inline" id="H6A3042F68ABC4832B239D1AC346040F9" style="USC">
<paragraph id="H81B6C7C53DF646ECAED71030C82B64C9" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">No small business concern may be listed in the database until the Secretary has verified that—</text>
<subparagraph id="HDCE0F3AA59244EBC9E8F70928325BFDF"><enum>(A)</enum><text>the small business concern is owned and controlled by veterans; and</text></subparagraph>
<subparagraph id="H93706B73BA1C4C33836CAB4F84502126"><enum>(B)</enum><text>in the case of a small business concern for which the person who owns and controls the concern indicates that the person is a veteran with a service-connected disability, that the person is a veteran with a service-connected disability.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H9ADA7BE69D954656B167E48031DC3EF7"><enum>(2)</enum><header>Applicability</header><text>In the case of a small business concern included in the database as of the date of the enactment of this Act for which, as of such date, the Secretary of Veterans Affairs has not verified the status of such concern in accordance with paragraph (4) of subsection (f) of section 8127 of title 38, United States Code, as amended by paragraph (1), not later than 60 days after the date of the enactment of this Act, the Secretary shall notify the person who owns and controls the concern that—</text>
<subparagraph id="H70BA42690BBE4432AB840C6A3F1F5A38"><enum>(A)</enum><text>the Secretary is required to verify the status of the concern in accordance with such paragraph, as so amended;</text></subparagraph>
<subparagraph id="H9597F4B4B579400F89709F6EA1ACF8EB"><enum>(B)</enum><text>verification of such status shall require that the person who owns and controls the concern apply for inclusion in the database in accordance with such subsection, as so amended;</text></subparagraph>
<subparagraph id="H18360401A3B64CC7B1851E1B6AF42613"><enum>(C)</enum><text display-inline="yes-display-inline">application for inclusion in the database shall constitute permission under section 552a of title 5, United States Code (commonly referred to as the Privacy Act), for the Secretary to access such personal information maintained by the Secretary as may be necessary to verify the information contained in the application; and</text></subparagraph>
<subparagraph id="H7074372D2E7F49D4BE7011A7DB64B286"><enum>(D)</enum><text>the person who owns and controls the concern must submit to the Secretary all information required by the Secretary under this paragraph within 90 days of receiving the Secretary’s notice of such requirement or the concern shall be removed from the database.</text></subparagraph></paragraph></subsection></section>
<section id="HDE51200D8CC940BDA17228F9804929DC"><enum>105.</enum><header>Demonstration project for referral of USERRA claims against Federal agencies to the Office of Special Counsel</header>
<subsection id="H0E1ACF55E24D4586885E7369C8B25924"><enum>(a)</enum><header>Establishment of project</header><text>The Secretary of Labor and the Office of Special Counsel shall carry out a 36-month demonstration project under which certain claims against Federal executive agencies under chapter 43 of title 38, United States Code, are referred to, or otherwise received by, the Office of Special Counsel for assistance, including investigation and resolution of the claim as well as enforcement of rights with respect to the claim. The demonstration program shall begin not later than 60 days after the Comptroller General of the United States submits the report required under subsection (e)(3).</text></subsection>
<subsection id="HB26CECC1B2AF46399FE5EB8D20538BA5"><enum>(b)</enum><header>Referral of All Prohibited Personnel Practice Claims to the Office of Special Counsel</header>
<paragraph id="H0E4F86C6B39D4180A285BC44C4E136EE"><enum>(1)</enum><header>In general</header><text>Under the demonstration project, the Office of Special Counsel shall receive and investigate all claims under chapter 43 of title 38, United States Code, with respect to Federal executive agencies in cases where the Office of Special Counsel has jurisdiction over related claims pursuant to section 1212 of title 5, United States Code.</text></paragraph>
<paragraph id="HD36B75D77A854A3189C133E8EC422E26"><enum>(2)</enum><header>Related claims</header><text>For purposes of paragraph (1), a related claim is a claim involving the same Federal executive agency and the same or similar factual allegations or legal issues as those being pursued under a claim under chapter 43 of title 38, United States Code.</text></paragraph></subsection>
<subsection id="H301502C0D2BE439CBCE74A9AF915D8FD"><enum>(c)</enum><header>Referral of Other Claims Against Federal Executive Agencies</header>
<paragraph id="H9FB1703190F54CC79F5D6763E0D3B680"><enum>(1)</enum><header>In general</header><text>Under the demonstration project, the Secretary—</text>
<subparagraph id="HF3087C629A3244E88185E30D13D1AFD0"><enum>(A)</enum><text>shall refer to the Office of Special Counsel all claims described in paragraph (2) made during the period of the demonstration project; and</text></subparagraph>
<subparagraph id="H6F892E737AF84A3E90D33CDA6F3E278F"><enum>(B)</enum><text>may refer any claim described in paragraph (2) filed before the demonstration project that is pending before the Secretary at the beginning of the demonstration project.</text></subparagraph></paragraph>
<paragraph id="H3D9CDCB055894CC78BAD5B18D77A7961"><enum>(2)</enum><header>Claims described</header><text>A claim described in this paragraph is a claim under chapter 43 of title 38, United States Code, against a Federal executive agency by a claimant with a social security account number with an odd number as its terminal digit or, in the case of a claim that does not contain a social security account number, a case number assigned to the claim with an odd number as its terminal digit.</text></paragraph></subsection>
<subsection id="H2800D020852F40C2AD7F028D553D2100"><enum>(d)</enum><header>Administration of demonstration project</header>
<paragraph display-inline="no-display-inline" id="H51EB6D98D12D43359D9ADE4B755ED99F"><enum>(1)</enum><header>In general</header><text>The Office of Special Counsel shall administer the demonstration project. The Secretary shall cooperate with the Office of Special Counsel in carrying out the demonstration project.</text></paragraph>
<paragraph display-inline="no-display-inline" id="H685AE967E487494889341865B7FE4CE6"><enum>(2)</enum><header>Treatment of certain terms in chapter 43 of title 38, United States Code</header><text>In the case of any claim referred to, or otherwise received by, the Office of Special Counsel under the demonstration project, any reference to the <quote>Secretary</quote> in sections 4321, 4322, and 4326 of title 38, United States Code, is deemed to be a reference to the <quote>Office of Special Counsel</quote>.</text></paragraph>
<paragraph display-inline="no-display-inline" id="H276B6DBBC1454BF186186FE547F0E819"><enum>(3)</enum><header>Administrative jurisdiction</header><text>In the case of any claim referred to, or otherwise received by, the Office of Special Counsel under the demonstration project, the Office of Special Counsel shall retain administrative jurisdiction over the claim.</text></paragraph></subsection>
<subsection id="HF355A3D9DF5C49359658337D72A79171"><enum>(e)</enum><header>Data comparability for reviewing agency performance</header>
<paragraph id="H88C29B72E99348C296E7865C43CF47AE"><enum>(1)</enum><header>In general</header><text>To facilitate the review of the relative performance of the Office of Special Counsel and the Department of Labor during the demonstration project, the Office of Special Counsel and the Department of Labor shall jointly establish methods and procedures to be used by both the Office and the Department during the demonstration project. Such methods and procedures shall include each of the following:</text>
<subparagraph id="H30E9886EBAC947E48BFA5B8C578182E2"><enum>(A)</enum><text>Definitions of performance measures, including—</text>
<clause id="H9D50D6FD3BDC4A0B8CF4211CA5D9325E"><enum>(i)</enum><text>customer satisfaction;</text></clause>
<clause id="H528880D70CD24020AD557E147147831B"><enum>(ii)</enum><text>cost (such as, but not limited to, average cost per claim);</text></clause>
<clause id="H0CB44F788D7344A1AAB99A0AEBD10B94"><enum>(iii)</enum><text>timeliness (such as, but not limited to, average processing time, case age);</text></clause>
<clause id="HCF31F0F105974933A051E7921B343A86"><enum>(iv)</enum><text>capacity (such as, but not limited to, staffing levels, education, grade level, training received, caseload); and</text></clause>
<clause id="HDF75B6DB35594E0486C3560E40A626E3"><enum>(v)</enum><text>case outcomes.</text></clause></subparagraph>
<subparagraph id="H81B448A2E6C5448C95D7A2496745F02C"><enum>(B)</enum><text>Definitions of case outcomes.</text></subparagraph>
<subparagraph id="HD9A2DBDDC8B4480A85D45DD3339A210F"><enum>(C)</enum><text>Data collection methods and timing of collection.</text></subparagraph>
<subparagraph id="HFF3E6029271D4D2AA6B343BD371DDD42"><enum>(D)</enum><text>Data quality assurance processes.</text></subparagraph></paragraph>
<paragraph id="HA4E928D0ACB44A63AA1A1ECD5CC845DC"><enum>(2)</enum><header>Joint report to congress</header><text>Not later than 90 days after the date of the enactment of this Act, the Special Counsel and the Secretary of Labor shall jointly submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives and to the Comptroller General of the United States a report describing the methods and procedures established under paragraph (1).</text></paragraph>
<paragraph id="H8FC8FC72184645D9B69D70B9D743B12D"><enum>(3)</enum><header>Comptroller General report</header><text>Not later than 30 days after the date of the submittal of the report under paragraph (2), the Comptroller General shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives a report on the report submitted under paragraph (2) and may provide recommendations for improving the methods and procedures described therein.</text></paragraph></subsection>
<subsection id="HBB76282B7EDE41DBB5A2618B00CB89C3"><enum>(f)</enum><header>Agency data to government accountability office</header><text>The Office of Special Counsel and the Secretary of Labor shall submit to the Comptroller General such information and data about the demonstration project as may be required by the Comptroller General, from time to time during the course of the demonstration project and at the conclusion, in order for the Comptroller General to assess the reliability of the demonstration data maintained by both the Office of Special Counsel and the Department of Labor and to review the relative performance of the Office and Department under the demonstration project.</text></subsection>
<subsection id="HA155B39EB42F4721A3FCB18733132AC7"><enum>(g)</enum><header>Government accountability office report</header><text>The Comptroller General shall review the relative performance of the Office of Special Counsel and the Department of Labor under the demonstration project and—</text>
<paragraph id="HEB65A65696104E09BB3F780E194AF9EC"><enum>(1)</enum><text>not later than one year after the commencement of the demonstration project, and annually thereafter during the period when the demonstration project is conducted, submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives an interim report on the demonstration project; and</text></paragraph>
<paragraph id="H4A4117509A0942B79DE024D79EF26BD3"><enum>(2)</enum><text>not later than 90 days after the conclusion of the demonstration project, submit to such committees a final report that includes the findings and conclusions of the Comptroller General regarding the relative performance of the Office and the Department under the demonstration project and such recommendations as the Comptroller General determines are appropriate.</text></paragraph></subsection></section>
<section id="HA7662D02D0EE46FC9DC29A277C8866AA"><enum>106.</enum><header>Veterans Energy-Related Employment Program</header>
<subsection id="H9A3E89CC9AED48188F7C00689F8F5139"><enum>(a)</enum><header>Establishment of pilot program</header><text display-inline="yes-display-inline">To encourage the employment of eligible veterans in the energy industry, the Secretary of Labor, as part of the Veterans Workforce Investment Program, shall carry out a pilot program to be known as the <quote>Veterans Energy-Related Employment Program</quote>. Under the pilot program, the Secretary shall award competitive grants to not more than three States for the establishment and administration of a State program to make grants to energy employers that provide covered training, on-job training, apprenticeships, and certification classes to eligible veterans. Such a program shall be known as a <quote>State Energy-Related Employment Program</quote>.</text></subsection>
<subsection id="H3D303BD58001496E9A5F46A5AC0F409C"><enum>(b)</enum><header>Eligibility for grants</header><text>To be eligible to receive a grant under the pilot program, a State shall submit to the Secretary an application that includes each of the following:</text>
<paragraph id="HCAA352FF85B744D2A5C0A5E194F308AE"><enum>(1)</enum><text display-inline="yes-display-inline">A proposal for the expenditure of grant funds to establish and administer a public-private partnership program designed to provide covered training, on-job training, apprenticeships, and certification classes to a significant number of eligible veterans and ensure lasting and sustainable employment in well-paying jobs in the energy industry.</text></paragraph>
<paragraph id="H862AB133E7DE43CAB763199C11DD2244"><enum>(2)</enum><text>Evidence that the State has—</text>
<subparagraph id="H9753E4D37307460CBDB41DA422F812B1"><enum>(A)</enum><text display-inline="yes-display-inline">a population of eligible veterans of an appropriate size to carry out the State program;</text></subparagraph>
<subparagraph id="H26E2668F61AA43AEA6B4F49996425CEB"><enum>(B)</enum><text>a robust and diverse energy industry; and</text></subparagraph>
<subparagraph id="H2610C9EF05CC485CA1CD71BF5CB0BBEB"><enum>(C)</enum><text>the ability to carry out the State program described in the proposal under paragraph (1).</text></subparagraph></paragraph>
<paragraph id="HCE71323224694AE483A001086E0F35D8"><enum>(3)</enum><text>Such other information and assurances as the Secretary may require.</text></paragraph></subsection>
<subsection id="H9BA7F70904984D42B53DC54418B1DDC2"><enum>(c)</enum><header>Use of funds</header><text>A State that is the recipient of a grant under this section shall use the grant for the following purposes:</text>
<paragraph id="H94910107639C42E49B84B82B5740DDFB"><enum>(1)</enum><text display-inline="yes-display-inline">Making grants to energy employers to reimburse such employers for the cost of providing covered training, on-job training, apprenticeships, and certification classes to eligible veterans who are first hired by the employer on or after November 1, 2010.</text></paragraph>
<paragraph id="H221FE6D8FD13496AB428B367922589E9"><enum>(2)</enum><text display-inline="yes-display-inline">Conducting outreach to inform energy employers and veterans, including veterans in rural areas, of their eligibility or potential eligibility for participation in the State program.</text></paragraph></subsection>
<subsection display-inline="no-display-inline" id="HD4DBC750A1964703B4FB6AD4B1BCD011"><enum>(d)</enum><header>Conditions</header><text display-inline="yes-display-inline">Under the pilot program, each grant to a State shall be subject to the following conditions:</text>
<paragraph id="HDA7D7F4B4BED446E8B7E0972D28D4050"><enum>(1)</enum><text>The State shall repay to the Secretary, on such date as shall be determined by the Secretary, any amount received under the pilot program that is not used for the purposes described in subsection (c).</text></paragraph>
<paragraph id="HB541BEFD05AA4AFF95C6ED2C0EFE39CF"><enum>(2)</enum><text display-inline="yes-display-inline">The State shall submit to the Secretary, at such times and containing such information as the Secretary shall require, reports on the use of grant funds.</text></paragraph></subsection>
<subsection id="H3EAFC3602975456F8F650492A78BCA32"><enum>(e)</enum><header>Employer requirements</header><text display-inline="yes-display-inline">In order to receive a grant made by a State under the pilot program, an energy employer shall—</text>
<paragraph id="HB55AAE32507847EBBC630256ACF97530"><enum>(1)</enum><text>submit to the administrator of the State Energy-Related Employment Program an application that includes—</text>
<subparagraph id="HAA7B65473CFE45AB9FE1CF83ECADEAA3"><enum>(A)</enum><text>the rate of pay, during and after training, for each eligible veteran proposed to be trained using grant funds;</text></subparagraph>
<subparagraph id="H65E20B6FAB63486D84366C3C4E21B7FD"><enum>(B)</enum><text>the average rate of pay for an individual employed by the energy employer in a similar position who is not an eligible veteran; and</text></subparagraph>
<subparagraph id="H508D2968563F42BCA6AA777A19C07A90"><enum>(C)</enum><text>such other information and assurances as the administrator may require; and</text></subparagraph></paragraph>
<paragraph id="HA9B1E5B9DB1C463DAFB652EA354DC4C5"><enum>(2)</enum><text>agree to submit to the administrator, for each quarter, a report containing such information as the Secretary may specify.</text></paragraph></subsection>
<subsection id="H2B5D0BE028624E569A0B6AED7FBE5230"><enum>(f)</enum><header>Limitation</header><text display-inline="yes-display-inline">None of the funds made available to an energy employer through a grant under the pilot program may be used to provide training of any kind to—</text>
<paragraph id="HDC61B1CB4C104A1DBF6C3254497EF791"><enum>(1)</enum><text>a person who is not an eligible veteran; or</text></paragraph>
<paragraph id="H64F23C99BC27452BB1B564559112D499"><enum>(2)</enum><text>an eligible veteran for whom the employer has received a grant, credit, or subsidy under any other provision of law.</text></paragraph></subsection>
<subsection id="HE853B10329474B45BDBE863F375E429A"><enum>(g)</enum><header>Report to Congress</header><text>Together with the report required to be submitted annually under section 4107(c) of title 38, United States Code, the Secretary shall submit to Congress a report on the pilot program for the year covered by such report. The report on the pilot program shall include a detailed description of activities carried out under this section and an evaluation of the program.</text></subsection>
<subsection id="H7888EBFC11124A6B81D0B44B768937E4"><enum>(h)</enum><header>Administrative and reporting costs</header><text>Of the amounts appropriated pursuant to the authorization of appropriations under subsection (j), two percent shall be made available to the Secretary for administrative costs associated with implementing and evaluating the pilot program under this section and for preparing and submitting the report required under subsection (f). The Secretary shall determine the appropriate maximum amount of each grant awarded under this section that may be used by the recipient for administrative and reporting costs.</text></subsection>
<subsection id="HFF14A68B37BB4BF0BACC1C36981FF963"><enum>(i)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section:</text>
<paragraph id="H502C3EE9DBCC4C2E894463E4468473BF"><enum>(1)</enum><text>The term <term>covered training, on-job training, apprenticeships, and certification classes</term> means training, on-job training, apprenticeships, and certification classes that are—</text>
<subparagraph id="H3CC8D4EB63CF4924A19E055BBF137C13"><enum>(A)</enum><text display-inline="yes-display-inline">designed to provide the veteran with skills that are particular to an energy industry and not directly transferable to employment in another industry; and</text></subparagraph>
<subparagraph id="H82646A876232497F8BD772978676D598"><enum>(B)</enum><text>approved as provided in paragraph (1) or (2), as appropriate, of subsection (a) of section 3687 of title 38, United States Code.</text></subparagraph></paragraph>
<paragraph id="H726D7150F580414EA97C3871C3695E55"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>eligible veteran</term> means a veteran, as that term is defined in section 101(2) of title 38, United States Code, who is employed by an energy employer and enrolled or participating in a covered training, on-job training, apprenticeship, or certification class.</text></paragraph>
<paragraph display-inline="no-display-inline" id="HC04BABA609C541D4B4374DEF1E9FABF8"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>energy employer</term> means an entity that employs individuals in a trade or business in an energy industry.</text></paragraph>
<paragraph id="H1510FB8359684F4A99D3EAF570F70EDA"><enum>(4)</enum><text>The term <term>energy industry</term> means any of the following industries:</text>
<subparagraph display-inline="no-display-inline" id="H506767DF9B2840E7A815639426D44B8F"><enum>(A)</enum><text>The energy-efficient building, construction, or retrofits industry.</text></subparagraph>
<subparagraph id="H19711B643F9C45A2B93ED1FBFC2B2F5C"><enum>(B)</enum><text>The renewable electric power industry, including the wind and solar energy industries.</text></subparagraph>
<subparagraph id="H5253C800ADE14A9CBFEEE46D5B3CB99A"><enum>(C)</enum><text>The biofuels industry.</text></subparagraph>
<subparagraph id="H59B187C97284443D85176725CE7ABCD2"><enum>(D)</enum><text>The energy efficiency assessment industry that serves the residential, commercial, or industrial sectors.</text></subparagraph>
<subparagraph id="H39B7FAF9930A4597B00734C283CE51E8"><enum>(E)</enum><text>The oil and natural gas industry.</text></subparagraph>
<subparagraph id="H4345B1FD9B7146F4AFBD0D455B71C3B8"><enum>(F)</enum><text>The nuclear industry.</text></subparagraph></paragraph></subsection>
<subsection id="H0EE30480D1314A4B82435820113816E6"><enum>(j)</enum><header>Appropriations</header><text>There is authorized to be appropriated to the Secretary $1,500,000 for each of fiscal years 2012 through 2014, for the purpose of carrying out the pilot program under this section.</text></subsection></section>
<section id="H9B7B53F8708E4D6FA4FB80849877C103"><enum>107.</enum><header>Pat Tillman Veterans’ Scholarship Initiative</header>
<subsection id="HBAC07D0B27224652BAC62BF8BFA6ED08"><enum>(a)</enum><header>Availability of scholarship information</header><text display-inline="yes-display-inline">By not later than June 1, 2011, the Secretary of Veterans Affairs shall include on the Internet website of the Department of Veterans Affairs a list of organizations that provide scholarships to veterans and their survivors and, for each such organization, a link to the Internet website of the organization.</text></subsection>
<subsection id="H577AB9F4244C4A7AB0974A97E31B44A0"><enum>(b)</enum><header>Maintenance of scholarship information</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall make reasonable efforts to notify schools and other appropriate entities of the opportunity to be included on the Internet website of the Department of Veterans Affairs pursuant to subsection (a).</text></subsection></section></title>
<title id="HF5A99E7F988A419E85D18F58FD993FC5"><enum>II</enum><header>HOUSING AND HOMELESSNESS MATTERS</header>
<section id="HD15CE085A7CD493A8DF44E87936E9CF0"><enum>201.</enum><header>Reauthorization of appropriations for Homeless Veterans Reintegration Program</header><text display-inline="no-display-inline">Section 2021(e)(1)(F) is amended by striking <quote>2009</quote> and inserting <quote>2011</quote>.</text></section>
<section display-inline="no-display-inline" id="HF36025BDAD7944B0B26CC76895DEFDA9"><enum>202.</enum><header>Homeless women veterans and homeless veterans with children reintegration grant program</header>
<subsection id="H41AFFAE3E4BD4A3DA9B74BEDC7E91BFF"><enum>(a)</enum><header>Grant program</header><text display-inline="yes-display-inline">Chapter 20 is amended by inserting after section 2021 the following new section:</text>

<section id="H7BE917184D6240DAAFE248EAA653A391"><enum>2021A.</enum><header>Homeless women veterans and homeless veterans with children reintegration grant program</header>
<subsection id="HD75470E92DAE42C6AF00F0F1529DAE68"><enum>(a)</enum><header>Grants</header><text display-inline="yes-display-inline">Subject to the availability of appropriations provided for such purpose, the Secretary of Labor shall make grants to programs and facilities that the Secretary determines provide dedicated services for homeless women veterans and homeless veterans with children.</text></subsection>
<subsection id="HA06711AB51484ECCA02E7A03C0E71E72"><enum>(b)</enum><header>Use of funds</header><text>Grants under this section shall be used to provide job training, counseling, placement services (including job readiness and literacy and skills training) and child care services to expedite the reintegration of homeless women veterans and homeless veterans with children into the labor force.</text></subsection>
<subsection commented="no" id="H30D4D1B7E160461FA6A350D321781EE7"><enum>(c)</enum><header>Requirement To Monitor Expenditures of Funds</header>
<paragraph commented="no" display-inline="yes-display-inline" id="H3D63479785E5424AB19D3F8B70534DE9"><enum>(1)</enum><text>The Secretary of Labor shall collect such information as that Secretary considers appropriate to monitor and evaluate the distribution and expenditure of funds appropriated to carry out this section. The information shall include data with respect to the results or outcomes of the services provided to each homeless veteran under this section.</text></paragraph>
<paragraph commented="no" id="H0A988111505746508F5747F24ADD10D1" indent="up1"><enum>(2)</enum><text>Information under paragraph (1) shall be furnished in such form and manner as the Secretary of Labor may specify.</text></paragraph></subsection>
<subsection commented="no" id="H1E25147119804825AEC9F12CB784685B"><enum>(d)</enum><header> Administration Through the Assistant Secretary of Labor for Veterans' Employment and Training</header><text>The Secretary of Labor shall carry out this section through the Assistant Secretary of Labor for Veterans’ Employment and Training.</text></subsection>
<subsection commented="no" id="H68FDA9CBF4A24CE5BE8680ECCE0750BA"><enum>(e)</enum><header>Biennial Report to Congress</header><text>The Secretary of Labor shall include as part of the report required under section 2021(d) of this title an evaluation of the grant program under this section, which shall include an evaluation of services furnished to veterans under this section and an analysis of the information collected under subsection (c).</text></subsection>
<subsection id="H872D1C83F6CC4DDB81979070857D1FEC"><enum>(f)</enum><header>Authorization of Appropriations</header>
<paragraph commented="no" display-inline="yes-display-inline" id="H088DEA419F51479C8ACFD0D8CE15D9A6"><enum>(1)</enum><text>In addition to any amount authorized to be appropriated to carry out section 2021 of this title, there is authorized to be appropriated to carry out this section $1,000,000 for each of fiscal years 2011 through 2015.</text></paragraph>
<paragraph commented="no" id="HEC0C779141464B2E84DA9038F12551AA" indent="up1"><enum>(2)</enum><text>Funds appropriated to carry out this section shall remain available until expended. Funds obligated in any fiscal year to carry out this section may be expended in that fiscal year and the succeeding fiscal year.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection id="H008DDD1AD46F4A349535F8B7E02A23C5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 21 is amended by adding at the end the following new section:</text>

<section id="H9EAC66B49175446EA37BAC4E098CD19D"><enum>2108.</enum><header>Specially adapted housing assistive technology grant program</header>
<subsection commented="no" id="H59232BA1EDDC4B44B4CF2D7D90A30F97"><enum>(a)</enum><header>Authority to make grants</header><text display-inline="yes-display-inline">The Secretary shall make grants to encourage the development of new assistive technologies for specially adapted housing.</text></subsection>
<subsection id="H6B3119769C7B4D25BDEBB930961DA2D8"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">A person or entity seeking a grant under this section shall submit to the Secretary an application for the grant in such form and manner as the Secretary shall specify.</text></subsection>
<subsection id="H9D86F20559134E918C4E0A89BBC2B3EC"><enum>(c)</enum><header>Grant funds</header>
<paragraph commented="no" display-inline="yes-display-inline" id="H21A34D082EBE452A80663F7DB8FC9F4A"><enum>(1)</enum><text display-inline="yes-display-inline">Each grant awarded under this section shall be in an amount of not more than $200,000 per fiscal year.</text></paragraph>
<paragraph id="H509F18914F6A4D589FB261125B8D013D" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">For each fiscal year in which the Secretary makes a grant under this section, the Secretary shall make the grant by not later than April 1 of that year.</text></paragraph></subsection>
<subsection id="HC2988F62B5154F209882D7214D0B981C"><enum>(d)</enum><header>Use of funds</header><text display-inline="yes-display-inline">The recipient of a grant under this section shall use the grant to develop assistive technologies for use in specially adapted housing.</text></subsection>
<subsection commented="no" id="H99F6C87B9D104A239E03945774496B18"><enum>(e)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than March 1 of each fiscal year following a fiscal year in which the Secretary makes a grant, the Secretary shall submit to Congress a report containing information related to each grant awarded under this section during the preceding fiscal year, including—</text>
<paragraph commented="no" id="HD308DA91D92D45D7A3CFFF693EC8F821"><enum>(1)</enum><text>the name of the grant recipient;</text></paragraph>
<paragraph commented="no" id="H3C41DCC64EA04D0C8265FDFD209478D3"><enum>(2)</enum><text>the amount of the grant; and</text></paragraph>
<paragraph commented="no" id="HDA4221FC59424CC69BBB8B1587BCAB2D"><enum>(3)</enum><text>the goal of the grant.</text></paragraph></subsection>
<subsection commented="no" id="HA98AADE874B047DB87D49B6D371639F0"><enum>(f)</enum><header>Funding</header><text display-inline="yes-display-inline">From amounts appropriated to the Department for readjustment benefits for each fiscal year for which the Secretary is authorized to make a grant under this section, $1,000,000 shall be available for that fiscal year for the purposes of the program under this section.</text></subsection>
<subsection id="H0F645ADFB34240868B5DCDEFB5F6B2EE"><enum>(g)</enum><header>Duration</header><text>The authority to make a grant under this section shall begin on October 1, 2011, and shall terminate on September 30, 2016.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection id="HFC5596BE77064FEF8799425DE6B6BF74"><enum>(a)</enum><header>Termination by servicemember</header>
<paragraph id="H7750C923E87940C8B6B077C6C152584B"><enum>(1)</enum><header>Termination</header><text>A servicemember may terminate a contract described in subsection (b) at any time after the date the servicemember receives military orders to relocate for a period of not less than 90 days to a location that does not support the contract.</text></paragraph>
<paragraph id="HCF81181A79ED40CB922032695BD8E8F1"><enum>(2)</enum><header>Notice</header><text display-inline="yes-display-inline">In the case that a servicemember terminates a contract as described in paragraph (1), the service provider under the contract shall provide such servicemember with written or electronic notice of the servicemember's rights under such paragraph.</text></paragraph>
<paragraph id="H6755497F36EE418A9E795BED57FB53B3"><enum>(3)</enum><header>Manner of termination</header><text>Termination of a contract under paragraph (1) shall be made by delivery of a written or electronic notice of such termination and a copy of the servicemember’s military orders to the service provider, delivered in accordance with industry standards for notification of terminations, together with the date on which the service is to be terminated.</text></paragraph></subsection>
<subsection id="H7F0B851185424EF0AE3C9CC2D0CDB8BA"><enum>(b)</enum><header>Covered contracts</header><text display-inline="yes-display-inline">A contract described in this subsection is a contract for cellular telephone service or telephone exchange service entered into by the servicemember before receiving the military orders referred to in subsection (a)(1).</text></subsection>
<subsection id="HAE1A6FD87BA142F5B1779DAFA972A788"><enum>(c)</enum><header>Retention of telephone number</header><text>In the case of a contract terminated under subsection (a) by a servicemember whose period of relocation is for a period of three years or less, the service provider under the contract shall, notwithstanding any other provision of law, allow the servicemember to keep the telephone number the servicemember has under the contract if the servicemember re-subscribes to the service during the 90-day period beginning on the last day of such period of relocation.</text></subsection>
<subsection display-inline="no-display-inline" id="H87462A2292CB4DD483051596933008B6"><enum>(d)</enum><header>Family plans</header><text display-inline="yes-display-inline">In the case of a contract for cellular telephone service entered into by any individual in which a servicemember is a designated beneficiary of the contract, the individual who entered into the contract may terminate the contract—</text>
<paragraph id="H3BC02672BEEF4E5DB7A0BE368383D7F5"><enum>(1)</enum><text display-inline="yes-display-inline">with respect to the servicemember if the servicemember is eligible to terminate contracts pursuant to subsection (a); and</text></paragraph>
<paragraph id="HA6F3C210F6794B0FA9401049E0B690CC"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to all of the designated beneficiaries of such contract if all such beneficiaries accompany the servicemember during the servicemember’s period of relocation.</text></paragraph></subsection>
<subsection id="H90EA03A3C36141E68109B4D323E4FCEB"><enum>(e)</enum><header>Other obligations and liabilities</header><text display-inline="yes-display-inline">For any contract terminated under this section, the service provider under the contract may not impose an early termination charge, but any tax or any other obligation or liability of the servicemember that, in accordance with the terms of the contract, is due and unpaid or unperformed at the time of termination of the contract shall be paid or performed by the servicemember. If the servicemember re-subscribes to the service provided under a covered contract during the 90-day period beginning on the last day of the servicemember’s period of relocation, the service provider may not impose a charge for reinstating service, other than the usual and customary charges for the installation or acquisition of customer equipment imposed on any other subscriber.</text></subsection>
<subsection id="H187B95C95072479281B065E5BA7F3D0C"><enum>(f)</enum><header>Return of advance payments</header><text display-inline="yes-display-inline">Not later than 60 days after the effective date of the termination of a contract under this section, the service provider under the contract shall refund to the servicemember any fee or other amount to the extent paid for a period extending until after such date, except for the remainder of the monthly or similar billing period in which the termination occurs.</text></subsection>
<subsection id="H9C4B6E16198441B1996F6C4ED4622B96"><enum>(g)</enum><header>Definitions</header><text>For purposes of this section:</text>
<paragraph id="HC2080DE40B634B1E82C5828A34CC334D"><enum>(1)</enum><text>The term <term>cellular telephone service</term> means commercial mobile service, as that term is defined in section 332(d) of the Communications Act of 1934 (47 U.S.C. 332(d)).</text></paragraph>
<paragraph id="HBFF3942A26A1420D9635B72174922824"><enum>(2)</enum><text>The term <term>telephone exchange service</term> has the meaning given that term under section 3 of the Communications Act of 1934 (47 U.S.C. 153).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H25E535D36C984544AB5023628049704D"><enum>(b)</enum><header>Technical amendment</header><text>The heading for title III of such Act is amended by inserting <quote><header-in-text level="title" style="OLC">, telephone service contracts</header-in-text></quote> after <quote><header-in-text level="title" style="OLC">leases</header-in-text></quote>.</text></subsection>

<subsection id="HD67B2A0F27B54CBF9171936238B27A85"><enum>(a)</enum><header>Civil action</header><text display-inline="yes-display-inline">The Attorney General may commence a civil action in any appropriate district court of the United States against any person who—</text>
<paragraph id="HE70E9056681D41D7A9D55520E2A6B41C"><enum>(1)</enum><text>engages in a pattern or practice of violating this Act; or</text></paragraph>
<paragraph id="H24794550DD394614B0097F215328ECCD"><enum>(2)</enum><text>engages in a violation of this Act that raises an issue of significant public importance.</text></paragraph></subsection>
<subsection id="H3147D729418743D39122C256085C3A63"><enum>(b)</enum><header>Relief</header><text>In a civil action commenced under subsection (a), the court may—</text>
<paragraph id="H90E0E33E39C045ACA7772567E01C077F"><enum>(1)</enum><text display-inline="yes-display-inline">grant any appropriate equitable or declaratory relief with respect to the violation of this Act;</text></paragraph>
<paragraph id="H017FAF62DA48426F814D36D51703862C"><enum>(2)</enum><text>award all other appropriate relief, including monetary damages, to any person aggrieved by the violation; and</text></paragraph>
<paragraph id="H465A53151D904018B0A98FA1BE7F7ADC"><enum>(3)</enum><text>may, to vindicate the public interest, assess a civil penalty—</text>
<subparagraph id="HF693A506248A4D2099D42EF25C788676"><enum>(A)</enum><text>in an amount not exceeding $55,000 for a first violation; and</text></subparagraph>
<subparagraph id="H188E6B04D6A943D183F2EE832A391291"><enum>(B)</enum><text>in an amount not exceeding $110,000 for any subsequent violation.</text></subparagraph></paragraph></subsection>
<subsection id="H6F16F997528740D7B0670D311B99F08D"><enum>(c)</enum><header>Intervention</header><text>Upon timely application, a person aggrieved by a violation of this Act with respect to which the civil action is commenced may intervene in such action, and may obtain such appropriate relief as the person could obtain in a civil action under section 802 with respect to that violation, along with costs and a reasonable attorney fee.</text></subsection></section>
<section id="HEA427D2F08194E2B89CC1C30764C62BB"><enum>802.</enum><header>Private right of action</header>
<subsection id="HE2CB8CD7BCF941098ABA17BB378F0C10"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any person aggrieved by a violation of this Act may in a civil action—</text>
<paragraph id="HD006391F181B449EBCCDA447D1C003FE"><enum>(1)</enum><text>obtain any appropriate equitable or declaratory relief with respect to the violation; and</text></paragraph>
<paragraph id="H25618CE8737647FA8EDD19286F101C4A"><enum>(2)</enum><text display-inline="yes-display-inline">recover all other appropriate relief, including monetary damages.</text></paragraph></subsection>
<subsection id="HEA14FA31ADD44C41A4D57C42B59A0D6F"><enum>(b)</enum><header>Costs and attorney fees</header><text display-inline="yes-display-inline">The court may award to a person aggrieved by a violation of this Act who prevails in an action brought under subsection (a) the costs of the action, including a reasonable attorney fee.</text></subsection></section>
<section id="HDACC4ED49DD449F9BB053F7EC2E31012"><enum>803.</enum><header>Preservation of remedies</header><text display-inline="no-display-inline">Nothing in section 801 or 802 shall be construed to preclude or limit any remedy otherwise available under other law, including consequential and punitive damages.</text></section></title><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HF0CFD15D39A34192AE725BEF73017338"><enum>(b)</enum><header>Conforming Amendments</header><text display-inline="yes-display-inline">Such Act is further amended as follows:</text>

<subsection id="H1A8491C281424C67BAD3F78F8C78F245"><enum>(a)</enum><header>Extension</header><text display-inline="yes-display-inline">Section 1968(a) is amended—</text>
<paragraph id="H2AA41ECF42B8481AB1451442319A059B"><enum>(1)</enum><text>in paragraph (1)(A), by striking clause (ii) and inserting the following new clause (ii):</text>

<section id="H09307F60A0CB45DDAE9AA6741652D2D0"><enum>404.</enum><header>Opportunity to increase amount of Veterans’ Group Life Insurance</header>
<subsection id="H5F63C7A1411A4123870B1A89B2378F0C"><enum>(a)</enum><header>Opportunity to increase amount</header><text display-inline="yes-display-inline">Section 1977(a) is amended—</text>
<paragraph id="H9F57E7330BF643BB912019F59B6FEDCA"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>Except as provided in paragraph (3),</quote> before <quote>Veterans’ Group Life Insurance shall be</quote>; and</text></paragraph>
<paragraph id="H27624A56ECB44A38A60E03106E74FB81"><enum>(2)</enum><text>by adding after paragraph (2) the following new paragraph:</text>
<quoted-block display-inline="no-display-inline" id="HA1202F21E8F6419F93676491D5B02EA7" style="OLC">
<paragraph id="HB5C85DE7394D41AD8489D84D2CC0AAC2" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Not more than once in each five-year period beginning on the one-year anniversary of the date a person becomes insured under Veterans’ Group Life Insurance, such person may elect in writing to increase by $25,000 the amount for which the person is insured if—</text>
<subparagraph id="H654EFD0D956B422CA538BAB2582017C4"><enum>(A)</enum><text display-inline="yes-display-inline">the person is under the age of 60; and</text></subparagraph>
<subparagraph id="HF4F4258AA81342CBB9FF753FEC671939"><enum>(B)</enum><text>the total amount for which the person is insured does not exceed the amount provided for under section 1967(a)(3)(A)(i) of this title.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="HD4F896EC7DEF43C2A4430487A21AD86E"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">Paragraph (3) of section 1977(a) of title 38, United States Code, as added by subsection (a), shall take effect on the date that is 180 days after the date of the enactment of this Act.</text></subsection></section>
<section id="H00E4528E460A4E5E93A86C8D47BFDBD1" section-type="subsequent-section"><enum>405.</enum><header>Elimination of reduction in amount of accelerated death benefit for terminally-ill persons insured under Servicemembers’ Group Life Insurance and Veterans’ Group Life Insurance</header>
<subsection id="H6A1815E09F6145B0A643B85B6C4A10BB"><enum>(a)</enum><header>Elimination of reduction</header><text display-inline="yes-display-inline">Section 1980(b)(1) is amended by striking <quote>reduced by</quote> and all that follows through <quote>the Secretary</quote>.</text></subsection>
<subsection id="H56CC1084AFC941949A661E5857C5D91B"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply with respect to a payment of an accelerated death benefit under section 1980 of title 38, United States Code, made on or after the date of the enactment of this Act.</text></subsection></section>
<section id="HC0FC95BF0CCB4DFDA89EBDB4CACEA943" section-type="subsequent-section"><enum>406.</enum><header>Consideration of loss of dominant hand in prescription of schedule of severity of traumatic injury under Servicemembers’ Group Life Insurance</header>
<subsection id="HAE3505B01B724959B0DB2DB10949765B"><enum>(a)</enum><header>Schedule</header>
<paragraph id="HE5847178A4BA41C9BDCC5DF81BAEFF05"><enum>(1)</enum><header>In general</header><text>Section 1980A(d) is amended—</text>
<subparagraph id="HA6715582E875491A8367399DB8A0E841"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>Payments under</quote> and inserting <quote>(1) Payments under</quote>; and</text></subparagraph>
<subparagraph id="H5B4AAD21D5C9460B80F0969A901B2ECD"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="H27D9328ED1E243B3B7F098EE677C334B" indent="up1"><enum>(2)</enum><text>As the Secretary considers appropriate, the schedule required by paragraph (1) may distinguish in specifying payments for qualifying losses between the severity of a qualifying loss of a dominant hand and of a qualifying loss of a nondominant hand.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>

<subsection id="H63E66C8A6A454B4CBCED3A71455799E8"><enum>(b)</enum><header>Payments for qualifying losses incurred before date of enactment</header>
<paragraph id="HFA704152B69B404B9AAAB1AE4D45DEAD"><enum>(1)</enum><header>In general</header><text>To the extent necessary, the Secretary of Veterans Affairs shall prescribe in regulations mechanisms for payments under section 1980A of title 38, United States Code, for qualifying losses incurred before the date of the enactment of this Act, by reason of paragraph (2) of subsection (d) of such section (as added by subsection (a)(1) of this section).</text></paragraph>
<paragraph id="H944C11F0237948D6984568701E9A1BF9"><enum>(2)</enum><header>Qualifying loss defined</header><text>In this subsection, the term <term>qualifying loss</term> means—</text>
<subparagraph id="HCC73A3098F26415CA56D5AF76C2CF27A"><enum>(A)</enum><text>a loss specified in the second sentence of subsection (b)(1) of section 1980A of title 38, United States Code; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H0EFC41D829484F33AFD2D9793C888A02"><enum>(B)</enum><text>any other loss specified by the Secretary of Veterans Affairs pursuant to the first sentence of that subsection.</text></subparagraph></paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="H87F28DDAB6D04C6A82A8B873A93BEEDA" section-type="subsequent-section"><enum>407.</enum><header display-inline="yes-display-inline">Enhancement of veterans’ mortgage life insurance</header>
<subsection commented="no" display-inline="no-display-inline" id="H6CCFFDB145CD411EB0473EDB58F1820A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2106(b) is amended by striking <quote>$90,000</quote> and inserting <quote>$150,000, or after January 1, 2012, $200,000,</quote>.</text></subsection>

<subsection commented="no" display-inline="no-display-inline" id="HB7189C081C8B4F879821A5402CC9F34B"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Paragraph (1) of section 501(b) of the Veterans’ Housing Opportunity and Benefits Improvement Act of 2006 (Public Law 109–233; 120 Stat. 414; 38 U.S.C. 1980A note) is amended by striking <quote>, if, as determined by the Secretary concerned, that loss was a direct result of a traumatic injury incurred in the theater of operations for Operation Enduring Freedom or Operation Iraqi Freedom</quote>.</text></subsection>

<section id="H0B8A60AF571D4605BE2BE37F2E706A79"><enum>501.</enum><header>Increase in certain burial and funeral benefits and plot allowances for veterans</header>
<subsection id="HD59D13A7D0AC48D9BFDFC3CEC0DCEE8A"><enum>(a)</enum><header>Increase in Burial and Funeral Expenses for Deaths in Department Facilities</header><text>Paragraph (1)(A) of subsection (a) of section 2303 is amended by striking <quote>$300</quote> and inserting <quote>$700 (as increased from time to time under subsection (c))</quote>.</text></subsection>
<subsection id="H0F181BB915C044EFA8EFB969E27B0305"><enum>(b)</enum><header>Increase in Amount of Plot Allowances</header><text>Subsection (b) of such section is amended by striking <quote>$300</quote> both places it appears and inserting <quote>$700 (as increased from time to time under subsection (c))</quote>.</text></subsection>

<paragraph id="H53311BAAD1C643F1B4F298232EF76962"><enum>(1)</enum><text>the Consumer Price Index (all items, United States city average) for the 12-month period ending on the June 30 preceding the beginning of the fiscal year for which the increase is made, exceeds</text></paragraph>
<paragraph id="HAF578E3EB45B499788610CB156E9A01C"><enum>(2)</enum><text>the Consumer Price Index for the 12-month period preceding the 12-month period described in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H5360E1C100A54198B12EBE054331D06D"><enum>(d)</enum><header>Effective Date</header>
<paragraph id="HE7FE1422BFC34B90A16E41C5A73DD5B6"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the amendments made by this section shall apply with respect to deaths occurring on or after October 1, 2011.</text></paragraph>

<subsection id="HC69F9B9657AC4757A2E64720E7348CDD"><enum>(a)</enum><header>Short title</header><text>This section may be cited as the <quote>Corey Shea Act</quote>.</text></subsection>
<subsection id="H8EF7EDC4AA0C4C6BB37C4858AC073E85"><enum>(b)</enum><header>Interment of parents of certain deceased veterans</header><text display-inline="yes-display-inline">Section 2402 is amended—</text>
<paragraph id="H88B7777A7E344A7BA04B3013027A9FC0"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>Under such regulations</quote> and inserting <quote>(a) Under such regulations</quote>;</text></paragraph>
<paragraph id="H89BCB76E445840E88620C11B803A397D"><enum>(2)</enum><text>by moving the margins of paragraphs (1) through (8) two ems to the right;</text></paragraph>

<subparagraph display-inline="no-display-inline" id="H6446BED5A15040CBBA08E4C9161C87F3" indent="up1"><enum>(B)</enum><text>A person described in this subparagraph is a person described in paragraph (1) who—</text>
<clause id="H241E45A983E94003AD649D8DC870D239"><enum>(i)</enum><text display-inline="yes-display-inline">is a hostile casualty or died from a training-related injury;</text></clause>
<clause id="HC164710A5F734797B54ABF8EAC39F306"><enum>(ii)</enum><text>is interred in a national cemetery; and</text></clause>
<clause id="HD213995AFDD84191B30C849BB543C048"><enum>(iii)</enum><text>at the time of the person’s parent’s death, did not have a spouse, surviving spouse, or child who is buried or who, upon death, may be eligible for burial in a national cemetery pursuant to paragraph (5).</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph id="HED2FB51BE3504025A311EEE1EE5A69B8"><enum>(4)</enum><text>by adding at the end the following new subsection:</text>
<quoted-block display-inline="no-display-inline" id="H4D07639E17A64AAE88981937713076E7" style="traditional">
<subsection id="HFCBF8B084E4E40928B4A584DCD743586"><enum>(b)</enum><text>For purposes of subsection (a)(9) of this section:</text>
<paragraph id="H807151537C1B483D9CED1C45DEFD8966"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>parent</term> means a biological father or a biological mother or, in the case of adoption, a father through adoption or a mother through adoption.</text></paragraph>
<paragraph id="HEE56853E07D14D8BB5585344BCFC9D10"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>hostile casualty</term> means a person who, as a member of the Armed Forces, dies as the direct result of hostile action with the enemy, while in combat, while going to or returning from a combat mission if the cause of death was directly related to hostile action, or while hospitalized or undergoing treatment at the expense of the United States for injury incurred during combat, and includes a person killed mistakenly or accidentally by friendly fire directed at a hostile force or what is thought to be a hostile force, but does not include a person who dies due to the elements, a self-inflicted wound, combat fatigue, or a friendly force while the person was in an absent-without-leave, deserter, or dropped-from-rolls status or was voluntarily absent from a place of duty.</text></paragraph>
<paragraph id="HB027A7E0776344EC9824F7623B4D28EC"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>training-related injury</term> means an injury incurred by a member of the Armed Forces while performing authorized training activities in preparation for a combat mission.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H799E40102BB54F83A57EDBB881AD7ACA"><enum>(c)</enum><header>Guidance required</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs, in consultation with the Secretary of Defense, shall develop guidance under which the parent of a person described in paragraph (9)(B) of subsection (a) of section 2402 of title 38, United States Code, as added by subsection (b), may be designated for interment in a national cemetery under that section.</text></subsection>

<paragraph id="H792A2AF00CD64816BDA79FB5915F77BA"><enum>(1)</enum><header>Report required</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to Congress a report on the selection of the sites described in paragraph (2) for the purpose of establishing new national cemeteries.</text></paragraph>

<subparagraph id="H2EDCB5877DEB439BA4BEBB87E301E7D1"><enum>(A)</enum><text>A schedule for the establishment of each cemetery at each site described in paragraph (2) and an estimate of the costs associated with the establishment of each such cemetery.</text></subparagraph>
<subparagraph id="H3C352C4900D14CF9BE9290132BB32444"><enum>(B)</enum><text display-inline="yes-display-inline">As of the date of the submittal of the report, the amount of funds that are available to establish each cemetery at each site described in paragraph (2) from amounts appropriated to the Department of Veterans Affairs for Advance Planning.</text></subparagraph></paragraph></subsection>
<subsection commented="no" id="HBF4FAF26E61F40A5B82CF3913FE2E07B"><enum>(b)</enum><header>Annual reports</header><text display-inline="yes-display-inline">Not later than two years after the date of the enactment of this Act, and each year thereafter until the date on which each cemetery at each site described in subsection (a)(2) is established, the Secretary shall submit to Congress an annual report that includes updates to the information provided in the report under subsection (a).</text></subsection></section></title>

An allowance authorized under this subsection shall be paid in lieu of any allowance authorized by subsection (r)(1).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>

<subparagraph id="H4F45CECD4BD045B4A9DB570A395AB816" indent="up1"><enum>(B)</enum><text>For the purposes of this paragraph, the term <term>catastrophic disability</term>, with respect to a veteran, means a permanent, severely disabling injury, disorder, or disease that compromises the ability of the veteran to carry out the activities of daily living to such a degree that the veteran requires personal or mechanical assistance to leave home or bed, or requires constant supervision to avoid physical harm to self or others.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HEBF399E69F824CF4B99B2565764B5092"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall take effect on October 1, 2011, and shall apply with respect to awards of compensation based on original claims that become effective on or after that date.</text></subsection></section>

<subparagraph id="H0533928E5F2A4ACD9DFA9D94A384D36D" indent="up1"><enum>(D)</enum>
<clause commented="no" display-inline="yes-display-inline" id="H501B8E25B588454DA4B6E2DE69D45C4A"><enum>(i)</enum><text>Whether the term <term>successor in interest</term> applies with respect to an entity described in subparagraph (A) for purposes of clause (iv) of such subparagraph shall be determined on a case-by-case basis using a multi-factor test that considers the following factors:</text>

<subclause id="H280B96939F7148C589755CF8C97C6CC2" indent="up1"><enum>(IV)</enum><text>Similarity of jobs and working conditions.</text></subclause>
<subclause id="HEA05EBD6AF74470995F22230C061109D" indent="up1"><enum>(V)</enum><text>Similarity of supervisory personnel.</text></subclause>
<subclause id="H6CE8150A64AB4A5F99E2B1C7232182FB" indent="up1"><enum>(VI)</enum><text>Similarity of machinery, equipment, and production methods.</text></subclause>
<subclause id="HC8886E2A4AA648C88DAE02A394849743" indent="up1"><enum>(VII)</enum><text>Similarity of products or services.</text></subclause></clause>
<clause id="HEE2822585B034B13954341F1A4AADFE9" indent="up1"><enum>(ii)</enum><text>The entity’s lack of notice or awareness of a potential or pending claim under this chapter at the time of a merger, acquisition, or other form of succession shall not be considered when applying the multi-factor test under clause (i).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HBBD87031C4EC433F98E8E8803C76924B"><enum>(b)</enum><header>Application</header><text>The amendment made by subsection (a) shall apply to—</text>
<paragraph id="H9287BCA4B5494C87B3B1E163B931544B"><enum>(1)</enum><text>any failure to comply with a provision of or any violation of chapter 43 of title 38, United States Code, that occurs before, on, or after the date of the enactment of this Act; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H41ABD1B8220A4F15B9E267CF2B716BB5"><enum>(2)</enum><text>all actions or complaints filed under such chapter 43 that are pending on or after the date of the enactment of this Act.</text></paragraph></subsection></section>
<section id="H5F5C0DF440A54101A754685C5AD4A36B"><enum>703.</enum><header>Technical amendments</header>
<subsection commented="no" display-inline="no-display-inline" id="HDA6BC215516B45C3B31D75EFBD1B2340"><enum>(a)</enum><header>Amendment to section 4324 of title 38, United States Code</header><text>Section 4324(b)(4) is amended by inserting before the period the following: <quote>declining to initiate an action and represent the person before the Merit Systems Protection Board</quote>.</text></subsection>

<subsection id="H568F888663614875BB62E3D4F8A98E7E"><enum>(b)</enum><header>Annual adjustment</header><text>Such section is further amended by adding at the end the following new subsection:</text>

<subsection id="H8762E8D10A4C47C38B80F21C00ACCC41"><enum>(e)</enum><text display-inline="yes-display-inline">Effective on October 1 of each year (beginning in 2011), the Secretary shall increase the dollar amount in effect under subsection (a) by a percentage equal to the percentage by which the Consumer Price Index for all urban consumers (U.S. city average) increased during the 12-month period ending with the last month for which Consumer Price Index data is available. In the event that such Consumer Price Index does not increase during such period, the Secretary shall maintain the dollar amount in effect under subsection (a) during the previous fiscal year.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H1BB1ECFEEDD147E897648838C400950F"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on October 1, 2011.</text></subsection></section>
<section commented="no" display-inline="no-display-inline" id="H9AEDC21514F344A6BAE0F38E51053B06" section-type="subsequent-section"><enum>805.</enum><header display-inline="yes-display-inline">National Academies review of best treatments for chronic multisymptom illness in Persian Gulf War veterans</header>
<subsection commented="no" display-inline="no-display-inline" id="HD23B953D063E4393A0C19C5B226A027E"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall seek to enter into an agreement with the Institute of Medicine of the National Academies to carry out a comprehensive review of the best treatments for chronic multisymptom illness in Persian Gulf War veterans and an evaluation of how such treatment approaches could best be disseminated throughout the Department of Veterans Affairs to improve the care and benefits provided to veterans.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H0EEE6BBC4821401D97DDED9C5448AE4E"><enum>(b)</enum><header display-inline="yes-display-inline">Group of medical professionals</header><text display-inline="yes-display-inline">Under any agreement entered into under subsection (a), the Institute of Medicine shall convene a group of medical professionals who are experienced in treating individuals who served as members of the Armed Forces in the Southwest Asia Theater of Operations of the Persian Gulf War during 1990 or 1991 and who have been diagnosed with chronic multisymptom illness or another health condition related to chemical and environmental exposure that may have occurred during such service.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HA9C0F9AE78BA436D8A5687A125BB785F"><enum>(c)</enum><header display-inline="yes-display-inline">Report</header><text>Any agreement entered into under subsection (a) shall require the Institute of Medicine to submit to the Secretary and to the Committees on Veterans’ Affairs of the Senate and House of Representatives a report on the review and evaluation described in subsection (a) by not later than December 31, 2012. The report shall include such recommendations for legislative or administrative action as the Institute considers appropriate in light of the results of the review.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HC73E0E0FCCE54E10BD7E3CFD5F75436F"><enum>(d)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">Pursuant to any agreement entered into under subsection (a), the Secretary shall provide the Institute of Medicine with such funds as are necessary to ensure the timely completion of the review described that subsection.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HAC1B323C9F4A4942865B1F1EC06773AD"><enum>(e)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">For purposes of this section:</text>
<paragraph commented="no" display-inline="no-display-inline" id="HBED992AD33F14BE28D94B9CA38B6B14C"><enum>(1)</enum><text>The term <term>chronic multisymptom illness in Persian Gulf War veterans</term> means a chronic multisymptom illness defined by a cluster of signs or symptoms relating to service in the Persian Gulf War, typically including widespread pain, persistent memory and concentration problems, chronic headaches, gastrointestinal problems, and other abnormalities not explained by well-established diagnoses.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H81721C67999C4CC5969619CAA87968E4"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>Persian Gulf War</term> has the meaning given that term in section 101(33) of title 38, United States Code.</text></paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="HDDDD59CBF83347FC863CE961DA2F2FE5" section-type="subsequent-section"><enum>806.</enum><header display-inline="yes-display-inline">Extension and modification of National Academy of Sciences reviews and evaluations on illness and service in Persian Gulf War and Post-<enum-in-header>9/11</enum-in-header> Global Operations Theaters</header>
<subsection id="HA9379F360479477492411AF8F6FD8D45"><enum>(a)</enum><header>Review and evaluation of agents and illnesses associated with Persian Gulf War service</header>
<paragraph id="H35F3E41DBFED42A492E001A5A0407354"><enum>(1)</enum><header>Extension of review and evaluation</header><text display-inline="yes-display-inline">Subsection (j) of section 1603 of the Persian Gulf War Veterans Act of 1998 (Public Law 105–277; 38 U.S.C. 1117 note), as amended by section 202(d)(2) of the Veterans Education and Benefits Expansion Act of 2001 (Public Law 107–173; 115 Stat. 989), is amended by striking <quote>October 1, 2010</quote> and inserting <quote>October 1, 2015</quote>.</text></paragraph>
