		<section id="HEB758034791E462E954E7114A0234075" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Local Television Freedom Act of
			 2009</short-title></quote>.</text>
		</section><section id="H4D76C491AD7E4366800068DD164D1ED1"><enum>2.</enum><header>Carriage of
			 stations in an adjacent underserved county under the Communications Act of
			 1934</header>
			<subsection id="H4F1A948D8BF64B640082E81B9F3E85E4"><enum>(a)</enum><header>Retransmission
			 Consent</header><text>Section 325(b) of the Communications Act of 1934 (47
			 U.S.C. 325(b)) is amended—</text>
				<paragraph id="H56DE0DAABC6440B4B23D1688672342A9"><enum>(1)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph id="HC273D280BBA54B0FBC48943A621D042E"><enum>(A)</enum><text>by striking
			 <quote>or</quote> at the end of subparagraph (D);</text>
					</subparagraph><subparagraph id="H4DD27E2FB92A45E2B3F000A034F457E5"><enum>(B)</enum><text>by striking the
			 period at the end of subparagraph (E) and inserting <quote>; or</quote>;</text>
					</subparagraph><subparagraph id="H18D81CA5B42940CC8100B1B793EF6FC8"><enum>(C)</enum><text>by inserting after
			 subparagraph (E) the following new subparagraph:</text>
						<quoted-block id="HBE9D09B8B72D4D4291216F3F961B06B7" style="OLC">
							<subparagraph id="HCCA672C4303C46BBA16804577EF668B5"><enum>(F)</enum><text display-inline="yes-display-inline">to retransmission of the signals of a
				television broadcast station by a multichannel video programming distributor to
				a subscriber located in the station’s adjacent underserved county, unless the
				station certifies to the multichannel video programming distributor that it is
				under no legal obligation restricting its ability to grant retransmission
				consent to such multichannel video programming
				distributor.</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HF69EB3CAE88844C88EB27608CDD6DA29"><enum>(D)</enum><text>in the last
			 sentence, by striking <quote>the term <quote>local market</quote> has the
			 meaning given that term</quote> and inserting <quote>the terms <quote>local
			 market</quote> and <quote>adjacent underserved county</quote> have the meanings
			 given such terms</quote>; and</text>
					</subparagraph></paragraph><paragraph id="HBD81BB9B229C4AFA8DB7E0E9DA698607"><enum>(2)</enum><text>by inserting after
			 paragraph (7) the following new paragraph:</text>
					<quoted-block id="HF3A140BF30C542128F946EEAB1DB729B" style="OLC">
						<paragraph id="H5417FC84717E475787589F27835F325C"><enum>(8)</enum><text display-inline="yes-display-inline">A television broadcast station that elects
				retransmission consent may not request as a condition to receiving
				retransmission consent that a multichannel video programming distributor not
				exercise its right to carry any other broadcast station in the station’s
				adjacent underserved
				county.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HACC0F293882341568E324B4C1C31854F"><enum>(b)</enum><header>Certification
			 rulemaking required</header><text>Within 120 days after the date of enactment
			 of this Act, the Federal Communications Commission (in this Act referred to as
			 the <quote>Commission</quote>) shall complete all actions necessary to
			 promulgate rules governing the certification provided by the television
			 broadcast station under section 325(b)(2)(F) of the Communications Act of 1934
			 (as added by subsection (a)(1)(C) of this Act).</text>
			</subsection><subsection id="HCA393911DA7742A1B4B20291A4FEB720"><enum>(c)</enum><header>Carriage of
			 Distant Signals</header><text display-inline="yes-display-inline">Section
			 339(a)(1)(B) of such Act (47 U.S.C. 339(a)(1)(B)) is amended by inserting
			 <quote>or adjacent underserved county</quote> after <quote>local
			 market</quote>.</text>
			</subsection><subsection id="H580249E2E8E4426A9BCFBB50D61D37BF"><enum>(d)</enum><header>Rulemaking
			 Required</header>
				<paragraph id="H94BD9E6CF72F4CB5B1B9EEA51201DAA0"><enum>(1)</enum><header>In
			 general</header><text>Within 90 days after the date of enactment of this Act,
			 the Commission shall commence a proceeding to revise the regulations concerning
			 network nonduplication protection, syndicated exclusivity protection, and
			 sports blackout protection (part 76 of title 47, Code of Federal Regulations)
			 against the retransmission by a multichannel video programming distributor of
			 signals of television broadcast stations to permit such retransmission if the
			 subscriber receiving the signals is located in the station’s adjacent
			 underserved county, as such term is defined in section 122(j)(6) of title 17,
			 United States Code (as added by section 3(a)(5) of this Act).</text>
				</paragraph><paragraph id="H61E2F0D119B548FEB30A2861676F111F"><enum>(2)</enum><header>Contents of
			 regulations</header><text display-inline="yes-display-inline">Regulations
			 issued pursuant to paragraph (1) shall prohibit a multichannel video
			 programming distributor from retransmitting the signal of a television
			 broadcast station in the station’s adjacent underserved county unless the
			 multichannel video programming distributor offers service in such county
			 pursuant to sections 338, 614, or 615 of the Communications Act of 1934 and
			 carries the signals of any station required to be carried in such county under
			 such sections.</text>
				</paragraph><paragraph id="HC902B28EE6C54E35918D2C7D7695DE69"><enum>(3)</enum><header>Deadline for
			 action</header><text>The Commission shall complete all actions necessary to
			 prescribe the revised regulations required by paragraph (1) within 180 days
			 after the date of enactment of this Act.</text>
				</paragraph></subsection></section><section id="HE5E8416F5D344DDF8105ADDAAA31C0B4"><enum>3.</enum><header>Carriage of
			 stations in an adjacent underserved county under the Copyright Act</header>
			<subsection id="H9F47EA56F24646B6B103A90060004F20"><enum>(a)</enum><header>Satellite
			 carriers</header><text>Section 122 of title 17, United States Code, is
			 amended—</text>
				<paragraph id="H4873611CB7F04C2788B634CDC4C75843"><enum>(1)</enum><text>in subsection (a),
			 in the matter preceding paragraph (1), by inserting <quote>or adjacent
			 underserved county</quote> after <quote>station’s local market</quote>;</text>
				</paragraph><paragraph id="HE4B31013A8234E5AB198EE3E1C9EEBDA"><enum>(2)</enum><text>in subsections (d)
			 and (e), by inserting <quote>or adjacent underserved county</quote> after
			 <quote>into the local market</quote>;</text>
				</paragraph><paragraph id="HE47EAEE1850B4DE8BA6664BC81F2A626"><enum>(3)</enum><text>in subsection (f),
			 by inserting <quote>or adjacent underserved county</quote> after
			 <quote>station’s local market</quote> in paragraphs (1) and (2);</text>
				</paragraph><paragraph id="H7D04D5C08EEC45E3902D47DD19B6584"><enum>(4)</enum><text>in
			 subsection (g), by inserting <quote>or adjacent underserved county</quote>
			 after <quote>station’s local market</quote>; and</text>
				</paragraph><paragraph id="H482649A5E06149AFB7557F8BBF55D159"><enum>(5)</enum><text>in subsection (j),
			 by adding at the end the following:</text>
					<quoted-block id="H1A8439BD446B48AEA8B8040045612661" style="OLC">
						<paragraph id="H3084DAA1C1AD4C14989F9100671FBE94"><enum>(6)</enum><header>Adjacent
				underserved county</header><text>The term <quote>adjacent underserved
				county</quote>, in the case of both commercial and noncommercial television
				broadcast stations, means a county within the station’s adjacent market that is
				both—</text>
							<subparagraph id="HBEB367F9CC11420596B6F75796ED4268"><enum>(A)</enum><text>located in the
				same State as the station’s community of license; and</text>
							</subparagraph><subparagraph id="H49812321705941FB9FC9D2CFC26E8DBE"><enum>(B)</enum><text>not within the
				local market of any other station that is both affiliated with the same network
				and located in the same State as such other station’s community of
				license.</text>
							</subparagraph></paragraph><paragraph id="HF016BFC12E1F4610A6F7C1CA1126118C"><enum>(7)</enum><header>Adjacent
				market</header>
							<subparagraph id="HFD5B6641531B4303B16786BBEE8702BB"><enum>(A)</enum><header>In
				general</header><text>The term <quote>adjacent market</quote>, in the case of
				both commercial and noncommercial television broadcast stations, means any
				local market adjacent to, and partially but not entirely in the same State as,
				the local market in which the station’s community of license is located.</text>
							</subparagraph><subparagraph id="H2861C53549834F00843FE85E72CD1CCF"><enum>(B)</enum><header>Treatment of
				certain counties</header><text>A county that is in a local market containing no
				in-State network stations, but which is not located in the adjacent market (as
				defined under subparagraph (A)) of any in-State network station, shall be
				considered to be the adjacent market of the nearest local market located in
				whole or in part within the State in which the county is
				located.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H19FF733F90324D8D82E9EAF400286257"><enum>(b)</enum><header>Cable
			 systems</header><text>Section 111(a) of title 17, United States Code, is
			 amended—</text>
				<paragraph id="HDE89E0D70DA640E0888F4037446F0505"><enum>(1)</enum><text>in paragraph (4),
			 by striking <quote>or</quote> after the semicolon;</text>
				</paragraph><paragraph id="H0B6AC67E8573438DB791A57FB15D67B7"><enum>(2)</enum><text>in paragraph (5),
			 by striking the period at the end and inserting <quote>; or</quote>; and</text>
				</paragraph><paragraph id="H62F329E98EBB487DBCC6A5BD93CD22C1"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="HD15BE486EF844E45A4461B58D8556858" style="OLC">
						<paragraph id="H9980E75CDCEE40FDA54202C32900A9ED"><enum>(6)</enum><text>the secondary
				transmission is to a subscriber in a broadcast station’s adjacent underserved
				county, in accordance with the same terms, conditions, and definitions as apply
				under section
				122.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
