		<official-title>To amend the Internal Revenue Code of 1986 to exclude
		  from gross income gain on the sale of certain residential leased-fee interests
		  to holders of the leasehold rights.</official-title>

		<section display-inline="no-display-inline" id="HAE842C48C3EB4B3E8759FD54E2D46817" section-type="section-one"><enum>1.</enum><header>Exclusion of gain from sales
			 of certain residential leased-fee interests to holders of the leasehold
			 rights</header>
			<subsection id="H13D1B42BEC1749DF997BD27AA260CFB7"><enum>(a)</enum><header>General
			 rule</header><text>Part III of subchapter B of chapter 1 of the Internal
			 Revenue Code of 1986 (relating to items specifically excluded from gross
			 income) is amended by inserting after section 139C the following new
			 section:</text>

					<section id="H2E7517B2FE1449D796B601393BFB593B"><enum>139D.</enum><header>Sales of
				certain residential leased-fee interests to holders of the leasehold
				rights</header>
						<subsection id="H0B2BA51C15DF42398EC72154B8C32686"><enum>(a)</enum><header>General
				rule</header><text display-inline="yes-display-inline">In the case of a fee
				simple owner-lessor, and legal and equitable owners, of qualified property,
				gross income does not include gain from the sale of such property to a holder
				of the leasehold right if such holder is—</text>
							<paragraph id="HFD97A1CF457B4CCA9288D2D473F81D55"><enum>(1)</enum><text>an association of
				apartment owners of a multi-family residential leasehold property, or</text>
							</paragraph><paragraph id="HBFAE8BCD77EE4F4481686C7045D2EF68"><enum>(2)</enum><text>a cooperative
				housing corporation for a residential leasehold property.</text>
							</paragraph></subsection><subsection id="H10FCDAAA87B240E9BD5109F51F4F262C"><enum>(b)</enum><header>Qualified
				property</header><text display-inline="yes-display-inline">For purposes of
				subsection (a), the term <term>qualified property</term> means the leased-fee
				interest to any residential house lot or the leased-fee interest in a
				condominium or co-operative housing apartment in a multi-family residential
				leasehold property.</text>
						</subsection><subsection id="H8F5F70C56B94415A98B8CE6EB0516B62"><enum>(c)</enum><header>Other
				definitions</header><text display-inline="yes-display-inline">For purposes of
				this section (b)—</text>
							<paragraph id="HB97E69F8968F44449A5D671F405C857C"><enum>(1)</enum><header>Fee simple
				owner, leased-fee interest, legal and equitable owners</header><text display-inline="yes-display-inline">The terms <term>fee simple owner</term>,
				<term>leased-fee interest</term>, and <term>legal and equitable owners</term>
				shall have the same meaning as defined in Hawaii Revised Statutes section
				516–1.</text>
							</paragraph><paragraph id="H2640C96F159D4DA09D54EE01FC853AEB"><enum>(2)</enum><header>Multi-family
				residential leasehold property, multi-family residential leasehold
				unit</header><text>The terms <term>multi-family residential leasehold
				property</term> and <term>multi-family residential leasehold unit</term> mean
				property or units within a planned unit development, condominium project, or
				cooperative housing project, as those terms are defined in Hawaii Revised
				Statutes section 514C–1.</text>
							</paragraph></subsection><subsection id="HAC497C419DEB46D5A5040A4864D3FE79"><enum>(d)</enum><header>Termination</header><text>This
				section shall not apply to any taxable year beginning after December 31,
				2014.</text>

			</subsection><subsection id="H7DE49E885B5F443D9253B76FBBC1B292"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections for such part is amended by
			 inserting after the item relating to section 139C the following new
			 item:</text>

					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H86F931482C184C2C9263D70F1670FC83"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to sales after December 31, 2009.</text>
