		<section commented="no" display-inline="no-display-inline" id="H149F65C15F0A43598DE652FE1D18487D" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Positive Aging Act of
			 2009</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H99EFD82117794DB5B5B195074CE4F908" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Demonstration projects to support
			 integration of Mental Health Services in primary care settings</header><text display-inline="no-display-inline">Subpart 3 of part B of title V of the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
			 290bb–31 et seq.) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="HECEEB2DB3EA7445DB2B295E63BA242E8"><enum>(1)</enum><text display-inline="yes-display-inline">in section 520(b)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H100CCC8C3A8E46738712A65C0B78D1A2"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (14), by striking
			 <quote>and</quote> after the semicolon;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDDF827C3F6D5429A8C7426DABBA0A4B6"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (15), by striking the period
			 at the end and inserting <quote>; and</quote>; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7BA2CA02CF6644448E4B391AE15322D9"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

					<section commented="no" display-inline="no-display-inline" id="H53DCBFC31A754983BE77C0810FEA7D69" section-type="subsequent-section"><enum>520K.</enum><header display-inline="yes-display-inline">Projects to demonstrate integration of
				Mental Health Services in primary care settings</header>
						<subsection commented="no" display-inline="no-display-inline" id="HC8D8CE0B9F3B4294AD967CEC41FB0C95"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Director
				of the Center for Mental Health Services, shall award grants to public and
				private nonprofit entities for projects to demonstrate ways of integrating
				mental health services for older adults into primary care settings, such as
				health centers receiving a grant under section 330 (or determined by the
				Secretary to meet the requirements for receiving such a grant), other federally
				qualified health centers, primary care clinics, and private practice
				sites.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="HC3FB7AB61E684420B4FA7B4DBD16CF6B"><enum>(b)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">In order to be eligible for a grant under
				this section, the project to be carried out by the entity shall provide for
				collaborative care within a primary care setting, provided by licensed mental
				health professionals with appropriate training and experience in the treatment
				of older adults, in which screening, assessment, and intervention services are
				combined into an integrated service delivery model, including—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="HF043386E76374B3780C903552712B920"><enum>(1)</enum><text display-inline="yes-display-inline">screening services by a mental health
				professional with at least a masters degree in an appropriate field of
				training;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDCC73823647146D4B2C8C61C3CD08C03"><enum>(2)</enum><text display-inline="yes-display-inline">referrals for necessary prevention,
				intervention, follow-up care, consultations, and care planning oversight for
				mental health and other service needs, as indicated; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9EA1A8578D424B8F837F5920FD5774C1"><enum>(3)</enum><text display-inline="yes-display-inline">adoption and implementation of
				evidence-based intervention and treatment protocols (to the extent such
				protocols are available) for mental disorders prevalent in older adults
				including, but not limited to, mood and anxiety disorders, dementias of all
				kinds (including the behavioral and psychological symptoms of dementia),
				psychotic disorders, and substance-related disorders.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H896E7B43709B449AA8447EC3617B2BE4"><enum>(c)</enum><header display-inline="yes-display-inline">Considerations in awarding
				grants</header><text display-inline="yes-display-inline">In awarding grants
				under this section, the Secretary, to the extent feasible, shall ensure
				that—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="HF7F37FA4EEDC470AAB29F09019527319"><enum>(1)</enum><text display-inline="yes-display-inline">projects are funded in a variety of
				geographic areas, including urban and rural areas; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0C6868BB24F846F89AB296BB88EB1855"><enum>(2)</enum><text display-inline="yes-display-inline">a variety of populations, including racial
				and ethnic minorities and low-income populations, are served by projects funded
				under this section.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HCDB98DF03B3245B08299136B125EEA35"><enum>(d)</enum><header display-inline="yes-display-inline">Duration</header><text display-inline="yes-display-inline">A project may receive funding pursuant to a
				grant under this section for a period of up to 3 years, with an extension
				period of 2 additional years at the discretion of the Secretary.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="H88B89F13621C40458550B858E4DBB35A"><enum>(e)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">To be eligible to receive a grant under
				this section, a public or private nonprofit entity shall—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="HBEF0A503634040EBAA9DB434B618E1F0"><enum>(1)</enum><text display-inline="yes-display-inline">submit an application to the Secretary (in
				such form, containing such information, and at such time as the Secretary may
				specify); and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H59E096FCB67E4917925E826AC0D73741"><enum>(2)</enum><text display-inline="yes-display-inline">agree to report to the Secretary
				standardized clinical and behavioral data and other performance data necessary
				to evaluate patient outcomes and to facilitate evaluations across participating
				projects.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE58D14FA8FA243F5B7E2E6F5D810DCFF"><enum>(f)</enum><header display-inline="yes-display-inline">Evaluation</header><text display-inline="yes-display-inline">Not later than July 31 of the second
				calendar year after the date of enactment of this section, and July 31 of every
				year thereafter, the Secretary shall submit to Congress a report evaluating the
				projects receiving awards under this section for the year involved.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="H535AE54777BC4E69825C120C91027082"><enum>(g)</enum><header display-inline="yes-display-inline">Supplement, not supplant</header><text display-inline="yes-display-inline">Funds made available under this section
				shall supplement, and not supplant, other Federal, State, or local funds
				available to an entity to carry out activities described in this
				section.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="H3A70391181D54A60A5E8470FDB390404"><enum>(h)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated such sums as may be necessary to carry out this
				section for fiscal year 2010 and each fiscal year
				thereafter.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="HB42213E59E4C4BE2B5E95D8F9362A4B2" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Grants for community-based mental health
			 treatment outreach teams</header><text display-inline="no-display-inline">Subpart 3 of part B of title V of the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
			 290bb–31 et seq.), as amended by section 2, is further amended by adding at the
			 end the following:</text>
			<quoted-block act-name="Public Health Service Act" display-inline="no-display-inline" id="HBD15B1638AEA4C508C07585072F99A05" style="OLC">
				<section commented="no" display-inline="no-display-inline" id="HF712DDB2715C4488B58026CF8EFE8030" section-type="subsequent-section"><enum>520L.</enum><header display-inline="yes-display-inline">Grants for community-based mental health
				treatment outreach teams</header>
					<subsection commented="no" display-inline="no-display-inline" id="H85BA5FAC7A4242A8A92DD68A9C66D5D8"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Director
				of the Center for Mental Health Services, shall award grants to public or
				private nonprofit entities that are community-based providers of geriatric
				mental health services, to support the establishment and maintenance by such
				entities of interdisciplinary geriatric mental health outreach teams in
				community settings where older adults reside or receive social services.
				Entities eligible for such grants include—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H2DB880FCF037425DBE6E7EFC8CCE3161"><enum>(1)</enum><text display-inline="yes-display-inline">mental health service providers of a State
				or local government;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA1BF91D77BE3455290352811DDDCD58E"><enum>(2)</enum><text display-inline="yes-display-inline">outpatient programs of private, nonprofit
				hospitals;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0D9A974E07C447F19B9D2F4C37BB3FA2"><enum>(3)</enum><text display-inline="yes-display-inline">community mental health centers meeting the
				criteria specified in section 1913(c); and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD7D7283ACCB74ACBB541A2B1242231A3"><enum>(4)</enum><text display-inline="yes-display-inline">other community-based providers of mental
				health services.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H21810C67464D4AA0B0A11CDFBB28E768"><enum>(b)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">To be eligible to receive a grant under
				this section, an entity shall—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="HAA654CD8EFF446EE94ABD352FB06AC76"><enum>(1)</enum><text display-inline="yes-display-inline">adopt and implement, for use by its mental
				health outreach team, evidence-based intervention and treatment protocols (to
				the extent such protocols are available) for mental disorders prevalent in
				older adults including, but not limited to, mood and anxiety disorders,
				dementias of all kinds (including the behavioral and psychological symptoms of
				dementia), psychotic disorders, and substance-related disorders, relying to the
				greatest extent feasible on protocols that have been developed—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="HBC7F522D078B41D58ED928EAD57FE212"><enum>(A)</enum><text display-inline="yes-display-inline">by or under the auspices of the Secretary;
				or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD83AC22928ED424F8412FD046B2A2081"><enum>(B)</enum><text display-inline="yes-display-inline">by academicians;</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA892BBF579084A81BFD964D108E49987"><enum>(2)</enum><text display-inline="yes-display-inline">provide screening for mental disorders,
				diagnostic services, referrals for treatment, and case management and
				coordination through such teams; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA0F762E3F9C64525B2A008757789C63E"><enum>(3)</enum><text display-inline="yes-display-inline">coordinate and integrate the services
				provided by such team with the services of social service, mental health, and
				medical providers at the site or sites where the team is based in order
				to—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="HABCA8E15328146548C87391CDB7D702E"><enum>(A)</enum><text display-inline="yes-display-inline">improve patient outcomes; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5731A365CA3A4D59A264885EB3B84AAD"><enum>(B)</enum><text display-inline="yes-display-inline">to assure, to the maximum extent feasible,
				the continuing independence of older adults who are residing in the
				community.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H702850DC254C46B3BA7B8455114BF6E1"><enum>(c)</enum><header display-inline="yes-display-inline">Cooperative arrangements with sites serving
				as bases for outreach</header><text display-inline="yes-display-inline">An
				entity receiving a grant under this section may enter into an agreement with a
				person operating a site at which a geriatric mental health outreach team of the
				entity is based, including—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H8A27231D89B94683B4DDEBA9F9034923"><enum>(1)</enum><text display-inline="yes-display-inline">senior centers;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H40230D16CCA54F859FF8DFF5B9141E9F"><enum>(2)</enum><text display-inline="yes-display-inline">adult day care programs;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE83536498BFC41E797F41A99101A660E"><enum>(3)</enum><text display-inline="yes-display-inline">assisted living facilities; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0210B49C00554351B305497D4165A101"><enum>(4)</enum><text display-inline="yes-display-inline">recipients of grants to provide services to
				older adults under the <act-name parsable-cite="OAA65">Older Americans Act of
				1965</act-name>, under which such person provides (and is reimbursed by the
				entity, out of funds received under the grant, for) any supportive services,
				such as transportation and administrative support, that such person provides to
				an outreach team of such entity.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H12DC747C73C14E37BFCDF0DAEBF3C674"><enum>(d)</enum><header display-inline="yes-display-inline">Considerations in awarding
				grants</header><text display-inline="yes-display-inline">In awarding grants
				under this section, the Secretary, to the extent feasible, shall ensure
				that—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="HFE3A471EFE8342AB9AF5424B8B58D14C"><enum>(1)</enum><text display-inline="yes-display-inline">projects are funded in a variety of
				geographic areas, including urban and rural areas; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H299D156FDECB4B31ADF21E0CD48CD6E2"><enum>(2)</enum><text display-inline="yes-display-inline">a variety of populations, including racial
				and ethnic minorities and low-income populations, are served by projects funded
				under this section.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB5352EDAB7F148589BCA1E52F4FA451E"><enum>(e)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">To be eligible to receive a grant under
				this section, an entity shall—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H26F7F9F487464E60AA7B6E28B6715B2C"><enum>(1)</enum><text display-inline="yes-display-inline">submit an application to the Secretary (in
				such form, containing such information, at such time as the Secretary may
				specify); and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD9C40E044410470685FB4DE5ED918A48"><enum>(2)</enum><text display-inline="yes-display-inline">agree to report to the Secretary
				standardized clinical and behavioral data and other performance data necessary
				to evaluate patient outcomes and to facilitate evaluations across participating
				projects.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7898825BC2FE4BF2A9706A768FAF314C"><enum>(f)</enum><header display-inline="yes-display-inline">Coordination</header><text display-inline="yes-display-inline">The Secretary shall provide for appropriate
				coordination of programs and activities receiving funds pursuant to a grant
				under this section with programs and activities receiving funds pursuant to
				grants under section 520K and sections 381, 422, and 423 of the
				<act-name parsable-cite="OAA65">Older Americans Act of 1965</act-name>.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="HF750AD81C1B240438204D5714C720A9C"><enum>(g)</enum><header display-inline="yes-display-inline">Evaluation</header><text display-inline="yes-display-inline">Not later than July 31 of the second
				calendar year after the date of enactment of this section, and July 31 of every
				year thereafter, the Secretary shall submit to Congress a report evaluating the
				projects receiving awards under this section for such year.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="HCF4D39FE127841228409CE4DF08EF549"><enum>(h)</enum><header display-inline="yes-display-inline">Supplement, not supplant</header><text display-inline="yes-display-inline">Funds made available under this section
				shall supplement, and not supplant, other Federal, State, or local funds
				available to an entity to carry out activities described in this
				section.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H9C0E2863B90840399B4C23F17890C317"><enum>(i)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated such sums as may be necessary to carry out this
				section for fiscal year 2010 and each fiscal year
				thereafter.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="HCF913A07D45F458AA878DAEDE3D92A18" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Designation of Deputy Director for Older
			 Adult Mental Health Services in Center for Mental Health Services</header><text display-inline="no-display-inline">Section 520 of the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
			 290bb–31) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="HD865EC6B8FCD4887A4BA2A551FA2B48F"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (c) as
			 subsection (d); and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEF58E203F9F44927A111F3BF045C63DF"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (b) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H7A1DCD3254AB4A049C2878FB16AA1EA4" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="H22DFC9DAE9DC489E80E128BEE557F57B"><enum>(c)</enum><header display-inline="yes-display-inline">Deputy Director for Older Adult Mental
				Health Services in Center for Mental Health Services</header><text display-inline="yes-display-inline">The Director, after consultation with the
				Administrator, shall designate a Deputy Director for Older Adult Mental Health
				Services, who shall be responsible for the development and implementation of
				initiatives of the Center to address the mental health needs of older adults.
				Such initiatives shall include—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H82D606703883491DB4657CD24C1E1EED"><enum>(1)</enum><text display-inline="yes-display-inline">research on prevention and identification
				of mental disorders in the older adult population;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE1FF8DF9004E424B97812A285C31DE03"><enum>(2)</enum><text display-inline="yes-display-inline">innovative demonstration projects for the
				delivery of community-based mental health services for older adults;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HED328F5E889B439A9A9C6CD58E71F24C"><enum>(3)</enum><text display-inline="yes-display-inline">support for the development and
				dissemination of evidence-based practice models, including models to address
				substance-related disorders in older adults; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA207325B33EF4425A5DB5AC7134EF060"><enum>(4)</enum><text display-inline="yes-display-inline">development of model training programs for
				mental health professionals and caregivers serving older
				adults.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H402B6957D2A94275BDB1FB5B7F36DBF6" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Membership of advisory council for the
			 Center for Mental Health Services</header><text display-inline="no-display-inline">Section 502(b)(3) of the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
			 290aa–1(b)(3)) is amended by adding at the end the following:</text>
			<quoted-block act-name="Public Health Service Act" display-inline="no-display-inline" id="H0F997CA4A6674CDFA8F9A49B5AB7FB4C" style="OLC">
				<subparagraph commented="no" display-inline="no-display-inline" id="HB080911E569D472982EA4F4D33B96354"><enum>(C)</enum><text display-inline="yes-display-inline">In the case of the advisory council for the
				Center for Mental Health Services, the members appointed pursuant to
				subparagraphs (A) and (B) shall include representatives of older adults or
				their families, and professionals with an expertise in geriatric mental
				health.</text>
				</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="HEFDC3AF76B634CABA7179B1ABB0892FA" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Projects of national significance targeting
			 substance abuse in older adults</header><text display-inline="no-display-inline">Section 509(b)(2) of the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.

			<subsection commented="no" display-inline="no-display-inline" id="H8CC25753C13345A596058A7869EDE321"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1912(b)(4) of the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
			 300x–2(b)(4)) is amended to read as follows:</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="H41055B9BC9F1478BB15A65D3713045E7"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 subsection (a) shall apply to State plans submitted on or after the date that
			 is 180 days after the date of enactment of this Act.</text>
