		and for other purposes.</quote>, do pass with the following</text>
		</section><amendment><amendment-instruction blank-lines-after="0"><text>Strike out all

				<continuation-text continuation-text-level="section">That the following sums are appropriated,
		out of any money in the Treasury not otherwise appropriated, for the fiscal
		year ending September 30, 2010, and for other purposes, namely:</continuation-text><title commented="no" id="idB95E1C80601F43C3BED9BA9A4B336A98" level-type="subsequent"><enum>I</enum>
					<appropriations-major commented="no" id="id7EDCDEA87AF848129D94705C90386866"><header display-inline="yes-display-inline">Corps of
	 engineers—civil</header>
					</appropriations-major><appropriations-major commented="no" id="H6B2C8C09E7F24F2589F89F56C2AE68EB"><header display-inline="yes-display-inline">Department of the
	 army</header>
					</appropriations-major><appropriations-intermediate commented="no" id="ID024E9F344E8849109F02F696AE8AEAC0"><header display-inline="yes-display-inline">Corps of engineers—civil</header><text display-inline="no-display-inline">The following appropriations shall be
	 expended under the direction of the Secretary of the Army and the supervision
	 of the Chief of Engineers for authorized civil functions of the Department of
	 the Army pertaining to rivers and harbors, flood and storm damage reduction,
	 shore protection, aquatic ecosystem restoration, and related
	 efforts.</text>
					</appropriations-intermediate><appropriations-small commented="no" id="ID34C581B1799F4D0A8E9AF1B2AD1969D2"><header display-inline="yes-display-inline">General Investigations</header><text display-inline="no-display-inline">For expenses necessary where authorized by
	 law for the collection and study of basic information pertaining to river and
	 harbor, flood and storm damage reduction, shore protection, aquatic ecosystem
	 restoration, and related needs; for surveys and detailed studies, and plans and
	 specifications of proposed river and harbor, flood and storm damage reduction,
	 shore protection, and aquatic ecosystem restoration projects and related
	 efforts prior to construction; for restudy of authorized projects; and for
	 miscellaneous investigations and, when authorized by law, surveys and detailed
	 studies, and plans and specifications of projects prior to construction,
	 $170,000,000, to remain available until expended.</text>
					</appropriations-small><appropriations-small commented="no" id="H9B928B2D1CDE44D0B0D1AB2E6C8E8518"><header display-inline="yes-display-inline">Construction, General</header><text display-inline="no-display-inline">For expenses necessary for the construction
	 of river and harbor, flood and storm damage reduction, shore protection,
	 aquatic ecosystem restoration, and related projects authorized by law; for
	 conducting detailed studies, and plans and specifications, of such projects
	 (including those involving participation by States, local governments, or
	 private groups) authorized or made eligible for selection by law (but such
	 detailed studies, and plans and specifications, shall not constitute a
	 commitment of the Government to construction); $1,924,000,000, to remain
	 available until expended; of which such sums as are necessary to cover the
	 Federal share of construction costs for facilities under the Dredged Material
	 Disposal Facilities program shall be derived from the Harbor Maintenance Trust
	 Fund as authorized by Public Law 104–303; and of which such sums as are
	 necessary pursuant to Public Law 99–662 shall be derived from the Inland
	 Waterways Trust Fund, to cover one-half of the costs of construction,
	 replacement, rehabilitation, and expansion of inland waterways projects
	 (including only Chickamauga Lock, Tennessee; Kentucky Lock and Dam, Tennessee
	 River, Kentucky; Lock and Dams 2, 3, and 4 Monongahela River, Pennsylvania;
	 Markland Locks and Dam, Kentucky and Indiana; Olmsted Lock and Dam, Illinois
	 and Kentucky; and Emsworth Locks and Dam, Ohio River, Pennsylvania) shall be
	 derived from the Inland Waterways Trust Fund: <italic>Provided</italic>, That
	 the Chief of Engineers is directed to use $18,000,000 of the funds appropriated
	 herein for the Dallas Floodway Extension, Texas, project, including the
	 Cadillac Heights feature, generally in accordance with the Chief of Engineers
	 report dated December 7, 1999: 
	 <proviso><italic>Provided further</italic></proviso>, That the Chief of
	 Engineers is directed to use $1,500,000 of funds available for the Greenbrier
	 Basin, Marlinton, West Virginia, Local Protection Project to continue
	 engineering and design efforts, execute a project partnership agreement, and
	 initiate construction of the project substantially in accordance with
	 Alternative 1 as described in the Corps of Engineers Final Detailed Project
	 Report and Environmental Impact Statement for Marlinton, West Virginia Local
	 Protection Project dated September 2008:<proviso><italic>Provided
		further</italic></proviso>, That the Federal and non-Federal shares shall be
	 determined in accordance with the ability-to-pay provisions prescribed in
	 section 103(m) of the Water Resources Development Act of 1986, as amended:
	 <italic>Provided further</italic>, That the Chief of Engineers is directed to
	 use $2,750,000 of the funds appropriated herein for planning, engineering,
	 design or construction of the Grundy, Buchanan County, and Dickenson County,
	 Virginia, elements of the Levisa and Tug Forks of the Big Sandy River and Upper
	 Cumberland River Project: <italic>Provided further</italic>, That the Chief of
	 Engineers is directed to use $4,000,000 of the funds appropriated herein to
	 continue planning, engineering, design or construction of the Lower Mingo
	 County, Upper Mingo County, Wayne County, McDowell County, West Virginia,
	 elements of the Levisa and Tug Forks of the Big Sandy River and Upper
	 Cumberland River Project: <italic>Provided further</italic>, That none of the
	 funds made available by this Act may be used to carry out any portion of the
	 Delaware River Main Channel Deepening Project identified in the committee
	 report accompanying this Act that is located in the State of Delaware until the
	 date on which the government of the State of Delaware issues an applicable
	 project permit for the Delaware River Main Channel Deepening
	 Project.</text>
					</appropriations-small><appropriations-small commented="no" id="H588C1FF170D043389020AD215C9C24A5"><header display-inline="yes-display-inline">Mississippi river and
	 tributaries</header><text display-inline="no-display-inline">For expenses
	 necessary for flood damage reduction projects and related efforts in the
	 Mississippi River alluvial valley below Cape Girardeau, Missouri, as authorized
	 by law, $340,000,000, to remain available until expended, of which such sums as
	 are necessary to cover the Federal share of eligible operation and maintenance
	 costs for inland harbors shall be derived from the Harbor Maintenance Trust
	 Fund: <italic>Provided</italic>, That the Secretary of the Army, acting through
	 the Chief of Engineers is directed to use $10,000,000 appropriated herein for
	 construction of water withdrawal features of the Grand Prairie, Arkansas,
	 project.</text>
					</appropriations-small><appropriations-small commented="no" id="H9127764AE3724DF29B3C65AF171E24D5"><header display-inline="yes-display-inline">Operation and maintenance</header><text display-inline="no-display-inline">For expenses necessary for the operation,
	 maintenance, and care of existing river and harbor, flood and storm damage
	 reduction, aquatic ecosystem restoration, and related projects authorized by
	 law; providing security for infrastructure owned or operated by the Corps,
	 including administrative buildings and laboratories; maintaining harbor
	 channels provided by a State, municipality, or other public agency that serve
	 essential navigation needs of general commerce, where authorized by law;
	 surveying and charting northern and northwestern lakes and connecting waters;
	 clearing and straightening channels; and removing obstructions to navigation,
	 $2,450,000,000, to remain available until expended, of which such sums as are
	 necessary to cover the Federal share of eligible operation and maintenance
	 costs for coastal harbors and channels, and for inland harbors shall be derived
	 from the Harbor Maintenance Trust Fund; of which such sums as become available
	 from the special account for the Corps established by the Land and Water
	 Conservation Act of 1965, as amended (16 U.S.C. 460l–6a(i)), shall be derived
	 from that account for resource protection, research, interpretation, and
	 maintenance activities related to resource protection in the areas at which
	 outdoor recreation is available; and of which such sums as become available
	 from fees collected under section 217 of the Water Resources Development Act of
	 1996 (Public Law 104–303), shall be used to cover the cost of operation and
	 maintenance of the dredged material disposal facilities for which such fees
	 have been collected: <italic>Provided</italic>, That 1 percent of the total
	 amount of funds provided for each of the programs, projects or activities
	 funded under this heading shall not be allocated to a field operating activity
	 prior to the beginning of the fourth quarter of the fiscal year and shall be
	 available for use by the Chief of Engineers to fund such emergency activities
	 as the Chief of Engineers determines to be necessary and appropriate; and that
	 the Chief of Engineers shall allocate during the fourth quarter any remaining
	 funds which have not been used for emergency activities proportionally in
	 accordance with the amounts provided for the programs, projects or
	 activities.</text>
					</appropriations-small><appropriations-small commented="no" id="idC65137D9F43441E8B1DCC03D279E1BD3"><header display-inline="yes-display-inline">Regulatory program</header><text display-inline="no-display-inline">For expenses necessary for administration of
	 laws pertaining to regulation of navigable waters and wetlands, $190,000,000,
	 to remain available until expended.</text>
					</appropriations-small><appropriations-small commented="no" id="H4139A9DA48C24E2A9A7D31A7A9BC1E26"><header display-inline="yes-display-inline">Formerly utilized sites remedial action
	 program</header><text display-inline="no-display-inline">For expenses necessary
	 to clean up contamination from sites in the United States resulting from work
	 performed as part of the Nation's early atomic energy program, $140,000,000, to
	 remain available until expended.</text>
					</appropriations-small><appropriations-small commented="no" id="idB72E207546FE44D8AA84BB01D6783A31"><header display-inline="yes-display-inline">General Expenses</header><text display-inline="no-display-inline">For expenses necessary for the supervision
	 and general administration of the civil works program in the headquarters of
	 the United States Army Corps of Engineers, and the offices of the Division
	 Engineers; and for the management and operation of the Humphreys Engineer
	 Center Support Activity, the Institute for Water Resources, the United States
	 Army Engineer Research and Development Center, and the United States Army Corps
	 of Engineers Finance Center, $186,000,000, to remain available until expended,
	 of which not to exceed $5,000 may be used for official reception and
	 representation purposes and only during the current fiscal year:
	 <italic>Provided</italic>, That no part of any other appropriation provided in
	 title I of this Act shall be available to fund the civil works activities of
	 the Office of the Chief of Engineers or the civil works executive direction and
	 management activities of the division offices: <italic>Provided
	 further</italic>, That any Flood Control and Coastal Emergencies appropriation
	 may be used to fund the supervision and general administration of emergency
	 operations, repairs, and other activities in response to any flood, hurricane,
	 or other natural disaster.</text>
					</appropriations-small><appropriations-small commented="no" id="id5988DBBA5E374B1CBCA54278D26DD9FD"><header display-inline="yes-display-inline">Office of assistant secretary of the army
	 (civil works)</header><text display-inline="no-display-inline">For the Office
	 of Assistant Secretary of the Army (Civil Works) as authorized by 10 U.S.C.
	 3016(b)(3), $5,000,000, to remain available until
	 expended.</text>
					</appropriations-small><appropriations-small commented="no" id="idFDB43AF1B4DB4822A6693E44C1F8245A"><header display-inline="yes-display-inline">Administrative provision</header><text display-inline="no-display-inline">The Revolving Fund, Corps of Engineers,
	 shall be available during the current fiscal year for purchase (not to exceed
	 100 for replacement only) and hire of passenger motor vehicles for the civil
	 works program.</text>
					</appropriations-small><appropriations-small commented="no" id="HF62DF714D8004830843067D65FFEB5D9"><header display-inline="yes-display-inline">General provisions, corps of
	 engineers—civil</header>
					</appropriations-small><section commented="no" display-inline="no-display-inline" id="H87FBD00190134B83ADB683410FA8DF9D" section-type="subsequent-section"><enum>101.</enum><subsection commented="no" display-inline="yes-display-inline" id="H7E7EEB4EA28C4EA4841F1CA15C68E872"><enum>(a)</enum><text display-inline="yes-display-inline">None of the funds provided in title I of
		this Act, or provided by previous appropriations Acts to the agencies or
		entities funded in title I of this Act that remain available for obligation or
		expenditure in fiscal year 2010, shall be available for obligation or
		expenditure through a reprogramming of funds that:</text>
							<paragraph changed="added" commented="no" display-inline="no-display-inline" id="HC346C92BAF034E8AA277917C61A0E8D8" reported-display-style="italic"><enum>(1)</enum><text display-inline="yes-display-inline">creates or initiates a new program,
		project, or activity;</text>
							</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="H97111332DB0B4996AA77EBC6B06CC4E5" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">eliminates a program, project, or
		activity;</text>
							</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="HEC54A11F31FF4237A2323340737D7AEF" reported-display-style="italic"><enum>(3)</enum><text display-inline="yes-display-inline">increases funds or personnel for any
		program, project, or activity for which funds have been denied or restricted by
		this Act, unless prior approval is received from the House and Senate
		Committees on Appropriations;</text>
							</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="H84D159A448864B8A84283F325524EED9" reported-display-style="italic"><enum>(4)</enum><text display-inline="yes-display-inline">proposes to use funds directed for a
		specific activity for a different purpose, unless prior approval is received
		from the House and Senate Committees on Appropriations;</text>
							</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="H6598B8C173374B178B9CA292F735AA6D" reported-display-style="italic"><enum>(5)</enum><text display-inline="yes-display-inline">augments or reduces existing programs,
		projects or activities in excess of the amounts contained in subsections 6
		through 10, unless prior approval is received from the House and Senate
		Committees on Appropriations;</text>
							</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="HE7F8546C42C443B4816870CFDEB54175" reported-display-style="italic"><enum>(6)</enum><header display-inline="yes-display-inline">Investigations</header><text display-inline="yes-display-inline">For a base level over $100,000,
		reprogramming of 25 percent of the base amount up to a limit of $150,000 per
		project, study or activity is allowed: <italic>Provided</italic>, That for a
		base level less than $100,000, the reprogramming limit is
		$25,000:<italic>Provided further</italic>, That up to $25,000 may be
		reprogrammed into any continuing study or activity that did not receive an
		appropriation for existing obligations and concomitant administrative
		expenses;</text>
							</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="HA5F8C1B54AE64C78A7A80B0837556041" reported-display-style="italic"><enum>(7)</enum><header display-inline="yes-display-inline">Construction</header><text display-inline="yes-display-inline">For a base level over $2,000,000,
		reprogramming of 15 percent of the base amount up to a limit of $3,000,000 per
		project, study or activity is allowed: <italic>Provided</italic>, That for a
		base level less than $2,000,000, the reprogramming limit is $300,000:
		<italic>Provided further</italic>, That up to $3,000,000 may be reprogrammed
		for settled contractor claims, changed conditions, or real estate deficiency
		judgments: <italic>Provided further</italic>, That up to $300,000 may be
		reprogrammed into any continuing study or activity that did not receive an
		appropriation for existing obligations and concomitant administrative
		expenses;</text>
							</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="H29F2B1EA34B6404981FDBC3A3867CC75" reported-display-style="italic"><enum>(8)</enum><header display-inline="yes-display-inline">Operation and maintenance</header><text display-inline="yes-display-inline">Unlimited reprogramming authority is
		granted in order for the Corps to be able to respond to emergencies:
		<italic>Provided</italic>, That the Chief of Engineers must notify the House
		and Senate Committees on Appropriations of these emergency actions as soon
		thereafter as practicable: <italic>Provided further</italic>, That for a base
		level over $1,000,000, reprogramming of 15 percent of the base amount a limit
		of $5,000,000 per project, study or activity is allowed: <italic>Provided
		further</italic>, That for a base level less than $1,000,000, the reprogramming
		limit is $150,000: <italic>Provided further</italic>, That $150,000 may be
		reprogrammed into any continuing study or activity that did not receive an
		appropriation;</text>
							</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="H9E22C81FA1A94D77A688D76F1BA28E28" reported-display-style="italic"><enum>(9)</enum><header display-inline="yes-display-inline">Mississippi river and
		tributaries</header><text display-inline="yes-display-inline">The same
		reprogramming guidelines for the Investigations, Construction, and Operation
		and Maintenance portions of the Mississippi River and Tributaries Account as
		listed above; and</text>
							</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="HD68430FAE73449D990BDD3C65B71A611" reported-display-style="italic"><enum>(10)</enum><header display-inline="yes-display-inline">Formerly utilized sites remedial action
		program</header><text display-inline="yes-display-inline">Reprogramming of up
		to 15 percent of the base of the receiving project is permitted.</text>
							</paragraph></subsection><subsection changed="added" commented="no" display-inline="no-display-inline" id="HEA0565281D3C45FFB7F9767ED8974B2D" reported-display-style="italic"><enum>(b)</enum><header display-inline="yes-display-inline">Continuing Authorities
		Program</header><text display-inline="yes-display-inline">Subsection (a)(1)
		shall not apply to any project or activity funded under the continuing
		authorities program.</text>
						</subsection><subsection changed="added" commented="no" display-inline="no-display-inline" id="HD1EE95B5C3C94B20B717F80B0CDD8511" reported-display-style="italic"><enum>(c)</enum><text display-inline="yes-display-inline">Not later than 60 days after the date of
		enactment of this Act, the Corps of Engineers shall submit a report to the
		House and Senate Committees on Appropriations to establish the baseline for
		application of reprogramming and transfer authorities for the current fiscal
		year: <italic>Provided</italic>, That the report shall include:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="H7547315E88B046019F73737DBC2CA4BC"><enum>(1)</enum><text display-inline="yes-display-inline">A table for each appropriation with a
		separate column to display the President's budget request, adjustments made by
		Congress, adjustments due to enacted rescissions, if appropriate, and the
		fiscal year enacted level;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA3F78F3D2CE6438CA3B7622E612F615E"><enum>(2)</enum><text display-inline="yes-display-inline">A delineation in the table for each
		appropriation both by object class and program, project and activity as
		detailed in the budget appendix for the respective appropriations; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBC960035333146B3BD07AB67545464D6"><enum>(3)</enum><text display-inline="yes-display-inline">An identification of items of special
		congressional interest.</text>
							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID09833B0F5BC44017AF1E45F8A3A16FCF" section-type="subsequent-section"><enum>102.</enum><text display-inline="yes-display-inline">None of the funds in this Act, or previous
		Acts, making funds available for Energy and Water Development, shall be used to
		implement any pending or future competitive sourcing actions under OMB Circular
		A–76 or High Performing Organizations for the U.S. Army Corps of
		Engineers.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID189BB0727DBA49E4A742CA6E8A269AD3" section-type="subsequent-section"><enum>103.</enum><text display-inline="yes-display-inline">Within 90 days of the date of the Chief of
		Engineers Report on a water resource matter, the Assistant Secretary of the
		Army (Civil Works) shall submit the report to the appropriate authorizing and
		appropriating committees of the Congress.</text>
						<appropriations-small commented="no" id="id1A8835E030CA46D6890B76524CFA6F6F"><header display-inline="yes-display-inline">Water Reallocation, Lake Cumberland,
	 Kentucky</header>
						</appropriations-small></section><section commented="no" display-inline="no-display-inline" id="H8AF63E5C44604872A0720F868521B1C6" section-type="subsequent-section"><enum>104.</enum><subsection commented="no" display-inline="yes-display-inline" id="HF0B4EB51FFA5400A859BB261BAD02B36"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">Subject to subsection (b), none of the
		funds made available by this Act may be used to carry out any water
		reallocation project or component under the Wolf Creek Project, Lake
		Cumberland, Kentucky, authorized under the Act of June 28, 1938 (52 Stat. 1215,
		ch. 795) and the Act of July 24, 1946 (60 Stat. 636, ch. 595).</text>
						</subsection><subsection changed="added" commented="no" display-inline="no-display-inline" id="H25E4EAE64D3B493CBA059AC4C285F8B9" reported-display-style="italic"><enum>(b)</enum><header display-inline="yes-display-inline">Existing Reallocations</header><text display-inline="yes-display-inline">Subsection (a) shall not apply to any water
		reallocation for Lake Cumberland, Kentucky, that is carried out subject to an
		agreement or payment schedule in effect on the date of enactment of this
		Act.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="ID3A879B3F0FB743D88E879C3E56521CAC" section-type="subsequent-section"><enum>105.</enum><text display-inline="yes-display-inline">None of the funds in this Act, or previous
		Acts, making funds available for Energy and Water Development shall be used to
		award any continuing contract that commits additional funding from the Inland
		Waterway Trust Fund unless or until such time that a permanent solution
		long-term mechanism to enhance revenues in the fund is enacted.</text>
					</section><section commented="no" display-inline="no-display-inline" id="IDcd798224f0c646febaa65c2a840b7ff1" section-type="subsequent-section"><enum>106.</enum><text display-inline="yes-display-inline">Section 592(g) of Public Law 106–53 (113
		Stat. 380), as amended by section 120 of Public Law 108–137 (117 Stat. 1837)
		and section 5097 of Public Law 110–114 (121 Stat. 1233), is further amended by
		striking <quote>$110,000,000</quote> and inserting <quote>$200,000,000</quote>
		in lieu thereof.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID09074d15f6e5448f90a6f33c7976e084" section-type="subsequent-section"><enum>107.</enum><text display-inline="yes-display-inline">The project for flood control, Big Sioux
		River and Skunk Creek, Sioux Falls, South Dakota authorized by section
		101(a)(28) of the Water Resources Development Act of 1996 (Public Law 104–303;
		110 Stat. 3666), is modified to authorize the Secretary to construct the
		project at an estimated total cost of $53,500,000, with an estimated Federal
		cost of $37,700,000 and an estimated non-Federal cost of $15,800,000.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID919db9a4da4a4147b5a92623c36ff2b2" section-type="subsequent-section"><enum>108.</enum><text display-inline="yes-display-inline">Section 595(h) of Public Law 106–53 (113
		Stat. 384), as amended by section 5067 of Public Law 110–114 (121 Stat. 1219),
		is further amended by—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="ID9a2da08f591542eda9339c29f94659e2"><enum>(1)</enum><text display-inline="yes-display-inline">striking the phrase <quote>$25,000,000 for
		each of Montana and New Mexico</quote> and inserting the following language in

		authorize the Secretary to construct the project at a total cost of $16,500,000
		with an estimated Federal cost of $10,725,000 and an estimated non-Federal cost

		is amended by striking <quote>$10,000,000</quote> and inserting
		<quote>$27,000,000</quote> in lieu thereof.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID7b9da49c124a4c32914cefeeb77ecd91" section-type="subsequent-section"><enum>112.</enum><text display-inline="yes-display-inline">The Secretary of the Army is authorized to
		carry out structural and non-structural projects for storm damage prevention
		and reduction, coastal erosion, and ice and glacial damage in Alaska, including
		relocation of affected communities and construction of replacement facilities:

		Sacramento, California, authorized by section 101(4), Water Resources
		Development Act, 1992, Public Law 102–580; Energy and Water Development
		Appropriations Act, 1999, Public Law 105–245, is modified to authorize the
		Secretary of Army, acting through the Chief of Engineers, to construct the
		project at a total cost of $53,040,000 with an estimated first Federal cost of

		and</text>
								</subparagraph><subparagraph id="idB44E652F31EE4C708B38177529BD0278"><enum>(B)</enum><text>dated August 30,
		2007.</text>
								</subparagraph></paragraph><paragraph changed="added" id="id17423E39674B4D8A8F2FA9F781195EE3" reported-display-style="italic"><enum>(3)</enum><header>Secretary</header><text>The
		term <term>Secretary</term> means the Secretary of the Army, acting through the
		Chief of Engineers.</text>
							</paragraph></subsection><subsection changed="added" id="idC1EF78862BA94931AED90A8DF434E96F" reported-display-style="italic"><enum>(b)</enum><header>Study</header>
							<paragraph id="id968C47F2B0774E2A9E476231CB3C350A"><enum>(1)</enum><header>In
		general</header><text>In implementing the project, not later than 1 year after
		the date of enactment of this Act, the Secretary shall complete a study of the
		residual risks associated with the options identified as <quote>Option
		1</quote>, <quote>Option 2</quote>, and <quote>Option 2a</quote>, as described
		in the pumping station report.</text>
							</paragraph><paragraph id="idE394E1A8219846329390E95B6EC55C3C"><enum>(2)</enum><header>Requirements</header><text>In
		carrying out the study under paragraph (1), the Secretary shall identify which
		option described in that paragraph—</text>
								<subparagraph id="idD56795DA13D146FEBD84252B61C27E97"><enum>(A)</enum><text>is most technically
		advantageous;</text>
								</subparagraph><subparagraph id="idD4ABEFF4500146F0BCC791D9EDE942B6"><enum>(B)</enum><text>is most effective from an
		operational perspective in providing the greatest long-term reliability in
		reducing the risk of flooding to the New Orleans area;</text>
								</subparagraph><subparagraph id="idD1F3C3B345994EF886B2FAD58C80C5BD"><enum>(C)</enum><text>is most advantageous
		considering the engineering challenges and construction complexities of each
		option; and</text>
								</subparagraph><subparagraph id="id9FA552FEC9E94526B1E5882130FE8037"><enum>(D)</enum><text>is most
		cost-effective.</text>
								</subparagraph></paragraph><paragraph id="idBBA80C13C2B842B9AE6CCE2D35F7B673"><enum>(3)</enum><header>Independent external
		peer review</header>
								<subparagraph id="idA4F99C84FD42474AA77E8DC3CE4881D6"><enum>(A)</enum><header>Duty of
		Secretary</header><text display-inline="yes-display-inline">In accordance with
		Section 2034 of the Water Resource Development Act of 2007, the Chief shall
		carry out an independent external peer review of—</text>
									<clause id="id8567FB71652B4C4D8D132D9B0A883775"><enum>(i)</enum><text display-inline="yes-display-inline">the results of the study under paragraph
		(1); and</text>
									</clause><clause id="id1E2AC0ABC769462BA0C5A6ED64391F6E"><enum>(ii)</enum><text display-inline="yes-display-inline">each cost estimate completed for each
		option described in paragraph (1).</text>
									</clause></subparagraph><subparagraph id="id8E5670982D9E4667AF0D7B6FBE9EE653"><enum>(B)</enum><header>Report</header>
									<clause id="id2280E0E26CDF41168F792B5F4321C574"><enum>(i)</enum><header>In
		general</header><text display-inline="yes-display-inline">Not later than 90
		days after the date of completion of the independent external peer review under
		subparagraph (A), in accordance with clause (ii), the Secretary shall submit a
		report to—</text>
										<subclause id="id63116CFF6F2141BF8E7DC0AD40BEFF98"><enum>(I)</enum><text display-inline="yes-display-inline">the Committee on Environment and Public
		Works of the Senate;</text>
										</subclause><subclause id="id6FED1120604848E499DFE1C38601762B"><enum>(II)</enum><text>the Committee on
		Appropriations of the Senate;</text>
										</subclause><subclause id="id4DD84ECB295C4CC4B6BD50E9B25DD761"><enum>(III)</enum><text>the Committee on
		Transportation and Infrastructure of the House of Representatives; and</text>
										</subclause><subclause id="id6B47B4A3725941388188741C7C4D48B8"><enum>(IV)</enum><text>the Committee on
		Appropriations of the House of Representatives.</text>
										</subclause></clause><clause id="idB9A0A454286441CD9AD53DF524A9FBE8"><enum>(ii)</enum><header>Contents</header><text>The
		report described in clause (i) shall contain—</text>
										<subclause id="id3EB1960BD5674DE3A1A756D8412CC8D5"><enum>(I)</enum><text>the results of the study
		described in paragraph (1);</text>
										</subclause><subclause id="idD24A7FE045FD482A90FBEBB5F231FB7F"><enum>(II)</enum><text>a description of the
		findings of the independent external peer review carried out under subparagraph
		(A); and</text>
										</subclause><subclause id="idF7C0DE1378EE4C7BA5AA5BC6C5AADC69"><enum>(III)</enum><text>a written response for
		any recommendations adopted or not adopted from the peer review.</text>
										</subclause></clause></subparagraph></paragraph><paragraph id="idACEE8357C3234B068E99387DD59D1925"><enum>(4)</enum><header>Suspension of certain
		activities</header><text display-inline="yes-display-inline">The Secretary
		shall suspend each activity of the Secretary that would result in the design
		and construction of any pumping station covered by the pumping station report
		unless the activity is consistent with each option described in paragraph
		(1).</text>
							</paragraph><paragraph id="id612E2A5EFF24463388D84B260EDE46C0"><enum>(5)</enum><header>Feasibility
		report</header><text>Within 18 months of enactment of this Act, the Secretary
		shall submit to the Committee on Environment and Public Works of the Senate and
		the Committee on Transportation and Infrastructure of the House of
		Representatives a report that contains a feasibility level of analysis
		(including a cost estimate) for the project, as modified under this
		subsection.</text>
							</paragraph><paragraph id="id9DF20AC087524AD8AACE5A1D5986813A"><enum>(6)</enum><header>Funding</header><text>In
		carrying out this subsection, the Secretary shall use amounts made available to
		modify the 17th Street, Orleans Avenue, and London Avenue drainage canals and
		install pumps and closure structures at or near the lakefront in the first
		proviso in the matter under the heading <quote><header-in-text level="appropriations-small" style="traditional">Flood control and coastal
		emergencies (including rescission of funds)</header-in-text></quote> under the
		heading <quote><header-in-text level="appropriations-intermediate" style="traditional">Corps of Engineers—Civil</header-in-text></quote> under the
		heading <quote><header-in-text level="appropriations-major" style="traditional">Department of the Army</header-in-text></quote> under the
		heading <quote><header-in-text level="appropriations-major" style="traditional">Department of Defense—civil</header-in-text></quote> of
		chapter 3 of title II of the Emergency Supplemental Appropriations Act for
		Defense, the Global War on Terror, and Hurricane Recovery, 2006 (Public Law
		109–234; 120 Stat. 454).</text>
							</paragraph></subsection></section><appropriations-small id="id4DCCCBA6E22043BD90AB39DEF98CFAF9"><header>Ten Mile Creek Water Preserve
	 Area</header>
					</appropriations-small><section id="id179CD7C649FA449D8972081A8B8798FB"><enum>118.</enum><text display-inline="yes-display-inline">Section 528(b)(3)(C)(ii) of the Water
		Resources Development Act of 1996 (110 Stat. 3769; 121 Stat. 1270) is
		amended—</text>
						<paragraph id="id16ACC37D74834C4A89B86EA68867EE22"><enum>(1)</enum><text>in subclause (I), by
		striking <quote>subclause (II)</quote> and inserting <quote>subclauses (II) and

									<item id="idF9EFF15D7B874D2FB0309078FDE72F19"><enum>(aa)</enum><text>the completion of a post
		  authorization change report; and</text>
									</item><item id="id4AE111047F8546149FF06C1D779D82B6"><enum>(bb)</enum><text>the maintenance of the
		  Ten Mile Creek Water Preserve Area in caretaker status through fiscal year
		  2013.</text>

						</paragraph></section><section id="id5CC315DD8B5B44199C52F3182C3EEEF1"><enum>119.</enum><text display-inline="yes-display-inline">As soon as practicable after the date of
		enactment of this Act, from funds made available before the date of enactment
		of this Act for the Tampa Harbor Big Bend Channel project, the Secretary of the
		Army may reimburse the non-Federal sponsor of the Tampa Harbor Big Bend Channel
		project for the Federal share of the dredging work carried out for the
		project.</text>

	 project</header>
					</appropriations-intermediate><appropriations-small commented="no" id="IDE4706A1979884C08B86B6DE7507D56B7"><header display-inline="yes-display-inline">Central utah project completion
	 account</header><text display-inline="no-display-inline">For carrying out
	 activities authorized by the Central Utah Project Completion Act, $40,300,000,
	 to remain available until expended, of which $1,500,000 shall be deposited into
	 the Utah Reclamation Mitigation and Conservation Account for use by the Utah
	 Reclamation Mitigation and Conservation Commission. In addition, for necessary
	 expenses incurred in carrying out related responsibilities of the Secretary of
	 the Interior, $1,704,000, to remain available until expended. For fiscal year
	 2010, the Commission may use an amount not to exceed $1,500,000 for
	 administrative expenses.</text>
					</appropriations-small><appropriations-intermediate commented="no" id="H54122977153246F593F9AE9F2B9493A0"><header display-inline="yes-display-inline">Bureau of reclamation</header><text display-inline="no-display-inline">The following appropriations shall be
	 expended to execute authorized functions of the Bureau of
	 Reclamation:</text>
					</appropriations-intermediate><appropriations-small commented="no" id="H63D6E698251241789C4D0AD0D71F0612"><header display-inline="yes-display-inline">Water and related
	 resources</header>
					</appropriations-small><appropriations-small commented="no" id="H01423A134D9B4080B028BDB146FE08C7"><header display-inline="yes-display-inline">(including transfers of
	 funds)</header><text display-inline="no-display-inline">For management,
	 development, and restoration of water and related natural resources and for
	 related activities, including the operation, maintenance, and rehabilitation of
	 reclamation and other facilities, participation in fulfilling related Federal
	 responsibilities to Native Americans, and related grants to, and cooperative
	 and other agreements with, State and local governments, federally recognized
	 Indian tribes, and others, $993,125,000, to remain available until expended, of
	 which $53,240,000 shall be available for transfer to the Upper Colorado River
	 Basin Fund and $17,936,000 shall be available for transfer to the Lower
	 Colorado River Basin Development Fund; of which such amounts as may be
	 necessary may be advanced to the Colorado River Dam Fund; of which not more
	 than $500,000 is for high priority projects which shall be carried out by the
	 Youth Conservation Corps, as authorized by 16 U.S.C. 1706:
	 <italic>Provided</italic>, That such transfers may be increased or decreased
	 within the overall appropriation under this heading: <italic>Provided
	 further</italic>, That of the total appropriated, the amount for program
	 activities that can be financed by the Reclamation Fund or the Bureau of
	 Reclamation special fee account established by 16 U.S.C. 460l–6a(i) shall be
	 derived from that Fund or account: <italic>Provided further</italic>, That
	 funds contributed under 43 U.S.C. 395 are available until expended for the
	 purposes for which contributed: <italic>Provided further</italic>, That funds
	 advanced under 43 U.S.C. 397a shall be credited to this account and are
	 available until expended for the same purposes as the sums appropriated under

	 expenditure for the Departmental Irrigation Drainage Program may be expended by
	 the Bureau of Reclamation for site remediation on a nonreimbursable

	 fund</header><text display-inline="no-display-inline">For carrying out the
	 programs, projects, plans, habitat restoration, improvement, and acquisition

	 derived from such sums as may be collected in the Central Valley Project
	 Restoration Fund pursuant to sections 3407(d), 3404(c)(3), and 3405(f) of
	 Public Law 102–575, to remain available until expended:
	 <italic>Provided</italic>, That the Bureau of Reclamation is directed to assess
	 and collect the full amount of the additional mitigation and restoration
	 payments authorized by section 3407(d) of Public Law 102–575: <italic>Provided
	 further</italic>, That none of the funds made available under this heading may
	 be used for the acquisition or leasing of water for in-stream purposes if the
	 water is already committed to in-stream purposes by a court adopted decree or
	 order.</text>

	 activities authorized by the Water Supply, Reliability, and Environmental

	 Denver office, and offices in the five regions of the Bureau of Reclamation, to
	 remain available until expended, $61,200,000, to be derived from the
	 Reclamation Fund and be nonreimbursable as provided in 43 U.S.C. 377:
	 <italic>Provided</italic>, That no part of any other appropriation in this Act
	 shall be available for activities or functions budgeted as policy and
	 administration expenses.</text>
					</appropriations-small><appropriations-small commented="no" id="HC86E5978EAC8459CAAB7273D2CBE4232"><header display-inline="yes-display-inline">Administrative provision</header><text display-inline="no-display-inline">Appropriations for the Bureau of Reclamation
	 shall be available for purchase of not to exceed seven passenger motor
	 vehicles, which are for replacement only.</text>
					</appropriations-small><appropriations-intermediate commented="no" id="H86C98AEFC3BD45E986F891523143B5D7"><header display-inline="yes-display-inline">General provisions, department of the
	 interior</header>
					</appropriations-intermediate><section commented="no" display-inline="no-display-inline" id="HB77FB314674B437180DCD9A784B1B1D5" section-type="subsequent-section"><enum>201.</enum><subsection commented="no" display-inline="yes-display-inline" id="HE5096CC0E4384DE79A0B38EDBDD6C4B9"><enum>(a)</enum><text display-inline="yes-display-inline">None of the funds provided in title II of
		this Act for Water and Related Resources, or provided by previous
		appropriations Acts to the agencies or entities funded in title II of this Act
		for Water and Related Resources that remain available for obligation or
		expenditure in fiscal year 2010, shall be available for obligation or
		expenditure through a reprogramming of funds that—</text>
							<paragraph changed="added" commented="no" display-inline="no-display-inline" id="id7123EE70CE7F4CEEAFA23C1F026B647E" reported-display-style="italic"><enum>(1)</enum><text display-inline="yes-display-inline">initiates or creates a new program,
		project, or activity;</text>
							</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="idCD41C451F83446D59C0B03FD9E494EA8" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">eliminates a program, project, or
		activity;</text>
							</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="id8626E10ADB4F431DB3C81BCBFE08EE86" reported-display-style="italic"><enum>(3)</enum><text display-inline="yes-display-inline">increases funds for any program, project,
		or activity for which funds have been denied or restricted by this Act, unless
		prior approval is received from the Committees on Appropriations of the House
		of Representatives and the Senate;</text>
							</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="H9A0B37DA94DD42F991AD41C1CAACFF84" reported-display-style="italic"><enum>(4)</enum><text display-inline="yes-display-inline">restarts or resumes any program, project or
		activity for which funds are not provided in this Act, unless prior approval is
		received from the Committees on Appropriations of the House of Representatives
		and the Senate;</text>
							</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="idB36E0E98CF1E462BB2F7D47CF80D6B21" reported-display-style="italic"><enum>(5)</enum><text display-inline="yes-display-inline">transfers funds in excess of the following
		limits, unless prior approval is received from the Committees on Appropriations
		of the House of Representatives and the Senate:</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id24E41E582A2B402ABE1D3F6BB23F06D3"><enum>(A)</enum><text display-inline="yes-display-inline">15 percent for any program, project or
		activity for which $2,000,000 or more is available at the beginning of the
		fiscal year; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2F8DC203F9684D288B0E21A89F1C955A"><enum>(B)</enum><text display-inline="yes-display-inline">$300,000 for any program, project or
		activity for which less than $2,000,000 is available at the beginning of the
		fiscal year;</text>
								</subparagraph></paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="id0C67EF9EF26C4F3B972869E4F7EBBA70" reported-display-style="italic"><enum>(6)</enum><text display-inline="yes-display-inline">transfers more than $500,000 from either
		the Facilities Operation, Maintenance, and Rehabilitation category or the
		Resources Management and Development category to any program, project, or
		activity in the other category, unless prior approval is received from the
		Committees on Appropriations of the House of Representatives and the Senate;
		or</text>
							</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="idD7CF6E6A3A2248048B074EDD568FF996" reported-display-style="italic"><enum>(7)</enum><text display-inline="yes-display-inline">transfers, where necessary to discharge
		legal obligations of the Bureau of Reclamation, more than $5,000,000 to provide
		adequate funds for settled contractor claims, increased contractor earnings due
		to accelerated rates of operations, and real estate deficiency judgments,
		unless prior approval is received from the Committees on Appropriations of the
		House of Representatives and the Senate.</text>
							</paragraph></subsection><subsection changed="added" commented="no" display-inline="no-display-inline" id="H0B54DA40D29B4B7B904F92096A34B55A" reported-display-style="italic"><enum>(b)</enum><text display-inline="yes-display-inline">Subsection (a)(5) shall not apply to any
		transfer of funds within the Facilities Operation, Maintenance, and
		Rehabilitation category.</text>
						</subsection><subsection changed="added" commented="no" display-inline="no-display-inline" id="H2FF3C00111E04AD5B8BF31A187907838" reported-display-style="italic"><enum>(c)</enum><text display-inline="yes-display-inline">For purposes of this section, the term
		<quote>transfer</quote> means any movement of funds into or out of a program,
		project, or activity.</text>
						</subsection><subsection changed="added" commented="no" display-inline="no-display-inline" id="HEED9D8F3281741C6AFE17DF418F2BAB5" reported-display-style="italic"><enum>(d)</enum><text display-inline="yes-display-inline">The Bureau of Reclamation shall submit
		reports on a quarterly basis to the Committees on Appropriations of the House
		of Representatives and the Senate detailing all the funds reprogrammed between
		programs, projects, activities, or categories of funding. The first quarterly
		report shall be submitted not later than 60 days after the date of enactment of
		this Act.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="H1173D4FC09DD4E699E3B2CDEB2C7D59E" section-type="subsequent-section"><enum>202.</enum><subsection commented="no" display-inline="yes-display-inline" id="HDC6B6D46382140A2B8FF01417DCD17C7"><enum>(a)</enum><text display-inline="yes-display-inline">None of the funds appropriated or otherwise
		made available by this Act may be used to determine the final point of
		discharge for the interceptor drain for the San Luis Unit until development by
		the Secretary of the Interior and the State of California of a plan, which
		shall conform to the water quality standards of the State of California as
		approved by the Administrator of the Environmental Protection Agency, to
		minimize any detrimental effect of the San Luis drainage waters.</text>
						</subsection><subsection changed="added" commented="no" display-inline="no-display-inline" id="H6A95D0E25A8B4800B376EB3491ECA353" reported-display-style="italic"><enum>(b)</enum><text display-inline="yes-display-inline">The costs of the Kesterson Reservoir
		Cleanup Program and the costs of the San Joaquin Valley Drainage Program shall
		be classified by the Secretary of the Interior as reimbursable or
		nonreimbursable and collected until fully repaid pursuant to the <quote>Cleanup
		Program-Alternative Repayment Plan</quote> and the <quote>SJVDP-Alternative
		Repayment Plan</quote> described in the report entitled <quote>Repayment
		Report, Kesterson Reservoir Cleanup Program and San Joaquin Valley Drainage
		Program, February 1995</quote>, prepared by the Department of the Interior,
		Bureau of Reclamation. Any future obligations of funds by the United States
		relating to, or providing for, drainage service or drainage studies for the San
		Luis Unit shall be fully reimbursable by San Luis Unit beneficiaries of such
		service or studies pursuant to Federal reclamation law.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="ID95F9B1012A33464782DFB0D817F32C0F" section-type="subsequent-section"><enum>203.</enum><text display-inline="yes-display-inline">None of the funds appropriated or otherwise
		made available by this or any other Act may be used to pay the salaries and
		expenses of personnel to purchase or lease water in the Middle Rio Grande or
		the Carlsbad Projects in New Mexico unless said purchase or lease is in
		compliance with the purchase requirements of section 202 of Public Law
		106–60.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID067DE28F288B48BD9EC6FC69DFD15203" section-type="subsequent-section"><enum>204.</enum><text display-inline="yes-display-inline">Funds under this title for Drought
		Emergency Assistance shall be made available primarily for leasing of water for
		specified drought related purposes from willing lessors, in compliance with
		existing State laws and administered under State water priority
		allocation.</text>
					</section><section commented="no" display-inline="no-display-inline" id="id58F843D794324E549429765785F08B4F" section-type="subsequent-section"><enum>205.</enum><text display-inline="yes-display-inline">Section 9 of the Fort Peck Reservation
		Rural Water System Act of 2000 (Public Law 106–382; 114 Stat. 1457) is amended
		by striking ‘‘over a period of 10 fiscal years’’ each place it appears in
		subsections (a)(1) and (b) and inserting ‘‘through fiscal year 2015’’.</text>
					</section><section id="id311F279297A34DF5AB1806ED85CE88DB"><enum>206.</enum><text display-inline="yes-display-inline">Section 208(a) of the Energy and Water

						</paragraph></section><section id="id09579E8696EA40FD9C7FD57D92278800"><enum>208.</enum><subsection commented="no" display-inline="yes-display-inline" id="id3B6020EFFEC24C9CA70B4C4A49643F67"><enum>(a)</enum><text display-inline="yes-display-inline">Of the amounts made available under section
		2507 of the Farm Security and Rural Investment Act of 2002 (43 U.S.C. 2211
		note; Public Law 107–171), the Secretary of the Interior, acting through the
		Commissioner of Reclamation, shall—</text>
							<paragraph changed="added" id="IDac430f7265ef4c638538d587863a3600" reported-display-style="italic"><enum>(1)</enum><text>provide, in accordance
		with section 208(a)(1)(A)(i) of the Energy and Water Development Appropriations
		Act, 2006 (Public Law 109–103; 119 Stat. 2268), and subject to subsection (b),
		$66,200,000 to establish the Walker Basin Restoration Program for the primary
		purpose of restoring and maintaining Walker Lake, a natural desert terminal
		lake in the State of Nevada, consistent with protection of the ecological
		health of the Walker River and the riparian and watershed resources of the
		West, East, and Main Walker Rivers; and</text>
							</paragraph><paragraph changed="added" id="IDe83e268319f446bf847e08e2f85a4a9a" reported-display-style="italic"><enum>(2)</enum><text>allocate—</text>
								<subparagraph id="ID66d2313b404e48ac8877e87189902e36"><enum>(A)</enum><text>acting through a
		nonprofit conservation organization that is acting in consultation with the
		Truckee Meadows Water Authority, $2,000,000, to remain available until
		expended, for—</text>
									<clause id="ID8977fa5429b045a8a23821fd67aa791b"><enum>(i)</enum><text>the acquisition of land
		surrounding Independence Lake; and</text>
									</clause><clause id="ID0b67aaa212cf484e89cd334133d5944f"><enum>(ii)</enum><text>protection of the native
		fishery and water quality of Independence Lake, as determined by the nonprofit
		conservation organization;</text>
									</clause></subparagraph><subparagraph id="IDa529d513eb0349ee94c8fe21e2490304"><enum>(B)</enum><text>$5,000,000 to provide
		grants of equal amounts to the State of Nevada, the State of California, the
		Truckee Meadows Water Authority, the Pyramid Lake Paiute Tribe, and the Federal
		Watermaster of the Truckee River to implement the Truckee-Carson-Pyramid Lake
		Water Rights Settlement Act (Public Law 101–618; 104 Stat. 3289);</text>
								</subparagraph><subparagraph id="ID88791a08d78b4b4680ed8e4aa069144e"><enum>(C)</enum><text>$1,500,000, to be divided
		equally by the city of Fernley, Nevada, and the Pyramid Lake Paiute Tribe, for
		joint planning and development activities for water, wastewater, and sewer
		facilities; and</text>
								</subparagraph><subparagraph id="IDe9fadfcdcc324f359f71d563b57f7ac4"><enum>(D)</enum><text>$1,000,000 to the United
		States Geological Survey to design and implement, in consultation and
		cooperation with other Federal departments and agencies, State and tribal
		governments, and other water management and conservation organizations, a water
		monitoring program for the Walker River Basin.</text>
								</subparagraph></paragraph></subsection><subsection changed="added" id="id102AB75FE21240E286C3DEC048A24133" reported-display-style="italic"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idBF4F2E87108E41AC862C04C184F9F6E1"><enum>(1)</enum><text>The amount made
		available under subsection (a)(1) shall be—</text>
								<subparagraph changed="added" id="IDdb4cd99993f0485a900c1907f97dd45c" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>used,
		consistent with the primary purpose set forth in subsection (a)(1), to support
		efforts to preserve Walker Lake while protecting agricultural, environmental,
		and habitat interests in the Walker River Basin; and</text>
								</subparagraph><subparagraph changed="added" id="idA98C0ED2988D42219739CE712AA52D77" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>allocated as
		follows:</text>
									<clause id="IDefee2f785e194da8b19a58ba82c1f498"><enum>(i)</enum><text>$25,000,000 to the Walker
		River Irrigation District, acting in accordance with an agreement between that
		District and the National Fish and Wildlife Foundation—</text>
										<subclause id="ID45c92c5a27f54d4aa0ae3e59691bb774"><enum>(I)</enum><text>to
		administer and manage a 3-year water leasing demonstration program in the
		Walker River Basin to increase Walker Lake inflows; and</text>
										</subclause><subclause id="ID7aa1b1802805498b83f6536ffca44d91"><enum>(II)</enum><text>for use
		in obtaining information regarding the establishment, budget, and scope of a
		longer-term leasing program.</text>
										</subclause></clause><clause id="ID2e73cc52b2e445a1bfd29009feb3be66"><enum>(ii)</enum><text>$25,000,000 to advance
		the acquisition of water and related interests from willing sellers authorized
		by section 208(a)(1)(A)(i) of the Energy and Water Development Appropriations
		Act, 2006 (Public Law 109–103; 119 Stat. 2268).</text>
									</clause><clause id="ID325f22f0f85e46f5906bb805bc9320ff"><enum>(iii)</enum><text>$1,000,000 for
		activities relating to the exercise of acquired option agreements and
		implementation of the water leasing demonstration program, including but not
		limited to the pursuit of change applications, approvals, and agreements
		pertaining to the exercise of water rights and leases acquired under the
		program.</text>
									</clause><clause id="ID6e0b2433e11e409fac694876ed02b4a9"><enum>(iv)</enum><text>$10,000,000 for
		associated conservation and stewardship activities, including water
		conservation and management, watershed planning, land stewardship, habitat
		restoration, and the establishment of a local, nonprofit entity to hold and
		exercise water rights acquired by, and to achieve the purposes of, the Walker
		Basin Restoration Program.</text>
									</clause><clause id="IDc48a15aaf0f14a20905f35d1a7058045"><enum>(v)</enum><text>$5,000,000 to the
		University of Nevada, Reno, and the Desert Research Institute—</text>
										<subclause id="ID4e7e4a21a04144aa9cfd6c98dd48f8ff"><enum>(I)</enum><text>for
		additional research to supplement the water rights research conducted under
		section 208(a)(1)(A)(ii) of the Energy and Water Development Appropriations
		Act, 2006 (Public Law 109–103; 119 Stat. 2268);</text>
										</subclause><subclause id="IDca4aaf937f6a488884be63e704bac50e"><enum>(II)</enum><text>to
		conduct an annual evaluation of the results of the activities carried out under
		clauses (i) and (ii); and</text>
										</subclause><subclause id="idC533F996F4934E05954AFA72992758D0"><enum>(III)</enum><text>to
		support and provide information to the programs described in this subparagraph
		and related acquisition and stewardship initiatives to preserve Walker Lake and
		protect agricultural, environmental, and habitat interests in the Walker River
		Basin.</text>
										</subclause></clause><clause id="ID66190538ef054282b91c113aad509b3f"><enum>(vi)</enum><text>$200,000 to support
		alternative crops and alternative agricultural cooperatives programs in Lyon
		County, Nevada, that promote water conservation in the Walker River
		Basin.</text>
									</clause></subparagraph></paragraph><paragraph changed="added" id="IDe13abd508bbe4737b781071b4dc939f9" indent="up1" reported-display-style="italic"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idED2DC015954243D1BC2DFDA682DF669C"><enum>(A)</enum><text>The amount made
		available under subsection (a)(1) shall be provided to the National Fish and
		Wildlife Foundation—</text>
									<clause changed="added" id="id7C1717AA3A5B4B41B25B3AEB5DE071EE" reported-display-style="italic"><enum>(i)</enum><text>in
		an advance payment of the entire amount—</text>
										<subclause id="id38D06E3B670C4E64B60315CC7C80B0A4"><enum>(I)</enum><text>on the
		date of enactment of this Act; or</text>
										</subclause><subclause id="idCC58FB5F946244CA8B30DEFFCE62B4EE"><enum>(II)</enum><text>as soon
		as practicable after that date of enactment; and</text>
										</subclause></clause><clause changed="added" id="idD36EF5EBE6964FC7978D29456537BAD4" reported-display-style="italic"><enum>(ii)</enum><text>except as provided in
		subparagraph (B), subject to the National Fish and Wildlife Foundation
		Establishment Act (16 U.S.C. 3701 et seq.), in accordance with section 10(b)(1)
		of that Act (16 U.S.C. 3709(b)(1)).</text>
									</clause></subparagraph><subparagraph changed="added" id="idEDCDE2369E6B4683B4491AAEE4EA9E35" reported-display-style="italic"><enum>(B)</enum><text>Sections 4(e) and
		10(b)(2) of the National Fish and Wildlife Foundation Establishment Act (16
		U.S.C. 3703(e), 3709(b)(2)), and the provision of subsection (c)(2) of section
		4 of that Act (16 U.S.C. 3703) relating to subsection (e) of that section,
		shall not apply to the amount made available under subsection (a)(1).</text>
								</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID2918c98adc0144e0ac73fefd95771d21" section-type="subsequent-section"><enum>209.</enum><text display-inline="yes-display-inline">Notwithstanding the provisions of section
		11(c) of Public Law 89–108, as amended by section 9 of Public Law 99–294, the
		Commissioner is directed to modify the April 9, 2002, Grant Agreement Between
		Bureau of Reclamation and North Dakota Natural Resources Trust to provide
		funding for the Trust to continue its investment program/Agreement No.
		02FG601633 to authorize the North Dakota Natural Resources Trust Board of
		Directors to expend all or any portion of the funding allocation received
		pursuant to section 11(a)(2)(B) of the Dakota Water Resources Act of 2000 for
		the purpose of operations of the Natural Resource Trust whether such amounts
		are principal or received as investment income: 
		<proviso><italic>Provided</italic></proviso>, That operational expenses
		that may be funded from the principal allocation shall not exceed 105 percent
		of the previous fiscal year’s operating costs: 
		<proviso><italic>Provided further</italic></proviso>, That the
		Commissioner of Reclamation is authorized to include in such modified agreement
		with the Trust authorized under this section appropriate provisions regarding
		the repayment of any funds that constitute principal from the Trust
		Funds.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID7695309ccd7647eabc113d981543aabc" section-type="subsequent-section"><enum>210.</enum><text display-inline="yes-display-inline">Title I of Public Law 108–361 is amended by
		striking <quote>2010</quote> wherever it appears and inserting
		<quote>2015</quote> in lieu thereof.</text>
					</section><section id="id4275DE9A8A4E442382B2AD7BD5C92DC0"><enum>211.</enum><subsection commented="no" display-inline="yes-display-inline" id="idBC409D8763DF48FCBD612BAC3C44250A"><enum>(a)</enum><text>Section 3405(a)(1)(M)

		Division contractor and a south-of-Delta CVP agricultural water service
		contractor, approved during a two-year period beginning on the date of

		River Restoration Settlement Act (part I of subtitle A of title X of Public Law

		10004(a)(4)(B) of that Act relating to implementation of paragraph 16 of the
		Settlement), and the Settlement (as defined in section 10003 of that Act);

	 enhance the security of the electricity grid:

	 of enactment, the Secretary shall invite applications from qualified entities
	 for the purpose of forming and governing a national energy sector cyber
	 organization that have the knowledge and capacity to focus cyber security
	 research and development and to identify and disseminate best practices;
	 organize the collection, analysis and dissemination of infrastructure
	 vulnerabilities and threats; work cooperatively with the Department of Energy
	 and other Federal agencies to identify areas where Federal agencies with
	 jurisdiction may best support efforts to enhance security of the bulk power
	 electric grid:

	 appropriated in this paragraph, $41,150,000 shall be used for projects
	 specified in the table that appears under the heading <quote>Congressionally
	 Directed Science Projects</quote> in the report of the Committee on
	 Appropriations of the United States Senate to accompany this
	 Act.</text>
					</appropriations-intermediate><appropriations-intermediate commented="no" id="H82C71FBD08C74E46A6018A2BC5BA40AE"><header display-inline="yes-display-inline">Nuclear waste disposal</header><text display-inline="no-display-inline">For nuclear waste disposal activities to
	 carry out the purposes of the Nuclear Waste Policy Act of 1982, Public Law
	 97–425, as amended (the <quote>NWPA</quote>), $98,400,000, to remain available
	 until expended, and to be derived from the Nuclear Waste Fund: 
	 <proviso><italic>Provided</italic></proviso>, That of the funds made
	 available in this Act for nuclear waste disposal and defense nuclear waste
	 disposal activities, 2.54 percent shall be provided to the Office of the
	 Attorney General of the State of Nevada solely for expenditures, other than
	 salaries and expenses of State employees, to conduct scientific oversight
	 responsibilities and participate in licensing activities pursuant to the NWPA: 
	 <proviso><italic>Provided further</italic></proviso>, That notwithstanding
	 the lack of a written agreement with the State of Nevada under section 117(c)
	 of the NWPA, 0.51 percent shall be provided to Nye County, Nevada, for on-site
	 oversight activities under section 117(d) of the NWPA: 
	 <proviso><italic>Provided further</italic></proviso>, That of the funds
	 made available in this Act for nuclear waste disposal and defense nuclear waste
	 disposal activities, 4.57 percent shall be provided to affected units of local
	 government, as defined in the NWPA, to conduct appropriate activities and
	 participate in licensing activities under Section 116(c) of the NWPA: 
	 <proviso><italic>Provided further</italic></proviso>, That of the amounts
	 provided to affected units of local government, 7.5 percent of the funds
	 provided for the affected units of local government shall be made available to
	 affected units of local government in California with the balance made
	 available to affected units of local government in Nevada for distribution as
	 determined by the Nevada affected units of local government: 
	 <proviso><italic>Provided further</italic></proviso>, That of the funds
	 made available in this Act for nuclear waste disposal and defense nuclear waste
	 disposal activities, 0.25 percent shall be provided to the affected
	 Federally-recognized Indian tribes, as defined in the NWPA, solely for
	 expenditures, other than salaries and expenses of tribal employees, to conduct
	 appropriate activities and participate in licensing activities under section
	 118(b) of the NWPA: 
	 <proviso><italic>Provided further</italic></proviso>, That notwithstanding
	 the provisions of chapters 65 and 75 of title 31, United States Code, the
	 Department shall have no monitoring, auditing or other oversight rights or
	 responsibilities over amounts provided to affected units of local government: 
	 <proviso><italic>Provided further</italic></proviso>, That the funds for
	 the State of Nevada shall be made available solely to the Office of the
	 Attorney General by direct payment and to units of local government by direct
	 payment: 
	 <proviso><italic>Provided further</italic></proviso>, That 4.57 percent of
	 the funds made available in this Act for nuclear waste disposal and defense
	 nuclear waste disposal activities shall be provided to Nye County, Nevada, as
	 payment equal to taxes under section 116(c)(3) of the NWPA: 
	 <proviso><italic>Provided further</italic></proviso>, That within 90 days
	 of the completion of each Federal fiscal year, the Office of the Attorney
	 General of the State of Nevada, each affected Federally-recognized Indian
	 tribe, and each of the affected units of local government shall provide
	 certification to the Department of Energy that all funds expended from such
	 payments have been expended for activities authorized by the NWPA and this Act:
	 
	 <proviso><italic>Provided further</italic></proviso>, That failure to
	 provide such certification shall cause such entity to be prohibited from any
	 further funding provided for similar activities: 
	 <proviso><italic>Provided further</italic></proviso>, That none of the
	 funds herein appropriated may be: (1) used directly or indirectly to influence
	 legislative action, except for normal and recognized executive-legislative
	 communications, on any matter pending before Congress or a State legislature or
	 for lobbying activity as provided in 18 U.S.C. 1913; (2) used for litigation
	 expenses; or (3) used to support multi-State efforts or other coalition
	 building activities inconsistent with the restrictions contained in this Act: 
	 <proviso><italic>Provided further</italic></proviso>, That all proceeds and
	 recoveries realized by the Secretary in carrying out activities authorized by
	 the NWPA, including but not limited to, any proceeds from the sale of assets,
	 shall be available without further appropriation and shall remain available
	 until expended: 
	 <proviso><italic>Provided further</italic></proviso>, That no funds
	 provided in this Act or any previous Act may be used to pursue repayment or
	 collection of funds provided in any fiscal year to affected units of local
	 government for oversight activities that had been previously approved by the
	 Department of Energy, or to withhold payment of any such
	 funds.</text>
					</appropriations-intermediate><appropriations-intermediate commented="no" id="H5E564BB1D40E4AD48E6D53515CCC34B0"><header display-inline="yes-display-inline">Title 17 innovative technology loan
	 guarantee program</header><text display-inline="no-display-inline">Such sums as
	 are derived from amounts received from borrowers pursuant to section 1702(b)(2)
	 of the Energy Policy Act of 2005 under this heading in prior Acts, shall be
	 collected in accordance with section 502(7) of the Congressional Budget Act of
	 1974: 
	 <proviso><italic>Provided,</italic></proviso>, That for necessary
	 administrative expenses to carry out this Loan Guarantee program, $43,000,000
	 is appropriated, to remain available until expended: 
	 <proviso><italic>Provided further</italic></proviso>, That $43,000,000 of
	 the fees collected pursuant to section 1702(h) of the Energy Policy Act of 2005
	 shall be credited as offsetting collections to this account to cover
	 administrative expenses and shall remain available until expended, so as to
	 result in a final fiscal year 2010 appropriations from the general fund
	 estimated at not more than $0: <italic>Provided further,</italic> That, in
	 administering amounts made available by prior Acts for projects covered by
	 title XVII of the Energy Policy Act of 2005 (42 U.S.C. 16511 et seq.), the
	 Secretary of Energy is required by that title to consider low-risk finance
	 programs that substantially reduce or eliminate upfront costs for building
	 owners to renovate or retrofit existing buildings to install energy efficiency
	 or renewable energy technologies as eligible for loan guarantees authorized
	 under sections 1703 and 1705 of that Act (42 U.S.C. 16513,
	 16516).</text>

					</appropriations-major><section commented="no" display-inline="no-display-inline" id="ID5EEF75EBD8F84A7FA91E9C73B4669A93" section-type="subsequent-section"><enum>301.</enum><text display-inline="yes-display-inline">None of the funds appropriated by this Act
		may be used to prepare or initiate Requests For Proposals (RFPs) for a program
		if the program has not been funded by Congress.</text>
					</section><section commented="no" display-inline="no-display-inline" id="IDEF9DCDF344534A099F45D989E3B34DB4" section-type="subsequent-section"><enum>302.</enum><text display-inline="yes-display-inline">None of the funds appropriated by this Act
		may be used—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H2F7C54A89416415089D14F7A9AB633EF"><enum>(1)</enum><text display-inline="yes-display-inline">to augment the funds made available for
		obligation by this Act for severance payments and other benefits and community
		assistance grants under section 4604 of the Atomic Energy Defense Act (50
		U.S.C. 2704) unless the Department of Energy submits a reprogramming request to
		the appropriate congressional committees; or</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9DA9C531B47C45ED9B3F6A5631550983"><enum>(2)</enum><text display-inline="yes-display-inline">to provide enhanced severance payments or
		other benefits for employees of the Department of Energy under such section;
		or</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3A5561F6F2874CDF94C0835BE744BC8F"><enum>(3)</enum><text display-inline="yes-display-inline">develop or implement a workforce
		restructuring plan that covers employees of the Department of Energy.</text>
						</paragraph></section><section commented="no" display-inline="no-display-inline" id="HAD4D89FD329048DBAF1130CAF934A1DF" section-type="subsequent-section"><enum>303.</enum><text display-inline="yes-display-inline">The unexpended balances of prior
		appropriations provided for activities in this Act may be available to the same
		appropriation accounts for such activities established pursuant to this title.
		Available balances may be merged with funds in the applicable established
		accounts and thereafter may be accounted for as one fund for the same time
		period as originally enacted.</text>
					</section><section commented="no" display-inline="no-display-inline" id="HEC99CD4A010943DCB16AE94C2F2253DB" section-type="subsequent-section"><enum>304.</enum><text display-inline="yes-display-inline">None of the funds in this or any other Act
		for the Administrator of the Bonneville Power Administration may be used to
		enter into any agreement to perform energy efficiency services outside the
		legally defined Bonneville service territory, with the exception of services
		provided internationally, including services provided on a reimbursable basis,
		unless the Administrator certifies in advance that such services are not
		available from private sector businesses.</text>
					</section><section commented="no" display-inline="no-display-inline" id="H32415F1573924B679850EFBCA41C0B17" section-type="subsequent-section"><enum>305.</enum><text display-inline="yes-display-inline">When the Department of Energy makes a user
		facility available to universities or other potential users, or seeks input
		from universities or other potential users regarding significant
		characteristics or equipment in a user facility or a proposed user facility,
		the Department shall ensure broad public notice of such availability or such
		need for input to universities and other potential users. When the Department
		of Energy considers the participation of a university or other potential user
		as a formal partner in the establishment or operation of a user facility, the
		Department shall employ full and open competition in selecting such a partner.
		For purposes of this section, the term <quote>user facility</quote> includes,
		but is not limited to: (1) a user facility as described in section 2203(a)(2)
		of the Energy Policy Act of 1992 (42 U.S.C. 13503(a)(2)); (2) a National
		Nuclear Security Administration Defense Programs Technology Deployment
		Center/User Facility; and (3) any other Departmental facility designated by the
		Department as a user facility.</text>
					</section><section commented="no" display-inline="no-display-inline" id="H0D28910F32B74FC59676CA30FA660D59" section-type="subsequent-section"><enum>306.</enum><text display-inline="yes-display-inline">Funds appropriated by this or any other
		Act, or made available by the transfer of funds in this Act, for intelligence
		activities are deemed to be specifically authorized by the Congress for
		purposes of section 504 of the National Security Act of 1947 (50 U.S.C. 414)
		during fiscal year 2010 until the enactment of the Intelligence Authorization
		Act for fiscal year 2010.</text>
					</section><section commented="no" display-inline="no-display-inline" id="H210FCB404DDA4B84854D1F1A941AC31E" section-type="subsequent-section"><enum>307.</enum><text display-inline="yes-display-inline">Of the funds made available by the
		Department of Energy for activities at Government-owned, contractor-operated
		laboratories funded in this Act or subsequent Energy and Water Development
		Appropriations Acts, the Secretary may authorize a specific amount, not to
		exceed 8 percent of such funds, to be used by such laboratories for laboratory
		directed research and development: <italic>Provided</italic>, That the
		Secretary may also authorize a specific amount not to exceed 4 percent of such
		funds, to be used by the plant manager of a covered nuclear weapons production
		plant or the manager of the Nevada Site Office for plant or site directed
		research and development.</text>
					</section><section commented="no" display-inline="no-display-inline" id="IDE74184D7E7EF4C7DBB62F81D0F63A3A1" section-type="subsequent-section"><enum>308.</enum><text display-inline="yes-display-inline">Not to exceed 5 per centum, or
		$100,000,000, of any appropriation, whichever is less, made available for
		Department of Energy activities funded in this Act or subsequent Energy and
		Water Development Appropriations Acts may hereafter be transferred between such
		appropriations, but no such appropriation, except as otherwise provided, shall
		be increased or decreased by more than 5 per centum by any such transfers, and
		request of such transfers shall be submitted promptly to the Committees on
		Appropriations of the House and Senate.</text>
					</section><section commented="no" display-inline="no-display-inline" id="idA4DE1095CD1B47729AC8182A5E99EDDF" section-type="subsequent-section"><enum>309.</enum><subsection commented="no" display-inline="yes-display-inline" id="id161809B6E5C2464B992D0D68C424D641"><enum>(a)</enum><text display-inline="yes-display-inline">Subject to subsection (b), no funds
		appropriated or otherwise made available by this Act or any other Act may be
		used to record transactions relating to the increase in borrowing authority or
		bonds outstanding at any time under the Federal Columbia River Transmission
		System Act (16 U.S.C. 838 et seq.) referred to in section 401 of division A of
		the American Recovery and Reinvestment Act of 2009 (Public Law 111–5; 123 Stat.
		140) under a funding account, subaccount, or fund symbol other than the
		Bonneville Power Administration Fund Treasury account fund symbol.</text>
						</subsection><subsection changed="added" commented="no" display-inline="no-display-inline" id="id0C11398B2DEE467BBAD5596EEB8BA571" reported-display-style="italic"><enum>(b)</enum><text display-inline="yes-display-inline">Funds appropriated or otherwise made
		available by this Act or any other Act may be used to ensure, for purposes of
		meeting any applicable reporting provisions of the American Recovery and
		Reinvestment Act of 2009 (Public Law 111–5; 123 Stat. 115), that the Bonneville
		Power Administration uses a fund symbol other than the Bonneville Power
		Administration Fund Treasury account fund symbol solely to report accrued
		expenditures of projects attributed by the Administrator of the Bonneville
		Power Administration to the increased borrowing authority.</text>
						</subsection><subsection changed="added" commented="no" display-inline="no-display-inline" id="idA551365A161B4CBFB7689BB3192311B8" reported-display-style="italic"><enum>(c)</enum><text display-inline="yes-display-inline">This section is effective for fiscal year
		2010 and subsequent fiscal years.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="ID8e2d137ce0d2465c9bc6f7166a09c852" section-type="subsequent-section"><enum>310.</enum><text display-inline="yes-display-inline">None of the funds made available by this
		Act may be used to make a grant allocation, discretionary grant award,
		discretionary contract award, Other Transaction Agreement, or to issue a letter
		of intent totaling in excess of $1,000,000, or to announce publicly the
		intention to make such an award, including a contract covered by the Federal
		Acquisition Regulation, unless the Secretary of Energy notifies the Committees
		on Appropriations of the Senate and the House of Representatives at least 3
		full business days in advance of making such an award or issuing such a letter:
		
		<proviso><italic>Provided</italic></proviso>, That if the Secretary of
		the Department of Energy determines that compliance with this section would
		pose a substantial risk to human life, health, or safety, an award may be made
		without notification and the Committees on Appropriations of the Senate and the
		House of Representatives shall be notified not later than 5 full business days
		after such an award is made or letter issued.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID7ca53cceeb83409e921fd70adc6e5029" section-type="subsequent-section"><enum>311.</enum><subsection commented="no" display-inline="yes-display-inline" id="idEE086324971E4FFFB6C95D6233A4E79C"><enum>(a)</enum><text display-inline="yes-display-inline">In any fiscal year in which the Secretary
		of Energy determines that additional funds are needed to reimburse the costs of
		defined benefit pension plans for contractor employees, the Secretary may
		transfer not more than 1 percent from each appropriation made available in this
		and subsequent Energy and Water Development Appropriation Acts to any other
		appropriation available to the Secretary in the same Act for such
		reimbursements.</text>
						</subsection><subsection changed="added" commented="no" display-inline="no-display-inline" id="ID526c9486adc24000b0d7d858f1af7fd3" reported-display-style="italic"><enum>(b)</enum><text display-inline="yes-display-inline">Where the Secretary recovers the costs of
		defined benefit pension plans for contractor employees through charges for the
		indirect costs of research and activities at facilities of the Department of
		Energy, if the indirect costs attributable to defined benefit pension plan
		costs in a fiscal year are more than charges in fiscal year 2008, the Secretary
		shall carry out a transfer of funds under this section.</text>
						</subsection><subsection changed="added" commented="no" display-inline="no-display-inline" id="IDfb48fdb778b44d03b4c1fd71b198dde6" reported-display-style="italic"><enum>(c)</enum><text display-inline="yes-display-inline">In carrying out a transfer under this
		section, the Secretary shall use each appropriation made available to the
		Department in that fiscal year as a source for the transfer, and shall reduce
		each appropriation by an equal percentage, except that appropriations for which
		the Secretary determines there exists a need for additional funds for pension
		plan costs in that fiscal year, as well as appropriations made available for
		the Power Marketing Administrations, the title XVII loan guarantee program, and
		the Federal Energy Regulatory Commission, shall not be subject to this
		requirement.</text>
						</subsection><subsection changed="added" commented="no" display-inline="no-display-inline" id="ID58f50f3f133a4bdf9273fe201fefd087" reported-display-style="italic"><enum>(d)</enum><text display-inline="yes-display-inline">Each January, the Secretary shall report to
		the Committees on Appropriations of the House of Representatives and the Senate
		on the state of defined benefit pension plan liabilities in the Department for
		the preceding year.</text>
						</subsection><subsection changed="added" commented="no" display-inline="no-display-inline" id="IDd96ee525f9f0447b9b25cec3e854b658" reported-display-style="italic"><enum>(e)</enum><text display-inline="yes-display-inline">This transfer authority does not apply to
		supplemental appropriations, and is in addition to any other transfer authority
		provided in this or any other Act. The authority provided under this section
		shall expire on September 30, 2015.</text>
						</subsection></section><appropriations-small id="id67F6231FB57446DAA35C2863233E59F0"><header>Authority of Nuclear Regulatory
	 Commission</header>
					</appropriations-small><section id="id2C22349665E241F99F210052E51EBE88"><enum>312.</enum><text display-inline="yes-display-inline">The Nuclear Regulatory Commission may use
		funds made available for the necessary expenses of the Nuclear Regulatory
		Commission for the acquisition and lease of additional office space provided by
		the General Services Administration in accordance with the fourth and fifth
		provisos in the matter under the heading <quote><header-in-text level="appropriations-small" style="traditional">Salaries and
		expenses</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-intermediate" style="traditional">Nuclear Regulatory
		Commission</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-major" style="traditional">Independent
		agencies</header-in-text></quote> of title IV of division C of the Omnibus
		Appropriations Act, 2009 (Public Law 111–8; 123 Stat. 629).</text>
					</section><section id="idDFF94C639B794B189A972ADCB456B678"><enum>313.</enum><text display-inline="yes-display-inline">None of the funds appropriated or otherwise
		made available by this Act may be used by the Department of Energy to enter
		into any federal contract unless such contract is entered into in accordance
		with the requirements of the Federal Property and Administrative Services Act
		of 1949 (41 U.S.C. 253) or Chapter 137 of title 10, United States Code, and the
		Federal Acquisition Regulation, unless such contract is otherwise authorized by
		statute to be entered into without regard to the above referenced
		statutes.</text>
					</section><section id="idC94EB822BC9A489DAD4CCB911CFC608B"><enum>314.</enum><subsection commented="no" display-inline="yes-display-inline" id="id7658A3EE03F8459AA022C3089AB4BEBF"><enum>(a)</enum><text display-inline="yes-display-inline">Except as provided in subsection (b), none
		of the funds appropriated or otherwise made available by this title for the
		Strategic Petroleum Reserve may be made available to any person that as of the
		enactment of this Act—</text>
							<paragraph changed="added" id="idE44B660AF14748AA8C1166DF482A033B" reported-display-style="italic"><enum>(1)</enum><text>is selling refined
		petroleum products valued at $1,000,000 or more to the Islamic Republic of
		Iran;</text>
							</paragraph><paragraph changed="added" id="id6BC657584BCE4065B889FBAC0FC1A83A" reported-display-style="italic"><enum>(2)</enum><text>is engaged in an activity
		valued at $1,000,000 or more that could contribute to enhancing the ability of
		the Islamic Republic of Iran to import refined petroleum products,
		including—</text>
								<subparagraph id="id78DFE358CF6046348D1AF53EC4C417D5"><enum>(A)</enum><text>providing ships or
		shipping services to deliver refined petroleum products to the Islamic Republic
		of Iran;</text>
								</subparagraph><subparagraph id="IDddb1ea8b89a9466b945093ef49b74434"><enum>(B)</enum><text>underwriting or otherwise
		providing insurance or reinsurance for such an activity; or</text>
								</subparagraph><subparagraph id="IDb1714d1b2bda4045b0ceeee2d23fb1df"><enum>(C)</enum><text>financing or brokering
		such an activity; or</text>
								</subparagraph></paragraph><paragraph changed="added" id="idE6DE210854E14FE58BDF2C5B1FF77291" reported-display-style="italic"><enum>(3)</enum><text>is selling, leasing, or
		otherwise providing to the Islamic Republic of Iran any goods, services, or
		technology valued at $1,000,000 or more that could contribute to the
		maintenance or expansion of the capacity of the Islamic Republic of Iran to
		produce refined petroleum products.</text>
							</paragraph></subsection><subsection changed="added" id="id646C9FFE3D414362BCAEDA553C33BF9D" reported-display-style="italic"><enum>(b)</enum><text>The prohibition on the
		use of funds under subsection (a) shall not apply with respect to any contract
		entered into by the United States Government before the date of the enactment
		of this Act.</text>
						</subsection><subsection changed="added" id="idD74D50947DA048EDAAE3A5DD31FF6114" reported-display-style="italic"><enum>(c)</enum><text display-inline="yes-display-inline">If the Secretary determines a person made
		ineligible by this section has ceased the activities enumerated in (a)(1)–(3),
		that person shall no longer be ineligible under this section.</text>
						</subsection></section></title><title commented="no" id="ID859D56E9D21B4AC1947E4A58C8F0F541" level-type="subsequent"><enum>IV</enum><header display-inline="yes-display-inline"></header>
					<appropriations-major commented="no" id="id03184801B1A246458D6F3894017113A7"><header display-inline="yes-display-inline">Independent
	 agencies</header>
					</appropriations-major><appropriations-intermediate commented="no" id="H28E964339B824B0BB65C6DB83BD9C40D"><header display-inline="yes-display-inline">Appalachian regional
	 commission</header><text display-inline="no-display-inline">For expenses
	 necessary to carry out the programs authorized by the Appalachian Regional
	 Development Act of 1965, as amended, for necessary expenses for the Federal
	 Co-Chairman and the Alternate on the Appalachian Regional Commission, for
	 payment of the Federal share of the administrative expenses of the Commission,
	 including services as authorized by 5 U.S.C. 3109, and hire of passenger motor
	 vehicles, $76,000,000, to remain available until expended:
	 <italic>Provided</italic>, That any congressionally directed spending shall be
	 taken from within that State's allocation in the fiscal year in which it is

	 board</header>

	 Nuclear Facilities Safety Board in carrying out activities authorized by the
	 Atomic Energy Act of 1954, as amended by Public Law 100–456, section 1441,
	 $26,086,000, to remain available until expended.</text>
					</appropriations-small><appropriations-intermediate commented="no" id="H380C7E1AE28D4C7FB260DA7CAAF9B5B6"><header display-inline="yes-display-inline">Delta regional
	 authority</header>
					</appropriations-intermediate><appropriations-small commented="no" id="H01AEF330C8C14552A82A668C4F2475D1"><header display-inline="yes-display-inline">Salaries and expenses</header><text display-inline="no-display-inline">For necessary expenses of the Delta Regional

					</appropriations-small><appropriations-intermediate commented="no" id="H69A953799C4E44A7A7B41F33A8341D67"><header display-inline="yes-display-inline">Denali commission</header><text display-inline="no-display-inline">For expenses of the Denali Commission
	 including the purchase, construction, and acquisition of plant and capital
	 equipment as necessary and other expenses, $11,965,000, to remain available
	 until expended, notwithstanding the limitations contained in section 306(g) of
	 the Denali Commission Act of 1998.</text>
					</appropriations-intermediate><appropriations-intermediate commented="no" id="H362205D9C7B44A37AAC6652871CB7F9D"><header display-inline="yes-display-inline">Nuclear regulatory
	 commission</header>
					</appropriations-intermediate><appropriations-small commented="no" id="H1C288A45A9E24B73B34752BA83110106"><header display-inline="yes-display-inline">Salaries and expenses</header><text display-inline="no-display-inline">For necessary expenses of the Commission in
	 carrying out the purposes of the Energy Reorganization Act of 1974, as amended,
	 and the Atomic Energy Act of 1954, as amended, including official
	 representation expenses (not to exceed $25,000), $1,061,000,000, to remain
	 available until expended: <italic>Provided</italic>, That of the amount
	 appropriated herein, $29,000,000 shall be derived from the Nuclear Waste Fund:
	 <italic>Provided further</italic>, That revenues from licensing fees,
	 inspection services, and other services and collections estimated at
	 $902,402,000 in fiscal year 2010 shall be retained and used for necessary
	 salaries and expenses in this account, notwithstanding 31 U.S.C. 3302, and
	 shall remain available until expended: <italic>Provided further</italic>, That
	 the sum herein appropriated shall be reduced by the amount of revenues received
	 during fiscal year 2010 so as to result in a final fiscal year 2010
	 appropriation estimated at not more than $158,598,000: <italic>Provided
	 further</italic>, That of the amounts appropriated, $10,000,000 is provided to
	 support university research and development in areas relevant to their
	 respective organization's mission, and $5,000,000 is to support a Nuclear
	 Science and Engineering Grant Program that will support multiyear projects that
	 do not align with programmatic missions but are critical to maintaining the
	 discipline of nuclear science and engineering.</text>
					</appropriations-small><appropriations-small commented="no" id="HD98B3FDEBB2E4120B36B4E34C601399C"><header display-inline="yes-display-inline">Office of inspector general</header><text display-inline="no-display-inline">For necessary expenses of the Office of
	 Inspector General in carrying out the provisions of the Inspector General Act
	 of 1978, as amended, $10,860,000, to remain available until expended:
	 <italic>Provided</italic>, That revenues from licensing fees, inspection
	 services, and other services and collections estimated at $9,774,000 in fiscal
	 year 2010 shall be retained and be available until expended, for necessary
	 salaries and expenses in this account, notwithstanding 31 U.S.C. 3302:
	 <italic>Provided further</italic>, That the sum herein appropriated shall be
	 reduced by the amount of revenues received during fiscal year 2010 so as to
	 result in a final fiscal year 2010 appropriation estimated at not more than
	 $1,086,000.</text>

	 the Alaska Natural Gas Pipeline Act of 2004, $4,466,000 until expended:

	 $4,683,000 shall not be available for obligation until appropriated in a

	 Provision</header>
					</appropriations-intermediate><section commented="no" display-inline="no-display-inline" id="IDE304D40C588B4436A72A09C6522A22ED" section-type="subsequent-section"><enum>401.</enum><text display-inline="yes-display-inline">Section 382B of the Delta Regional
		Authority Act of 2000 is amended by deleting (c)(1) and inserting in lieu
		thereof the following: <quote> ‘(1)
		<header-in-text level="paragraph" style="OLC">In
		general—voting</header-in-text>.—A decision by the Authority shall require the
		affirmative vote of the Federal cochairperson and a majority of the State
		members (not including any member representing a State that is delinquent under
		subsection (g)(2)(C)) to be effective.</quote> .</text>
					</section></title><title commented="no" id="ID7D20D4881C7A407C87588DC3E752E669" level-type="subsequent"><enum>V</enum><header display-inline="yes-display-inline"></header>
					<appropriations-major commented="no" id="id1333E2F26C1346DFA0B88F2988C602CA"><header display-inline="yes-display-inline">General
	 provisions</header>
					</appropriations-major><section commented="no" display-inline="no-display-inline" id="ID2AAC33A1C65345E38FDFA1CC317BDA7E" section-type="subsequent-section"><enum>501.</enum><text display-inline="yes-display-inline">None of the funds appropriated by this Act
		may be used in any way, directly or indirectly, to influence congressional
		action on any legislation or appropriation matters pending before Congress,
		other than to communicate to Members of Congress as described in 18 U.S.C.
		1913.</text>
					</section><section commented="no" display-inline="no-display-inline" id="IDF4ADF4DD5DBF47F2BB05D7337AF0C8A1" section-type="subsequent-section"><enum>502.</enum><text display-inline="yes-display-inline">None of the funds made available in this
		Act may be transferred to any department, agency, or instrumentality of the
		United States Government, except pursuant to a transfer made by, or transfer
		authority provided in this Act or any other appropriation Act.</text>
					</section><section id="s2"><enum>503.</enum><text display-inline="yes-display-inline">Title IV of division A of the American
		Recovery and Reinvestment Act of 2009 (Public Law 111–5) is amended by adding
		at the end of the title, the following new section 411:</text>
						<quoted-block display-inline="no-display-inline" id="idEFE0FD59A2B94BEC92F65EDBDC12D9B0" style="appropriations">
							<section id="idF9D64F79B0BA4FA6A21A8C3C6957E762"><enum>411.</enum><text display-inline="yes-display-inline">Up to 0.5 percent of each amount
		  appropriated to the Department of the Army and the Bureau of Reclamation in
		  this title may be used for the expenses of management and oversight of the
		  programs, grants, and activities funded by such appropriation, and may be
		  transferred by the Head of the Federal Agency involved to any other appropriate
		  account within the department for that purpose: <italic>Provided,</italic> That
		  the Secretary will provide a report to the Committees on Appropriations of the
		  House of Representatives and the Senate 30 days prior to the transfer:
		  <italic>Provided further,</italic> That funds set aside under this section
		  shall remain available for obligation until September 30,
		  2012.</text>
							</section><after-quoted-block>.</after-quoted-block></quoted-block>
						<appropriations-small id="idC99B136894414FA39F3236309A32FD04"><header>Agency Administrative
	 Expenses</header>
						</appropriations-small></section><section id="id1C34A8E0C75E4561AA0A064C9CDCAA44"><enum>504.</enum><subsection commented="no" display-inline="yes-display-inline" id="id029F1366E2BC40DFB42DE69E8CA14154"><enum>(a)</enum><header>Definitions</header><text>In
		this section:</text>
							<paragraph changed="added" id="id5F169F27076942CC970F7AC63776B051" reported-display-style="italic"><enum>(1)</enum><header>Administrative
		expenses</header><text>The term <term>administrative expenses</term> has the
		meaning as determined by the Director under subsection (b)(2).</text>
							</paragraph><paragraph changed="added" id="id2BF800B024594FCDA3CF6102D805DACE" reported-display-style="italic"><enum>(2)</enum><header>Agency</header><text>The
		term <term>agency</term>—</text>
								<subparagraph id="idD06E284340004D77A9CF0F829CF1AEC6"><enum>(A)</enum><text>means an agency as
		defined under section 1101 of title 31, United States Code, that is established
		in the executive branch; and</text>
								</subparagraph><subparagraph id="id845FE133EC3F472A9B31F90D5EDEE913"><enum>(B)</enum><text>shall not include the
		District of Columbia government.</text>
								</subparagraph></paragraph><paragraph changed="added" id="id07F2551E9D864E17AB4D6C9CE59A5BE0" reported-display-style="italic"><enum>(3)</enum><header>Director</header><text>The
		term <term>Director</term> means the Director of the Office of Management and
		Budget.</text>
							</paragraph></subsection><subsection changed="added" id="id9AE947E48A5A42E1998BED5A32F5A2B0" reported-display-style="italic"><enum>(b)</enum><header>Administrative
		expenses</header>
							<paragraph id="idEC1075CF585943EA855088373B9CC816"><enum>(1)</enum><header>In
		general</header><text display-inline="yes-display-inline">All agencies shall
		include a separate category for administrative expenses when submitting their
		appropriation requests to the Office of Management and Budget for fiscal year
		2011 and each fiscal year thereafter.</text>
							</paragraph><paragraph id="id96E3D09D48694E21AC1791D1753711B7"><enum>(2)</enum><header>Administrative expenses
		determined</header><text display-inline="yes-display-inline">In consultation
		with the agencies, the Director shall establish and revise as necessary a
		definition of administration expenses for the purposes of this section. All
		questions regarding the definition of administrative expenses shall be resolved
		by the Director.</text>
							</paragraph></subsection><subsection changed="added" id="id0AB1E9A70FA548F5BBC0749A3E96CD69" reported-display-style="italic"><enum>(c)</enum><header>Budget
		submission</header><text display-inline="yes-display-inline">Each budget of the
		United States Government submitted under section 1105 of title 31, United
		States Code, for fiscal year 2011 and each fiscal year thereafter shall include
		the amount requested for each agency for administrative expenses.</text>
						</subsection></section><section id="idA9896193F7424927B3E2FE79A1179402"><enum>505.</enum><subsection commented="no" display-inline="yes-display-inline" id="idC12C89BB9F624CD6B7B79850EF7C78C1"><enum>(a)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this
		Act and except as provided in subsection (b), any report required to be
		submitted by a Federal agency or department to the Committee on Appropriations
		of either the Senate or the House of Representatives in an appropriations Act
		shall be posted on the public Website of that Agency upon receipt by the
		committee.</text>
						</subsection><subsection changed="added" id="id614BA40A864541A39E38AC4C4E55DF2C" reported-display-style="italic"><enum>(b)</enum><text>Subsection (a) shall not
		apply to a report if—</text>
